Meeting minutes presented to the Board June 15 th 2020 Meeting minutes approved by the Board June 15 th 2020 Due to the Covid-19 Pandemic, the Board of Trustees met via teleconference on May 11 th 2020 in accordance with the State of Illinois Executive Order 2020-18 and the Illinois Open Meetings Act. The public was in attendance electronically. Supervisor Meyers conducted the Meeting of Township Board where the following official business was transacted. Also present was Highway Commissioner Mike De Vivo, Attorney Sramek, Homer Township Clerk Kathleen Kruczek, and Assessor Karen Szynkowski. The meeting began at 7:02 pm with the Pledge of Allegiance to the United States of America and ended at 7:38 pm. 1. Call to order and Pledge of Allegiance to the Flag of the United States of America: The Pledge of Allegiance to the Flag of the United States of America was performed. 2. Roll Call: Supervisor Meyers, Trustee Kalas, Offord and Fijan. Excused absence Trustee Kruczek 3. Matters from the Public: 1) Jennifer Consolino- Mrs. Consolino spoke regarding the Advisory Referendum to be presented to the Board later in this agenda. She cited that this was the petition presented by Tom Fijan to be voted on at the Annual Town meeting. Subsequently, this meeting was suspended due to the Coronavirus pandemic. Mrs. Consolino read the agenda item/petition aloud: The petitioner is requesting the Township Board (in accordance with 60 ILCS 1/80-80) to authorize the following advisory question be placed on the ballot of the next regularly scheduled election and shall certify the question to the proper election officials who shall submit the question in accordance with the general election law. A motion is requested of the Board to authorize the following Advisory Referendum (petition) question: Shall the Homer Township Board in accordance with its Open Space Program pursue grant funding WITHOUT increasing or adding any new real estate taxes, for the purposes of constructing a multipurpose, pole barn style structure to be used for educational, environmental, recreational and social community activities?” Mrs. Consolino stated she is disturbed that the Township would attempt to pursue an advisory referenda during a global pandemic of which people are dying from on a daily basis. Noting that the Governor of Illinois indicated that the Covid-19 virus has yet to peak in totals and deaths. Furthermore, she contends that at the February 2020 Regular Town Board Meeting she inquired about the Annual Town Meeting and the effect that Covid-19 may have on it. Meeting minutes presented to the Board June 15th 2020

Meeting minutes approved by the Board June 15th 2020

Due to the Covid-19 Pandemic, the Board of Trustees met via teleconference on May 11th 2020 in

accordance with the State of Illinois Executive Order 2020-18 and the Illinois Open Meetings Act. The

public was in attendance electronically. Supervisor Meyers conducted the Meeting of Township Board

where the following official business was transacted. Also present was Highway Commissioner Mike De

Vivo, Attorney Sramek, Homer Township Clerk Kathleen Kruczek, and Assessor Karen Szynkowski.

The meeting began at 7:02 pm with the Pledge of Allegiance to the United States of America and ended at

7:38 pm.

1. Call to order and Pledge of Allegiance to the Flag of the United States of America: The Pledge

of Allegiance to the Flag of the United States of America was performed.

2. Roll Call: Supervisor Meyers, Trustee Kalas, Offord and Fijan. Excused absence Trustee Kruczek

3. Matters from the Public: 1) Jennifer Consolino- Mrs. Consolino spoke regarding the Advisory Referendum to be presented to the

Board later in this agenda. She cited that this was the petition presented by Tom Fijan to be voted on

at the Annual Town meeting. Subsequently, this meeting was suspended due to the Coronavirus

pandemic. Mrs. Consolino read the agenda item/petition aloud: “The petitioner is requesting the

Township Board (in accordance with 60 ILCS 1/80-80) to authorize the following advisory question

be placed on the ballot of the next regularly scheduled election and shall certify the question to the

proper election officials who shall submit the question in accordance with the general election law. A

motion is requested of the Board to authorize the following Advisory Referendum (petition) question:

Shall the Homer Township Board in accordance with its Open Space Program pursue grant funding

WITHOUT increasing or adding any new real estate taxes, for the purposes of constructing a

multipurpose, pole barn style structure to be used for educational, environmental, recreational and

social community activities?”

