Cameron McDonald Vowell, Ph.D.Chair

Term Expires 2009

Cameron McDonald Vowell, Ph.D., wasconfirmed by the Alabama Senate on April6, 2004 for a term which began September1, 2004 and expires August 31, 2009. Dr.Vowell was elected Vice Chair at theAugust 1, 2007, Commission Meeting. Shehas been active in community affairs sincegraduation from Hollins College in 1968.She has her Ph.D. in biochemistry fromUAB and an MA in environmental sciencesfrom the University of Texas at Dallas.She served for 14 years on the AlabamaAir Pollution Control Commission and itssuccessor agency, the Alabama Environ-mental Commission. She served for nineyears on the national Board of Governorsof The Nature Conservancy and she cur-rently serves on the Board of her alma

mater, Hollins University. Dr. Vowell hasworked with a number of groups whichencourage philanthropy for causes affect-ing women and girls, including theWomen’s Fund, an endowment for projectsbenefitting women and girls. She hasserved for 11 years on the board of theCommunity Foundation of Greater Birm-ingham and on the boards of the AlabamaSymphony, Gateway/Family and ChildServices, and the Black Warrior/CahabaLand Trust. Dr. Vowell has acceptedappointments for boards, commissions andcommittees from city, state and countygovernments. Her most recent activity isin the field of geriatrics. She serves on theBoard of Counselors of the Center forAging at UAB, and is active in promotingattention to geriatric issues across thecommunity. Dr. Vowell and her husbandScott, Presiding Circuit Judge of JeffersonCounty, have one son.

Michael K. K. Choy, Esq.Vice-Chair

Term Expires 2010

Michael K. K. Choy, Esq. was con-firmed by the Alabama Senate on May 3,2005, to serve a term on the AlabamaEthics Commission that began on Sep-tember 1, 2005, and ends on August 31,2010. Mr. Choy was born in Queens,New York on July 29, 1958. He graduat-ed from Holy Family Catholic HighSchool in Birmingham in 1976. Hereceived his Bachelor of Arts degree inPolitical Science from the University ofAlabama at Birmingham in 1980, andreceived his Juris Doctorate from theCumberland School of Law at Samford

University in Birmingham in 1984. Hewas a law clerk to the Honorable U. W.Clemon, Chief Judge of the UnitedStates District Court for the NorthernDistrict of Alabama. After seven yearsas In-House Counsel with BellSouthCorporation, Mr. Choy entered privatepractice. He is presently managingmember of the law firm CHOY LICHEN-STEIN LLC where he practices civil liti-gation. He is a former Alabama StateBar Examiner, and a current member ofthe State Bar’s Character and FitnessCommittee. Mr. Choy is a Trustee forthe J. Craig and Page T. Smith Scholar-ship Foundation, which benefits Alaba-ma high school seniors who are first intheir family to attend college. He hastwo daughters.

Linda Lloyd GreenTerm Expired 2006

Linda L. Green was confirmed by theAlabama Senate on January 17, 2002 toserve a term which expired August 31,2006. Mrs. Green has continued to serveuntil her successor is confirmed. She waselected Chairman at the August 3, 2005Commission meeting. Mrs. Green wasborn in 1951 in Huntsville, Alabama andgraduated from Huntsville High School in1969. She has a B.S. degree from the Uni-versity of Alabama and an M.S. degreefrom Auburn University. She also holdsFINRA licenses — Series 7, Series 24 andSeries 63. Beginning in 1976 to 1993, Mrs.Green worked for Parisian, Inc. where sheserved in a number of roles before manag-ing each of the two stores in Huntsville.From 1993 to 2004 she worked for ColonialBank where she served as CEO and Presi-dent of the Northern Region and from

2004 to 2007 as EVP for Colonial Banc-Group as Wealth Management Director.She currently works with Renasant Bankas the President for Madison County. Herprofessional and civic activities includeserving on the UAH Foundation as Trea-surer and a member of the Executive Com-mittee, past Chair for Volunteers of Amer-ica, Madison County Veterans MemorialBoard member, and Crestwood HospitalWomen’s Advisory Group. Her pastinvolvement is varied, including serving asa board member for Intergraph Corpora-tion, Vice-Chair and Chair of the AlabamaSpace Science Exhibit Commission, theVon Braun Center Board of Control, theAlabama State Banking Board, 1998 Chairfor the Huntsville/Madison County Cham-ber of Commerce, the Board of Directors ofUnited Way, and numerous other civic andcharitable organizations. Mrs. Green ismarried to Randy Green, and they haveone son, daughter-in-law, and grandson.

