NICOSIA – For the purposes of harmonizing the practice of Cyprus regarding black and white or greyscale trademarks with the rest of European Union countries, the Intellectual and

Industrial Property Section of the Department of the Registrar of Companies and Official Receiver of the Republic of Cyprus has issued a new practice direction which will apply for all trademark applications filed after July 15, 2014.

Accordingly, trademarks filed in black and white or greyscale are no longer protected in all colors.

The new Practice consists of four parts and determines use of a black and white or greyscale trademark in color is considered genuine use if the following conditions are met:

1. The color should not be part of the main element that makes the trademark distinctive.

2. The color or combination of colors in the trademark is not considered distinctive in itself

3. The word and figurative elements of the trademark should be the most distinctive elements and should be used in the same way as the black and white or greyscale trademark

4. The contrast between the shade of the trademark should be respected.

SANA’A - The Yemeni Ministry of Industry and Trade issued the Ministerial Decision No. 105

of the year 2014 regarding the increase in fees for publication in the Official Trademark Gazette (AL-TIJARAH).

Such increase will be applied to all IP issues (trademarks, patents, industrial designs and drawings, etc…) as of August 7, 2014, as follows:

• Charges for publication of trademarks will be increased by 48.51%

• Charges for publication of industrial designs and drawings will be increased by 30%

• Charges for publication of patents will be increased by 30%

WASHINGTON, DC - The Internet Corporation for Assigned Names and Numbers (ICANN) has told a US federal court in the District of Columbia, that a country code Top-Level Domain (ccTLD) cannot be considered “property,” and thus cannot be attached by plaintiffs in a lawsuit, who are trying to obtain the assets of countries that they argued have supported terrorism, a press release by the Corporation stated.

“We filed a Motion to Quash in the US federal court today, to ensure that the court has the essential information about how the Internet’s domain name system (DNS) works. While we sympathize with what plaintiffs may have endured, ICANN’s role in the domain name

system has nothing to do with any property of the countries involved”, said John Jeffrey, ICANN’s General Counsel and Secretary.

“We explained in our Motion to Quash, that country code Top-Level Domains (ccTLD) are part of a single, global interoperable Internet which ICANN serves to help maintain.” Jeffrey further explained that “ccTLD’s are not property, and are not ‘owned’ or ‘possessed’ by anyone including ICANN, and therefore cannot be seized in a lawsuit.”

ICANN’s arguments were put forth when the victims of terrorism who had successfully won lawsuits against Iran, Syria and North Korea, sought to collect on those civil judgments. In their attempt to recover assets from these countries, the plaintiffs served ICANN with “writs of attachment” and subpoenas seeking information to help them seize the ccTLDs of those nations.

The ccTLDs (and related IP addresses) targeted by the plaintiffs include; .IR (Iran), .SY (Syria) and .KP (North Korea),

as well as internationalized top-level domains in non-ASCII characters for Iran and Syria.

ICANN’s mission is to ensure a stable, secure and unified global Internet. To reach another person on the Internet you have to type an address into your computer - a name or a number. That address has to be unique so computers know where to find each other. ICANN coordinates these unique identifiers across the world. Without that coordination we wouldn’t have one global Internet. ICANN was formed in 1998. It is a not-for-profit public-benefit corporation with participants from all over the world dedicated to keeping the Internet secure, stable and interoperable. It promotes competition and develops policy on the Internet’s unique identifiers. ICANN doesn’t control content on the Internet. It cannot stop spam and it doesn’t deal with access to the Internet. Talal Abu-Ghazaleh Organization (TAG-Org) has recently issued Talal Abu-Ghazaleh Dictionary for Patent Terms, which is the sixth in a series of specialized dictionaries conducted by the Organization.

The new Dictionary contains around 20 thousand words and terms, including a section on continuous controversy over the concept of patent, its legitimacy and application. It also comprises other sections regarding green patents, patent governance, patent portfolio management, analysis of information related to patents and patent audit, as well as a crucial section including the most prominent crimes concerning patents and another section on litigation and arbitration of patent disputes.
