Final Determination

THE Scientific Committee, established by the Threatened Species Conservation Act has made a Final Determination to list the Carex Sedgeland of the New England Tableland, Nandewar, Brigalow Belt South and NSW North Coast Bioregions as an ENDANGERED ECOLOGICAL COMMUNITY in Part 3 of Schedule 1 of the Act. Listing of Endangered Ecological Communities is provided for by Part 2 of the Act.

The Scientific Committee has found that:

1. Carex Sedgeland of the New England Tableland, Nandewar, Brigalow Belt South and NSW North Coast Bioregions is the name given to the ecological community characterised by the species assemblage listed in paragraph 2. These Bioregions are as defined by Thackway and Cresswell (1995). A map of this version of Interim Biogeographic Regionalisation of Australia is available at

2. Carex Sedgeland of the New England Tableland, Nandewar, Brigalow Belt South and NSW North Coast Bioregions is characterised by the following assemblage of species:

3. The total species list of the community is considerably larger than that given above, with many species present in only one or two sites or in low abundance. The species composition of a site will be influenced by the size of the site, recent rainfall or drought condition and by its disturbance history. The number of species and the above ground relative abundance of species will change with fire and grazing regime. At any one time, above ground individuals of some species may be absent, but the species may be represented below ground in the soil seed banks or as dormant structures such as bulbs, corms, rhizomes, rootstocks or lignotubers. The list of species given above is of vascular plant species; the community also includes micro-organisms, fungi, cryptogamic plants and a diverse fauna, both vertebrate and invertebrate. These components of the community are poorly documented.

4. Carex Sedgeland comprises fens dominated by sedges, grasses and semi-aquatic herbs. The dominant species are Carex appressa, Stellaria angustifolia, Scirpus polystachyus, Carex gaudichaudiana, Carex sp. Bendemeer, Carex tereticaulis and Isachne globosa, either as single species or in combinations. Other common species include Geranium solanderi var. solanderi, Haloragis heterophylla, Lythrum salicaria, Epilobium billardierianum subsp. hydrophilum and Persicaria hydropiper (Hunter and Bell 2009).

5. Carex Sedgeland mainly occurs in drainage depressions in valley floors, frost hollows and undulating terrain between 440 and 1360 m in altitude. It occurs on a variety of lithologies including granite, basalt, metasediments, acid volcanics, sandstone and Aeolian sands (Hunter and Bell 2009). Carex Sedgeland occurs as a part of a mosaic of native vegetation communities including swamps, bogs, wetlands, grasslands and sclerophyll forests (Costin 1954; Benson and Ashby 2000; Hunter and Bell 2007; Bell et al. 2008). Carex Sedgeland is mostly found at higher altitude on tablelands but may extend onto the slopes. The size of these fens is usually small (< 0.1 ha) but may be



as large as 32.5 ha (Hunter and Bell 2009). Carex Sedgeland falls within the general formation of montane bogs and fens (Beadle 1981, Keith 2004).

6. Carex Sedgeland includes the fen communities; C1 Carex appressa–Stellaria angustifolia, C2 Carex appressa, C3 Scirpus polystachyus–Carex appressa, C4 Carex tereticaulis, C5 Carex gaudichaudiana–Isachne globosa and Carex sp. Bendemeer–Carex gaudichaudiana of Hunter and Bell (2009), but does not include those communities dominated only by Carex gaudichaudiana which are a part of the Carex gaudichaudiana Alliance of Costin (1954). This last community is a part of the Montane Peatlands and Swamps of the New England Tableland, NSW North Coast, Sydney Basin, South East Corner, South Eastern Highlands and Australian Alps bioregions which is currently listed as an Endangered Ecological Community under the Threatened Species Conservation Act 1995. Carex Sedgeland is also described as Sedge fens of areas of impeded drainage of the Nandewar and New England Tablelands Bioregion ID 582 by Benson (unpub data). Carex Sedgeland often grades into dense Pennisetum alopecuroides tussock grassland.

7. Carex Sedgeland of the New England Tableland, Nandewar, Brigalow Belt South and NSW North Coast Bioregions has been recorded from the local government areas of Armidale Dumaresq, Coonabarabran, Glen Innes Severn, Guyra, Gwydir, Inverell, Liverpool Plains, Tamworth, Uralla and Walcha and may occur elsewhere in these bioregions.

8. Carex Sedgeland occupies a total estimated extent of 5000 ha which is estimated to be a 50% decline in extent since European settlement. Less that 100 ha is currently represented in conservation reserves in NSW (Hunter and Bell 2009). Clearing and draining for agriculture has removed or degraded many fens. Other fens have dams built along their drainage channels with 20% of fens surveyed by Hunter and Bell (2009) having one or more dams present.

9. Carex Sedgeland is known to contain the Vulnerable species Lysimachia vulgaris var. davurica and several undescribed herbaceous species that may also be threatened. These species are Eryngium sp. Little Llangothlin NR (D.M. Bell 56), Leiocarpa sp. Uralla (D.M. Bell NE 54142), Carex sp. Bendemeer (D.M. Bell 296) and Carex sp. Tingha (D.M. Bell 339).

