The Contract of Insurance

Thank you for choosing Bank of Ireland for your home insurance needs.

The Policy is evidence of the contract between the insurer RSA InsuranceIreland Limited and You, the Policyholder.

The Policy, the Schedule and any Endorsements are to be read as onedocument and any word or expression used with a specific meaning appearsin bold text and has the same meaning wherever it appears.

The insurer will provide under those Sections which are shown in theSchedule the insurance described in the Policy during any Period ofInsurance.

The Conditions which appear in the Policy or in any Endorsement are part ofthe contract and must be complied with. They are where their nature permitsConditions precedent to your right to recover under the Policy.

This Policy provides wide cover but no insurance policy can protect Youagainst every loss. For example, You cannot claim when the only damage iswear, tear or deterioration caused by normal everyday use.

Premiums are subject to a Government Levy and/or contribution where applicable.In accordance with Section 93 of the Insurance Act 1936 it is understood andagreed that all monies which become or may become due and payable by theinsurer under this Policy shall be payable and paid in the Republic of Ireland.Stamp Duty has been or will be paid in accordance with the provisions ofSection 5 of the Stamp Duties Consolidation Act, 1999 (as amended).

All monies referred to and/or due under this Policy are expressed in and/orpayable in Euro.

Home Insurance PolicyThis is Your Home Insurance Policy. It sets out the details of the contract You have made with Us.The Proposal Form and Declaration which You made to Us are incorporated in and form part of thiscontract.

COOLING OFF PERIODPLEASE READ YOUR POLICY THOROUGHLY TO MAKE SURE THAT IT MEETS ALL YOURREQUIREMENTS PAYING PARTICULAR ATTENTION TO POLICY DEFINITIONS EXCLUSIONS ANDENDORSEMENTS. IF IT DOES NOT MEET YOUR REQUIREMENTS, YOU CAN SEND IT BACK TOUS WITHIN 30 DAYS AND WE WILL REFUND YOUR PREMIUM PROVIDED YOU HAVE NOTMADE ANY CLAIM DURING THE 30 DAY PERIOD. SHOULD YOU DECIDE TO RETURN THEPOLICY TO US, YOU WILL NOT BE ABLE TO MAKE A CLAIM AT A LATER DATE.

We confirm that We will insure You in the terms set out in this Policy for any period for which Youoffer Us Your premium and We accept it.

The Schedule and any Endorsements are all part of Your Policy and shall be considered as onedocument. Check Your Schedule to find out which Sections You have insured and read them alongwith Your Policy. You should also pay particular attention to the Conditions and Exclusions set outon Pages 59-64 as these apply to all Sections.

You must tell Us immediately of any changes in the information You have given Us in Your ProposalForm or any other changes which affect this insurance. For example, if You make any alteration toYour property, which makes losses more likely to happen or more serious if they do or if You movehouse. If You do not let Us know You could invalidate Your Policy. Remember to tell Us if You planto leave Your Home Unoccupied for more than 45 consecutive days since there is some reduction incover in these circumstances.

PARAGRAPH 1 - COVER

We insure the Buildings against Damage bythe following causes:

a Fire, Explosion, Lightning, Earthquake

b Smoke

c Escape of water or oil from any fixed water orheating installation or domestic appliance

d Impact involving an aircraft, aerial device oranything falling from them, or by a vehicle,train or animal

e Falling trees or branches

f Falling aerials, satellite aerials, their fittings ormasts

g Riot, Civil Commotion, Strike, Labour orPolitical Disturbance

h Malicious persons or vandals

i Storm or Flood

We will not pay for:- The Excess shown in the Schedule

- Where the Damage results in Subsidencethe first €1,000, or higher SubsidenceExcess as shown on the Statement of Fact/ Schedule, of each claim will be excluded

- Damage to the component or appliancefrom which the water or oil escapes

- Loss or Damage to walls, ceilings and/ortiles caused by the gradual ingress orseepage of water from shower units, baths,permanently sited hot tubs, saunas or othersanitary fixtures

- Loss of or Damage to any fixed domesticheating installation due to wear and tear, rust or gradual deterioration

- Remediation to a standard which will pose arisk to health or property or carried out by acontractor not approved by Us

- Damage occurring after Your Home hasbeen Unoccupied for more than 45consecutive days

