Thereafter the applicant’s first Review Application was also rejected on 01.03.2017. Against the said order of rejection dated 01.03.2017, the applicant preferred LTA before the Hon’ble Apex Court with DY No.33310 of 2017 and the Hon’ble Apex Court after condoning the delay, rejected the LTA and also dismissed the appeal. Even after rejection of the LTA by the Hon’ble Apex Court, second Review Application was moved by the applicant which was rejected by this Tribunal on 01.04.2019. Since the applicant moved repeated Review Application without any substance, therefore, the Tribunal imposed a cost of Rs.10,000/- on the review applicant and exemption application was also rejected by the Tribunal. We fail to understand as to why learned counsel for the applicant has taken such steps when the case of the applicant stands finalized by the Hon’ble Apex Court. Moving of such applications without any substance amounts to abuse of process of court and also wastage of precious time of the Tribunal. Therefore, we are compelled to dismiss the application for Leave to Appeal with cost of Rs.15,000/-, which shall be paid within one month from today and if the same is not paid, the same shall be recovered as arrears of land revenue. In this case, O.A. No.33 of 2011 was dismissed vide order dated

01.02.2017. Thereafter the applicant’s first Review Application was also

rejected on 01.03.2017. Against the said order of rejection dated

01.03.2017, the applicant preferred LTA before the Hon’ble Apex Court with

DY No.33310 of 2017 and the Hon’ble Apex Court after condoning the

delay, rejected the LTA and also dismissed the appeal. Even after rejection

of the LTA by the Hon’ble Apex Court, second Review Application was

moved by the applicant which was rejected by this Tribunal on 01.04.2019.

Since the applicant moved repeated Review Application without any

substance, therefore, the Tribunal imposed a cost of Rs.10,000/- on the

review applicant and exemption application was also rejected by the

Tribunal.

We fail to understand as to why learned counsel for the applicant has

taken such steps when the case of the applicant stands finalized by the

Hon’ble Apex Court. Moving of such applications without any substance

amounts to abuse of process of court and also wastage of precious time of

the Tribunal. Therefore, we are compelled to dismiss the application for

Leave to Appeal with cost of Rs.15,000/-, which shall be paid within one

month from today and if the same is not paid, the same shall be recovered

as arrears of land revenue. Cost so recovered shall be transmitted to the

Bar Association, AFT, Lucknow for enrichment of the library.

This is an application for recall of order dated 26.03.2019 passed by this

Tribunal by means of which a cost of Rs.50,000/- was imposed on the

respondents. Ld. Counsel for the respondents further submitted that a copy of

Government Sanction when received, was forwarded to PCDA (P), Allahabad,

hence, the respondents submission to Tribunal earlier was to that extent correct

and their intention was not to mislead the Tribunal.

Ld. Counsel for the applicant fairly conceded that the Government

Sanction is different thing and the forwarding the claim of the applicant to the

PCDA (P), Allahabad is different.

Ld. Counsel for the respondents submits that both the submission made

are correct and there is no apparent contradiction between the two submissions,

as both the things Government Sanction and Claim are independent of each other.

The Government Sanction is the formal approval while the claim in respect of the

aforesaid is to be forwarded by the Record Office after receipt of Government

Sanction to PCDA (P), Allahabad.

In view of aforesaid the Misc. Application No. 381 of 2019 filed by the

respondents for recalling the order dated 26.03.2019 is allowed. The order dated

26.03.2019 so for as the imposing the cost of Rs.50,000/- is concerned is recalled

and cost is waived off.

execution application has rendered infructuous and is accordingly dismissed.

The petitioner may move an application before this Tribunal, in case he has

any grievance against the order of compliance.