10. Threats to Carex Sedgeland include clearing, changes in groundwater flow, fertilizer application, trampling and grazing by domestic stock. These threats are escalating due to the intensification of agriculture in northern NSW. Climate change may exacerbate threats for example through effects on water flow and fire regimes. Fens are sensitive to small changes in groundwater flow (Weltzin et al. 2000: Van Diggelen et al. 2006). Intensive livestock grazing changes the species dominance of fens and facilitates the invasion of introduced species (Costin 1954). In combination with the addition of superphosphate, grazing also leads to an increase in exotic annuals, loss of native perennials and decreased abundance of native forbs (Hobbs and Yates 1999, Lunt et al. 2007). Other threats include the invasion of exotic perennial grass species including Eragrostis curvula (African Lovegrass), Nassella neesiana (Chilean Needlegrass) and Nassella trichotoma (Serrated Tussock) (Hunter and Bell 2009). Other herbaceous exotic species that also threaten this community include Holcus lanatus (Yorkshire Fog), Cirsium vulgare (Scotch Thistle), Rumex crispus (Curled dock), Trifolium repens (White Clover) and Rubus angocandicans (Blackberry) (Hunter and Bell 2009). ‘Alteration to the natural flow regimes of rivers and streams and their floodplains and wetlands’, ‘Anthropogenic Climate Change’, ‘Clearing of native vegetation’ and ‘Invasion of native plant communities by exotic perennial grasses’ are listed as Key Threatening Processes under the Threatened Species Conservation Act 1995.

11. Carex Sedgeland in the New England Tableland, Nandewar, Brigalow Belt South and NSW North Coast Bioregions is not eligible to be listed as a Critically Endangered Ecological Community.

12. Carex Sedgeland in the New England Tableland, Nandewar, Brigalow Belt South and NSW North Coast Bioregions is eligible to be listed as an Endangered Ecological Community as, in the opinion of the Scientific Committee, it is facing a very high risk of extinction in New South Wales in the near future, as determined in accordance with the following criteria as prescribed by the Threatened Species Conservation Regulation 2010:

Clause 19 Reduction in ecological function of the ecological communityThe ecological community has undergone, is observed, estimated, inferred or reasonably suspected to have undergone or is likely to undergo within a time span appropriate to the life cycle and habitat characteristics of its component species:

Final Determination

THE Scientific Committee, established by the Threatened Species Conservation Act has made a Final Determination to list the Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland in the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions as an ENDANGERED ECOLOGICAL COMMUNITY in Part 3 of Schedule 1 of the Act. Listing of Endangered Ecological Communities is provided for by Part 2 of the Act.

NOTE: The Scientific Committee placed a Preliminary Determination regarding this ecological community on public exhibition under the name Tablelands Frost Hollow Grassy Woodlands in the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions. The Committee considers that Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland in the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions is a more appropriate name for this ecological community.


1. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland in the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions (hereinafter called Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland) is the name given to the ecological community characterised by the species assemblage listed in paragraph 2. In NSW all sites are within the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions (sensu Thackway and Cresswell 1995).

2. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland is characterised by the following assemblage of species:

The list of species given above is of vascular plant species; the community also includes micro-organisms, fungi, cryptogamic plants and a diverse fauna, both vertebrate and invertebrate. These components of the community are poorly documented.

4. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland typically forms an open-forest, woodland or open woodland that transitions into grassland at low tree cover. The canopy is dominated by Eucalyptus pauciflora (Snow Gum), E. rubida (Candlebark), E. stellulata (Back Sallee) and E. viminalis (Ribbon



Gum), either as single species or in combinations. Other more localized Eucalyptus species may also occur within this community such as E. aggregata and E. parvula. A shrub layer may be present and sub-shrubs are often a component of the ground stratum; characteristic species include Hymenanthera dentata and Melichrus urceolatus. The ground layer is dominated by grasses and other herbaceous species including Themeda australis, Poa spp., Austrostipa spp., Austrodanthonia spp., Leptorhynchos squamatus, Chrysocephalum apiculatum and Asperula conferta. This community may also occur as secondary grassland where the dominant trees have been removed but the ground stratum remains.

5. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland mainly occurs on valley floors, margins of frost hollows, footslopes and undulating hills between approximately 600 and 1400 m in altitude. It occurs on a variety of substrates including granite, basalt, metasediments and Quaternary alluvium. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland occurs as a part of a mosaic of native vegetation communities including swamps, bogs, wetlands, grasslands and sclerophyll forests. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland falls within the structural formation of Grassy Woodlands and the vegetation classes of Subalpine Woodlands and Tableland Clay Grassy Woodlands (Keith 2004).

6. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland includes communities described as Frost Hollow Grassy Woodlands (Tozer et al. 2010) and Tablelands and Slopes Herb/Grassland/Woodland VG 153 (Gellie 2005). Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland is included in a number of previously identified map units and vegetation types including Map Units 44 and 45 (NSW NPWS 2003), Broad Vegetation Type (BVT) 25 (DEC 2006a and 2006b), Map Units 11 and 15 (DEC 2006c) and community 5 (Hunter 2002). Various high altitude woodlands of the Australian Alps, South Eastern Highlands and Sydney Basin Bioregions dominated by Eucalyptus pauciflora subsp. niphophila, E. pauciflora subsp. debeuzevillei and E. lacrimans are not covered by this determination. The Endangered Ecological Community Ribbon Gum, Mountain Gum, Snow Gum Grassy Forest/Woodland of the New England Tableland Bioregion has a similar structure to Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland but differs in its floristic composition. A number of Endangered Ecological Communities are known to inter-grade with the nominated community and are thus considered to be related. These include: White Box Yellow Box Blakely’s Red Gum Woodland (NSW TSC Act 1995 EEC) (Costin 1954; Keith 2004; Fallding 2002); Montane Peatlands and Swamps of the New England Tableland, NSW North Coast, Sydney Basin, South East Corner, South Eastern Highlands and Australian Alps Bioregions (NSW TSC Act 1995 EEC); and Natural Temperate Grassland of the Southern Tablelands of NSW and the Australian Capital Territory (Commonwealth Environment Protection and Biodiversity Conservation Act 1999 Threatened Ecological Community) (Costin 1954; Keith 2004; Fallding 2002).

7. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland has been recorded from the local government areas of Bathurst, Blayney, Bega Valley, Blue Mountains, Bombala, Cabonne, Cooma-Monaro, Eurobodalla, Goulburn-Mulwaree, Lithgow, Oberon, Orange, Palerang, Shoalhaven, Snowy River, Tumbarumba, Tumut, Upper Lachlan, Wingecarribee and Yass Valley local government areas (within the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions [sensu Thackway and Cresswell 1995]) and may occur elsewhere in these Bioregions (Tozer et al. 2010).

Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland occupies a total estimated extent of 14100 ha which is estimated to be a 72% decline in area since European settlement (Tozer et al. 2010). Clearing for agriculture has fragmented the community and in one region (Lake Bathurst) it has been estimated that no current patch exceeds 60 ha and that 70% of patches are smaller than 20 ha (Gellie 2005). Less than 4000 ha is currently represented in conservation reserves in NSW (Crooks in litt. 2009).

10. Threats to Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland include climate change, clearing, fragmentation, fertilizer application, tree dieback, trampling and grazing by domestic livestock, weed invasion and altered fire regimes. Many of these threats are escalating due to the intensification of agriculture, pine plantations and residential development in southern NSW. Intensive livestock grazing changes the dominance of native grasses and causes their replacement by introduced species (Costin 1954; Hancock 1972; Tremont and McIntyre 1994; McIntyre et al. 2002; Lunt et al. 2007) and, together with simplification of vegetation structure, consequently changes the fauna associated with the plant community (Maron and Lill 2005). In combination with the addition of superphosphate, grazing also leads to an increase in exotic annuals, loss of native tussock grasses and decreased abundance of native forbs (Hobbs and Yates 1999; McIntyre et al. 2002; Prober et al. 2002; Garden et al. 2003; Clarke 2003). Restoration of the ground stratum of temperate grassy communities requires intensive remediation (Prober et al. 2005). The community is threatened by the invasion of exotic perennial grass species including Eragrostis curvula (African Lovegrass), Nassella neesiana (Chilean Needlegrass) and Nassella trichotoma (Serrated Tussock). Other herbaceous exotic species that also threaten this community include Echium plantagineum (Patterson’s Curse) and Hypericum perforatum (St johns Wort). Woody exotics that threaten this community include Crataegus monogyna (Hawthorn), Pinus radiata wildlings (Radiata Pine) and Rubus introduced Rubus spp. (Blackberry) (Williams and Wardle 2005). The dominant feral herbivores are the European Rabbit (Oryctolagus cuniculus) and the Brown Hare (Lepus europaeus) resulting in changes to the structure and composition of the vegetation (Costin 1954). The presence of grazing, feral herbivores, pasture improvement and weeds results in tree death and limits the recruitment of understorey plants and tree species giving rise to the rural tree dieback phenomenon (Hobbs and Yates 1999). Altered fire regimes, and/or climate change, may also change the composition of these communities where the woody component is affected (Leigh and Holgate 1979; Knox and Clarke 2004, 2006; Lunt et al. 2010). Lack of fire may also be limiting the recruitment of herbaceous and woody species as fire is a seed dormancy-breaking cue for many grassy woodland species (Clarke et al. 2000; Hill and French 2003; Clarke and French 2005). ‘Anthropogenic climate change’, ‘Clearing of native vegetation’, ‘Competition and grazing by the feral European Rabbit Oryctolagus cuniculus (L.)’, ‘High frequency fire resulting in the disruption of life cycle processes in plants and animals and loss of vegetation structure and composition’ and ‘Invasion of native plant communities by exotic perennial grasses’ are listed as Key Threatening Processes under the Threatened Species Conservation Act 1995.

11. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland in the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions is not eligible to be listed as a Critically Endangered Ecological Community.



12. Tablelands Snow Gum, Black Sallee, Candlebark and Ribbon Gum Grassy Woodland in the South Eastern Highlands, Sydney Basin, South East Corner and NSW South Western Slopes Bioregions is eligible to be listed as an Endangered Ecological Community as, in the opinion of the Scientific Committee, it is facing a very high risk of extinction in New South Wales in the near future, as determined in accordance with the following criteria as prescribed by the Threatened Species Conservation Regulation 2010:

THE Scientific Committee, established by the Threatened Species Conservation Act has made a Final Determination to list the Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion, as a CRITICALLY ENDANGERED ECOLOGICAL COMMUNITY in Part 2 of Schedule 1A of the Act and as a consequence, to omit reference to Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion from Part 3 of Schedule 1 (Endangered Ecological Communities) of the Act. Listing of Critically Endangered Ecological Communities is provided for by Part 2 of the Act.


1. Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion is the name given to the ecological community characterised by the species assemblage listed in paragraph 2. In NSW all sites are within the Sydney Basin Bioregion (sensu Thackway & Cresswell 1995).

2. Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion is characterised by the following assemblage of species:

3. The total species list of the community is considerably larger than that given above, with many species present in only one or two sites or in low abundance. The species composition of a site will be influenced by the size of the site, recent rainfall or drought condition and by its disturbance (including fire and grazing) history. The number of species and the above ground relative abundance of species will change with time since fire and may also change in response to changes in fire regime (including changes in fire frequency). At any one time, above ground individuals of some species may be absent, but the species may be represented below ground in the soil seed banks or as dormant structures such as bulbs, corms, rhizomes, rootstocks or lignotubers. The list of species given above is of vascular plant species; the community also includes micro-organisms, fungi, cryptogamic plants and a diverse fauna, both vertebrate and invertebrate. These components of the community are poorly documented.

4. Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion is naturally restricted to volcanic diatremes and associated higher nutrient clay soils and is currently known to occur in the Sun Valley area, a semi-rural area of the lower Blue Mountains. Sun Valley Cabbage Gum Forest was originally a tall open forest dominated by Eucalyptus



amplifolia subsp. amplifolia (Cabbage Gum) in association with Eucalyptus eugenioides (Thin-leaved Stringybark). Extensive clearing for timber, pastoralism and urban development has depleted and often completely removed, the overstorey which now exists predominantly as regrowth less than approximately 30 years old with relatively few older trees. The native grassy understorey includes Acacia parramattensis, Imperata cylindrica, Lomandra longifolia and Pteridium esculentum, although most remnant understoreys have been highly modified by grazing and disturbance. Disturbed or modified remnants are still considered to form part of the community including remnants where the vegetation, either understorey, overstorey or both, would, under appropriate management, respond to assisted natural regeneration, such as where the natural soil and associated seed bank are still at least partially intact. Other diatremes in the area support related communities but these are dominated by different canopy species, do not support Eucalyptus amplifolia and have less-grassy understoreys with more developed shrub layers (Benson 1992).

5. Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion includes part of Glen Forest (Map unit 6c) of Benson (1992). It has been mapped as a variant of Glen Forest (Map unit 6c) by Douglas (2001); as Eucalyptus amplifolia Tall Open-forest (sub-community 97) and map-unit 21 in derivative mapping and interpretation by BMCC (2002); and as an outlier of Burragorang River Flat Forest (FOW p31) by Tozer et al. (2006). These maps are only indicative of the location of Sun Valley Cabbage Gum Forest and the community is not restricted to the mapped extent. Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion belongs to the Northern Hinterland Wet Sclerophyll Forests vegetation class of Keith (2004).

6. Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion has been recorded from the Blue Mountains local government area within the Sydney Basin Bioregion (sensu Thackway and Creswell 1995) and may occur elsewhere in the Bioregion. The community is not represented in any NSW National Parks and Wildlife Service estate or other conservation reserves.

7. The pre-European distribution of Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion, previously estimated at approximately 50 ha, has most recently and reliably been estimated at c. 15-20 ha, approximately 75% of which has been cleared. This equates to a large reduction in geographic distribution. Less than 5 ha of the community are extant (Douglas 2001, BMCC 2002) and this is equivalent to an extent of occurrence and an area of occupancy of 4 km2 (based on 2 x 2 km grid cells, the scale of assessment recommended by IUCN 2010). A remnant of the extant community occurs on Crown land in a council-managed reserve which is largely cleared, has a high edge to area ratio and has competing recreational uses. Other remnants occur on private land. A small remnant of the community may be present nearby in the Warrimoo area (Smith & Smith in litt. 2010). The geographic distribution is inferred to be very highly restricted.

8. Threats to Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion include clearing of native vegetation, severe fragmentation, trampling and grazing by horses and other livestock, herbicide and fertilizer application, weed invasion, feral animals, altered fire regimes (particularly high frequency fire associated with bushfire mitigation and hazard reduction), climate change and demographic and environmental stochasticity due to the restricted distribution of the community and extremely small size of remnant patches in degraded condition with high edge to area ratios. Extensive logging, grazing and clearing for housing and infrastructure has heavily depleted Eucalyptus amplifolia subsp. amplifolia, the dominant canopy species, throughout most of the estimated pre-European distribution of the community. The majority of the community now exists as young regrowth with no known old growth or hollow-bearing individuals and this is likely to have impacted significantly on hollow-dependent fauna. Removal of the understorey has significantly altered the community structure and resulted in the invasion of weed species which, together with grazing and fertilizer application, are limiting the recruitment of understorey plants and tree species. The vast majority of remnants with an intact overstorey no longer contain a significant native understorey and recruitment of overstorey species is negligible due to widespread livestock grazing, mowing, slashing, gardening and maintenance of cleared or modified areas on private land. Altered fire regimes and high frequency fire may be threatening remnants on private land proximal to housing. Removal of dead trees and coarse woody debris on private land for firewood and/or bushfire hazard reduction reduces the community’s habitat complexity and may exclude some fauna species. Feral and domestic animals may significantly degrade the ecological function of the community through the spread of weeds, herbivory and soil disturbance and the predation and depletion/local extinction of native fauna. Anthropogenic climate change has the potential to threaten the community through more frequent, more intense and longer duration droughts, altered fire regimes, more frequent and/or more severe storms leading to increased soil erosion and physical damage to vegetation. ‘Clearing of native vegetation’, ‘Invasion of native plant communities by exotic perennial grasses’, ‘Invasion and establishment of exotic vines and scramblers’, ‘High frequency fire resulting in the disruption of life cycle processes in plants and animals and loss of vegetation structure and composition’, ‘Loss of hollow bearing trees’, ‘Removal of dead wood and dead trees’ and ‘Anthropogenic climate change’ are listed as Key Threatening Processes under the Threatened Species Conservation Act 1995. Collectively, these threats have led to changes in community structure and species composition, disruption of ecological processes, habitat degradation and fragmentation and invasion and establishment of exotic species, indicative of a very large reduction in ecological function of the community.

9. Weed invasion is a major threat to the community, particularly at its interface with housing, roads and drainage and on private land. Exotic species that threaten the community include:

Fauna species of conservation significance which may be associated with Sun Valley Cabbage Gum Forest include the Squirrel Glider, Petaurus norfolcensis (Smith and Smith 1995) and the Spotted Tailed Quoll, Dasyurus maculatus (Sun Valley Bushcare Group 2010), both of which are listed as Vulnerable species on Schedule 2 of the Threatened Species and Conservation Act 1995

11. Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion is currently listed as an Endangered Ecological Community on Part 3 of Schedule 1 of the Act.

