WELCOME You should be proud to know that you are part of a school with a long history and rich tradition. Originally opened in 1927 as Fontana Junior High School, Fontana Middle School consisted of only the “A” Building and was one of the first junior high schools in the country. In 1956, the school was joined with the newly formed Fontana Unified School District, and the district’s administrative offices were housed here. Over the years the school continued to evolve: buildings were added, student population increased, and staff was hired to accommodate this growth.

Today, Fontana Middle School remains as the center of a growing city and school district. Recently, a large-scale modernization project began here. Changes in the appearance and function of our physical plant will allow us to keep current and meet the needs of all the students in the quickly changing, technologically rich world in which we live.

At the same time, architects are maintaining the integrity of the original design of this beautiful and stately old school, reminding us of the tradition and history of these hollowed grounds. We are glad you’re here and that you enjoy your experiences at Fontana Middle School.

TROJAN PRIDE The mascot of Fontana Middle School is the Trojan, representing honor and integrity, as well as courage under pressure. When you think of your school, remember this symbol. During your years here it is our sincerest hope that we all live up to the ideals it represents. ATTENDANCE

Every day counts… Every day a student misses school, he/she becomes more than two days behind in class. Not only is the missed day lost, the return day is spent catching up.

Under Education Code, Sections 48200 and 48260 (a) attendance in school is mandatory. Each child between the ages of 6 and 18, unless exempted or excluded, is subject to compulsory full time education. The student shall attend full time school or continuation school or the full time designated as the length of school day by the governing board of the school district in which the residency of either the parent/legal guardian/caregiver is located. (Education Code sections 46141-46142).

Attendance is an integral part of a student’s education. Students will be held responsible for the content of all course work regardless of absences.

A Student may be excused legally (Education Code section 48205) from school when the absence is due to:

• Illness or injury. (A general rule of thumb is to stay home with a fever or anything contagious. For something less significant, however, the student should come to class).

• Medical, dental, optometric, or chiropractic services rendered. Please provide a note. An appointment, with any luck, should be scheduled before or after school hours. If the appointment must be made during the school day, it is advantageous for students to come to school before and/or after the appointment. A note from the doctor or dentist is required.

• Attendance at funeral services for a member of the immediate family (limited to one day in the state, and three days out of state).

• Exclusion for failure to present evidence of immunization.

• Observation of holiday or ceremony of his/her religion.

• Attendance at religious retreats not to exceed four hours per semester.

• Observation of holiday or ceremony of his/her religion.

• Appearance in court. Requires a note.

• Appearance at SARB or SART.

NOTE: You have three days to excuse your child’s absence, then the absence becomes a truancy.

Every absence verification, whether in the form of a note or phone call, should include all of the following elements:

• Full name of student

• Date(s) of absence

• Specific reason of absence

• Name and/or identity of person making the verification

• Date when the verification is made

Unexcused Absence

Unexcused Absence is one in which the student is not legally excused, therefore, not exempt from compulsory law. Local board policy establishes guidelines on excused absences in accordance with statutory laws. The principal and/or assigned attendance personnel use board policy, Education Code, and unique circumstances to make the determination.

To avoid unexcused absence: If you plan on having your child absent from school for at least 5 consecutive days, consider doing an Independent Study Contract. This option allows the student to take class work assignments home to complete during the extended absence. Upon timely completion, the student will get attendance and grade credit. You need to request the independent study contract at least three days in advance.

Truancy Multiple unexcused absences and tardies violate state law and can be categorized as truancies. Students need to be in class ready for the day’s lesson BEFORE the tardy bell rings. Excessive tardies may result in detention, After School Work Program, Minimum Day School, or Suspension. A class cut is a truancy. When a parent takes a child out of school early, for reasons not acceptable as excused, for longer than a 30 minute period, more than three times during the year, that child becomes a truant.

A truant is a pupil who is absent from school without a valid excuse three (3) full school days or tardy thirty (30) minutes or more on three (3) occasions in a school year, or a combination thereof, without a valid excuse.

Consequences to Unexcused Absences and Truancies

• The City of Fontana has adopted a policy that will allow police officers to pick up and ticket school truants resulting in fines and possible court intervention for student truancy.

• Also, on February 13th 2007, the city passed an ordinance relating to juveniles in public places while school is in session. Ordinance 16-2 had language added to it to include a juvenile that was on the campus of the school but not in the classroom. The definitions provided in 16-2 apply to this section: It is unlawful for any juvenile who it subject to compulsory full-time education or to compulsory continuation education under state law to remain in any public place or on the premises of any establishment in the city, other than a public school classroom or other assigned area of study required participation to which the student is assigned during school attendance hours, during those hours that his/her school is in session…

It means that your students must be in the classroom when the bell rings. If they are not, they are late and may be issued a citation. The citation will be issued to the students for them to appear in traffic court. Once at court, students may receive a fine. They will have to bring a parent to court which of course means you have to find time in your already busy schedule to escort them.

• After three unexcused absences or three truancies or a combination of both, you will receive a SART 1 letter to inform you of the problem and to instigate some actions. If the problem persists, after three more incidents SART 2 will be sent, and after three more incident SART3.

If after the SART 3 letter, no improvements have been made yet, you will be asked to attend a meeting at the District Office.

