Certificate of Pump Installation Completion for Well No. 6223-01 (TMK 4-3-007:006)

We are pleased to inform you that the Pump Installation work permitted for the Paauilo Deepwell Well (Well No. 6223-01) is complete and acceptable. This certificate of pump installation completion allows you to continue pumping your well for reasonable & beneficial water use.

To protect Hawaii's natural ground water resources for the benefit of all, the following requirements apply to the use of your well:

1. If the well is not in use it must be properly capped.

2. If the well is to be abandoned then the landowner must cause a licensed contractor to apply for a well abandonment permit in accordance with § 13-168-12(t) prior to any well sealing or plugging work.

3. In the event that the well operator and/or landowner changes, the Commission shall be notified of the change prior to the change, and all forms shall be transferred to the new owner.

4. In the event the benchmark in the concrete base of the well is altered in any way, an updated elevation survey (page 5 of the Well Completion Report Part I) shall be submitted to the Commission. The Well Completion Report Part I can be obtained by contacting staff or at www.hawaii.gov/dlnr/cwrmlforms.htm.

5. Your approved pump has a capacity of 300 gpm at a head of 1100 ft. In the future, pump replacements of equal or lesser capacity will not require an additional permit from the Commission, but will require the submission of a Well Completion Report Part II by the licensed pump installer. If the pump replacement is greater than the existing pump, you will need to apply for a new pump installation permit.

6. The landowner shall cause the well operator to maintain the installed meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a monthly basis, on forms provided by the Chairperson, in accordance with § 13-168-7, HAR.

7. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. The authorization to drill a well and/or install a pump shall not constitute a determination of correlative water rights. The landowner and well operator are notified that the quantity of water taken from the well and/or the pump capacity could be reduced by the Commission in the future.

8. In the event that your installed pump is less than 70 gallons per minute, and no elevation survey has been completed, you may be required to do one in the future.

Because groundwater in Hawaii is a public trust, and adverse effects at one well may affect other water resources, any violation of the above conditions, or any other provision of the Hawaii Administrative Rules, may be subject to fines of up to $5,000/day. The Commission needs your help and asks that you to do your part in utilizing this shared resource. We prefer to work with you in meeting the goal of protecting our ground water resources together.

A) JOB NO. 89-488, PIIHONUA WELL NO. 3 EXPLORATORY DRILLING:

Our special legal counsel, Mr. Sherman Hee,will provide us with status regarding the filing of the suit against the bonding company-, AmWest Surety Insurance Company.

Additional report will be provided at the meeting.

B) PIIHONUA PRODUCTION WELL NO.3 SUB-RECIPIENT AGREEMENT - 1990 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM:

We received the draft sub-recipient agreement document for review and for execution by the Water Commission and the County of Hawaii.

The Department of Water Supply through the Office of Housing and Community Development submitted an application for the use of reprogrammed 1990 Community Development Block Grant (CDBG) funds. The application was approved for the amount of $250,000.00. This amount will be used to supplement the construction portion of this project. The current estimated cost is $1,000,000.00.

For the Commission's information, this project consists of outfitting the existing Piihonua Well No.3 into a production source. This exploratory well remains to be completed. However, a suit (complaint) has been served on the bonding company. We anticipate that the well will be completed shortly and that the scheduling for the advertisement of bids for this production well project will take place accordingly.

This sub-recipient agreement specifies that schedules, terms and conditions for the use of the CDBG funds. The agreement will be forwarded to our Corporation Counsel for their review and approval.

RECOMMENDATION: It is recommended that the Commission accept the sub-recipient agreement subject to the approval of the Corporation Counsel and that the Chairman or Vice Chairman be authorized to sign the documents.

C) REQUEST FOR ABANDONMENT OF lO-FOOT WIDE PIPELINE EASEMENT IIAII -DANIEL AND JULIA RODRIGUES, TAX MAP KEY 2-7-33:04, PAPAIKOU, SOUTH HILO, HAWAII :

We received a request from Daniel and Julia Rodrigues for consideration for the abandonment of a 10-foot wide pipeline easement running' alongside their side property line.