Mrs. Consolino stated she is disturbed that the Township would attempt to pursue an advisory

referenda during a global pandemic of which people are dying from on a daily basis. Noting that the

Governor of Illinois indicated that the Covid-19 virus has yet to peak in totals and deaths.

Furthermore, she contends that at the February 2020 Regular Town Board Meeting she inquired about

the Annual Town Meeting and the effect that Covid-19 may have on it. To her dismay, she recalled

that Supervisor Meyers laughed at her question but indicated at that time should the epidemic worsen

the Annual Town meeting could be postponed. Mrs. Consolino queried then, why this Agenda

indicated the Annual Town Meeting would be suspended indefinitely when according to her TOI

specifies otherwise. Probing further, she speculated why the Township is pushing to have Mr. Fijans

petition/ Advisory Referendum placed on the ballot for the November election alluding that the

election may not even take place. Confused by the Township’s determination to pursue an Advisory

Referendum during the current state of the economy, she questioned the forethought of spending

money from Open Space funds for a Community Center which would allegedly be used for social

interaction. Supporting her contentions, she cited businesses are failing and people are out of work.

Adding, that monies would be better served to support our seniors, special needs, children, businesses,

the unemployed, property tax relief and the indigent rather than spending it on a community center.

Disappointed by the Township’s desire to move forward with this Advisory Referendum, she referred

to it as being unnecessary and unessential. Having attended all Open Space and Board meetings for

the past year, Ms. Consolino cited she has witnessed no support for a structure such as this, nor does it

adhere to the Open Space Mission Statement or the Oslad Grant. Concluding that specific information

about the structure and support for it is lacking, she questioned why a Community Center is far more

important than the current state of the economy and those affected by it.

Note: Mrs. Consolino indicated she would be emailing a printed copy of her communication which

was read aloud and requested it be added to the permanent record. That communication has yet to be

received as of the writing of these minutes. Every effort was made to note her concerns/ objections

accurately despite intermittent disturbances in audio clarity. In addition, Mrs. Consolino desired the

following be made available on the minutes: The Homer Township Open Space Program Mission

Statement and the OSLAD Grant. These items are readily available for viewing by contacting the

Homer Township Administration Building.

Supervisor Meyers responded that the purpose of the Advisory Referendum is to seek and receive the

public’s input on the question at the next scheduled election. Considering the issue does have

supporters, was already voted on at a previous meeting of the Township Electors yet continues to be

raised by a few people, it is the petitioners request to receive the participation of a majority of residents

on the question. Regarding Mrs. Consulino’s recommendations to use the Open Space Funds for other

uses in light of Covid 19, legally these funds can only be used for Open Space Program purposes as

outlined in the Illinois State Statutes; therefore, her advice would be in violation of the law.

Concerning Mrs. Consulino’s contentions that constructing a multipurpose building as identified in the

advisory referendum is improper according to the Open Space Program and Grant guidelines, Meyers

pointed out that based upon information provided by legal counsel, Mrs. Consulino’s assertions are

incorrect.

2) Kierra Vizza Milligan- Ms. Kierra Vizza Milligan questioned what a pole barn style structure is. She

also asked about any potential food drives for residents similar to those taking place in neighboring

Orland Park. Supervisor Meyers answered a pole barn style structure is a prefabricated building

similar to the one recently built by the Highway Department or the Maintenance building the

Township constructed next to the Old Town Hall. In regard to the Orland Park Food Pantry,

Supervisor Meyers cited, Orland Park has an existing food pantry in place and are able to draw from

its inventory. Homer Township has a cooperative agreement with the not for profit Lockport Fish

Food Pantry and residents in need are directed to contact the Pantry directly for necessary

commodities. The Lockport Fish serves both Homer and Lockport Township.

3) John Flemming- Mr. Flemming voiced his disappointment with the Advisory Referendum to be

considered at this meeting. He contends that given the Coronavirus pandemic there are more urgent

matters at hand that take precedent. Supervisor Meyers answered, while she can’t speak for the

petitioner who requested the Advisory Referendum, its presentation at this meeting is perhaps due to

deadlines for submission to the Will County Clerk for ballot placement. Adding, that this is an

“Advisory” Referendum and is not all conclusive but rather a means to gather public input before

moving forward. She cited comparable Advisory Referendums have been presented to the public in

the past as a tool to gauge the wishes of the majority of our community.

