MARCH, 2019, AT 11.30 AM, IN THE CONFERENCE HALL OF THE GOA STATE POLLUTION CONTROL BOARD, SALIGAO.
I. The 138th meeti~ (Special meeting) of the Goa State Pollution Control Board was held on 29 March , 2019 at 11.30 a.m. in the Conference hall of the Goa State Pollution Control Board. '
The following members attended the meeting.

II. At the outset Member Secretary informed the members that this particular meeting was scheduled to be held on 1 s"" March, 2019. However, the board was ', than in receipt of complaints from one Adv. Sunaina Chari levelling allegations that the conduct of the Board meeting was in violation of the Model Code of Conduct. These complaints were forwarded to the Board by the Chief Electoral Officer. TI1e office of the Chief Electoral Officer considering the Board's reply to the aJlegations of Adv. Sunaina Chari directed the Board to place the matter before the Screening Committee. The approval of the Chief Electoral Officer for convening the Board meeting has now been received. Hence today's meeting was scheduled.
Member Secretary placed the complaints received from Adv. Sunaina Chari on behalf of various organisations before the Members. Members on perusing the allegations in the complaints have found the same to be baseless and untrue and have decided that the gcnuiness of the complaints and Adv. Sunaina Chari as well as the allegation in the complaint require to be investigated.

Decision: It was resolved that the matter be referred to the State Government for conducting a detailed inquiry in the matter and to probe the veracity of the

This penalty will be in addition to the late fees charged by the Board as stated above, who fail to apply for Renewal of Consent prior to expiry of validity or the establishments who are operating without the Consent of the Board which are 50% of the fees applicable and if the unit is found to be operating without the Consent of the Board.
It was further decided that if the establishment is still found violating, then the penalty will be double for every additional violation.
The above penalty is for industries/ estabJishmenY h_otels/ hospitals ~_t_~. ·who are under the-purview of Water and Air Act. However for violations under Solid Waste Management Rules, 2016 including Construction and Demolition Waste and all other types of waste is as follows:

Agenda item no. 2 - (a) The members noted that Mis South West Port Limited (SWPL) and Mis Adani Mormugao Port Terminal Pvt. Ltd., (AMPTPL) have deposited an amount of Rs. 10 lakhs each as penalty in terms of Polluter pays Principle. (b) The members further noted that Amendment to Consent to Operate has been issued to Mis SWPL and Mis AMPTPL incorporating the conditions as decided by the Board. And that Mis AMPTPL has deposited a Bank Guarantee amounting to Rs. 1 Crore with a validity period in line to the Consent issued towards satisfactory compliance of the Consent conditions.

Agenda item no. 03 Consents issued under OCMMS Software (On-line Consent Management and Monitoring System) .
The members perused the details of Consents issued by the Board under OCMMS Software (On-line Consent Management and Monitoring System) from 6th February, 2019 to 7'" March, 2019, by the Delegated Authorities for grant of Consents under Red, Orange and Green category of Industries.
Agen'd,i item no. 04 Requisitioning of the services of the staff of the Board by the State Government
Member Secretary informed the members that the State Government while sanctioning various posts in the Goa State Pollution Control Board on J:0108/201 L, have stated that 'the State Government reserves the right to utilise the services of any or at! the Officers I Officials of the Goa State Pollution Control Board for its activities and any other task assigned from time to time. Further vide letter dated. I 1/07 /20 I 11, it is stated that the liability on account of expenditure incurred to meet the requirements of salaries and all other allcwarrces of the said posts shall vest with the GSPCB and shall be drawn from their own funds, with no liability on the Government.
Member Secretary further informed the members that the officials of the Board are trained in their respective fields and decided that henceforth no staff of the Board other than those already deputed in addition to their own work in GSPCB should be deputed to any other department or for election related work.
Agenda item no. 05 Application of Mis South West Port Ltd. (SWPL) for Consent to Operate under Air Act and Water Act
Member Secretary informed the members that the application of Mis South West Port Ltd. for renewal of Consent to Operate under the Air Act and the Water Act was discussed at the 1361h and J37'h meetings of the Board, since the unit had defaulted in carrying out operations during high wind conditions, the same was kept in abeyance. The Consent of J\1/s S\\'PL expires on 3 l/03/20 l 9.