At last resort, you will be referred to the School Attendance Review Boards (SARBs). SARB members will look with you for a solution for resolving the problem and ask parents to sign an attendance contract. Failure to comply with the contract will result in the order of a citation to appear in court. On the first conviction a fine of not more than $100.00 plus penalties could amount to as much as $375.00.

Parents are responsible for a child’s attendance from the age 6 until age 18. When parents fail to meet their obligations to take their child to school on time everyday, they may be found guilty of an infraction and subject to criminal prosecution. The child may also be subject to prosecution.

Give your children the chance they deserve in life. Take them to school everyday.

Behavior Expectations General Information

Responsibility 1. Get organized. Students are expected to stay up to date with all assignments. 2. Students are expected to have these items with them at all times:

a) A three-ring binder and pouch for 2 pencils and 2 pens b) The Student Handbook with assignments written clearly daily c) All books and necessary materials for each class d) All required assignments e) P.E. clothes and shoes f) Student I.D.

General Classroom Rules

Trustworthiness:1. Turn in completed homework on time. Respect: 2. Follow directions. Each teacher will establish academic and behavior

expectations for his/her classroom. Responsibility: 3. The Student Handbook is required daily in each class.

4. Be prompt to class. Fairness: 5. Accept people for their differences. Caring: 6. Be kind and polite to everyone. Citizenship: 7. Be prepared for class by having appropriate materials and attitude.

General Lunch Behavior

Fairness: 1. Walk to lunch – Do not run. Line up to buy your food. Do not cut in line or save a place for your friends. Do not take food or drinks into classroom.

Citizenship: 2. Eat lunch in the designated areas marked by the yellow lines. Respect: 3. Be courteous to all staff members. Good behavior and table manners

are expected. Do not throw food. 4. Large groups are prohibited. “Parading” around the lunch area is

prohibited. Responsibility: 5. Clean your eating area. “Trash your trash!” Violators will be assigned

“Clean up duty”.

General Assembly Behavior Citizenship: 1. Entering and exiting assemblies in an orderly manner is expected. You

will be under the supervision of your teacher. Respect: 2. Assemblies have a purpose. You are expected to take a seat quickly

and stop talking when asked. Give your attention to the speaker or presentation.

3. Clapping politely is appropriate. Whistling and booing are not appropriate behavior.

Responsibility: 4. Food and drink products are not allowed in the theater.

GROUNDS FOR SUSPENSION AND EXPULSION 1. Caused attempted to cause, or threatened to cause physical injury to another person or willfully used force or violence upon the person of another, except in self-defense (Education Code 48900(a1 & a2)) 2. Possessed, sold or otherwise furnished any firearm, knife, explosive or other dangerous object unless, in the case of possession of any object of this type, the student had obtained written permission to possess the item from a certificated school employee, with the principal or designee’s concurrence (Education Code 48900(b)) (cf.5131.7 – Weapons and Dangerous Instruments) 3. Unlawfully possessed, used, sold or otherwise4 furnished, or was under the influence of, any controlled substance as defined in Health and Safety Code 11053-11058, alcoholic beverage, or intoxicant of any kind (Education Code 48900 (c)) (cf.5131.6 – Alcohol and Other Drugs) 4. Unlawfully offered, arranged and negotiated to sell any controlled substance as defined in Health

and Safety Code 11053-11058, alcoholic beverage or intoxicant of any kind, and then sold, delivered and otherwise furnished to any person another liquid, substance or material and represented same as controlled substance, alcohol beverage or intoxicant

(Education Code 48900(d)) 5. Committed or attempted to commit robbery or extortion (Education Code 48900(e)) 6. Caused or attempted to cause damage to school property or private property (Education Code 48900(f)) 7. Stole or attempted to steal school property or private property (Education Code 48900 (g)) 8. Possessed or used tobacco or any products containing tobacco or nicotine products, including, but not limited to, cigars, cigarettes, miniature cigars, clove cigarettes, smokeless tobacco, snuff, chew packets and betel. This restriction shall not prohibit a student from using or possessing his/her own prescription products. (Education Code 48900(h)) 9. Committed an obscene act or engaged in habitual profanity or vulgarity (Education Code 48900(i)) 10. Unlawfully possessed or unlawfully offered, arranged or negotiated to sell any drug paraphernalia, as defined in Health and Safety Code 11014.5 (Education Code 48900(j)) 11. Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, administrators, other school officials, or other school personnel engaged in the performance of their duties (Education Code 48900(k)) 12. Knowingly received stolen school property or private property (Education Code 48900(l))

13. Possessed an imitation firearm, i.e., a replica of a firearm that is so substantially similar in physical properties to an existing firearm as to lead a reasonable person to conclude that the replica is a firearm (Education Code 48900(m)) 14. Committed or attempted to commit a sexual assault as defined in Penal Code 261, 266c, 286, 288, 288a or 289 or committed a sexual battery as defined in Penal Code 243.4 (Education Code 48900(n)) 15. Harassed threatened or intimidated a student who is a complaining witness or witness in a school disciplinary proceeding for the purpose of preventing that student from being a witness and/or retaliating against that student for being a witness (Education Code 48900(o)) 16. Unlawfully offered, arranged to sell, negotiated to sell, or sold the prescription drug Soma. (Education Code 48900(p)) 17. Engaged in, or attempted to engage in, hazing. For purposes of this subdivision, “hazing” means a method of initiation or preinitiation into a pupil organization or body, whether or not the organization or body is officially recognized by an educational institution, which is likely to cause serious bodily injury or personal degradation or disgrace resulting in physical or mental harm to a former, current, or prospective pupil. For purposes of this subdivision, “hazing” does not include athletic events or school sanctioned events. (Education Code 48900(q)) 18. Engaged in an act of bullying. For purposes of this subdivision, the following terms have the

following meanings:

