G.S.R. 585 (E) .-Whereas the treaty betweenGreat Britain and Belgium for the' Mutual Extra-dition of Fugitive Criminals of 29 October, 1901as amended by the Conventions dated 5 March,1907 and 3 March, 1911 and by Exchange ofLetters dated 30th May, 1958 and 30th December,1958 on the subject between the two countries areconsidered to be in force between India and, Bel-gium by the Exchange of Letters dated 3 August,1954 and 6 'November, 1954 and the said treatyprovides as follows :-

"ART. 1. It is agreed that His BritarmicMajesty .and His Majesty the King of the'Belgians shall, on requisition made intheir name by their respective Diploma-tic Agents, deliver on to each otherre~ciprocaUy, under the circumstances and

, conditions stated in the' present Treaty,any 'persoqs who, bei~gaccused or CO'1-

, victed, as principals, or accessories, ofany of the crimes 'hereinafter specified,committed within the territories of the'requinngParty,' shall beJound within theterritories of the other Party' :

'II. In the dominions of His Britannic Majesty,other than the Colonies or foreign possessions ofHis Majesty, the manner of proceeding shall be asfollows:

In the case of a person accused-The requisition for the surrender shall' be made

to His Britannic Majesty's Principal Secretary ofState for Foreign Affairs by the Minister or other'Diplomatic Agent of His Majesty the King of theBelgians, accompanied by a warrant of attest orother equivalent, judicial document issued by a.Judge or Magistr~te duly authorised to take cog-nizance of the acts charged against the accused inBelgium, together with duly authenticated deposi-tions or statements taken on oath or upon oolemnaffirmation before such Judge or Magistrate,clearly setting forth the said acts, and containinga description of the. person claimed, and anyparticulars whiah may serve to identity him.

The said Secretary of State shall transmit suchdocuments to His Britannic Maiesty's PrincipalSecretary of State for the Home ~partment, whoshall then by order under his hand and seal, signifyto some Police Magistrate in London that suchrequisition has, been made, and, require him, ifthe;e, pe due .cause, to issue his warrant for theapprehension of the fugitive.

On the receipt of such order from the Secretaryof State, and on the production of such evidenceas would, in the opiilionof the Magistrate, justifythe issue of the warrant if the crime had beencommitted in the' United Kingdom, he shallissue his warrant' accordingly.

When the fugitive shall have been apprehended,he shall be brought before a competent Magistrate.If the evidence to' be then produced shall be suchas to justify, according to the iaw of England, the'commital for trial of the prisoner, if the crime ofwhich he is accused had been committed in Eng-land, th~ Magistrate shall commit him to prison,to await the warrant of the Secretary of State forhis surrender, sending immediately to the Secretaryof State a certificate of the commital and a reportupon the case. , ".;",o..~~.,~"~.~",i,,

After the expiration of a period from the com-mital of the' prisoner, which shall never be lessthan fifteen days, the Secretary of State shall, byorder undet his hand and seal, order the fugitivecriminal to be surrendered to such person as maybe duly authorised to receive hinl on the part ofthe Government of His Majesty the Kin~ of theBelgians.

2. In the case of a person convicted-,

The Course of proceeding shall be the 'same asin the case of person accused, except thatthe fw~r_ ,rant to be transmitted by the Minister or other Dip- tlomatic Agent in support of his requisition shallclearly set forth the crime of which "the personclaimed has been convicted, and state the fact,place, and date of his conviction. The evidence tobe produced before the Magistrate shall be suchas would, according to the law of England, provethat the ,prisoner was convicted of the crime 'charged. .

After the Magistrate shall/have committed theaccused or convicted· person to awmt the order ofa Secretary of State for his' surrender, .such personshall .have the right t9 apply for,'a writ of habeascorpus; if he should so apply his surrender mustbe deferred untiL after the decision of the CourtupOh theretuin to the" writ, and' even then canonly take place if the decision is adverse theapplicant.

HI. .In the dominions of His Majesty' the Kingof the Belgians, other than the Colonies or foreignpossessions of His said Majesty, the manner of pro-ceeding shall be as follows : '.

1. In the case of apersoIi accused-' '

The requisition for the surrender shall be madeto the Minister for Foreign Affairs of His Majestythe King of the Belgians by the Minister or otherDiplomatic Agent of His .Britannic Majesty, a9-companied by a wc.:trant of arrest or 'otherequivalent judicial document issued by a Judge orMagistrate duly authorised to take cognizance ofthe a~ts charged against the accused in Great Bri-tain, together with duly authenticated depositions.or statements taken on oath or upon solemn affir-~ination before such Judge or Magistrate, 'clearly~etting forth the said acts, and containing a descrip-tion bf the person claimed, and any other parti-culars which may serve to identify him.

The Minister for Foreign Affai.rs shall transmitthe warrant of arrest, with the documents theretoannexed, to the Minister of Justice, who shall for-ward the same to the 'proper judicial authority,inorder tlJ,at the warrant of arrest ~ay be ,put incourse 9f executiqn by the Ch~ber of the Coun-cil, (Chambre du Conseil) Dfthe Court of FirstInstance of the place of residence of the accused,or of the place where.'he may be found. .