Sun Valley Cabbage Gum Forest in the Sydney Basin Bioregion is eligible to be listed as a Critically Endangered Ecological Community as, in the opinion of the Scientific Committee, it is facing an extremely high risk of extinction in New South Wales in the immediate future, as determined in accordance with the following criteria as prescribed by the Threatened Species Conservation Regulation 2010.

(a) very highly restricted,and the nature of its distribution makes it likely that the action of a threatening process could cause it to decline or degrade in extent or ecological function over a time span appropriate to the life cycle and habitat characteristics of the ecological community’s component species.

ALTERATION OF PURPOSE/CONDITIONS OF A WESTERN LANDS LEASE

IT is hereby notifi ed that in pursuance of the provisions of section 18J, Western Lands Act 1901, the purpose and conditions of the undermentioned Western Lands Leases have been altered as shown.

The purpose of Western Lands Lease 1313 being the land contained within Folio Identifi er 4788/767999 has been altered from “Pastoral Purposes” to “Grazing & Cultivation (Irrigated)” effective from 29 March, 2011.

As a consequence of the alteration of purpose and conditions rent will be assessed annually in line with the Western Lands Act 1901 and Regulations. The conditions currently annexed to the leases have been revoked and the following conditions have been annexed thereto:(1) In the conditions annexed to the lease, the expression

“the Minister” means the Minister administering the Western Lands Act 1901, and any power, authority, duty or function conferred or imposed upon the Minister by or under those conditions may be exercised or

performed either by the Minister or by such offi cers of the Land and Property Management Authority as the Minister may from time to time approve.

(2) In these conditions and reservations the expression “the Commissioner” means the Commissioner charged with the administration of the Western Lands Act 1901 (“the Act”) in accordance with section 4(2) of the Act.

(3) (a) For the purposes of this clause the term Lessor shall include Her Majesty the Queen Her Heirs and Successors the Minister and the agents servants employees and contractors of the Lessor Her Majesty Her Majesty’s Heirs and Successors and the Minister.

(b) The lessee covenants with the Lessor to indemnify and keep indemnifi ed the Lessor from and against all claims for injury loss or damage suffered by any person or body using or being in or upon the Premises or any adjoining land or premises of the Lessor arising out of the Holder’s use of the Premises and against all liabilities for costs charges and expenses incurred by the Lessor in respect of the claim of any such person or body except to the extent that any such claims and demands arise wholly from any negligence or wilful act or omission on the part of the Lessor.

(c) The indemnity contained in this clause applies notwithstanding that this Lease authorised or required the lessee to undertake or perform the activity giving rise to any claim for injury loss or damage.



(d) The lessee expressly agrees that the obligations of the Holder under this clause shall continue after the expiration or sooner determination of this Lease in respect of any act deed matter or thing occurring before such expiration or determination.

(4) The rent of the lease shall be assessed in accordance with Part 6 of the Western Lands Act 1901.

(5) The rent shall be due and payable annually in advance on 1 July in each year.

(6) (a) “GST” means any tax on goods and/or services, including any value-added tax, broad-based consumption tax or other similar tax introduced in Australia.“GST law” includes any Act, order, ruling or regulation, which imposes or otherwise deals with the administration or imposition of a GST in Australia.

(b) Notwithstanding any other provision of this Agreement:(i) If a GST applies to any supply made by

either party under or in connection with this Agreement, the consideration provided or to be provided for that supply will be increased by an amount equal to the GST liability properly incurred by the party making the supply.

(ii) If the imposition of a GST or any subsequent change in the GST law is accompanied by or undertaken in connection with the abolition of or reduction in any existing taxes, duties or statutory charges (in this clause “taxes”), the consideration payable by the recipient of the supply made under this Agreement will be reduced by the actual costs of the party making the supply that are reduced directly or indirectly as a consequence of the abolition of or reduction in taxes.

(7) The lessee will advise the lessor of the name, address and telephone number of the lessee’s company secretary, that person being a person nominated as a representative of the company in respect of any dealings to be had with the company. The lessee agrees to advise the lessor of any changes in these details.

(8) Any change in shareholding of the lessee’s company which alters its effective control of the lease from that previously known to the Commissioner shall be deemed an assignment by the lessee.

(9) Where any notice or other communication is required to be served or given or which may be convenient to be served or given or in connection with this lease it shall be suffi ciently executed if it is signed by the company secretary.

(10) A copy of the company’s annual fi nancial balance sheet or other fi nancial statement which gives a true and fair view of the company’s state of affairs as at the end of each fi nancial year is to be submitted to the Minister upon request.

(11) The lessee must pay all rates and taxes assessed on or in respect of the land leased during the currency of the lease.

(12) The lessee must hold and use the land leased bona fi de for the lessee’s own exclusive benefi t and must not transfer, convey or assign the land or any portion thereof without having fi rst obtained the written consent of the Minister.

(13) The lessee must not enter into a sublease of the land leased unless the sublease specifi es the purpose for which the land may be used under the sublease, and it is a purpose which is consistent with the purpose for which the land may be used under this lease.

(14) If the lessee enters into a sublease of the land leased, the lessee must notify the Commissioner of the granting of the sublease within 28 days after it is granted.

(15) The land leased must be used only for the purpose of Grazing and Cultivation (Irrigated).

(16) The lessee must maintain and keep in reasonable repair all improvements on the land leased during the currency of the lease and shall permit the Minister or the Commissioner or any person authorised by the Minister or the Commissioner at all times to enter upon and examine the whole or any part of the land leased and the buildings or other improvements thereon.