Braxton L. Kittrell, Jr.Term Expires 2012

Braxton L. Kittrell, Jr., was confirmedby the Alabama Senate May 8, 2008, toserve a term on the State of AlabamaEthics Commission ending August 31,2012. Kittrell received a J.D. degree fromthe University of Alabama in 1967 andbegan practicing law in Mobile in 1969.He was elected Circuit Judge for the 13th

Judicial Circuit (Mobile County) in 1976,and served in that office from January,1977 until he retired in April of 1999. Heserved as Presiding Circuit Judge fromJanuary 18, 1989 until his retirement.Kittrell was a member of the JudicialInquiry Commission of the State of Alaba-ma from 1987-99, and served as its Chair-man from 1995-99. He was president ofthe International Academy of State TrialJudges (1982-83); he served as Chairmanof the Regional Planning and AdvisoryBoard for Region 6, Alabama Law Enforce-

ment Planning Agency (1980-83) and as amember of the Executive Committee of theState Supervisory Board of the AlabamaLaw Enforcement Planning Agency (1980-83). He served as Chairman of the Sen-tencing and Corrections Committee of theAmerican Bar Association, JudicialAdministration Division from 1993-97,and as a member of the Executive Com-mittee of the National Conference of StateTrial Judges of the American Bar Associa-tion from 1995 through 1998. He alsoserved as President of the Alabama Associ-ation of Circuit Judges (1996-97), and as amember of the Alabama Supreme CourtCourt Advisory Committee on CriminalProcedure (1997-99). He presently holdsmembership in the American, Alabamaand Mobile Bar Associations, the AlabamaAssociation of Circuit Judges, the Interna-tional Academy of State Trial Judges, theAmerican Judicature Society and serveson the board of directors of the AlabamaForest Resources Center.

Josephine M. VenableTerm Expires 2013

Josephine M. Venable was confirmedby the Alabama Senate on May 28, 2008for a term which began September 1, 2008and will expire August 31, 2013. Mrs. Ven-able is a native of Clio, Alabama whereshe graduated from Barbour County HighSchool. She received a Bachelor of Sciencedegree with Education Certification inPhysics, Chemistry and Biology from theUniversity of Alabama in 1961. Shetaught advanced science and biology inMontgomery before moving with her hus-band, the late Honorable Jack B. Venable,to Washington, D. C. In 1970 they pur-chased The Tallassee Tribune in Tallassee,Alabama at which time Mrs. Venablebecame Co-Owner and Associate Publish-er. After the death of her husband, shecontinued the newspaper as Publisherand Editor. She sold The Tribune in 2007and remains as Editor Emeritus. She has

been an active member of the AlabamaPress Association for many years, beingnamed to various committees. Mrs. Ven-able has served her community as Presi-dent of the Tallassee Chamber of Com-merce and Secretary/ Treasurer of the Tal-lassee Industrial Development Board. Shehas also served as Chairman of the Com-munity Hospital Board of Directors aswell as Chairman of the Alabama Councilof Hospital Trustees. She continues herservice with the board of Community Hos-pital as a member of the Executive andFinance Committees. She is a member ofthe Advisory Board, Elmore Division,BankTrust. Mrs. Venable is a member ofFirst United Methodist Church of Tal-lassee having served in many areasincluding Board of Trustees and LayLeader. She has been named to numerousother community boards and committees.Mrs. Venable and her late husband havetwo children, daughter Cameron, son-in-law Steve and son Ben.

Anthony HumphriesTerm Expires 2014

Mr. Humphries graduated from GoodHope High School in Cullman County in1973. He received a B.A. degree in PoliticalScience from Auburn University in 1977 andgraduated from the Graduate School ofBanking at LSU in 1988. He, along with agroup of business leaders in Calhoun County,organized a new community bank in 2005.Mr. Humphries has served as the Bank’sPresident & CEO and as a member of theBank’s Board of Directors since September2005. He has over 30 years of banking expe-rience in the Calhoun County market. Healso served on Governor Riley’s cabinet asSuperintendent of the Alabama BankingDepartment from 2003 to 2005. Mr.Humphries began his banking career withSouthTrust Bank, gaining experience as heprogressed from management trainee toAssistant Vice President, Vice President andSenior Vice President/Senior Lending Offi-cer. After 6 years with SouthTrust, he washired by AmSouth Bank where he served asthe Senior Vice President/Commercial Bank-

ing Sales Manager for 13 years. In 1997, hereturned to SouthTrust Bank as the marketCEO.