The Department made some waterline improvements in the area many years ago. And, the existing 3-inch G.I. pipeline in that easeme~t was disconnected and abandoned in place. There is no need to have this easement and the easement can be abandoned and returned to the property owner. We will work with our Corporation Counsel to draft the cancellation of easement agreement.

RECOMMENDATION: It is recommended that the Commission approve of this cancellation of easement subject to the approvaV of our Corporation Counsel and that the Chairman and Vice Chairman be authorized to sign the documents.

5) HAMAKUA:

A) HAMAKUA SUGAR COMPANY WATER SYSTEM:

See attached report.

6) SOUTH KOHALA:

A) AGREEMENT WITH MAUNA LANI RESORT, INC., AND MAUNA KEA PROPERTIES, INC.:

Attached are proposed agreements with Mauna Lani Resort, Inc., and Mauna Kea Properties, Inc., on further development of water in South Kohala.

They are ready to develop more water but would like to support our transmission project if it becomes a reality.

A report of recommendation will be given at the meeting.

7) NORTH KONA:

A) JOB NO. 89-504, CONSTRUCTION OF THE WAIAHA WELL EXPLORATORY DRILLING:

Our special legal counsel, Mr. Sherman Hee, will provide us with status regarding the discussions with the bonding company, National American Insurance Company, for the completion of this project.

Additional report will be provided at the meeting.

B) KEALAKEHE WELL SITE AND ACCESS AND UTILITY EASEMENT - TOKUNAGA MASONRY, INC., TAX MAP KEY 7-4-03:05 (PORTION):

We have negotiated and will be acquiring a well site together with access and utility easement. The current owner is Tokunaga Masonry, Inc. The well site is approximately 15,000 square feet and the purchase price is for $50,000.00.

The deed and easement documents have been transmitted to our Corporation Counsel for their review.

RECOMMENDATION: It is recommended that the Commission accept these documents subject to the approval of our Corporation Counsel and that the Chairman or Vice Chairman be authorized to sign the documents.

8) MISCELLANEOUS:

A) DEDICATION OF WATER SYSTEM:

We received the following document for action by the Water Commission. The water system has been constructed in accordance with the Department's standards and is in acceptable condition for dedication.

(1) Mountain View Elementary School Water Meter Easement Owner: State of Hawaii District: 01aa, Puna, Hawaii Tax Map Key: 1-8-01:07

RECOMMENDATION: It is recommended that the Commission accept this document, subject to the approval of the Corporation Counsel, and that either the Chairman or the Vice-Chairman be authorized to sign the document.

B) VEHICLE BID NO. 94-2, FURNISHING AND DELIVERING VEHICLES TO THE DEPARTMENT OF WATER SUPPLY, COUNTY OF HAWAII:

Bids for this project will be opened on November 17, 1994 and a report and recommendation will be provided at the meeting.

This bid will be for two (2) 4-door sedans. One vehicle will be for the Engineering Division and the other for fiscal Division.

C) REFUND AGREEMENTS:

A 70 Percent Refund Agreements: Mr. Eugene Aguiar and Kapoho Water Company.

Recommend that the Water Commission enter into and approve a 70 percent refund agreement with these two developers. Attached are drafts of the agreement which are subject to Corporation Counsel's approval.

In accordance with the Department of Land and Natural Resources Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", your application to install a 300 gallons per minute pump in Paauilo-DWS Well (Well No. 6223-01) within Tax Map Key: 4-3-07:4, for municipal use, is approved subject to the following conditions:

1. The Division of Water Resource Management (DWRM), P.O. Box 373, Honolulu, HI 96809, shall be notified, in writing, before any work covered by this permit commences.

2. The proposed pump installation shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct and pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.