(17) All minerals within the meaning of the Mining Act 1992, and all other metals, gemstones and semiprecious stones, which may be in, under or upon the land leased are reserved to the Crown and the lessee shall permit any person duly authorised in that behalf to enter upon the land leased and search, work, win and remove all or any minerals, metals, gemstones and semiprecious stones in, under or upon the land leased.

(18) Mining operations may be carried on, upon and in the lands below the land leased and upon and in the lands adjoining the land leased and the lands below those lands and metals and minerals may be removed therefrom and the Crown and any lessee or lessees under any Mining Act or Acts shall not be subject to any proceedings by way of injunction or otherwise in respect of or be liable for any damage occasioned by the letting down, subsidence or lateral movement of the land leased or any part thereof or otherwise by reason of the following acts and matters, that is to say, by reason of the Crown or any person on behalf of the Crown or any lessee or lessees, having worked now or hereafter working any mines or having carried on or now or hereafter carrying on mining operations or having searched for, worked, won or removed or now or hereafter searching for, working, winning or removing any metals or minerals under, in or from the lands lying beneath the land leased or any part thereof, or on, in, under or from any other lands situated laterally to the land leased or any part thereof or the lands lying beneath those lands, and whether on or below the surface of those other lands and by reason of those acts and matters or in the course thereof the Crown reserves the liberty and authority for the Crown, any person on behalf of the Crown and any lessee or lessees from time to time to let down without payment of any compensation any part of the land leased or of the surface thereof.

(19) The lessee must comply with the provisions of the Local Government Act 1993, and of the ordinances made thereunder.



(20) The lessee must comply with the provisions of the Water Management Act 2000 and any regulations made in pursuance of that Act.

(21) The lessee must not erect or permit any person to erect any buildings or extend any existing buildings on the land leased except to the satisfaction of the Commissioner.

(22) The lessee must ensure that the land leased is kept in a neat and tidy condition to the satisfaction of the Commissioner and not permit refuse to accumulate on the land.

(23) Upon termination or forfeiture of the lease the Commissioner may direct that the former lessee remove any structure or material from the land at his own cost and without compensation. Where such a direction has been given the former lessee must leave the land in a clean and tidy condition free from rubbish and debris.

(24) The lessee must, within 1 year from the date of commencement of the lease or such further period as the Commissioner may allow, enclose the land leased, either separately or conjointly with other lands held in the same interest, with a suitable fence to the satisfaction of the Commissioner.

(25) The lessee must not obstruct or interfere with any reserves, roads or tracks on the land leased, or the lawful use thereof by any person.

(26) The lessee must erect gates on roads within the land leased when and where directed by the Commissioner for public use and must maintain those gates together with approaches thereto in good order to the satisfaction of the Commissioner.

(27) The right is reserved to the public of free access to, and passage along, the bank of any watercourse adjoining the land leased and the lessee must not obstruct access or passage by any member of the public to or along the bank.

(28) Any part of a reserve for travelling stock, camping or water supply within the land leased must, during the whole currency of the lease, be open to the use of bona fide travellers, travelling stock, teamsters and carriers without interference or annoyance by the lessee and the lessee must post in a conspicuous place on the reserve a notice board indicating for public information the purpose of such reserve and, in fencing the land leased, the lessee must provide gates and other facilities for the entrance and exit of travelling stock, teamsters and others. The notice board, gates and facilities must be erected and maintained to the satisfaction of the Commissioner. The lessee must not overstock, wholly or in part, the areas leased within the reserve, the decision as to overstocking resting with the Commissioner.

(29) The Crown shall not be responsible to the lessee or the lessee’s successors in title for provision of access to the land leased.

(30) The lessee must comply with the provisions of the Native Vegetation Act 2003 and any regulations made in pursuance of that Act.

(31) The lessee must comply with requirements of section 18DA of the Western Lands Act 1901 which provides that except in circumstances referred to in subsection

(3) of that section, cultivation of the land leased or occupied may not be carried out unless the written consent of the Authority has fi rst been obtained and any condition to which the consent is subject under sub section (6) is complied with.

(32) Notwithstanding any other condition annexed to the lease, the lessee must, in removing timber for the purpose of building, fencing or fi rewood, comply with the routine agricultural management activities listed in the Native Vegetation Act 2003.

(33) The lessee must not interfere with the timber on any of the land leased which is within a State forest, timber reserve or fl ora reserve unless authorisation has been obtained under the provisions of the Forestry Act 1916 and must not prevent any person or persons duly authorised in that behalf from taking timber on the land leased. The lessee shall not have any property right in the timber on the land leased and must not ringbark, kill, destroy or permit the killing or destruction of any timber unless authorised under the Forestry Act 1916 or unless approval has been issued in accordance with the Native Vegetation Act 2003, but the lessee may take such timber as the lessee may reasonably require for use on the land leased, or on any contiguous land held in the same interest, for building, fencing or fi rewood.

(34) The lessee must undertake any fuel management and/or provision of fi re trail access in accordance with fi re mitigation measures to the satisfaction of the NSW Rural Fire Service.

(35) The lessee must, as the Commissioner may from time to time direct, foster and cultivate on the land leased such edible shrubs and plants as the Commissioner may consider can be advantageously and successfully cultivated.

(36) Whenever so directed by the Commissioner, the lessee must, on such part or parts of the land leased as shall be specifi ed in the direction, carry out agricultural practices, or refrain from agricultural practices, of such types and for such periods as the Commissioner may in the direction specify.