(1) “Bullying” means any severe or pervasive physical or verbal act or conduct, including

communications made in writing or by means of an electronic act, and including one or more acts

committed by a pupil or group of pupils as defined in Section 48900.2, 48900.3, or 48900.4, directed

toward one or more pupils that has or can be reasonably predicted to have the effect of one or more

of the following:

(A) Placing a reasonable pupil or pupils in fear of harm to that pupil’s or those pupils’ person or

property.

(B) Causing a reasonable pupil to experience a substantially detrimental effect on his or her physical

or mental health.

(C) Causing a reasonable pupil to experience substantial interference with his or her academic

performance.

(D) Causing a reasonable pupil to experience substantial interference with his or her ability to

participate in or benefit from the services, activities, or privileges provided by a school.

(2) “Electronic act” means the transmission of a communication, including, but not limited to, a

message, text, sound, or image, or a post on a social network Internet Web site, by means of an

electronic device, including, but not limited to, a telephone, wireless telephone or other wireless

communication device, computer, or pager.

(3) “Reasonable pupil” means a pupil, including, but not limited to, an exceptional needs pupil, who

exercises average care, skill, and judgment in conduct for a person of his or her age, or for a person of

his or her age with his or her exceptional needs.

19. A pupil may not be suspended or expelled for any of the acts enumerated in this section, unless that act is related to school activity or school attendance occurring within a school under the jurisdiction of the superintendent or principal or occurring within any other school district. A pupil may be suspended or expelled for acts that are enumerated in this section and related to school activity or attendance that occur at any time, including, but not limited to, any of the following: (1) While on school grounds; (2) While going to or coming from school; (3) During the lunch period whether on or off campus; (4) During, or while going to or coming from, a school sponsored activity. (Education Code 48900 (s)) 20. A pupil who aids or abets, as defined in Section 31 of the Penal Code, the infliction or attempted infliction of physical injury to another person may suffer suspension, but not expulsion, pursuant to this section, except that a pupil who has been adjudged by a juvenile court to have committed, as an aider and abettor, a crime of physical violence in which the victim suffered great bodily injury or serious bodily injury shall be subject to discipline pursuant to subdivision (a). (Education Code 48900 (t)) 21. Made terrorist threats against school officials and/or school property (Education Code 48900.7) A student in grades 4 through 12 is also subject to suspension or recommendation for expulsion when it is determined that he/she: 22. Committed sexual harassment as defined in Education Code 212.5 (Education Code 48900.2) (cf.5145.7 – Sexual Harassment) 23. Caused, attempted to cause, threatened to cause, or participated in an act of violence as defined in Education Code 233 (Education Code 48900.3) 24. Intentionally harassed, threatened or intimidated a student or group of students to the extent of having the actual and reasonably effect of materially disrupting class work, creating substantial disorder and invading student rights by creating an intimidating or hostile educational environment (Education Code 48900.4) (cf.5145.3 – Nondiscrimination/Harassment)

While on school grounds 2. While going to or coming from school 3. During the lunch period, whether on or off the school campus 4. During, going to, or coming from a school-sponsored activity Alternatives to suspension or expulsion will be used with students who are truant, tardy, or otherwise absent from assigned school activities. (cf.5113 – Absences and Excuses) (cf.5114.2 – Suspension and Expulsion/Due Process (Individuals with Disabilities)

MAKE-UP WORK If a student misses one day of school, he or she will be expected to take any tests and/or turn in assignments that were due on the day of the absence upon return. For each day absent, the student will have a reasonable amount of time to make-up the work assigned during the absence. Students should have a ‘study buddy’ in each class who they can call for missed assignments.

CAMPUS SECURITY VIDEO In order to maintain a safe and secure learning environment, security video cameras are placed throughout the campus. These cameras record 24 hours and are monitored by the administration, Fontana PD and School Police. GOING ON A TRIP Parents may request an Independent Study-contract if a student is going to be away from school for reasons other than illness or medical appointments. This contract is for a minimum of 5 days and no more than 20 days. Parents need to request this contract at least three days prior to the start of the absence. Upon return and completion of the assignment missed, students will receive credit and excused absences. The Independent Study contract needs to be returned with the work to the office upon return to the school.

HOMEWORK REQUESTS (Due to absence) Homework requests can be made through the office. Homework may be picked up usually after two working days. Upon request, homework can also be sent home via another student.

HEALTH OFFICE Students are to notify the teacher immediately if an injury occurs. A student who feels ill or wishes to discuss a health problem with the health clerk should ask for a pass from his/her teacher. In case of a serious accident/injury, parents are contacted for referral to their family physician. Parents are requested to notify the health clerk about serious health concerns and regularly prescribed medications. Medication cannot be given to students without a doctor’s order.