3. The permit shall be for installation of a 300 gpm capacity pump in the well.

4. The applicant shall provide and maintain an approved meter for measuring and reporting total water usage on a monthly basis.

5. The following shall be submitted to DWRM within 30 days after completion of the work:

a. Well Completion Report. b. As-built sectional drawing of the installed pump.

6. The applicant shall comply with all applicable laws, rules, and ordinances.

7. The permit may be revoked if work is not started within six months of the date of issuance or if work is suspended or abandoned for six months. The work proposed in the permit application shall be completed within 24 months from the date of permit issuance.

This letter is in response to the Department of Health's (DOH) comments on the above subject matter dated September 4, 1991 by Mr. Thomas E. Arizumi.

The Paauilo Well Development, DWS Job No. 90-531, calls for the construction of a production well to service the Paauilo Community. The Paauilo Water System has 89 service connections, services a population of 274, and purchases water from Hamakua Sugar Company (HSC). This source development project will provide an additional supply of water for the community and thereby relieve our dependency on Waimea surface water and also purchasing water from HSC.

We are aware that Chapter 20, II Potab 1 e Water System, II app 1 i es and wi 11 comp 1 y with the regulation. We are awaiting final design plans for this project in order that we can submit an Engineering Report for New Potable Water Source to the DOH. An Environmental Assessment, Negative Declaration, was submitted by the Department of Land and Natural Resources.

The design of Paauilo Well will prevent the possibility of groundwater contamination by sealing the well to prevent seepage or floodwaters from migrating down the well shaft.

Thank you for the opportunity to review and comment on the subject document. We have examined the application and have the following comments to offer:

1. The application indicates that the subject well will be for municipal use. If the well is to serve 25 or more individuals at least 60 days per year or will have a minimum of 15 service connections, the applicant will be required to comply with the Department's Administrative Rules, Title 11, Chapter 20, "Potable Water Systems."

2. Section 11-20-29 of Chapter 20 requires that a new source of potable water serving a public water system be approved by the Director of Health prior to its use. Such an approval is based primarily upon the submission of a satisfactory engineering report which addresses the requirements set in Section 11-20-29.

3. The proposed well is situated above the Underground Injection Control (UIC) line. Land areas above the UIC line are considered to contain underground sources of drinking water. Thus, it is essential that the well be designed and constructed to prevent the possibility of groundwater contamination. For example, the well should have a concrete well pad and full grouting to prevent seepage or floodwaters from migrating down the well shaft.

We believe that the proposed installation of a pump on this existing well will have "no effect" on historic sites. Although this parcel has never been surveyed for historic sites, aerial photographs indicate that the well location had been cultivated in sugar cane for many years. We do not expect any historic sites to have survived mechani2ed cultivation.

Water from Kawainui, Alakahi, Kaiawe, and Waima Streams is diverted into Lower Hamakua Ditch and supplies approximately 30 MGD on average for irrigation of sugar cane, hydroelectric power generation, and mill operations.

Water from Lalakea, Hakalaoa, and Hiilawe Streams is diverted into Lalakea Ditch and supplies approximately 2.5 MGD on average for irrigation of sugarcane.

Water pumped from Paauilo Shaft via a 250 gpm pump is used for municipal supply at Paauilo, Kaohe Subdivision, and Nakale Camp. Ookala Shaft is used for municipal supply at Ookala, Niu, Kukui & Milo Villages, and Akasaki Camp.

Four springs are used to provide domestic water supply: Hulilii Gulch Spring for Kaiaakea Camp; Kawilahilahi Gulch and Kihalani Gulch springs for Papaaloa / Kekoa Community; and Kapehu Gulch Spring for Kapehu Community.

Our department has made tentutive plans (under the construction contract) to conduct a three-day pumping test on its recently completed exploratory well at Paauilo on the north Hamakua coast of the Bie Island, beginning LJonday. April is. 1985.

