three parts: statute, board policies and court decisions. In 2011, the state legislature amended the Worker’s Compensation Statute. Now, Indiana legislators are examining the disparity between Indiana’s worker’s compensation benefits and those of surrounding states. Come learn how last year’s changes and current legislative developments impact Indiana employers. These issues and key cases concerning the Worker’s Compensation Act will be addressed.

In nearly every case in which an employee is absent from work due to a work-related injury, FMLA issues arise. Similarly, in light of the recent amendments to the ADA, many employees who suffer work-related injuries may also have disabilities under the ADA that employers must reasonably accommodate. This session will provide guidance in working through the ADA, FMLA and worker’s compensation maze.

3:00 p.m. Hand Injuries occurring in the Workplace: a Surgeon’s perspective

A worker’s hands are vital for performing specific work tasks, and they may be exposed to more risk and potential hazard than other parts of the body. According to industry statistics, hand injuries represent nearly one-third of all reported workplace injuries. Annually, hand injuries account for approximately 90 million days of restricted work activity and 16 million days of missed work. This presentation will discuss the different types of work-related hand injuries and conditions, the accurate diagnosis and care of these injuries, the rehabilitation process and return-to-work parameters. Additionally, the presentation will discuss common hazards found in the workplace, and will offer suggestions and preventive measures that employers may use to protect working hands.

Your SpeakersSheila Denman, ma, mS, pt, is the Senior Vice President of ATI Worksite Solutions. She is responsible for consulting, training and instructional materials design for programs intended to enhance the systems that make up the work environment. Her primary focuses are ergonomic systems and work processes, injury prevention/intervention management strategies, physical abilities testing, safe worker behavior and return to work. Over the past decade, Sheila has developed and implemented fully integrated ergonomics and injury intervention programs utilized by national companies to protect/educate their employees and reduce the cost of worker’s compensation by taking ownership of their risk.

Sandy Fralich is senior account executive at JWF Specialty. She is currently consulting with Indiana’s largest employers and municipalities to create efficient and economically sound liability, worker’s compensation and disability programs, providing the essential tools for risk management and loss control. Sandy has consulted with the Indiana General Assembly on numerous legislative proposals and made recommendations for amendments and on the passage of several worker’s compensation bills. She is a professional speaker/trainer with extensive experience in worker’s compensation educational presentations for employer groups, including large employers; human resource professionals; risk managers; attorneys; insurance professionals; and other various industry groups.

matt kelley is an Associate at Ogletree Deakins. Matt received his J.D. from the Indiana University-Bloomington School of Law in 2008. While attending I.U. Kelley served as the Executive Notes Editor of the Indiana Journal of Global Legal Studies and competed in the Phillip C. Jessup International Law Moot Court Competition. Matt also holds a master’s degree in Russian Studies from I.U. Matt currently handles a wide array of employment and labor law issues, while specializing in the area of traditional labor law, working with employers on a variety of traditional labor issues.

Dr. kevin knox, m.D. is a surgeon at Indiana Hand to Shoulder Center. He was an Indiana Hand to Shoulder Center fellow in 2010 and became the first plastic surgeon to join the practice in 2011. Dr. Knox’s specialty interests include upper extremity and microvascular surgery. He is also very involved in medical volunteerism and has participated in numerous surgical missions to Bangladesh and Nicaragua. Dr. Knox continues to be actively involved in scientific research and writing. He has written and published scientific articles, book chapters, scientific abstracts and has given presentations at local, national, and international conferences. He is enthusiastic about his role as an educator in the Indiana Hand to Shoulder Center fellowship program.

ken Siepman is a Shareholder at Ogletree Deakins. For nearly 20 years, Siepman has represented and advised private and public employers on a wide array of labor and employment issues. He regularly serves as lead counsel for employers in federal and state courts, arbitrations, and with administrative agencies such as the EEOC, NLRB, OSHA, and the Indiana and United States Departments of Labor. He also works with employers to develop employment applications, contracts, personnel policies and handbooks, non-compete agreements, severance agreements and other employment-related documents.