The members perused the various complaints received by the Board in this respect (enclosed as Annexure 'A'), same were read out by the Member Secretary. The members also perused the ambient air monitoring data for the months of January to March, 2019, the comments of Dr. Sengupta, former Member Secretary of Central Pollution Control Board, Mr. M.K. Verma, scientist, CPCB in connection with the Affidavit filed by Goa Foundation,
which includes observations of Dr. D.B. Boralkar. As regards to the submission made by Goa Foundation that the machinery of Mis SWPL is obsolete as per the submission made in National Green Tribunal, it is observed that the Board has issued NOC in July, 2016 for replacing the mobile harbour crane with grab ship unloader. from existing diesel engine to electric engine and was also granted Consent for modernisation and installation of rapid in motion wagon loading system at berth no. 5A and 6A in the year 20 I 3. With regard to issue of air quality in the Vasco city and surrounding areas, the reports of the AAQM for the months of January, February and March were placed before the Board.
______ The Board after taking int<:> COll~ideration !h_e Phase I report of Dr. Sethl of _ Source apportionment, comments of Dr. Sengupta, Ex. Member Secretary, Central Pollution Control Board on the IIT study as well as comments on N.K. Verma, ex- Scientist, Central Pollution Control Board and also the observation of Dr. Boralkar on the IIT study report decided to accept the recommendation made by Dr. Sengupta and N.K. Verma and direct MPT to implement the said recommendation.
The Board also took in consideration that the Source Apportionment study is in. progress and there is no conclusive evidence the high value of PM IO recorded at fuse call and Sada are due to handling of coal at berth no. 5A and 6A which is also a part observation made by Dr. Boralkar in his comments on behalf of Goa foundation and decided to recommend the renewal of Consent to operate at 0.4 MMT/month.
De •.. ~.ision: The Board resolved to grant renewal of Consent to Operate to Mis SWPL to handle coal at berth no. 5A and 6A for 0.4 MT/month and handling of • limestone and steel of I million MT/annum each for a further period of one year upto 3 I /03/2020.
The Board also resolved to direct Mis Morrnugao Port Trust (MPT) to include the recommendations made by Dr. Sen Gupta in the Source Apportionment Study and implementation of wind protection wall for dust emission control, including use of chemical binders and suppression.
The Board also resolved to direct MPT to implement the recommendations made by BITS Pilani in their study report and implement the measures on the other berths as the existing coal handling berths are already equipped with the record systems.
With reference to the conditions imposed on the units with regard to 'wind speed', the Board is in receipt of two representation from Mis South West Port Ltd. and Mis Adani Mormugao Port Terminal Pvt. Ltd. requesting to amend the Consent condition as issued vide addendum no. 5/356/18-PCB/CJ-5403 dated

25/02/2019. The unit has requested to change the condition 6 (XXV) 'The port handlers shall not carry out.activities when the wind speed is more than 10 km/hr. The unit has requested for permissible wind speed of l O m/s against the l O km/hr imposed by the Board.
After deliberations and scientific presentation made. by the Scientific staff of the Board (Annexure 'B' ) on the wind speed data, scales and studies, decided to amend the conditions of Consent to permit handling of coal upto wind speed of 30 kms/hr with the following conditions (i) Normal operations permitted upto a wind-speed of 28 km./hr. (i.e. Beaufort _s,-ale_c- Q_1)_. (ii) Precautionary
.... ···------~measured should be in place with proportionate scaling-down Operations when the wind-speed exceeds 28 km/hr. (i.e. Beaufort scale - 05) (iii) All operations should stop at a wicd-speed of 30 km./hr. and amend the Consent of Mis Adani Mormugao Port Terminal Pvt. Ltd. (AMPTPL) as well as of Mis SWPL accordingly. However, the condition·ofwind speed will not be applicable to rail wagon loading activities and during monsoons.
The Board also resolved to amend the conditions of Mis AMPTPL to reduce stack height to 9 metres and to improve his existing wind shield .

·&. Agenda item no. 06 Request received from Mis Mormugoa Port Trust for coal handling at Mooring Dolphin l, 2 and 3
Member Secretary, informed the members that Mis Mormugao Port Trust has made an application to the Board for Consent to Operate for handling coal at Mooring Dolphin l, 2, and 3.
Members perused the agenda notes and· decided that Mis Mormugao Port Trust be called to make a presentation before the Board of his proposed activities. The item has been def en ed to the next Board meeting.
Agenda item no. 07 Request from M's Momrngao Port Trust for grant of Common Consent for the entire berth.

Member Sccretar, informed the members that Mis Mormugao Port Trust has made a request for grant of Common Consent for entire Port of Ml'T. On perusal of the request made hv the unit, the members decided that MPT makes a presentation before th, Board of the activities carried out at the Port and have deterred this item to the next Board meeting.
Agenda item no. 08 Revision of the of fees for Authorization issued by the Board under the Solid Waste Management Rules, 2016
Member Secretary informed the members that the Board at its 122"• • th
meeting held on 28 November, 2016 had proposed to levy a fee of Rs. I 0,000/- for issue of Authorisation for Municipal Solid Waste. The fee was required to be reviewed in lieu of Solid Waste Management Rules, 2016 which has included in its ambit Village Panchayat or any facility handling solid waste. Member Secretary further informed that the fees are ne_CJJlire!i tg' be imposed as the Board will be required to conduct-inspections, compilation of annual reports and attending to complaints.