The foreigner may claim to be provisionally setat liberty in any case in which a Belgian enjoysthat right, and under the same conditions. .

"The application shall be submitted to the Chan)-ber of the Council (Chambre du conseil).

The Government will take the opinion of theChamber of Indictments or Investigatron (Chambredes Mises en Accusation) of the Court of Appealwithin whose jurisdiction the foreigner shall havebeen arrested. '

The heaiiQg of the case.. shall be public, unlessthe foreigner should demand that it should be with

, closed doors. '

The public authorities and the foreigner shall beheard. The latter may obtain the assistance ofcounsel.

The course of 'proceeding shall be the same asin the'case ,of 'a person accused, except that theconviction or 'sentence of condenmationissued in original or in an authenticated copy, to betransmitted by the Minister or other DiplomaticAg~nt in support of his requisition, shall clearly setforth the crime of which the person claimed hasbeen convicted, and state the' fact, place, and dateof his conviction. The evidence to be producedshall be, such as would, according to the' Belgianlaws, prove that the prisoner was convicted of thecrime charged.

IV. A fugitive criminal may, however, be appre-hended under a warrant signed by any Police, Ma-gistrate, Justice of the P~ace; or other competentauthority, in ,either c~untry, on such infonm.:tion orcomplaint, and such e,vidence, or after such pro-ceedings as, would, in :the opinion of the personissuing the .warrapt, ,justifY the'issue of a warrantif the crime had been ,committed, or the prisonerconyicted ,in, that. part, of t4ti dominions of the twoContracting, Parties ill wbich he exercises jurisdic-tion : Provid~d; hO\~ev,er, that, in the United'King-dom, the accused shall in such C\'ISe be sei1t asspeedily as possible before a competent Magistrate,He shall be discharged, as well in the United King-'dom,as in Belgil,lm,.if within fourteen days a req-uisition shaH not have been mad~ for his surrenderby the Diplomatic Agent of the 'requiring State inthe manuer directed by Articles II and III of thisT:re~ty. , " , ,

X V. The present Treaty shall come into ope~a-tion ten days -after its publication, in conformltywith the la~vs of the respective countries.

From the day when the present Treaty shallcome into force,- the Treaty of Extradition qetweenthe two c'ountries of the 20th May, 1876; theDeclaration between the British and Belgian Gov-ernment dated 23rd_ July, 1877, extending theTreaty ~f the 20th M<:y, 1876, to certain add.itiOl_l-al crimes; the further Declaration of the 21stApril, 1887, amending Article 1 of the!reatyof the 20th May, 1876; -and the ConventiOn ofthe 27th August, 1896, further amending . the _Treaty of the 20th May, 1876, shall all ceas~ tohave effect; but the present Treaty shall app~yto all crimes within the Treaty, whether commIt-ted before or after the day when it comes intoforce.

Either Party may at any time term.inate theTreaty on giving to the other six months' notice ofits intention.

XVI. The present Treaty shaUb.e ratified, andthe ratifications shall be exchanged at Brussels assoon as may be within six weeks from the dateof signatu;re.

In witness whereof -the respective Plenipotentia-ries have signed the same, and have affixed there-to the seals of their anns.

Done at Brussels, the 29th day of October inthe year of our Lord 1901.".

Now; therefore, in exercise of the powers con-felTed by section 3 of the Extradition Act, 1'962(34 of 1962),' the Central Government herebydirects that the provisions of the said Act, :Jtherthan Chapter III, shall apply to Belgium on andfrom the date of publication of this order.

In case he sho.uld be proceeded against ordetained in such country on. account of obligationscontracted towards private individuals, his surrend-er shall nevertheless, take place, the injured partyrctaining his right to prosecute his claims beforethe competent authority. .

XII. Every article found in possession of theinCllvidllal claimed at the time of his arrest shall,if the competcnt authority so decide, be seized, inorder to be delivered up with his person at thetime when the surrender shall be niade.' Su·ch de-livery shall not be limited to the property or articlesobtained by stealing or by fraudulent bankruptcy,but shaH extend to everything that may serve asproof of the crime. It shaH take pbce even when·the surrender, after haing been ordered, shall beprevented from taking place by reason of theescape or death of the il1dividual claimed.

The rights of third parties with regard to thesaid property or articles are, nevertheless, reserved.

XITI. Each of the High Contracting Parties shall.defray the expenses occasioned hy the arrcst withinits territories, the detention, and the conveyance toits frontier, ·of the persons whomJ'it may consent tosurrender in pursUc.Ilce of the present Treaty.

XlV. The stipulations of the prescnt Tl"eatyshaH be applicable to the Colonies and foreignpossessions of the two High Contmcting Paitics.

The requisition for the surrender of a fugitjv~criminal who bas taken refuge in a Colony orforeign possession of either Party shall be made tothe Govemor or Chief authority of such, Colony orpossession by the chief Consular officer of the otherin such. Colony or possession; or, if the fugitive hasescaped from a Colony or foreign possession of theParty on whose behalf the requisition is made, bythe Governor or chief authority of such Colony or