4) Galaxy CS9- (Zoom audience member) requested to speak however did not present on audio when

called. No public comment was received.

5. Highway Commissioner Mike DeVivo Report: No Report

A. Presentation of Homer Township Road District TENTATIVE Budgets: Equipment & Building and Road

& Bridge Funds for fiscal year April 1, 2020 thru March 31, 2021. With the consensus of the Board, the

Clerk will publish the Notice of Public Hearing scheduled for June 15, 2020. Consensus of the Board

approved. All Yes- No discussion

6. Assessor Karen Szynkowski Report: Assessor Szynkowski reminded the audience that all exemptions

(senior freeze, disabled veterans, disabled exemptions etc…) will not be mailed out until the end of May.

Supervisor Meyers recalled a comment that indicated that Homer Township is responsible for receiving

and establishing the dates for payment of property taxes and asked Assessor Szynkowski to clarify.

Assessor Synkowski explained that the Will County Treasurer is responsible for distribution of tax

statements, late fees and deadlines. Furthermore, she is aware that some counties are waiving late fees

however at this time Will County is not. Supervisor Meyers thanked Assessor Szynkowski and added

that should anyone have issues with property taxes including but not limited to waiving of late fees,

deadlines etc… they should contact their Will County District Board Representative Steve Balich or

Mike Fricilone for further assistance. In addition, they can also call the Will County Treasurers office.

Assessor Szynkowski added, they can call the Homer Township Assessors office as well at 708-301- 8166

for further guidance. With that in mind, Supervisor Meyers reminded the audience that should anyone

need provisions there are mechanisms in place at the Township to lend support. Moreover, while she

hasn’t witnessed a high demand of desired assistance, she invited residents to call the Township with any

concerns.

1) CDBG Program-Homer Township/Lockport Heights Sanitary District/ Will County

a) Appointments with the residents are being scheduled and the work of the current project will be

begin again hoping to conclude the project ASAP.

b) The 2020 CDBG Program Application on behalf of the Lockport Heights Sanitary District for the

phased project to replace existing undersized transite water mains as detailed in the project

summary and cost analysis in the amount of $441,750 has been submitted to meet the filing

deadline requirement of May 1, 2020.

1. Motion to endorse the proposed construction costs and scope of work by Trustee Offord,

Second by Supervisor Meyers, No discussion, All Yes- Motion carries.

c) As required, a Public Hearing on the project will be published and scheduled to occur at the

Township’s June 15, 2020 Board Meeting, after which the Board will be asked to approve the

‘Exhibit B’ Resolution authorizing its Chief Executive Officer to execute the document.

B. Status Report Facilities/Property Management:

1) Senior Housing Facility:

a) All rental payments are current, all available units are occupied and lease agreements up-to-date.

b) The asphalt driveways and parking lots are in need of sealcoating.

1. Motion to accept proposal from Mrs. B Parking Lot Maintenance, Inc. in the amount of

$1,879 by Trustee Fijan, second by Trustee Kalas, No discussion, All yes-Motion carries.

2) Morris Park:

a) MI Homes/Lockport Park District/Homer Township property conveyance agreement: Attorney

Sramek is working with all parties to develop provisions of an agreement to be presented for

Board review and authorization. Attorney Sramek is awaiting a draft from the Attorney

representing MI homes.

3) Town Center Sports Field properties:

a) Football Announcers Tower Repair status report: The subcontractor has ordered materials with an

estimated lead-time of 4-5 weeks. They are anticipating commencement of the project early June.

b) Baseball Field Scoreboard Replacement status report: Contractor is waiting for completed

engineering reports to facilitate scope of work and proposal preparation in accordance with

permitting standards required by the Village of Homer Glen.

c) Baseball Field Mechanical Shed: Two proposals for the repairs to the exterior of the shed were

submitted.

A. Notice of Public Hearing:

1) The Lockport Plan and Zoning Commission has scheduled a Public Hearing on May 12, 2020 at

7:00pm on the third floor of 222 East 9th Street for the purpose of considering and hearing testimony

for the rezoning (with annexation) from R2 Residential (unincorporated Will County) to R2 Single

Family Residential (City of Lockport) and special use permit for a Government Office for the property

located at 16415 W. 151st Street. The purpose is to bring the property of the existing Homer Township

Fire Protection District, Fire Station #3 into conformance with City Codes and Ordinances upon

annexation.