Mr. Humphries volunteers his time withseveral organizations throughout CalhounCounty and the surrounding areas. He is onthe Board of Directors of the First NationalBankers Bank-Alabama, the CommunityBankers Association of Alabama, the North-east Alabama Regional Medical Center, theAnniston Museum of Natural History Foun-dation, the Knox Concert Series and theAnniston Country Club. He is a formerChairman of the Calhoun County Chamberof Commerce and serves now as Chairman ofits Transportation Task Force. Mr.Humphries is the Vice Chairman of theMcClellan Development Authority, the entitycharged with the redevelopment of the for-mer Fort McClellan. He is a member of theAnniston Rotary Club and the Oxford Quar-terback Club and serves as a Trustee for theWomen’s Missionary Union (WMU). He is anactive member of the First Baptist Church ofOxford where he serves as a Deacon. He ismarried to the former Cristy Chase and hastwo sons and one granddaughter.

James L. (Jim) Sumner, Jr.Currently, Mr. Sumner is the Director of

the Alabama Ethics Commission. He wasappointed to the position by the Commission inApril, 1997. Mr. Sumner holds an additionalappointment as a Deputy Attorney General.

From October, 1987 to April, 1997, Mr.Sumner served as Assistant to the Vice Chan-cellor for External Affairs of the University ofAlabama System. The UA System is comprisedof campuses in Tuscaloosa, Birmingham andHuntsville. At that time, the System had over43,000 students, 18,500 employees and anannual budget exceeding $1.35 billion.

From January to October, 1987, Mr. Sumn-er served as Vice President/Legislative Affairsfor the Alabama Hospital Association.

Mr. Sumner was the Executive Assistant tothe Lieutenant Governor and served as Chiefof Staff in the Lieutenant Governor’s Officefrom January, 1983 to January, 1987.

From January, 1979 to May, 1982, Mr. Sum-ner served as Corporate Secretary and in-house counsel of Royal Cup, Inc. of Birming-ham, the largest coffee roaster in the South.

Mr. Sumner served as an Assistant Attor-ney General from October, 1974 to January,1979.

Mr. Sumner is a native of Jasper, Alabamaand attended Jasper public schools and WalkerCounty High School.

He was graduated from the University ofAlabama in 1970 with a Bachelor of ScienceDegree.

In 1974, Mr. Sumner received his Doctor ofJurisprudence Degree from CumberlandSchool of Law at Samford University.

Before joining the Attorney General’s staff,Mr. Sumner served for three years as Adminis-trative Assistant to the Chairman of the Demo-cratic Party in Alabama, Robert S. Vance.Vance was later appointed by President Carterto the U. S. Court of Appeals for the EleventhCircuit.

Mr. Sumner holds membership in theAmerican Bar Association and the AlabamaState Bar Association.

He is married to Deanna Benefield Sumnerof Huntsville and they have three adult chil-dren: Matthew, Amelia and Aaron.

COMMISSION STAFF

PURPOSE, POWERS AND DUTIES

The Alabama Ethics Commission was established in 1973 by Act No. 1056 of the AlabamaLegislature which has subsequently been amended by Acts 75-130, 79-460, 79-698, 82-429,86-321, 92-342, 95-194, 96-261, 97-651, 2000-797 and Act. No. 2001-474.

The Mission of this law is to ensure that public officials are independent and impartial;that decisions and policies are made in the proper governmental channels; that public officeis not used for private gain; and, most importantly, that there is public confidence in theintegrity of government.

DIGEST OF ADVISORY OPINIONS

AO NO. 2008-26

A member of the Board of Directors of the Industrial Development Board of the City ofBirmingham may serve as a real estate broker on a land purchase by the Industrial Devel-opment Board; provided, that the Board itself approached the member about his represen-tation; that all activities related to the transaction are done on his own time; that he doesnot use Industrial Development Board resources to assist him in performing his services;and, that he does not vote, attempt to influence or otherwise participate in any aspect ofthe contract/transaction as a member of the Industrial Development Board.