(37) The lessee must not overstock, or permit or allow to be overstocked, the land leased and the decision of the Commissioner as to what constitutes overstocking shall be fi nal and the lessee must comply with any directions of the Commissioner to prevent or discontinue overstocking.

(38) The lessee must, if the Commissioner so directs, prevent the use by stock of any part of the land leased for such periods as the Commissioner considers necessary to permit of the natural reseeding and regeneration of vegetation and, for that purpose, the lessee must erect within the time appointed by the Commissioner such fencing as the Commissioner may consider necessary.

(39) The lessee must furnish such returns and statements as the Commissioner may from time to time require on any matter connected with the land leased or any other land (whether within or outside the Western Division) in which the lessee has an interest.

(40) The lessee must, within such time as may be specifi ed by the Commissioner take such steps and measures as the Commissioner shall direct to destroy vermin and such animals and weeds as may, under any Act, from



time to time be declared (by declaration covering the land leased) noxious in the Gazette and must keep the land free of such vermin and noxious animals and weeds during the currency of the lease to the satisfaction of the Commissioner.

(41) The lessee must not remove or permit any person to remove gravel, stone, clay, shells or other material for the purpose of sale from the land leased unless the lessee or the person is the holder of a quarry license under regulations made under the Crown Lands Act 1989 or, in respect of land in a State forest, unless the lessee or the person is the holder of a forest materials licence under the Forestry Act 1916, and has obtained the special authority of the Minister to operate on the land, but the lessee may, with the approval of the Commissioner, take from the land such gravel, stone, clay, shells or other material for building and other purposes upon the land as may be required by the lessee.

(42) The lessee shall not clear any native vegetation or remove any timber within the irrigation area unless written approval has been granted by the appropriate Authority.

(43) The lessee shall only cultivate an area of 121 hectares (WLL 1313) and 234 Hectares (WLL 1402) as indicated by the cross hatched area on the diagram below.

(44) Cultivation is permitted over the whole of the area shown cross hatched on the diagram below unless the Commissioner has required that specifi c areas remain uncultivated.

(45) The lessee must ensure that cultivation and associated activities do not interfere with any road formation within the allowable area.

(46) The lessee shall ensure no cultivation or ancillary works associated with any cultivation is undertaken within 500 metres of the Darling River, except with the specifi c approval of the Commissioner. These areas are not to be disturbed by the use of any implements or used for the purposes of any silo, temporary grain storage, machinery shed or other installations or works of any kind.

(47) The lessee shall ensure no cultivation or ancillary works associated with any cultivation is undertaken within at least 75 metres of the Bourke-Weilmoringle Road.

(48) The lessee shall ensure incised drainage lines, other than man- made structures, which carry water after storms are left uncultivated in the channels and for a distance of at least 20 metres on either side of the banks of the channels except when the Commissioner specifi es otherwise.

(49) The lessee must consider the requirements of the National Parks and Wildlife Act 1974 with regard to Aboriginal sites and relics, which are extremely vulnerable to many kinds of agricultural development. Under Section 90 it is an offence to damage or destroy relics without prior consent of the Director-General of the Department of Environment, Climate Change and Water. If any Aboriginal archaeological relics or sites are found in the cultivation areas, the cultivation must cease until the lessee has notifi ed Department of Environment, Climate Change and Water of the

(50) The lessee must establish windbreaks at his/her own expense as may be ordered by the Commissioner to provide adequate protection of the soil.

(51) The lessee must ensure that stubble and other crop residue is retained on the soil surface and shall not be burnt, except with the written approval of the Western Lands Commissioner or his delegate. Where such approval is granted, stubble burning must be carried out with the approval as per requirements of the NSW Rural Fire Services.

(52) The lessee shall undertake any appropriate measures, at his/her own expense, ordered by the Commissioner to rehabilitate any degraded cultivated areas.

(53) Disposal of tail water into creeks and rivers is controlled by the Department of Environment, Climate Change and Water under the Protection of the Environment Operations Act 1997. Before disposing of any tail water or water that may be contaminated with fertiliser, herbicide or pesticide the Department Of Environment, Climate Change and Water must be contacted.

(54) The lessee must ensure that no tail water or drainage water run-off will escape or discharge into or onto adjoining lands by any means including surface or sub-surface drains or pipes.

(55) The cultivation area partly covers Travelling Stock Reserve 27301 and suitable arrangements must be made with the relevant Livestock Health and Pest Authority prior to commencement of any development. If suitable arrangements cannot be made with the Livestock, Pest and Health Authority the matter will be determined by the Commissioner.

(56) The lessee must ensure that soils with a surface texture of loamy sand or coarser are left uncultivated unless specifi cally approved by the commissioner.

(57) The lessee shall ensure land within 60 metres of any texture contrast or duplex soil area remains uncultivated except in accordance with a plan approved by the Commissioner. Texture contrast (or duplex) soils are soil types which have a sandy to loamy topsoil abruptly overlying a clay subsoil and are prone to scalding (producing claypans and hummocks).

(58) The lessee shall ensure areas with a slope greater than 2% remain uncultivated until any soil conservation measures documented in a plan approved by the Commissioner have been implemented at the lessee’ expense.

(59) The lessee must ensure that Cultivation and cropping do not alter the natural fl ood regime or obstruct the reasonable passage of fl oodwaters. Crops are not to be protected by levees.

(60) The lessee shall ensure a monitoring regime of piezometers is established, in consultation with a suitably qualifi ed engineer, to detect water logging of soils, rising salt levels in soil and/or rising groundwater levels, adjacent to the water storage.