- Damage to tennis courts- The cost of removing a tree or branch unless

the Buildings are damaged at the same time

- Any loss where We make a payment under Section 2 Contents Paragraph 1 Cover f

- Damage caused by You or Your Householdor any person lawfully in the Home

- Loss or Damage occurring after Your Homehas been Unoccupied for more than 45consecutive days

- Damage to gates, hedges, fences or tenniscourts

- Damage caused by frost- Loss or Damage to roofs constructed with a

flexible weather roofing membrane exceeding10 years of age or other mineral roofing feltexceeding 5 years of age

j Subsidence or Ground Heave of the sitebeneath the Buildings or Landslip

- Damage caused by bedding down ofstructures or settlement

- Damage to solid floor slabs or Damageresulting from their movement unless thefoundations beneath the external walls ofYour Home are damaged at the same time

- Damage caused by coastal or river erosion- Damage resulting from:

i demolition or structural repairs oralterations to the Buildings

ii faulty workmanship or the use of defective materials in the Buildings

- Loss or Damage caused by You or YourHousehold or by any person(s) who haslegally entered the premises

- Loss while Your Home or any part of it is lentto any persons other than a member of YourHousehold or let to tenants or occupied bypaying guests, not involving forcible and / orviolent entry into or exit from the Buildings orits domestic outbuildings or garages

- Loss or Damage by stealing not involvingforcible and / or violent entry into or exit fromthe Buildings or its domestic outbuildings orgarages, where the property at the addressshown in the Statement of Fact / Scheduleis left unattended

- Where the property at the address shown inthe Statement of Fact / Schedule is leftunattended and an intruder alarm is installedbut not operative at the time of loss the first€500 of each claim will be excluded

- Loss or Damage occurring after Your Homehas been Unoccupied for more than 45consecutive days

- Damagea Whilst Your Home or any part

of it is lent to any persons other than amember of Your Household

b Whilst Your Home or any part of it is let totenants or occupied by paying guests

c Caused by Settlement or shrinkage- Any loss or Damage specifically excluded

m Rent and Alternative Accommodation

If Your Home is made uninhabitable by any ofthe causes under Paragraph 1 of this SectionWe will pay

i) Rent which You still have to pay for parts ofYour Home which are unfit to live in

ii) Reasonable additional costs of comparablealternative accommodation until Your Homeis fit to live in again

d Fire Brigade ChargesWe will pay the cost of the charges made onYou by a Local Authority in accordance withthe provisions of the Fire Services Act 1981for Fire Brigade Attendance as a result of anyincident involving fire affecting the Buildingsin circumstances which give rise to a validclaim under this Policy

- Where the Damage results in Subsidencethe first €1,000, or higher SubsidenceExcess as shown on the Statement of Fact/ Schedule, of each claim will be excluded

- Damage which You are not legallyresponsible to repair

- Where the Damage results in Subsidencethe first €1,000, or higher SubsidenceExcess as shown on the Statement of Fact/ Schedule, of each claim will be excluded

- Damage occurring while Your Home hasbeen left Unoccupied for more than 45consecutive days

PARAGRAPH 3 - INFLATION PROTECTION FOR SECTION 1

Index linkingThe Sum Insured on Buildings will be adjusted monthly in line with the House Rebuilding Cost Indexprepared by the Department of the Environment. Where there has been an inflationary increase abovethe House Rebuilding Cost Index or if this index is not available We will use a suitable alternativeindex to increase the Sum Insured. No additional premium will be charged for these adjustmentsbetween the anniversary dates of Your Policy, but the renewal premium will be calculated on therevised Sum Insured as appropriate.

Protection after lossThe Sum Insured on Buildings will continue to be index linked following loss or Damage by anycause listed in this Section while the Buildings are being reinstated, provided You take allReasonable steps to ensure that the reinstatement is carried out without undue delay.

Provided the Damage is covered under Your Policy, We will settle Your claim as explained belowsubject to the maximum amount payable

1 Where

(a) the damaged parts of the Buildings can be repaired or replaced, and

(b) Your Home is in good repair, and

(c) the Sum Insured is not less than the cost of rebuilding the Buildings, inclusive of Fees,Removal of Debris, and Local Authority Requirements

at our option We will either

(a) replace or

(b) reinstate or

(c) pay the full reasonable cost of repair to the Buildings to You.