The daughters of the Mayor of the Town of Geiger, Alabama, may not receive CDBG grantsfrom ADECA administered through the Town of Geiger, when the Mayor voted for theTown to make an application to ADECA for the grant, and also voted for the selection ofthe grant administrator, unless all eligible applicants receive the benefits of the grantprior to the Mayor’s daughters receiving the grant, and where the Mayor plays no furtherrole in the administration of the grants.

The Wilcox County Commission may rent storage space at one of its buildings to the GeesBend Water Company, while a Commission member is an owner/partner in the WaterCompany; provided, it is an arms-length transaction; that the rental price is based on thefair market value; and, that the Commission member does not vote, attempt to influenceor in any manner participate in the discussions or any aspect of the transaction betweenthe County Commission and the Gees Bend Water Company.

AO NO. 2009-03

A retired Circuit Court Judge may use documents that were at one time confidential thathave become public records to assist him in writing a book about a case he presided overwithout violating the confidentiality provisions of the Alabama Ethics Law, once the infor-mation loses its confidential status.

An individual against whom a complaint is filed with the Ethics Commission is not pro-hibited from using that information in any way he or she so desires; provided that theinformation and its use are not subject to the Grand Jury Secrecy Act, codified at Sections12-16-214 through 12-16-216.

The requestor of this opinion is advised to contact the Judicial Inquiry Commission (JIC)regarding any confidentiality provisions relating to complaints before that body. Thestatute of limitations for the disclosure of confidential information begins to run at thetime the confidential information is used or disclosed in a manner that could result infinancial gain.

Receiving permission to disclose what is considered confidential information under theEthics Law, does not negate the confidentiality provision.

A former employee of the Alabama Oil and Gas Board may have informal contact with hisformer employer, the Alabama oil and Gas Board, within two years of his retirement; pro-vided, the contact does not involve lobbying, or representing the interests of clients and/orhis current employer.

A former employee of the Alabama Oil and Gas Board may not participate in informalmeetings between the Board’s staff and clients or potential clients, when the meetinginvolves furthering the interests of that client, regardless of whether or not the matter willbe heard by the Board at some future date.

■ 2 Cases were Closed with No Probable Cause

STATEMENT OF ECONOMIC INTERESTS:

The Alabama Ethics Law requires a Statement of Economic Interests Form to befiled no later than April 30th of each year covering the preceding calendar year forindividuals who fall into one of 24 categories.

In Fiscal Year 2009:

■ 49,381 forms filed with the Ethics Commission

■ First Year for Electronic Filing of Form Through Website

■ 30,716 forms or 62.2% were filed on-line

LOBBYIST REGISTRATIONS:

The Alabama Ethics Law requires all lobbyists to register with the Commission byJanuary 31 of each year or within 10 days after the first undertaking requiring suchregistration.

In Fiscal Year 2009:

■ 692 Lobbyists registered with the Ethics Commission

■ 874 Principals were represented

■ First Year for On-Line Registration Through Website

On June 1, 2009, Marie Malinowski retired from the AlabamaEthics Commission after 10 years of dedicated service to theagency. According to Mr. Sumner, “Marie served the EthicsCommission, and more importantly, the public, for ten wonder-ful years. She was dedicated in her service and always loyal tothe mission of the Commission.” Congratulations, Marie! ! !

COMMISSION MEETING HIGHLIGHTS

October 1, 2008, Montgomery, Alabama

The Commission, chaired by Cameron M. Vowell, Ph.D., rendered two Advisory opinionsand heard four cases. Three were handled administratively and one case was continuedfor further investigation.

The Commission rendered two Advisory opinions, carried over one opinion, and heardfive cases. Three cases were referred to the Attorney General’s office and two caseswere handled administratively. Subsequently, the opinion carried over was withdrawnon May 12, 2009.

April 1, 2009, Montgomery, Alabama

The Commission rendered two Advisory opinions and heard five cases. Two cases werereferred to the District Attorney, and three were handled administratively.

June 3, 2009, Montgomery, Alabama

The Commission heard three cases. Two cases were handled administratively and onecase was referred to the District Attorney. No Advisory opinions were rendered.

August 5, 2009, Montgomery, Alabama

At the August Commission meeting, two cases were heard and both were continued. NoAdvisory opinions were rendered. The Commission elected Michael K. K. Choy as Chairand Linda Green as Vice-Chair. The Commissioners then presented Cameron Vowellwith a “Plaque of Appreciation” for her service on the Commission. Meeting dates for2010 were approved.