B. Advisory Referenda: 1) An Advisory Referendum petition submitted to the Township Board to be placed on the Agenda of

Annual Town Meeting petitioning a question of public policy be placed on the ballot of the next

regularly scheduled election in the township. In light of the Covid 19 pandemic, the Annual Town

Meeting has been indefinitely suspended by Executive Order 2020-22.

2) The petitioner is requesting the Township Board (in accordance with 60 ILCS 1/80-80) to authorize

the following advisory question be placed on the ballot of the next regularly scheduled election and

shall certify the question to the proper election officials who shall submit the question in accordance

with the general election law.

A. Covid 19-Gubernatorial Executive Orders: 1) Executive Orders 2020-32, 33 & 34 extending previous Executive Orders until May 29, 2020.

2) Governor Pritzker’s “Restore Illinois” (5/5/20) plan to reopen the State of Illinois. Supervisor

Meyers added efforts have been made to insure the safety of the Township work force in order to

keep them performing and to provide services to the public. Noting, while assumptions are

made that a governmental office has easy or prioritized access to PPE’s, sanitation or other

supplies that unfortunately is not the case. However, the Township was able to procure a slight

amount of PPE’s and supplies that will assist staff’s ability to continue safely providing services

to the community while extending work hours. In addition, there has been a small amount of

residents that have requested support due to the Covid-19 pandemic. Supervisor Meyers is

happy to report that the Township was capable of providing the necessary assistance or

guidance requested. Adding, that the Township lacks the authority to spend taxpayer’s dollars

on issues individually perceived as warranted as they must adhere to state guidelines. She

reminded the audience that General assistance is available to qualified participants should need

be indicated.

A. Notice of Public Hearing:

1) The Lockport Plan and Zoning Commission has scheduled a Public Hearing on May 12, 2020 at

7:00pm on the third floor of 222 East 9th Street for the purpose of considering and hearing testimony

for the rezoning (with annexation) from R2 Residential (unincorporated Will County) to R2 Single

Family Residential (City of Lockport) and special use permit for a Government Office for the property

located at 16415 W. 151st Street. The purpose is to bring the property of the existing Homer Township

Fire Protection District, Fire Station #3 into conformance with City Codes and Ordinances upon

annexation.

B. Advisory Referenda: 1) An Advisory Referendum petition submitted to the Township Board to be placed on the Agenda of

Annual Town Meeting petitioning a question of public policy be placed on the ballot of the next

regularly scheduled election in the township. In light of the Covid 19 pandemic, the Annual Town

Meeting has been indefinitely suspended by Executive Order 2020-22.

2) The petitioner is requesting the Township Board (in accordance with 60 ILCS 1/80-80) to authorize

the following advisory question be placed on the ballot of the next regularly scheduled election and

shall certify the question to the proper election officials who shall submit the question in accordance

with the general election law.

a) A motion is requested of the Board to authorize the following Advisory Referendum (petition)

question: “Shall the Homer Township Board in accordance with its Open Space Program pursue

grant funding WITHOUT increasing or adding any new real estate taxes, for the purposes of

constructing a multipurpose, pole barn style structure to be used for educational, environmental,

recreational and social community activities?”

A. Covid 19-Gubernatorial Executive Orders: 1) Executive Orders 2020-32, 33 & 34 extending previous Executive Orders until May 29, 2020.

2) Governor Pritzker’s “Restore Illinois” (5/5/20) plan to reopen the State of Illinois.

NOTICE UNDER THE AMERICANS WITH DISABILITIES ACT

In accordance with the requirements of title II of the Americans with Disabilities Act of 1990 ("ADA"), Homer Township will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities.

Employment: The Township does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under title I of the ADA.

Effective Communication: The Township will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in Homer Township programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.

Modifications to Policies and Procedures: The Township will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services, and activities. For example, individuals with service animals are welcomed in Township offices, even where pets are generally prohibited.

Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of Homer Township, should contact the office of the Township Clerk Kathy Kruczek, 14350 W. 151st Street, Homer Glen, IL 708-301-7042 as soon as possible but no later than 48 hours before the scheduled event.

The ADA does not require Homer Township to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden. Homer Township will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.
