    Gas safety briefing:

    The aim of the campaign is to increase the awareness of local business operators with respectto the dangers of gas appliances used by catering establishments

    In the first quarter of 2009 the Health and Safety Team investigated two serious incidentsinvolving Tandoori oven explosions. In both investigations it was found that cleaning andmaintenance were found to be considerable causal factors. The investigations revealedshortcomings in restaurant owners knowledge with regard to the legal responsibilities tomaintain ovens and also with the level of maintenance offered by the gas fitters.

    These two incidents have not been in isolation; in fact experts at the Health and SafetyLaboratory have been concerned for some time and have commissioned research into bothTandoori and duck ovens.

    The Inspections

    The inspections are to run between the months of September to November 2010. Howeverofficers may wish to carry out inspections prior to this.

    As this briefing session is not intended to make anyone an expert in gas safety there is noexpectation that officers carry out enforcement action where they are unsure. You are advised,therefore to contact the Health and Safety Team for further advice if you are unsure about anyparticular appliance, etc.

    An inspection form is contained within this pack and it is expected that officers carrying out

    inspections during the campaign complete the form and return them to James Rudman, HST.

    Draft notices are attached for officers to use as deemed necessary. They are included foradvice only and can be altered to suit the circumstances as you see fit. Also, a guidance sheetis attached, showing photographs of common issues. For further advice contact James Rudmanon 0121 3039916, or [email protected]

    Flame Failure Devices(FFDs)

    A flame failure device is a control that detects the presence of a flame and in the absence of aflame, prevents the uncontrolled release of gas to the burner. (source: Technical Buletin 044, GasSafe Register, June 2010)

    Guidance information

    Further information on accidents

    Accident 1:On 13th November 2008 an employee was working at Chandni Chowk Restaurant and Sweets. At thestart of his shift he began to light the gas appliances in the ground floor kitchen. He successfully litthe ovens and fryers then began to light the tandoori oven. The igniter on the oven was notworking, so he lit a paper serviette and began to throw it into the tandoori oven clay pot, when anexplosive ignition occurred. The employee suffered burns to his hand, face and eyes, and was takento hospital for treatment.

    The explosive ignition occurred because the tandoori oven had a gas leak on the main supply pipeinto the oven. This meant that when the gas was turned on at the mains, unburnt gas would leakinto the clay pot of the oven. Therefore when a naked flame was applied, the unburnt gasexplosively ignited, causing a fireball to come out of the top of the oven and burn the employee.

    The tandoori oven was examined by a specialist inspector from the Health and Safety Laboratories.

    He found that the leak of gas was coming from a loose nut on the supply side of the controlknob. He also found other defects on the oven: the igniter was not working as the wire had burntthrough, there was silver tape on the end of the igniter wire which appeared to be an attempted repairjob, there was silver tape partially blocking the air inlet hole, there was grease and debrisblocking the ports of the burner and there was evidence that the oven had not been maintainedin a safe condition.

    Sukhdevs Catering Services Ltd admitted that they had not had the appliance serviced or maintainedsince they purchased it in March 2007. They did not have the appliance installed by a Corgiregistered engineer (now Gas Safe Register), In fact it had been installed by a chef and repairs hadbeen made by someone who was not a competent registered engineer.

    Sukhdevs Catering Services Ltd pleaded guilty in magistrates court for failing to maintain the oven(Regulation 35, Gas Safety Installation and Use) Regulations 1998) and were fined 3,500 andordered to pay 2,500 in costs.

    Accident 2:On 12th March 2009 the Head Chef at a restaurant in Sutton Coldfield, began his shift by lighting aTandoor oven when it exploded in his face causing burns to his face and arm. He was taken straightto hospital as a result of his injuries, where he remained for a number of days on a ventilator beforebeing released.

    The tandoori oven being lit by the employee was found to bedefective in the following ways:

    1. The ignition cable, connecting the piezo ignition button tothe pilot light assembly was missing (ZAL/01) which is whythe ignition switch failed to work and why injured personhad to use a lighter.

    2. The ventilation opening into the burner was partially blocked by dust and food debris, indicatingpoor servicing and cleaning. (TM/01 & TM/04)

    3. The test nipple at the rear of the oven was leaking gas because the screw cap was missing.

    4. The tray containing the oval pebble like coals situated above the burner was badly corrodedand had been dropping debris from the coals and cooking residue onto the top of the burner.