Medication at School: All medications must be kept in the health office. Medications will be given at school under the following conditions:

1. A current written order from a physician and written consent by the parent must be on file in the health office and renewed yearly.

2. The medication must be in a prescription labeled bottle as ordered by the physician and

should contain only the necessary medication for school. MEDICAL AND OTHER APPOINTMENTS

If at all possible, appointments should be made out of school time. If it is necessary for a student to have an appointment during the school day, the student must present a written request from the parent or guardian to the office giving the necessary information so that the pupil may be excused. The student will be required to checkout through the office when leaving the campus and to check in to the office upon his or her return. Students are allowed to leave only with parent/guardian or other authorized adult as listed on the emergency card. All persons wishing to pick up a student MUST present a valid form of picture ID before a student can be released. STUDY HALL Please be aware that due to liability issues, all students that are ordered to wear a cast due to injury or are ordered “Off Physical Education” for more than 5 days will be placed in study hall for the duration of their “Off P.E.” doctor’s order. Students will not be allowed to return to Physical Education until they receive a doctor’s clearance. OFF CAMPUS PERMIT When it is necessary for a student to leave campus early for a medical, dental appointment, family emergency, or due to illness, the student must checkout through the attendance office. Students will then be allowed to leave only with parent/guardian or other authorized adult as listed on the emergency card. All persons wishing to pick up a student MUST present a valid form of picture ID before a student can be released. CHANGE OF ADDRESS AND/OR VITAL INFORMATION

Inform the office if you change your address, telephone number, doctor, emergency contact number or parent’s work phone number. This is essential for proper and necessary communication. If you are listing a person as your emergency contact, please make sure you have their permission. It is essential that we have current contact phone numbers in case of an emergency. Every student

must have contact numbers of relatives or neighbors in the event there is no home numbers. The

contact person must also be listed on the emergency card to check students out of school.

HOW TO GET HELP If you have a concern about courses, class schedules, teacher(s), friend(s), family, etc., and you would like to talk to someone about it, fill out a ‘Blue Slip’ form available in the office. The person you want to see will call you out of class at his or her first opportunity. The counseling and administrative staff are available to help with serious problems that need immediate attention. If you need to leave class, be sure to get a pass from your teacher.

ANNOUNCEMENTS Announcements will be made each morning as the bulletin is read in your first class. These announcements will include information concerning meetings, assemblies, changes in the bell schedule, and other items of interest to you. It is the student’s responsibility to listen quietly while the announcements are being made.

TELEPHONE The school phone number is 357-5370. Students may use the office phone for emergencies and/or after 1:45 after school.

MESSAGES FOR STUDENTS Parents, please make arrangements with your child before he or she leaves for school regarding appointments, errands, or changes in the time or place for after school pick-up, etc. The office will take messages for students; but unless it is an emergency, students will not be taken out of class to receive messages.

PERSONAL PROPERTY Students assume the responsibility for loss or damage to their clothing, equipment, books, instruments, and/or other private property. The school attempts to protect all personal property, but is not liable for them. LARGE SUMS OF MONEY AND ARTICLES OF REAL OR SENTIMENTAL VALUE SHOULD NOT BE BROUGHT TO SCHOOL. When items of value must be brought to school, they should be taken to the office for safe keeping until they are needed. Do not leave your possessions unattended. The school is not liable for lost items. NOTE: RADIOS, CD PLAYERS, MP3 PLAYERS, CD(s), TRADING CARDS, VIDEO GAMES, TOYS, SKATEBOARDS, PAGERS, CELL PHONES, AND CAMERAS ARE NOT ALLOWED AT SCHOOL.

LOST AND FOUND Students who find lost articles should take them to the ‘Lost and Found’ area in the Attendance office. LIBRARY/TEXT BOOKS REGULATIONS

Textbooks are the property of the Fontana Unified School District. These books are loaned to pupils and subject to the following conditions:

1. Books are to be used only by the student to whom they are issued. Students are not to lend their books to other students.

2. Books are to be returned when requested or at the time of withdrawal if the pupil leaves before the end of the year.

3. If the book is damaged in excess of reasonable wear or is lost, the pupil must pay for a replacement.

4. We recommend that books be covered. 5. Clearance of lost or damaged books is done in the library.

6. Library books are checked out for a two-week period and are renewable. Only two books may be checked out at a time.

7. Students with outstanding library charges will be placed on ASB suspension. 8. Students are responsible for lost or damaged textbooks left in classrooms.

HOMEWORK Homework is a vital part of the educational program at Fontana Middle School. We strongly recommend that students plan their homework so they do some each night instead of waiting until the last minute. Parents are urged to contact the teacher if their student suddenly starts to indicate that there is no homework.

REPORT CARDS AND PROGRESS REPORTS Report cards are mailed home at the end of each semester. Parents should contact the school if they do not receive a report card. District generated Progress Reports are mailed home once during each semester. Site based Progress Reports will be sent every two weeks with your children. Parents are strongly encouraged to contact school immediately with any concerns about your students’ academic progress. You may also request a weekly progress report from your child’s counselor. Parents can also sign up for access to your student’s academic data through our Parent Connect program. Contact the school office for more information.