MAGISTRATES EARLY REFERRAL INTO TREATMENT (MERIT) PROGRAMME

NATURE AND PURPOSE 1. The MERIT programme is a pre plea diversion programme

for defendants with drug problems conducted in the Local Court of NSW. At selected locations the MERIT programme includes Alcohol MERIT for persons charged with offences before the Local Court who have alcohol problems.

2. The programme provides for the early referral for assessment of arrested persons who are eligible for bail (or do not require bail consideration), who are motivated and volunteer to engage in treatment and rehabilitation for their drug use problem.

3. The programme brings together the health, justice and law enforcement systems with the focus on the reduction of criminally offending behaviour associated with drug use.

4. Successful engagement in the MERIT programme can be taken into account in sentence proceedings.

5. The MERIT programme is available at over 50 Local Court locations across New South Wales. Additional locations may be added from time to time. Those wishing to make a referral to the programme should contact their nearest Local Court registry for information as to whether the MERIT programme is available at a particular location.

REFERRALS TO THE MERIT PROGRAMME 6. Referrals to the programme may come from any of the

following sources: (i) on apprehension by the Police who may refer a

defendant for assessment into the programme (ii) at or prior to the commencement of proceedings:

• the defendant; • the defendant’s lawyer; • the presiding Magistrate; or• any other person (such as family/friend, health

professional, probation and parole offi cer) may make a referral for assessment into the programme.



PRELIMINARY CONSIDERATIONS FOR ENTRY INTO MERIT PROGRAMME: 7. The MERIT programme is designed as a pre-plea scheme

to encourage referral for assessment at an early stage of the Court process and entry into the programme is not dependant on the person’s guilt or innocence.

8. Notwithstanding (7) above a plea may be entered at any time from the person’s fi rst appearance before the Court until the conclusion of the programme.

CRITERIA FOR ELIGIBILITY TO PARTICIPATE IN MERIT PROGRAMME:9. To be eligible to participate in the MERIT programme the

defendant must meet the following criteria: (i) they must be an adult. (ii) the offences should not involve strictly indictable

offences, sexual offences or offences involving signifi cant violence and the defendant should not have like offences pending before a Court.

(iii) the defendant must be suspected of using drugs or have a history of drug use

(iv) the defendant must be eligible for bail and suitable for release on bail or not require bail consideration

(v) the defendant must voluntarily agree to participate

GENERAL PROCEDURE:10. If considered eligible to participate, the defendant should

be referred to the MERIT assessment team attached to the Court for the relevant assessment to be undertaken to ensure that the defendant is suitable for the programme. The Court proceedings should be adjourned for a short period to allow that assessment to occur. 10.1 As part of the assessment, the MERIT case worker

will assess the nature of the defendant’s drug use and other associated problems.

10.2 The case worker is to assess the defendant against the criteria for suitability for entry to the programme and then formulate a proposed treatment plan for the defendant to undertake and prepare a report for the Court.

10.3 If the defendant is considered suitable for the MERIT programme, the Magistrate may approve placement of the defendant onto the programme.

10.4 If the defendant is considered not suitable for the programme, the defendant will be asked to enter a plea and the matter will proceed in the usual way.

11. While awaiting the assessment report from the MERIT case worker, bail may be granted with specifi c conditions such as reporting and particular residential conditions applying. 11.1 When placed on the programme, bail should

be granted in accordance with the Bail Act, if appropriate, and consideration may be given to imposing a relevant bail condition such as requiring compliance with all directions of the MERIT Team. Once on the program the defendant is aware that the MERIT team will report any non compliance with program conditions to the court as soon as practicable.

12. Once the Magistrate formally approves the placement of the defendant on the MERIT programme, the treatment plan as devised by the MERIT case worker, if it has not already commenced, will be commenced.

12.1 The determination of an appropriate treatment module is a matter solely within the discretion of the MERIT case worker. Their trained role is to identify the needs, risks, long and short term goals of the participant and then to oversee the provision of available treatment services in the best interests of that participant. Examples of the drug treatment programmes available include:• medically supervised and home based

detoxifi cation;

• methadone and other pharmacotherapies such as naltrexone and buprenophine;

• residential rehabilitation; • individual and group counselling and psychiatric

treatment.

12.2 The MERIT programme is generally planned as a 12 week intensive programme. It may be extended in special circumstances with the agreement of the Magistrate, the MERIT case worker and the defendant.

12.3 During the treatment phase the Court effectively case manages the process. Once accepted into the MERIT Programme, the defendant is required to return to Court at such intervals as determined by the Magistrate usually on the recommendation of the MERIT Team. At each adjournment, an update report is provided and the defendant required to attend unless excused by the Court with the concurrence of the MERIT Team. At the conclusion of the programme a fi nal report is provided by the MERIT team.

13. Should the defendant fail the programme despite suffi cient opportunities to comply with the directions of the MERIT Team, the MERIT Team must, as soon as possible, notify the Court. The defendant’s continuation on the program is a matter for Magisterial discretion. If the defendant is removed from the program by the Magistrate, or withdraws voluntarily at any time, the matter should be relisted as soon as possible for normal judicial management. 13.1 While minor issues of non-compliance with the

agreed treatment plan need not necessarily be actioned, reference to such conduct should appear in the interim or fi nal reports.

14. At the conclusion of the programme, the fi nal report will set out the achievements or otherwise of the participant under the programme. At that time, the defendant will be asked (if it has not already happened) to enter a plea. The case will then proceed through the normal justice process.14.1 On sentence, the successful completion of the

MERIT programme is a matter of some weight to be taken into account in the defendant’s favour. At the same time, as the MERIT programme is a voluntary opt in programme, its unsuccessful completion should not, on sentence, attract any additional penalty.

14.2 The fi nal sentencing outcome should be formally communicated by the Court to the MERIT Team for their recording purposes.