Where We agree to pay You We reserve the right to withhold final payment until all works arecomplete, final invoice submitted and final inspection completed by Us.

2 If the damaged parts of the Buildings cannot be economically repaired or replaced, We will paythe reduction, solely due to the Damage, in the market value of the Buildings prior to theDamage

- Loss or Damage to the component orappliance from which the water or oilescapes

- Damage occurring after Your Home hasbeen Unoccupied for more than 45consecutive days

3 If the Buildings are not in good repair We will make a deduction from the settlement for wear, tear,depreciation and / or Betterment

4 Under Insurance ClauseIf at the time of the Damage the Sum Insured is less than the full rebuilding cost We will pay onlyfor the proportion of the Damage which the Sum Insured bears to such cost.

5 MaintenanceYour Policy does not cover You for the cost of gradual deterioration – it is not a maintenancecontract. It is a Condition of the Policy that You keep Your property in good order and takeReasonable steps to avoid loss or Damage.

Maximum Amount PayableThe maximum amount payable in respect of any one incident (less any Excess) is:

1 Buildings including Fees, - The Sum InsuredRemoval of Debris andLocal Authority Requirements

2 Satellite Aerial - €700

3 Fire Brigade Charges - €2,000

4 Trace and Access - €700

5 Legal Fees - €12,750

6 Rent and Alternative Accommodation - 20% of the Sum Insured on Buildings

The Sum Insured on Buildings will not be reduced following payment of a claim.

Insurance is provided for any amounts whichYou become legally liable to pay in respect of:

• Accidental bodily injury, death, disease orillness of any person

• Accidental loss of or Damage to propertyarising solely as owner (but not Occupier) ofthe Buildings or the land belonging to the Home

LimitWe will pay up to €3,000,000 in connectionwith any one incident inclusive of all costs,expenses and solicitors fees which You haveto pay, provided We confirm Our agreementin writing

PARAGRAPH 5 - OWNERS LIABILITY TO THE PUBLIC

We will not pay for liability directly or indirectlyarising from:

- Any injury, death, disease or illness of anymember of Your Household

- Loss of or Damage to property owned,occupied or in the custody or control of anymember of Your Household

- An agreement unless the liability would haveexisted without the agreement

- Your employment, business or profession otherthan the provision in Your Home of:

i a child minding service for up to 2 childrenii accommodation for up to 6 paying guests

- The use of lifts or mechanically or electricallypropelled vehicles (other than gardeningequipment)

- Injury to any person in Your employment- Bodily injury, death, disease or illness or fear of

suffering bodily injury, death, disease or illnessarising out of actual or suspected exposure toAsbestos, Asbestos Dust or AsbestosContaining Materials

Where there has been aninflationary increase above the Durable Household Goods Section of the Consumer Price Index or ifthis index is not available We will use a suitable alternative index to increase the Sum Insured. Noadditional premium will be charged for these adjustments between the anniversary dates of YourPolicy, but the renewal premium will be calculated on the revised Sums Insured as appropriate.

Conditions Which Apply to theWhole Policy1 Notification of a Claim

You must notify Us when You becomeaware of a claim under Your Policy assoon as possible (Refer to page 67). Ifthere has been stealing, attempted stealing,vandalism, loss or any malicious act, Youmust tell the Gardai or Local LawEnforcement Agency as soon as possible.

You must at Your own expense provide Uswith all details and evidence We reasonablyrequest, including written estimates andproof of ownership and value.

Do not dispose of any damaged items untilWe have had the opportunity to inspectthem.

Any writs, summons, other legaldocuments, letters of claim or othercorrespondence served on You or anymember of Your Household in connectionwith a claim must be sent to Us as soon aspossible. You must not answer thiscorrespondence without Our writtenconsent. We will not unreasonably withholdOur consent.

2 Conduct of the ClaimYou must give Us whatever information orassistance We reasonably request andmust not admit, deny, negotiate or promiseto pay any claim without Our writtenconsent. We will not unreasonably withholdOur consent. We may enter any Buildingwhere loss or Damage has occurred anddeal with the salvage but no property maybe abandoned to Us.

3 FraudIf any claim is in any respect fraudulent, orif any fraudulent means or devices are usedby You, any member of Your Householdor anyone acting on Your or their behalf toobtain benefit under Your Policy, then allbenefits under Your Policy will beterminated. We may let the appropriateLaw Enforcement authority know about thecircumstances. We may declare thePolicy void and We will be entitled torecover from You the amount of any claimWe have already paid under the Policy.