ASB Student officers are elected during the previous school year. Under the direction of the ASB Advisor, these students plan assemblies; conduct and approve fund raising activities; sponsor dances and lunchtime activities; and facilitate other school events. ID BADGES A student identification (I.D.) card and lanyard is given to each student. It must be worn around their neck at all times. Consequences will be assigned for failure to wear their ID. If a student loses his/her card he/she must purchase another I.D. card at the cost of $5. ACTIVITIES To be eligible to participate in any activity (athletic contests, dances, field trips, assemblies, etc.), students are required to be in attendance on the day of the activity, unless other arrangements have been made. A “No- Go” list will be developed prior to each school – wide extra-curricular activity. Students who have been suspended or owe Library books/fines or other ASB monies will be placed on the “No Go” list. Students with any Fs will not be allowed to attend non-academic activities. All school-sponsored activities are subject to the same rules as the regular school day for behavior and dress code.

FUNDRAISING

Students who participate in fundraisers and their parents are responsible for returning fundraising materials in good condition. They are also responsible for all missing items and all monies. Any student who fails to return items or money will be placed on the ASB/ No Go restriction list.

ASSEMBLIES

Each assembly has a purpose that requires the students’ attention and orderly behavior. Students earn the right to attend assemblies by demonstrating good behavior as follows:

1. Entering and exiting in an orderly manner under the supervision of their teachers. 2. Showing respect to the speaker by coming to order quickly when asked. 3. Giving their attention to the speakers or presentation. 4. Booing and whistling are not appropriate behaviors. 5. No food, drink, gum or writing instruments are allowed.

P. E. LOCKERS & UNIFORMS A locker and lock is assigned to each student the first week of school. P.E. uniforms are sold through the physical education department.

1. Students are responsible for securing their own belongings. 2. The P.E. uniform is not to be worn as an alternative to the school uniform. 3. Loaners are available on a limited basis for specific cases. 4. Students may be assigned a consequence such as after school detention for failure to adhere

to the P.E. uniform policy. 5. Students are expected to wear appropriate socks and tennis shoes for safety/health reasons.

SPECIFIC SCHOOL RULES Students are expected to be courteous and respectful at all times. Disobedience, defiance, and disrespect toward adults will not be tolerated. Students must comply with reasonable instructions from adult school system employees at all times.

Abusive language or obscene gestures toward another person will not be tolerated.

Stealing or being in possession of stolen property, cheating, forging, extortion, and gambling are prohibited.

The disruption of school activities, pulling the fire alarm, or other forms of willful defiance and/or disruption will not be tolerated.

1. GANG RELATED ACTIVITY OR BEHAVIOR: Any form of gang related activity or behavior is prohibited. Students should be aware that this restriction includes but is not limited to hand signs, graffiti on books, property, body, clothing, belts, buckles, manner of grooming, and wearing or displaying gang related clothing. Clothing that advocates drug use, violence, disruptive behavior, or other safety issues will not be tolerated. This policy shall be applied at the principal’s discretion as the need arises (BP 5136a). 2. CLOSED CAMPUS: Students are to remain on the school grounds from the time they arrive at school until they are dismissed at the end of the school day. If a student walks off campus without parent or administrator permission, he/she may be cited for daytime truancy. All visitors to school must obtain approval to be on campus from the administration. School age visitors are not allowed on campus or in classrooms during the school day. Parents and Guardians are welcome and should check in at the front office (Administration office).

3. FIGHTING/DISRUPTION: Behavior that disrupts the educational setting will not be tolerated. This policy includes but is not limited to attempting or threatening to cause physical injury to another person. If a fight does occur, students will be cited and fined for Public Fighting (P.C. 415.1) and suspended from school. 4. WEAPONS: Students are not allowed to bring or have in their possession any weapon or dangerous object to include but not limited to the following: any size knife, gun, ‘look alike’ weapon, firecracker, popper or other explosive device, stink bombs, or objects which may be harmful to themselves or others if used in a fight situation. Students who violate this rule will be suspended and may be cited and/or recommended for expulsion. 5. TOBACCO, ALCOHOL, DRUGS, OR PARAPHERNALIA: Fontana Middle School is a tobacco and drug free campus. Possession, use, or being under the influence of any of these substances is against State law and is subject to suspension, a possible citation, and recommendation for ‘Insight’ counseling, AOD Intervention, and/or a recommendation for expulsion.

6. DEFACEMENT OR DAMAGE TO SCHOOL, STUDENT OR STAFF PROPERTY: The Education Code states that any pupil who willfully cuts, defaces, or otherwise damages in any way, any property, is liable for all damages. MARKERS, HIGHLIGHTERS, PAINT STICKS, LIQUID CORRECTION,

PAINT, OR GLITTER GLUE will not be allowed on campus. Parents and/or guardians are responsible for all damages. 7. GRAFFITI: Graffiti on or in student books, property, body, belts, buckles, clothing, etc. is not allowed. Students caught defacing school property (walls, lockers, desks, books, windows, etc.) will be suspended and may be cited and/or recommended for expulsion. 8. RADIOS, CD PLAYERS, MP3 PLAYERS, CD(s), TRADING CARDS, VIDEO GAMES, SKATEBOARDS, PAGERS, CELL PHONES, AND CAMERAS: These items are not allowed at school. They will be confiscated and kept until a specific return date. In most cases, parents may pick up the item immediately. If a student violates this rule, he/she may be suspended. The school is not liable for lost or stolen items.

