The Board of Education of the Fontana Unified School District held aRegular Meeting on June 19, 2002, at the John D. Piazza Education Center,9680 Citrus Avenue, Fontana, California. The President called a Work Session to order. She announced that thediscussion regarding Interest Based Bargaining would be postponed. Sheopened the meeting to discussion regarding the 2002-2003 Budget.

Mr. Emmanuel D’Souza and Ms. Melissa Anderson, Director, FiscalServices, provided information and comments regarding the budget.

Mr. Hawthorn asked why COLA numbers aren’t included in the budgetand how that decision was made. He reminded Mr. D’Souza that the Board haddirected that it be included and questioned why they weren’t warned ahead oftime that it was not included.

Mr. D’Souza explained that it would not be possible to present a budgetwith a 2% ending balance if the COLA was included. He stated that theadministration clearly understood the Board’s direction and is working towardthat end. He also noted that benefits are negotiable and the Benefits Committeeis still working on recommendations that will be presented to the Board. Hefelt it would not be right to include a number before settling with the unions.

Mr. Hawthorn also questioned why there is not enough money fortextbooks when he was always informed previously that there was.

Dr. Harshman stated that some years ago the district began usinggeneral fund monies for textbooks in addition to state monies.

Mr. Mike Bement, Director, Media and Public Information, explainedthat in all likelihood, based on orders which have been submitted, textbookneeds would be met. He noted two areas of risk – if major cuts occur at thestate level and if we have unanticipated burst in attendance. He also noted thatthere is continual pressure in the absence of lockers to issue books to studentsas well as keeping class sets.

Mr. Hawthorn stated that he had the following concerns regarding thebudget development: formulas for instructional materials and supplies in thatthere is no information on why or when they were developed; no COLAincluded, no benefits costs, no clear answer on funds for textbooks. Based onthat he felt he could not support the budget as presented.

Mrs. Binks also questioned the lack of information on benefit increases.

Dr. Peoples stated that information has been provided to employeeorganizations and possible changes in the structure are being studied whichmight mitigate some of the increases.

Mr. Poindexter stated that they know that the health benefit cost willincrease. The real question that will be negotiated is who is going to pay for itand the FTA membership has clearly indicated they would choose benefits oversalary. Obviously, however, at this time the true cost is not known. At thistime they would like to see movement into a trust but they would like to see atleast the COLA included in the budget with a decision on how it is spent to bedetermined through the negotiations process.

Mr. McClure asked if it is the intention of the district to bargain benefitspursuant to Interest Based Bargaining.

Mr. Poindexter responded that it has been under discussion, however, hedid not believe the teams are adequately trained for this year.

Mr. Hawthorn stated that since the workshop had not been held yet, hethought that discussion might be premature and perhaps even out of line.

Mr. McClure stated he did not believe so.

Ms. Mancha adjourned the Work Session and called a Public Hearing toorder.

Mr. Louie Nardone, Harry S. Truman Middle School Teacher,expressed concerns regarding obesity of students. He noted he hadimplemented several programs throughout the years at middle schools toaddress this problem. He noted that p.e. teachers cannot do it themselves. Ittakes the entire district and community working together to do something aboutthis crisis.

Dr. Ruble stated he had attended Congressman Baca’s presentation andthat was the main focus which was mentioned over and over again. There ismuch concern about exercise and obesity.

Mr. Tony Orlich provided a capsule of Adolf Hitler’s life.

Ms. Dawn Dooley spoke on behalf of PTA, Girl Scouts & FontanaSwim Club regarding charges for use of facilities. She noted that the increasescause a hardship for nonprofit organizations and requested that the Board notpass this recommendation. She stated that they charge low fees to allow morefamilies to participate in these youth activities.

Ms. Darlene Caringella also spoke on behalf of Girl Scouts. Sheasserted that the charges are not financially fit for their organization which hasno budget for them. She felt these programs keep kids busy and off the streets.She also urged the Board not to pass this schedule.

Mr. Carl Wuebben also spoke on behalf of the Girl Scouts and chargingfees for use of facilities. He suggested that maybe they could work together toturn off lights, etc. He also noted that this amount of money to hold a girl scoutmeeting would be very difficult.

Ms. Paula Colby, Teacher at Harry S. Truman Middle School, alsospoke in support of providing students with the opportunity to try freshwholesome food. She stated she had found ways to incorporate foods into allsubject areas in her teaching.

Mr. Tony Micciche stated that in December, 2000 he had expressed aconcern that campus security would be moved from the classified bargainingunit to school police. He noted that there is a recommendation on this agenda tomove campus security officers from elementary to secondary levels and to formCSO II and CSO I positions. He stated that the CSO I position would not beexpected to perform at the same level as the CSO II which is unfair. TheSchool Police Department is making the assignments. He questioned why ifcurrent positions are being abolished they are not given the same rights as allother classified positions and why these elementary people were not allowed touse the same process. He also noted there are many other recommendations toapprove substitute employees and not permanent employees. He commentedthat they believe the classified bargaining unit is being butchered. He alsoasked about the status of a survey of district employees that was discussed in2000.

Mr. Micciche then referred to Interest Based Bargaining and stated hehad heard there would be a workshop but didn’t receive any notification ofwhen it would be held. He requested more information on that. He stated thathis bargaining unit had also surveyed members in regard to benefits and it isone of the number of concerns of respondents that is important and they areready to bargain on that issue.

Mr. Poindexter complimented the Teachers of the Year and noted that itwas an incredible and difficult job to make the choices.