4 Alteration in RiskYou must notify Us as soon as possible ofany alteration in risk which materially affectsYour Policy.

Material information would include anyinformation on a member of YourHousehold or any special feature of Yourproperty which makes losses more likely tohappen or more serious if they do.

We may reassess Your Policy cover and

premium following notification of materialinformation. Failure to disclose all materialinformation may result in the wrong termsbeing quoted, a claim being rejected orreduced, or Your Policy being invalid.Where any change to the cover providedby Your Policy and agreed by Us, resultsin additional premium payable by You toUs of not more than €3, inclusive of levy,then We will not charge You in respect ofsuch additional premium.

Where any change to the cover provided byYour Policy and agreed by Us, results in apremium due to You from Us of not morethan €3, inclusive of levy, then We will notrefund You in respect of such return premium.

5 PrecautionsYou and any member of Your Householdmust take all reasonable steps to preventor minimise loss, Damage or accident andmaintain the insured property in a soundcondition and good repair.

6 Annual Premium CancellationYou may cancel Your Policy by givingBank of Ireland Insurance Services Ltd.written instructions confirming the requireddate of cancellation or by calling Bank ofIreland Insurance Services Ltd. on 1890 608 608. Please note calls arerecorded.

We may cancel Your Policy. If We cancelYour Policy, We will write to You at Yourlast known address confirming that allcover will cease 14 days after the date ofOur letter.

If Your Policy is cancelled by You or Us,You may be entitled to a refund of premiumfor any unexpired period of cover.

7 Monthly Premium CancellationYou may cancel Your Policy by givingBank of Ireland Insurance Services Ltd.written instructions confirming the requireddate of cancellation or by calling Bank ofIreland Insurance Services Ltd. on 1890 608 608. Please note calls arerecorded. You should also instruct YourBank to cancel Your Direct Debitarrangement.

In the event of Your default in paying anyinstalment on the date it becomes due allcover under this Policy will cease fromsuch date.

We may cancel Your Policy.

If We cancel Your Policy We will write toYou at Your last known address confirmingthat all cover will cease 14 days after thedate of Our letter. 59

If Your Policy is cancelled by Us, You willreceive a full refund of premium for anyunexpired period of cover provided noclaim has been made during the currentPeriod of Insurance.

If Your Policy is cancelled under thisCondition, We will stop applying for Yourmonthly premium.

8 Other InsuranceWhere a claim is covered under YourPolicy and this claim is covered by anyother insurance, We will only pay Ourrateable proportion.

This Condition does not apply to Section 7Personal Accident.

9 SubrogationBefore or after We pay Your or themember of Your Household's claim underYour Policy You or the member of YourHousehold must, if We ask You to, take orallow Us to take in Your or the member ofYour Household's name, all the stepsneeded to enforce Your or the member ofYour Household's rights against any otherperson, including the defence or settlementof any claim or the pursuit of a claim in anyperson's name.

We will pay any reasonable costs andexpenses involved.

This Condition does not apply to Section 7Personal Accident.

“WHAT DO I DO IF MY PROPERTYIS LOST OR DAMAGED?”Naturally We hope You won't have anyaccidents or misfortune, but if You do, thefollowing advice might be useful.

• Take any emergency action which may benecessary to protect Your property fromfurther Damage e.g. switch off the gas,electricity and water. If You have to arrangefor a contractor to carry out emergencywork, please keep the repair account whichWe will need to see.

• Inform the Claims Unit at RSA, RSA House,Dundrum Town Centre, Sandyford Road,Dublin 16. Telephone 1890 608 608,Facsimile (01) 671 7541 as soon as possiblefor advice on how to proceed with Yourclaim. You will be asked to complete a claimform and/or provide all relevant informationin relation to the incident and return with therelevant estimates/valuations/receipts.

• Check Your Policy wording carefully, to seeif the loss or Damage is covered. YourPolicy lists the events (e.g. Storm orStealing) which are covered and not coveredand also any general Exclusions orConditions which apply to Your wholePolicy (see pages 57 - 64).

