THE FEDERAL TRADE COMMISSION has joined the U.S. Department of Justice’s Antitrust Division in an amicus brief filed by the Solicitor General in the cases of Visa Inc., et al. v. Osborn and Visa Inc., et al. v. Stoumbos, Nos. 15-961 and 15-962, pending before the U.S. Supreme Court. The FTC’s amicus brief urges the court to affirm the U.S. Court of Appeals for the District of Columbia Circuit, which held that the plaintiffs’ complaints adequately alleged an agreement among defendants Visa and Mastercard and their client banks, and reversed a district court ruling hold-ing otherwise. The Visa and Mastercard rules in question, adopted when they were member-owned associations, prohibit ATM operators, including banks, from offering dis-counted ATM access fees to consumers who use debit cards linked to other networks, such as STAR, Pulse, and NYCE, that are cheaper to use.

U.S. DEPARTMENT OF JUSTICE (DOJ) lost a decision in the U.S. Court of Appeals for the Second Circuit on September 26, 2016, over American Express’s “non-dis-crimination” provisions that prohibit merchants from asking for a card brand other than an Amex card. The DOJ has petitioned that same appellate court for a reconsideration of their decision either by the three judges who issued the earlier verdict or by all of that court’s 11 active judges.

MARQETA, which provides its card issuer customers with an open API processing platform, offers Instant Issuance technology that allows cards or tokens to be added directly into a mobile wallet without any cardholder action, such as taking a photo of their card or inputting the account number. U.S. PAYMENTS FORUM has released a white paper called “Optimizing Transaction Speed at the POS.” It provides details on faster EMV solutions, contactless/NFC transactions, and EMV checkout optimization. THE U.S. SUPREME COURT will hear an appeal to a New York state law barring retailers from imposing surcharges on customers who make purchases with a credit card. Merchants filed the appeal in response to a 2nd U.S. Circuit Court of Appeals decision of September 2015, which upheld New York state law. Nine U.S. states that collectively account for more than 50% of the country’s population have laws that ban surcharges on purchases using credit cards.

THE FEDERAL TRADE COMMISSION has filed charges against prepaid card company NetSpend, a subsidiary of TSYS, in U.S. District Court for the Northern District of Georgia. The complaint alleges that NetSpend claims in marketing materials and on its website that consumers who purchase the NetSpend card can “use it today,” will have “immediate access,” that their money is “always available,” and that they have “guaranteed approval” for the card. The FTC alleges many consumers did not receive access to the funds as promised. Consumers must go through an identity verification process before the card can be activated, and many people have difficulty satisfying this legal require-ment. Many consumers could not access their funds for weeks, or at all, and suffered severe financial hardship. The FTC wants “refund of monies paid, disgorgement of ill-gotten monies, and other equitable relief.”

features include viewing balance and purchase activity, checking available credit, and making payments. Everything is done with a smartphone. Currently, no retailer clients use the Synchrony plug-in (SyPi) for in-app or in-store purchases.

SyPi, which is branded with the retailers’ service marks, was created by Synchrony and

GPShopper, a mobile commerce platform provider with 10 years of experience creating mobile apps.

GPShopper has also done work

for Alliance Data and

MoneyGram. It can build a mobile app from scratch or augment a retailer’s existing app by providing a software development kit (SDK) to an in-house development team. The SDK offers hundreds

7.9% and accounted for 59.04% of all spending. Debit card purchase volume of $1.557 trillion grew by 7.5% and accounted for 40.96% of all spending. Debit card figures include prepaid cards.

Visa’s share of combined credit and debit card purchase volume increased to 58.18% from 56.83% for the first three quarters of the prior year. Mastercard’s share slipped to 25.73% from 25.75%. American Express’s share dropped to 13.75% from 14.96%. Discover’s share slid to 2.34% from 2.46%.

Credit card cash advances of $78.23 billion accounted for 3.37% of total credit card volume, up from 3.34%. Cash withdrawals of $499.07 billion on debit cards accounted for 24.28% of total debit card volume, down from 24.64%.

Combined credit and debit card purchase transactions totaled 66.50 billion for the first nine months of 2016, an increase of 9.6% or 5.81 billion more than in the first nine months of

2015. Purchase transactions on credit cards were 24.94 billion, up 11.0%. Purchase transactions on debit cards of 41.55 billion increased by 8.7%. Debit cards generated 62.49% of all purchase transactions, down from 62.99%.