    5. Ignition of the main burner by the pilot light was poor due to the dirty burner and poor

    maintenance. (TM/01 & TM/04)

    6. The flame failure device did not operate. This meant the main gas supply could be turned onwithout the pilot light being lit, which would allow for a big build up of gas in the oven if it wasnot lit immediately. (TM/03)

    7. The flame failure device was inoperable because the spring from the device actuator and itsseal had been deliberately removed. (TM/03)

    8. When lit the flame picture for the main burner was very poor with long orange and yellowflames. The primary air inlet and burner tube were restricted by debris and dirt indicating poormaintenance.

    Enforcement advice

    The following enforcement advice is intended to give a brief overview of what actions officers can take Itdoesnt consider all of the circumstances likely to be encountered and of course, officers should consider eachdeviation from the legislation on a case by case basis as they would with any other type of enforcement action.If officers are unsure then it is recommended that they contact HST / Gas Safe Register before taking action.

    In the event that a natural gas appliance is unsafe then officers may wish to considercontacting the gas supplier (National Grid) on 0800 111 999 who have the power to

    disconnect the supply of gas from a premises.

    Emergencies involving LPG Contact should be made to the LPG provider (Details normallyfound on cylinders 4 main providers: Calor 08457 444999; BP 0845 6076118; Flogas 08457200100; and Shell 0870 7539 999.

    For advice on non emergency situations then Gas Safe Register can be contacted on 08004085500.

    LegislationBelow are some of the main pieces of legislation relating to Gas Safety:

    Gas Safety (Installation and Use) Regulations 1998:

    Reg 3: - Qualification and supervision

    (1) No person s ha l l carry out any work in re lat ion to a gas f i t t ing o r gas storagevesse l un less he is com petent to do so.

    (2) The employer of any person carry ing out suc h wo rkfor that employer, everyother employerand self-employed person who has cont ro l to any extent of suchwork and every employer and self-employed person who h as requ i red such work tobe carr ied o ut at any p lace of wo rk un der h is co nt ro l sha l l ensure that paragraph

    (I) abov e is com plied within relation to such work.

    (3) Without prejudice to the generality of paragraphs (1) and (2) above and subject toparagraph (4) below, no emp loyer sha l l al low any o f h is employees to carry outany wo rk in relat ion to a gas f i t t ing o r service pipeworkand no self-employedperson shall carry out any such work, unless the employeror self-employed person,as the case may be, is a member of a class of persons approvedfor the time beingby th e Health and Safety Execut ivefor the purposes of this paragraph.

    Reg 4 - Duty on Emp loyer

    Where an emplo yeror self-employed person requires any wo rk in relation to a gasf i tt ing to be carr ied out at any p lace of work u nder h is co nt ro l orwhere anemployeror self-employed person has cont ro l to any extent of w ork in re la t ion to agas f i t t ing,he shal l take reasonable stepsto ensure that the person u ndertaking

    that work is, or is employed by , a member of a class of personsapproved by theHealth and Safety Executive under regulation 3 (3) above.

    Reg 36(4) Duty on Landlord

    Places duty on Landlord to ensure that any wo rk is carr ied ou t by a person w ho

    is a memb er of a class of p ersons approved by HSE.

    Reg35Duties of employers and self-employed persons

    It shall be the duty of every employeror self-employed person to ensure that any

    gas appl iance, insta l lat ion p ipewo rk or f lue insta l led at any place of wo rk und erh is cont ro lis maintained in a safe con dit ion so as to prevent risk of in jury to anyperson.

WHICH:Applies to work equipment first provided for use in the workplace

    after 5 December 1998Gas Appliance (Safety ) Regs 95 require large scale kitchen appliances to be fittedwith Flame failure safeguards. - Enforced by HSE at supply.

    Reg 12(3) Duty on employer to prevent exposure to specified hazards.

    1) Arrange for a competent person to inspect the tandoori oven located in thekitchen. Carry out any necessary repairs or maintenance to ensure that theappliance is in a safe condition so as to prevent risk of injury to any person.When carrying out the work, reference should be made to thedesigner/manufacturer instructions for the appliance.

    N.B. A competent person is a person that is registered on the Gas SafeRegister for work on commercial catering systems and the appropriate categoryof appliance.

    AND

    2) Provide proof of competence of the person carrying out the work (i.e. GasSafe registration number) to this Department. Provide a copy of the reportof inspection to this Department, detailing the works carried out andconfirming that the gas appliances are in a safe condition so as to prevent arisk of injury to any person.