• Remember that Your Policy is not amaintenance contract and does not coverany loss or Damage caused by normal wearand tear - no Insurance Policy does.Remember too that the amount You areentitled to claim may be reduced if Yourproperty has not been properly maintained.

• We have arranged a 24 hour EmergencyHelpline Service to give You immediateaccess to the experts who will solve Youremergency.

“I THINK I AM COVERED - WHATDO I DO NOW?”If the damaged item can be cleaned orrepaired• Items such as carpets, soft furnishings etc.,

may often be capable of being cleaned orrepaired. If You contact Us by telephone wecan make the necessary arrangements forspecialist attention.

“IS THERE ANYTHING ELSE I SHOULD DO?”• Please do not dispose of damaged items

before We have had the opportunity toinspect them.

• Report any incident involving loss, stealing,malicious Damage or hit and run Damageto the Gardai or Local Law EnforcementAgency.

• If someone is making a claim against You orany member of Your Household for anyinjury to them or Damage to their property,You must send Us full details, in writing,immediately. Any letters or legal documentsYou receive should be sent to Us,unanswered, without delay. It is mostimportant that You leave Us to deal with thematter on Your behalf and do not getinvolved in any correspondence orconversation with the other person.

“HOW WILL THE CLAIMS UNITDEAL WITH MY CLAIM?”Our aim is to deal with Your claim promptly,efficiently and fairly. At all times We will try toprovide You with the highest standard ofservice. If You have any comment or complaintor if Our service has not met Your expectationsplease do let Us know.

Depending on the type of claim and valueinvolved We may:

• Contact You by telephone or letter toprogress Your claim.

• Arrange for one of Our claims team topersonally call on You.

• Appoint an independent Loss Adjuster todeal with Your claim on Our behalf.

If an item is lost or damaged beyond repair, Wehave a network of suppliers who can provide afast and efficient replacement service.

Please read the following carefully as it containsimportant information relating to the informationthat you give us. If you provide informationrelating to anyone other than yourself, you areresponsible for obtaining their consent to theuse of their data in the manner outlined below.

What does RSA do with Yourpersonal data?Information you provide will be used by RSA forthe purposes of processing your applicationand administering your insurance policy. RSAmay need to collect sensitive data relating toyou (such as medical or health records orconvictions) in order to process your applicationand/or any claim made.

All information supplied by you will be treated inconfidence by RSA and will not be disclosed toany third parties except (a) to our agents, sub-contractors and re-insurers (b) to third partiesinvolved in the assessment, administration orinvestigation of a claim, (c) where your consenthas been received or (d) where permitted bylaw. In order to provide you with products andservices this information will be held in the datasystems of RSA or our agents orsubcontractors.

RSA may pass your information to othercompanies for processing on its behalf. Someof these companies may be based outside theEEA, but in all cases RSA will ensure that itstransfers of data are lawful and that yourinformation is kept securely and only used forthe purposes for which it was provided.

Calls to RSA may be recorded for qualityassurance or verification purposes.

Fraud prevention, detection &claims historyIn order to prevent and detect fraud and thenon-disclosure of relevant information RSA mayat any time:

• Share information about you withcompanies within the RSA Insurance Group,other organisations outside the RSA Groupincluding where applicable private

investigators and public bodies including AnGarda Síochána;

• Check and / or file your details with fraudprevention agencies and databases, and ifyou give us false or inaccurate informationand we suspect fraud, we will record this.

RSA may also search these agencies anddatabases to:

• Help make decisions about the provisionand administration of insurance, credit andrelated services for you and members ofYour Household;

• Trace debtors or beneficiaries, recover debt,prevent fraud and to manage your accountsor insurance policies;

• Check your identity to prevent moneylaundering, unless you furnish us with othersatisfactory proof of identity;

• Undertake credit searches and additionalfraud searches.

Insurance DatabaseWe subscribe to the Insurance Link database,the Irish Insurance Federation’s database forfraud prevention purposes and to check againstnon-disclosure. Under the conditions of yourinsurance policy, you must tell us about anyincident which may or may not give rise to aclaim. When you tell us about an incident, wewill pass information relating to it and you toInsurance Link. We may request informationabout you and your claims history and / orshare information we hold about you and yourclaims history with other insurance companiesdirectly, their agents and with any otherintermediary acting for you. In assessing anyclaims made, we may undertake checks againstpublicly available information we hold about youand your claims history.