The average amount of a credit card purchase transaction declined to $89.95 from $92.55. The average debit card amount

declined to $37.46 from $37.89.

Visa credit cards generated 55.21% of credit card purchase transactions for the first nine months of 2016, up 215 basis points from 53.06% for the same period in 2015. Mastercard’s share of debit card purchase transactions increased by 35 basis points to 29.18%.

When measuring combined credit and debit card purchase transactions, Visa’s market share grew by 50 basis points to 64.97%, and Mastercard’s share grew by 10 basis points to 27.07%. American Express and Discover lost market share.

One group includes service providers such as parking space companies, fuel sellers, location-based offers providers, and quick

service restaurants (QSRs). Another group is sales

channels such as car manufacturers and car rental companies. A third group includes

payment networks — card and ACH. A

fourth group includes marketplaces needed to

connect service providers to both cars and cardholders. A fifth group includes transaction handlers that provide application programming interfaces (APIs) to service providers to be used to pass all necessary information (location ID, pump ID, and more) from the point of sale to the marketplaces.

Proof of concepts (POC) related to payments for goods and services from connected cars have involved SAP, Visa, ZipLine (an ACH debit card provider), Volkswagen, Toyota, Honda, Seat, and other car manufacturers. Now Mastercard, IBM, General Motors and its OnStar subsidiary have announced they will have an end-to-end service in a year.

While several use cases have been identified, business cases have yet to be established. One challenge is that a purchase tied to a connected car requires the involvement of members from each of the five groups mentioned above.

The first intersection between connected cars and payment cards was a 2014 test of SAP Vehicles Network’s marketplace involving Verifone, Toyota, and Rotten Robbie, a regional gasoline retailer

that offers its customers an ACH debit card from ZipLine. That test involved a single fuel outlet where drivers could unlock the pump and pay for gas from their cars.

In November 2014, SAP conducted a test in Hanover, Germany, with Volkswagen Mobility Card customers that included reserving and paying for parking spots and paying for gas at Shell stations.

Visa, Pizza Hut, and Accenture announced in March 2015 a POC for mobile and online payments from connected cars. The test included Visa Checkout (Visa’s online payment service), cellular

connectivity, Bluetooth low energy, and Beacon technology. Pizza Hut store clerks in a single outlet were alerted when a customer arrived to pick up an order. The test lasted three months.

In October 2015, DocuSign announced it had worked on a connected car project with Visa. The POC involved DocuSign’s Digital Transaction Management

platform and eSignature technology. Consumers sat in a car in a showroom and used its in-dash management system to select the lease option they preferred and signed it, registered the car’s identity using the bitcoin blockchain, chose an insurance option, linked a Visa card to pay for the lease, insurance, and all future automated toll expenses, vehicle maintenance, music

downloads, parking, and more. Visa is an investor in DocuSign.

In February 2016, Visa announced its token service would be made available to auto manufacturers, and it offered them assistance with Bluetooth and QR codes to support mobile and online card payments from their cars. Visa also announced it worked with Honda and ParkWhiz to develop apps for fuel and parking payments from connected cars. Both apps included the Visa Token Service and Visa Checkout.

At that same conference, SAP announced a partnership with Samsung and Seat, a Spanish car manufacturer, focused on digital keys for cars, as well as parking and other payment services.

Mastercard, IBM, and GM will have an end-to-end service in a year.

connections to the banks and acquirers in those countries that enable it to offer ubiquitous card and alternative payment acceptance to a combined 110 million ecommerce shoppers. Last year, those shoppers generated more than $75 billion in online purchases, led by Brazil, which accounted for more than 45% of the total, followed by Mexico (18%), Argentina (10%), and Chile (8%).

Allpago provides a single application programming interface (API) to acquirers, gateway providers, and

other PSPs to allow access to all online buyers in the region. It also handles value-added services such as chargeback management and local tax advice. Allpago is Latin America’s only master merchant for PayPal. It collects funds from local PayPal users and remits them to online sellers abroad.

The company offers every local payment acceptance option in its five markets, pays all relevant local market taxes, and is PCI compliant. It charges 3.99% of the monetary value of a transaction before adding fees for value-added services. Allpago employs local personnel to head operations and sales in each country.