Bargaining UnitRepresentatives’ Comments

Ms. Elaine McFadden stated that a student from Fohi would bepresenting the report on the School Health Assessment. She stated that teachersand students are an under utilized resource. Students have a good perspectiveon how to address the problems and encouraged everyone to start workingtogether as a team, take it one step at a time and work towards the goal of betterhealth for kids. She appealed to the Board to recognize that nutrition andlearning are inter related and to take advantage of that. She stated she wouldlike someone from the Board to work as a mentor or someone to turn to to getopinions from the Board level. She also asked for Board support so that otheremployees on the campus may participate in meetings during their work time ifnecessary. She introduced Destiny from Fontana High School who presentedthe Board with information regarding a recently conducted School HealthAssessment.

Mr. Hawthorn commented that there are many change orders on thisagenda. He stated over the years he has been opposed to them and he did havean opportunity to review all of them with district staff. He noted his concernhas always been paying for things that are not the district’s fault. He stated hewould support all of these change orders with the understanding that the districtwill try to recoup those funds in the areas that could have been prevented.

Mr. Hawthorn requested that the recommendation to increase use offacility fee schedule be pulled from this agenda. He stated that he understandsthe need and fees will have to go up but asked if alternative sources have beenlooked at.

Ms. Mancha asked who served on the committee and how were usersnotified of the increase.

Mr. D’Souza stated that representatives from high schools and middleschools served on the committee. He also stated they had not notified anycurrent users of the facilities as yet as they were waiting on Board action.

Dr. Harshman stated that it has been many years since there have beenany increases. She noted this is not rental of the facilities but is only for theout-of-pocket costs recognizing that many of the activities are with youth. Thebottom line, however, is that expenses are incurred. She suggested that perhapsa survey of other districts could be conducted. She asked if these groups coulduse other public facilities. The district is not making any money – they arelosing money.

Dr. Ruble questioned charging for custodians who are already on duty.

Mr. D’Souza stated that time is taken away from cleaning classrooms.

Mr. Hawthorn agreed that additional information would be helpful but itneeded to be made clear that the fee schedule will not change.

Ms. Mancha suggested that youth organizations approach service clubsfor donations to support their costs.

Dr. Ruble asked for comments from the administration regarding themovement of Campus Security Officers.

Dr. Peoples explained that a part of the budget cuts was to re-deploypersons presently assigned as CSO at the elementary sites to vacantpositions at secondary schools. That action required establishment of a jobdescription for those persons.

Dr. Ruble asked if this is a way or means of getting rid of anemployee later on because they are not performing satisfactorily at thesecondary level even though they did at the elementary level.

Dr. Peoples indicated she knew of no employees who are currentlyunder discipline regarding their employment and the new job descriptiondoes include duties they currently perform. She also noted that this doesnot involve a change in the line of authority or any attempt to move themout of the classified bargaining unit. These positions have beensupervised, trained, evaluated, hired through the school police servicesdepartment.

Mrs. Binks asked if they are they being provided additional trainingto move to the secondary level.

School Police Chief McCurry stated that all Campus SecurityOfficers have gone through the same mandated training required by thestate and they receive additional training at their sites. He explained theCSO I position is primarily going to be stationed at entries, exits, andparking lots. He further explained that some bicycle training was providedat the secondary level on a voluntary basis that was not mandatory and hewould not envision a CSO I being involved in those. He noted that they arecoming from campuses where they have had to deal with controversy forsome time and they are experienced Campus Security Officers.

Mr. Micciche expressed concern that middle schools only have twoofficers and they have to rely on their co worker to deal with situations. Hefelt that some of these people have been in their positions at elementarylevels for a number of years, are aging and perhaps cannot adequately assistat the middle school levels. He also again expressed concern that they arecalled “Officers” and wondered if they would remain in the classifiedbargaining unit.

Dr. Peoples stated that is a general title within the district. Sheassured him there is no intent to take them out of the United Steelworkers ofAmerica, Local 8599, unit. She reminded him that they had agreed thatthey should not be moved to the CSO II position and that a new jobdescription should be created. She also stated that when employees moveto new positions they are not provided a choice unless it is in a layoffposition.

Mr. Micciche asserted his opinion that by abolishing their position itis no different than if you went through a normal layoff situation whichwould allow them to choose by seniority.

Mr. McClure requested that the recommendation to approve aconsultant agreement with The Pulliam Group be removed from theConsent Calendar. He stated he could not support paying anyone $1,000 aday and while he agrees it is a critical position he would have to vote no.

Dr. Harshman explained that this agreement is for 18 days for anexperienced person for a highly technical, legal position. She also indicatedthat this person was not earning $1,000 a day but that was the terms of theagreement with The Pulliam Group. She noted that interviews for thevacancy would be conducted on July 8 and she could not let this position gounfilled during the interim.

Mr. Hawthorn suggested that the agreement be reworded to “not toexceed 18 days”.

Kathy asked if the incentive program for cost saving ideas is still inplace. She suggested that when employees earn these kinds of awards thatthey be invited to Board Meetings.

Mr. McClure commented on the Valedictorian and Salutatorian whogave speeches in both English and Spanish and stated he felt that saidsomething special about those students as well as the Fontana UnifiedSchool District.

Mr. Hawthorn asked what the district has in place to help those kidswho need assistance in passing the high school exit exams.

Dr. Gilleland, Director, High School Education, stated that there areseveral programs in place and there are summer school courses thatspecifically speak to standards addressed on the high school exit exam. Healso commented that the curriculum currently in place also addresses thisarea.

Mrs. Binks suggested that Dr. Ruble serve as Board liaison withElaine McFadden.

The Board concurred and Dr. Ruble accepted.

Ms. Mancha asked if there was some means to keep kids in schooleven though they were struggling with the high school exit exam.

Ms. Mazzolini stated that discussion would be held with high schoolprincipals.