LASER POINTERS are dangerous when pointed at another person and are not allowed at school. Students who bring them to school or use them in any manner are subject to suspension and a possible citation and/or recommendation for expulsion. In the event of an injury, the offending student may be subject to arrest and criminal prosecution. 9. BICYCLES: Bicycles may be ridden to school but students must get off their bike and walk it as they enter the school grounds. Students are expected to use a bike lock and wear a helmet. 10. BOOKS: Students are responsible for the care of all books and materials issued to them by the teachers or librarian. The parents or guardians must pay for lost or damaged books and materials. Students who lend books to other classmates are still responsible for any loss or damage to the book issued to them.

11. CANDY OR ‘JUNK’ FOOD: Students cannot sell items at school unless under the supervision of a staff sponsor for an approved fundraising activity. Food or drink items cannot be sold during breakfast or lunch. Gum, seeds and pacifiers are not allowed.

12. OFFICE: The office is a place of business. Students should come to the office only when they need to see a counselor or when they receive a call slip from a staff member. Students must sign in and sign out to register their attendance at the office.

13. CLEAN CAMPUS: Students are responsible for keeping the campus clean. Those responsible for leaving trash items will be assigned clean-up detail. Pitch in and keep our campus neat and clean! Drinks and food items are not allowed in the classrooms, library or auditorium.

SEXUAL HARASSMENT The Fontana Unified School District is committed to an educational environment in which all students are treated with respect and dignity. Each student has the right to learn in an environment that promotes equal educational opportunity and is free from any discriminatory practices. Therefore, the District strongly condemns, opposes and prohibits sexual harassment of students whether verbal, physical or environmental by anyone in or from the District.

Any student who sexually harasses anyone may be subject to discipline, up to and including expulsion.

SEXUAL HARASSMENT means unwelcome sexual advances, requests for sexual favors, and other verbal, visual or physical conduct of a sexual nature. This includes inappropriate touching or gesturing by one student towards another. HATE VIOLENCE: A pupil may be suspended or recommended for expulsion for causing, threatening to cause or participating in an act of ‘Hate Violence’.

HARASSMENT, THREATS, INTIMIDATION:

A pupil may be suspended or recommended for expulsion if the pupil engages in harassment, threats, extortion, or intimidation that disrupts the educational environment of other students.

MANDATORY EXPULSIONS: Certain offenses will result in immediate and mandatory suspension and recommendation for expulsion. These include:

1. Causing serious physical injury 2. Possession of knife, explosive, or other dangerous objects

3. Selling or distributing a controlled substance 4. Robbery or extortion 5. Possession of firearm(s)

If a student violates Civil Law on campus or at any school event, the police will become involved in the situation, in addition to school district action.

DISCIPLINE CONSEQUENCES TEACHER DETENTION: When students misbehave in the classroom, they may be assigned detention. Failure to serve assigned detention may result in other disciplinary consequences. AFTER SCHOOL WORK PROGRAM (ASWP): Students may be assigned to work after school picking up trash and helping to keep the campus clean or may be given a written assignment.

DRESS CODE The Governing Board of the Fontana Unified School District believes that appropriate dress and grooming contribute to a productive learning environment. The Board expects students to give proper attention to personal cleanliness and to wear clothes that are suitable for the school activities in which they participate. Students’ clothing must not present a health or safety hazard or a distraction that would interfere with the educational process. (Board Policy 5132)

1. Shoes must be worn at all times. Sandals must have heel straps. Steel toed boots, slippers, flip-flops, footsies, moccasins or other soft-soled shoes or backless shoes are not acceptable. No heels over 1 inch.

2. Bandanas, hats, beanies, or hair nets of any kind cannot be WORN OR CARRIED.

3. See through, cut-up, strapless, “spaghetti” strapped, backless, off-the-shoulder, bare midriff style, tank tops, halter or low cut tops are not permitted. Muscle or T-back shirts are not to be worn. NO UNDERGARMETS CAN BE VISIBLE.

4. Excessively baggy clothing and sagging are not permitted. Excessively long, frayed, slashed or

torn pants are not to be worn. NOTE: Frayed, slashed, or torn pants MAY NOT be worn EVEN with leggings underneath).

5. Leggings, tights, spandex may not be worn as pants or shorts. Overly tight clothing is not to be

worn.

6. Athletic jerseys are allowed; however, the administration has the discretion to prohibit an athletic jersey if they feel it is worn to convey an apparent message or represent gang affiliation.

7. Excessively long chains/necklaces with medallions and pocket chains, or spiked bracelets are

not permissible.

8. Shorts, skorts, or skirts are to be no shorter than mid-thigh.

9. Any article of clothing that advocates racial, ethnic or religious prejudice is prohibited.

10. Clothing, jewelry and personal items (backpacks, purses, tote bags, etc.) shall be free of writing, pictures or any other insignia which are crude, vulgar, profane, sexually suggestive or bear drug, alcohol or tobacco advertising or endorsements.

11. Initial and/or oversized belt buckles and spiked belts are prohibited. Shoe laces are not to be

worn in place of a proper belt.