Payment acceptance alternatives to credit and debit cards are critical in Latin America, where U.S. dollar-denominated card accounts represent only 20% of the total card base. The remaining 80% of accounts are blocked for cross-border transactions. Clients including Wirecard, Paysafe, ACI (Pay.On), Symantec, McAfee, and Getty Images reach customers in Latin America through agreements they have with allpago. Last month, Mastercard announced a connected car partnership with IBM, General Motors, and OnStar, the subscription-based, in-car

communication system subsidiary of General Motors. The initiative is part of Mastercard’s Commerce for Every Device program for IoT devices including wearables, smart homes, and chatbots. For connected cars, tokenized Mastercard account numbers will be linked to Masterpass, Mastercard’s omnichannel, global digital payment service. IBM will hold tokens and request dynamic

data from Mastercard’s token service for each transaction before passing those credentials to the OnStar Go platform.

OnStar and IBM will be marketplaces, creating a network of participating service providers — fuel, hospitality, media and entertainment, QSR, and travel and entertainment companies. Those companies will have the ability to communicate with General Motors cars that use the OnStar Go system. ExxonMobil, Glympse, iHeartRadio, and Parkopedia have already signed.

IBM’s Watson machine learning computer system, which can answer questions in natural language, will connect to OnStar and be used to learn a driver’s buying preferences. The aim will be to create individualized, location-based commerce offers from among the service providers

connected to OnStar Go. IBM will lead the sales effort to add service providers.

By the end of 2016, General Motors expects that 12 million OnStar-connected cars will be on the road worldwide. The connected car program will launch in the U.S. in the fourth quarter of 2017 and Europe in 2018.

SAP Vehicles Network is the pioneer marketplace in the connected cars field. Over the last year, it has been building its inventory of participating service providers (fuel sellers, parking providers, QSRs, offers providers) with the aim of accumulating enough scale to present its platform to car manufacturers, car rental firms, and other sales channel providers.

prepaid consumer and commercial cards including American Express, Diners Club, Discover, domestic-only, Maestro, Mastercard, and Visa brands. Issuers represented 11 countries. Argentina led with 10 issuers. Brazil and Venezuela each had 9 banks on the list, Mexico had 6 banks, and Chile had 5.

Measured by only Visa and Mastercard purchase volume, the top 50 largest general purpose card issuers collectively generated $475.37 billion in spending from 498.8 million cards. Those issuers collectively accounted for 87.5% of combined Visa

and Mastercard purchase volume and 80.1% of the cards issued in Latin America and the Caribbean.

Latin America’s 50 largest credit card issuers generated purchase volume of $382.25 billion from 259.9 million cards. This was an average of $1,471 per card annually.

Latin America’s 50 largest debit card issuers generated purchase volume of $397.96 billion from 490.9 million cards. This was an average of $811 per card annually.

legacy network infrastructures, which are built on VPNs (virtual private networks) and WANs (wide area networks). They have made significant investments

in those technologies but now find that they are complex and difficult to manage. They also lack the flexibility needed to execute speedy updates to new applications, particularly mobile apps. Handling any change affecting network endpoints is time-consuming and costly.

Diebold Nixdorf ’s i–Service Station leverages software-defined wide area networks (SD-WAN) to connect in-store payment and other systems with cloud-based management. The always on, 100% network availability of SD-WAN, something that is a requirement in an industry with self-service unattended fuel pumps, permits automating application implementation and

changes in the cloud for every outlet in a network in minutes. There is no need to send a technician to any site.

Cybera, which provides the SD-WAN technology used by Diebold Nixdorf, also counts Verifone and other vendors as clients in the petroleum industry. Its SD-WAN technology, available since 2011, can be used to create application-specific discrete networks that handle payments, including links to multiple processors as well as loyalty programs integrated into the payment flow. They can also support ATMs, onsite Wi-Fi, surveillance, and more. Restaurant chains and other vertical markets with large numbers of network endpoints that need to support a large number of applications can benefit from Cybera’s SD-WAN. Cybera can install one of its virtual networks to connect thousands of outlets in a week.

Legacy networks can add Cybera’s service as a bridge to next-generation services. Cybera’s particular SD-WAN operates on its own cloud, which allows it to remotely inject security features for antimalware, antivirus, application filtering, antispyware, load balancing, and other protections.