Table item no. 01 Public Interest Litigation - Writ Petition no. 33 of2017
Memebr Secretary informed the members that the office was in receipt of ' a Notice from the Hon. High Court of Bombay at Goa Panaji, which was forwarded to the members, in respect of Public Interest Litigation - Writ Petition no. 33 of2017 -Kashinath Jairam Shetye and 15 Ors. V/s The State of Goa, through Chief Secretary, Govt. of Goa and 5 ors. wherein the Constitution of the Board has been challenged.
Member Secretary further informed the members that Notification constituting the Board is issued by the the Director/ Ex- officio Joint Secretary, Science, Technology and Environment in exercise of the powers conferred by sub-section (I) and (2) of section 4 of the Water (Prevention and Control of Pollution) Act 1974 (Central Act 6 of I 974), conveying the approval of the Government of Goa to re-constitute the Goa State Pollution Control Board for the period of three years from the date of Notification in Official Gazette.
Members after deliberations decided to write to the State Govenunent to defend the Board members in the Court of Law.

It was also resolved that the Board shall appoint an independent Advocate to defend the case in the Court of Law. The members also authorised Member Secretary and Chairman "to appoint an independent Advocate to defend the interest of the Chairman, Member Secretary and the Board members.

Board is in receipt of a Complaint/objection from Mr.Savio Correia dated
28/02/2019 and email, stating the units are still operating in the wind

Board is in receiptof an objection from Goa Foundation requesting no to
grant renewal of consent to Mis South west port ltd. It is submitted that
the two technical reports submitted by llT professor and BITS pilani
should not be relied upon. It is submitted that the IIT report on which the
board revoked the suspension of consent is a draft interim report and is ,
not based on empirical data or analysis Further states that the model
adopted isa complete failure since the actual emission levels are 14 times
what is assumed in the model. Secondly. complainant states that the
BlTS reports on the mooring dolphin is technical incompetent as the
wind rose are wrongly interpreted in the report.

dolphin, Application of MPT for common consent should be adjoined.
• In the representation dated 21/03/2019 .it is submitted that Mis SWPL
has already imported coal in excess in past years by exceeding the
handling capacity and board vide order dated 9/0 l/20 l 8 directed SWPL
to halt the coal handling operations at the port. Further is submitted diat
the total quantities imported by SWPL in excess of th.e .consent terms are
equivalent to four year import handling and hence the CTO should. not be
granted for coal handling for .next fo.ur years.
• In above stated representation, it is stated that the opposition to Renewal
of Consent is in lieu of the admission made by SWPL in their petition
No. 173/2018 which seeks directions to the Central Government to
consider their application forenvieonmentat clearance.
3. Complainant from Goa First dated 08/3/2019
• Complainant bas stated that both the unit i.e Mis SWPL and Mis
AMPTPL are operating their conveyor belts and operation during the • night time thus creating noise pollution above 70c!BA against the 45 dBa
Standards. Complaint has requested that action may be initiated against the unit to reduce the noise levels.

The Board had also received letters from Mr. Sherwi 11 Correia and
others residents of Monnugao and Vasco da Gama daled 18/02/2019

AMPTPL. . The Board also received from the Aam Admi Party dated
18/02/2019 requesting the Board to revoke the Consent to Operate issued
by it to all the Coal handling units and Mis Mi'T on the ground that these - -- ---- - - -- - - --
companies do not have title of ownership on the land they are located
upon. They had also requested to be heard before the Board today. A
representation dated 12/02/2019 from Mr. Ashley Noronha, President

28/02/2019 and email, stating tbe units are still operating in tbe wind speed
condition of greater tbat IOKM/hr. Complainant requested that the l OKM/hr
imposed by the board may be maintained. Also it is requested that as a

Board is in receipt of an letter dated 25/02/19 from Mis Soutbwest port Pvt Ltd
requesting amerulm.ent in the consent conditions as issued vide addendum.
5/356/l 8PCB/CI05403 dated 25/02/2019.Unit has requested to change the
condition 6(XXV) "The port handlers shall not carryout activities when the wind speed is more than I OKm/lir".
Unit has submitted that during the presentation on 21/02/2019 it was discussed •,
for 1 Orn/s wind speed. Also it was not discussed for daily average, weekly
average. It is submitted that as a normal practice .the port operations are stopped
at 25Knots (46KM/hr/l2.86m/s).lt is submitted that owing to special condition
they can stop the operations at 19.SK.nots (36Kin/br/l Om/sj.It is further
submitted that the grab ship OEM doesn't permit the operation above
20m/s.Unit submitted request to operate half of the wind speed as suggested in by the grab ship OEM ie to 1 Om/s.