We have informed your Drinking Water staff of the three-day test (April 8-11) in the event that your department might wish and be able to sample the well Welter during the test period for a routine analysis for pesticides. The well is located in the mauka area of existing cane fields and will e'"entually be turned over to the County Department of VJater Supply for their usc. Because of its mauka location, 1000 foot depth, anci annular space surrounding the casing having been sealed with c~"!ment, we fully expect the well to produce uncontut!linated g-round \'.i'ater.

SUBJECT: Water Level Measurement, Paauilo Well (6223-01), Hawaii

On Tuesday, February 12, 1985 at about 10: 30 a. m. the water level at Paauilo Well (6223-01) was measured with a steel surveyor's tape by the wet chalk method. The measurement operation was witnessed by Hiroo Hamano of the Hawaii County Dept. of Water Supply and assisted by Bob Richardson and Jack Lindberg of Water Hesources Inter:national.

Hiroo said the elevation at the southeast corner of the concrete slab around the 12-inch diameter well casing was 1053.52'. The elevation \.vas established from a known USGS bench mark on a bridge not far from the well site. Measurement with a tape rule was taken to the top of the steel casing from a 3i-inch recessed section in the slab. The projecting steel casing measured 1.33 feet.

Thus, the elevation at the top of the steel casing was arrived at by sub tracing 0.29'(3i") from 1.33' equals 1.04' and adding to 1053.52 = 1054.56 (see attached sketch).

1060 feet of steel tape was reeled into the cased well. Evidence of water mark appeared at 17.00' from the lead end of the tape. Therefore, the depth to water from the top of steel casing = 1060' minus 17.00' = 1043.00 and the static water level = 1054.561 (top of steel casing) minus

A preconstruction meeting for the subject project was held on October 16, 1984 at the DOWALD office. Present were the following:

Dan Lum - DOWALD, Water Resources Branch Bill Craddick, Howard Akagi - Water Resources Intll, Inc.

Mr. Fujii opened the meeting with a general discussion of the project. Mr. Morimatsu informed the contractor that the processing of the contract was complete and notice to proceed could be given immediately.

Inspection of the well drilling will be handled by Mr. Hiroo Hamano, Hawaii County Department of Water Supply, under the direction of Mr. Dan Lum. Contract administration will be handled by DOWALD Construction Section.

The well location will be determined by Hawaii County DWS. All substitution requests shall be in writing and submitted to DOWALD.

The specifications were discussed. The project sign location will be determined in the field by Mr. Hamano. The use of bentonite will be allowed subject to the approval of DOW ALD. The contractor was reminded to submit casing certifications and that casing should be clearly marked as complying to the specifications.

The plans were discussed next. Mr. Lum changed the detail on filling the annular space as shown on the attached drawing. The additional cement grouting shall be paid for under Item 505B - Cement Grouting the Annular Space and the rock packing shall be paid for under Section 9.4 -Force Account Work of the Standard Specifications.

As requested in your letter of October 18, 1984, permission is hereby granted to work 24 hours a day, 5 days a week, Monday through Friday, on the above project until a depth of 1020 feet or elevation +30 feet (msl) is reached. All work shall be done in accordance with the plans and specifi­cations and the following conditions:

(1) The contractor shall conform to Section 7.1C of our Standard Specifications for Construction Work, 1964.

(2) Work shall be coordinated with Hiroo Hamano of the Department of Water Supply on Hawaii and Dan Lum in Honolulu.

(3) No work shall be done on Saturdays, Sundays and State holidays.

( 4) All inspectional and administrative costs resulting from overtime work shall be borne by the contractor.

(5) All work required by the contract specifications to be done during normal daylight hours or in the presence of the Engineer, such as installing casing, shall not be included in overtime work.

(6) When directed by the Engineer to halt 24-hour operations for a justifiable reason, the contractor shall return to normal operations at no cost to the State.