12. No pajama tops or bottoms.

13. Hair shall be clean and neatly groomed. Hair may not be sprayed be any coloring that would drip when wet.

14. PE uniforms may not be worn in classes other than Physical Education classes.

15. Backpacks, purses, clothing, notebooks, etc., are to be graffiti free at all times.

Dress should be appropriate for normal school activities; it should reflect pride and respect. Just as overall attitude and competency contribute to a productive learning and working environment, so does appropriate dress and grooming. Health and safety are guides to acceptable school attire. Garments should meet acceptable standards, be appropriate for school activities and be in good repair. Violations of Dress Code are disruptive to the learning process and/or classroom instruction. The student will be required to change clothes. Loaner clothes are available through the office. Loaner clothing is to be returned at the end of the school day.

The administration retains the sole discretion to determine if the garment meets this standard. In case of questionable dress (not covered in the rules listed above), the site administrators will make the final decision. If necessary, an appropriate consequence may be assigned for repeated dress code violations. DANCE RULES

1. Tickets are sold previous to the dance.

2. You must have your school I.D. to buy a ticket AND to get into the dance.

3. Only one ticket will be sold per student 4. If you are suspended during the current grading period you are not able to attend the dance.

5. No one will be allowed to enter the dance 15 minutes after the dance starts. 6. No one will be allowed to leave before the dance ends unless accompanied by a

parent/guardian.

7. Any behavior that a chaperon considers unsafe or inappropriate (including but not limited to running, slamming, profanity, dirty dancing, etc.) is grounds for dismissal from the dance and may include a referral or suspension. No refund will be given.

8. The district dress code must be followed. 9. No food or drinks are allowed in the gymnasium.

10. You must attend the dance to win any raffles or give-aways.

Retention Policy Information State law dictates that students not achieving the grade level standards in specific content related skills are to be retained. The grade level standards have been established by the California Department of Education and are the basis for the statewide California Standards testing program. All students in grades 1-8 will be identified according to specific curriculum components. The retention/promotion identifying areas are the California Standards tests, site-based common and formative assessments and grades.

Students and parents/guardians will be notified if the student is at-risk of failing a grade. Students who are notified they may be failing have the ability to change their status by earning passing grades in their classes and earning passing marks on the district assessments. Additionally, students who are notified they may be failing a grade may be assigned to receive additional help in reading, writing, or math. This extra help may be held before or after-school. It is important that all students take their classes seriously and work to their full potential. California High School Exit Exam This year’s eighth grade students, who will be seniors in the class of 2017, will be required to pass the California High School Exit Examination (CAHSEE) to receive a high school diploma. State law (senate Bill 2, Statutes of 1999) authorized this new graduation requirement for all California public school students.

School Accountability Report Card

Public schools in California are required by Education Code 33126 to publish a School Accountability Report Card (SARC) annually. This card provides information about student achievement and the school to the community. As a result of federal legislation resulting from the No Child Left Behind Act (NCLB, 2003), California schools are also required to disseminate district-level information through a District Accountability Report Card (DARC). These cards provide a variety of data to allow parents and other community members to evaluate and compare schools in terms of student achievement, environment, resources, and demographics. Uniform Complaint Procedures FONTANA UNIFIED SCHOOL DISTRICT

GOAL It is the goal of the Fontana Unified School District to ensure compliance with applicable state and federal regulations. The district has adopted policies and procedures for the investigation and resolution of complaints alleging failure to comply with applicable state and federal laws. RESPONSIBILITY FOR UNIFORM COMPLAINT PROCEDURES The Associate Superintendent of Human Resources will monitor compliance with provisions outlined in the District’s Uniform Complaint Procedure Process. Complaints or allegations regarding noncompliance with applicable state and federal guidelines should be submitted in writing to the Associate Superintendent of Human Resources. WHO MAY FILE A COMPLAINT? A complaint may be filed by any individual, including a duly authorized representative, interested third party, public agency, and/or organization. Individuals who may file complaints include District students, employees, and parents or guardians. Investigations are conducted in a manner that protects against retaliation and confidentiality of parties and the facts to the greatest extent possible. FILING A COMPLAINT A written complaint alleging unlawful discrimination shall be filed by one who alleges that he or she has personally suffered unlawful discrimination, or by one who believes an individual or any specific class of individuals has been subjected to prohibited discrimination and evidence relevant to the complaint can be presented during the process. A complaint alleging unlawful discrimination shall be filed with the Associate Superintendent, Human Resources, 9680 Citrus Avenue, P. O. Box 5090, Fontana, CA 92335-5090, no later than six months from the date the complainant first obtained knowledge of the facts of the alleged discrimination. A complainant may file a written request for an extension of time for filing a complaint of unlawful discrimination with the State Superintendent of Public Instruction. The District has 60 days from the date the complaint is received to investigate and render a decision. APPEALS Any complainant(s) may appeal a District decision to the State Superintendent of Public Instruction by filing a written appeal with the Superintendent within 15 days of receiving the District decision. The complainant shall specify the reason(s) for appealing the District decision. The appeal shall include:

• A copy of the complaint; and

• A copy of the District decision. CIVIL LAW REMEDIES Please be advised that you are not required to exhaust the District Uniform Complaint Procedure prior to pursuing civil law remedies in Superior court. Statutory authority for such actions includes, but is not limited to, the following:

