RECOMMENDATIONStaff recommends approval of the Motions authorizing an amendment to the ProfessionalServices Agreement with AMEC Foster Wheeler Environment & Infrastructure, Inc. for additionalgeotechnical/soils engineering and materials testing/report review services for the GlendaleCentral Library Renovation Project, in the amount of $125,298.

BACKGROUND/ANALYSISThe Glendale Central Library Renovation project will improve the facility’s functionality, addresschanges in how people approach and access the library, provide building improvements such asupgrades to the roofing, electrical and communication systems, heating, ventilation and airconditioning systems; fulfill ADA compliance; improve space utilization; and provide seismicretrofits. The overall project will enhance the structure’s compatibility with Library functions tobetter accommodate collections and services, and improve access to the facility. The renovationwill also allow for new models of service that include a single service point, a room dedicated toMan’s Inhumanity to Man, and a Maker Space. Finally, relocating the cooling/heating plant setsthe stage for a future east-west Paseo south of the Library that will continue the passagewayfrom Brand Boulevard all the way through Central Park.

On May 19, 2015, the City Council and the Successor Agency awarded the constructioncontract to Kemp Bros. Construction, Inc. of California. The Contractor mobilized on Jury 6,2015, starting with the delivery of the construction trailer to site, setting up temporary power,and construction fencing. A major portion of the renovation scope of work includes structuralimprovements, such as concrete shear walls, fiber wrap of concrete beams, and new slab ongrade and exposed architectural concrete walls. During this phase, geotechnical and specialinspections, foundation observations, and materials inspection, testing and reporting servicesare required. A consulting firm must be contracted by the project owner, not the contractor, toensure no conflict of interest exists during performance of the required work noted above.

These consulting services were anticipated in the project planning and the cost was included inthe project budget.

On December 17, 2013, the City Council awarded consultant contracts to five geotechnicalconsulting firms through an extensive competitive selection process that was conducted by thePublic Works Department, Engineering Division.

Due to the timing constraints imposed on the Central Library Renovation project, staff issued aRequest for Proposals to the three of the most qualified and experienced consultants. Sincethey were already deemed qualified to execute the scope of work and could meet the City’s andthe Agency’s insurance requirements, RFPs were sent to the following firms:

AMEC Foster Wheeler (AMEC) demonstrated thorough understanding of the nature of thisproject, its aggressive and demanding project schedule, and the need to maintain the Library’sprogramming operations at various phases during construction.

On July 21, 2015 the City Council awarded the Professional Services Agreement to AMECFoster Wheeler Environment & Infrastructure. Since the beginning of the Central LibraryRenovation Project, AMEC Foster Wheeler Environment & Infrastructure has been providingGeotechnical and materials inspection and testing services during construction activities. The

initial proposal provided an estimated fee for geotechnical and materials inspection and testingservices for the subject project for a total of $153,909. AMEC has been performing theprescribed services in accordance with the terms of the Professional Services Agreement on anas-requested time and materials basis. The majority of the fee has been expended with aremaining balance of $28,658. Due to the following reasons, additional services are needed tocomplete the geotechnical and materials inspection and testing services for this project:

1. Unforeseen existing conditions which required additional concrete, rebar, andwelding inspections,

2. Batch plant inspections which were not included in the original scope of work,3. Waterproofing and vapor barrier installation. This is a specialized inspection that is

typically performed by a specialty consultant that wasn’t included in the originalscope of work,

4. Structural steel shop fabrication was excluded from the original scope of work. Theshop inspection has been performed on an as-requested basis,

5. In an effort to expedite the project schedule and maintain the project progressactivities, multiple inspectors were used at different areas of the site to provideadequate inspection of the work,

6. Concrete placement was anticipated to be in larger volumes; instead of a number ofsmall batches of concrete placement due to contractor’s construction schedule whichwas not available during the original proposal process. AMEC had to makeassumptions based on the information available at the time of the proposal.

Based on the current construction schedule, an additional fee of $153,956 is needed tocomplete the project. With the current existing balance on the Professional ServicesAgreement, this amounts to an additional $125,298 worth of inspection services.

Staff recommends that the City Council and the Agency authorize the City Manager to approvean amendment to the Professional Services Agreement with AMEC Foster WheelerEnvironment & Infrastructure, lnc.to complete the necessary services for the Central LibraryRenovation project.

FISCAL IMPACTFunding for the additional amount of $125,298 for the Geotechnical/Soils Engineering andMaterials Testing/Report Review services project is available in the Library Mitigation Fee Fund51150-407-681-51318

Environmental ReviewThis project is Categorically Exempt under the provisions of the California Environmental QualityAct (CEQA) as a Class 1 Exemption pursuant to the California Code of Regulations, Title 14,Section 15301.

Proiect ScheduleThe Construction work begun in July 2015 and it is anticipated to be completed by January2017.

ALTERNATIVES

Alternative 1: The City Council and the Agency may approve the Motion authorizing anamendment to the Professional Services Agreement with AMEC FosterWheeler Environment & Infrastructure, Inc. for Geotechnical/Soils Engineeringand Materials Testing/Report Review Services, in the amount of $125,298.

The City Council and the Agency may reject the Motion authorizing anamendment to the Professional Services Agreement with AMEC FosterWheeler Environment & Infrastructure, Inc. for Geotechnical/Soils Engineeringand Materials Testing/Report Review Services, in the amount of $125,298. Thisalternative will delay the project until another consultant can be selected,approved, and entered into contract.

Alternative 3: The City Council and the Agency may consider any other alternative notproposed by staff.