1. California Education Code Section 200, et. Seq. prohibition of sex discrimination. 2. California Government code section 11135 prohibition of discrimination in programs funded by the State. 3. Title VI Civil Rights Act of 1964 (42 U.S.C. section 2000d) prohibition of race, color, or national origin

discrimination. 4. Title IX Education Amendments of 1972 (20 U.S.C. sections 1681, et. Seq.) prohibition of sex discrimination. 5. Notice to Families Regarding the New FUSD Wellness Policy The Board of Education of the Fontana Unified School District adopted in June 2006 a Student Wellness Policy (Board Policy 5030) in order to comply with new state and federal laws. The new policy recognizes the link between student health and learning. Board Policy 5030 – Student Wellness outlines the components of a comprehensive health literacy program designed to build the skills and knowledge that all students need to maintain a healthy lifestyle and includes: physical activity; health education; nutrition services; counseling services; safe and healthy school environments; and parent/guardian and community involvement. A major component of the policy outlines the new nutrition standards for foods and beverages sold to students during and immediately after the school day, including sales from vending machines, student stores and fundraisers; the new nutrition standards for food and beverages offered to students during celebrations, classroom parties and as rewards. This is now effective for Middle and High School students as of July 2007. With these required changes, we believe that we are developing a better nutrition/wellness program for our students and sending them a consistent message that proper health and nutrition are an important part of their education. We appreciate your understanding and support of this policy. MIDDLE & HIGH SCHOOL NUTRITIONAL REQUIREMENTS

Items offered must be commercially prepared and stable at room temperature unless proper cold/hot temperatures can be maintained. Food/Snack Standards:

▪ Not more than 35% of its total calories shall be from fat. ▪ Not more than 10% of its total calories shall be from saturated fat. ▪ Not more than 35% of its total weight shall be composed of sugar, including naturally occurring

and added sugar. ▪ Not more than 250 calories. ▪ Exemptions are nuts, nut butters, seeds, eggs, cheese packaged for individual sale, fruits,

vegetables that have not been deep fried, or legumes. Beverage Standards:

▪ Fruit-based and vegetable-based drinks that are at least 50% juice without added sweeteners. ▪ Drinking water without added sweeteners. ▪ Milk products including 2%, 1%, nonfat, soy, rice and other similar non-dairy milk. ▪ An electrolyte replacement beverage that contains no more than 42 grams of added sweetener

per 20-oz. serving.

School Day

One school related organization may sell up to 3 snack and/or beverage items (listed below) on any day provided that all the following conditions are met:

▪ The food sold meets the nutritional requirements listed. ▪ The specific nutritious food item is pre-approved by the principal or designee. ▪ The items offered for sale are intended to supplement the meal program or meals

brought from home. ▪ The food sold is not one sold in the food service program during the school day. ▪ The food sold is commercially prepared and stable at room temperature unless

proper cold/hot temperatures can be maintained. Schools may select no more than 4 schools days on which any number of organizations may sell any number of items, providing that:

▪ The sale is approved by the Principal or designee. ▪ The items selected for sale meet the requirements for snacks and/or beverages

(listed below). ▪ The school cafeteria staff is given a minimum of two weeks notice.

Fundraising

The sale of food and beverages that do not meet nutrition standards is allowed under two circumstances:

▪ Sale by students at school at least 30 minutes after the end of the school-day. ▪ Sale by students is off and away from school premises

Celebrations & Parties

Rewards and Incentives:

▪ Food or beverages will not be used as rewards for students’ academic performances, accomplishments or behavior.

Parents and staff are strongly encouraged not to use food and beverages for celebrations and classroom parties.

1. Sufficient textbooks and instructional materials as defined in Education Code 60119: A pupil does not have standards-aligned textbooks or instructional materials, or state- or district-adopted

A condition poses an urgent or emergency threat to the health or safety of students or staff, including; gas leaks, nonfunctioning heating, ventilation, fire sprinklers or air-conditioning systems, electrical power failure, major sewer line stoppage, major pest or vermin infestation, broken windows or exterior doors or gates that will not lock and that pose a security risk, abatement of hazardous materials previously undiscovered that pose an immediate threat to pupils or staff, structural damage creating a hazardous or uninhabitable condition, and any other emergency conditions the school district determines appropriate.

A school restroom has not been maintained or cleaned regularly, is not fully operational, or has not been stocked at all times with toilet paper, soap, and paper towels or functional hand dryers.

The school has not kept all restrooms open during school hours when pupils are not in classes, and has not kept a sufficient number of restrooms open during school hours when pupils are in classes. This does not apply when temporary closing of the restroom is necessary for pupil safety or to make repairs.

3. Teacher vacancy or misassignment: A semester begins and a teacher vacancy exists, as defined in Education Code 35186(h) (2) and (3). A teacher lacks credentials or training to teach English learners and is assigned to teach a class with

more than 20% English learners in the class. A teacher is assigned to teach a class for which the teacher lacks subject matter competency.

4. California High School Exit Exam: Pupils who have not passed the high school exit exam by the end of grade 12 were not provided the

opportunity to receive intensive instruction and services for up to two consecutive academic years after the completion of grade 12 in accordance with Education Code 37254(d).
