WHEREAS, the Lorain County Engineer by letter dated March 8, 2018 submitted the following request:

“The Engineer’s Office requests that the Board of Commissioners authorize the Clerk to receive bids on this project as soon as possible. Copies of the legal notice and the Resolution to advertise are attached. Please contact us should have any questions.

This project is necessary because of the severely distressed condition of the culvert deep below the earthen embankment of Columbia West River Road. This presents a dangerous safety risk of collapse to the roadway above, despite our frequent efforts to repair the road surface. Also, a large concrete retaining wall must be replaced.

We estimate the cost of construction at $190,886 according to our plans and specifications. The Ohio Public Works Commission will contribute its grant of 59% of the project costs; and Columbia Township will contribute $50,000 through its Community Cost-Share Program from the Northeast Ohio Regional Sewer District. The Lorain County Engineer will fund the balance of the project through its MVGT account.

Department, 4th floor, 226 Middle Avenue, Elyria, Ohio for the furnishing of all labor, material and equipment for the Columbia West River Road #0564 Culvert Replacement project in Columbia Township (Columbia Station, Ohio) in accordance with plans and specifications prepared by the office of Ken Carney, Lorain County Engineer. Each proposal shall be enclosed in a sealed envelope marked “Columbia West River Road #0564 Culvert Replacement.” All interested parties may attend the bid opening to be held immediately following the deadline, in the Lorain County Commissioners Public Hearing Room D.

The work consists of replacing the culvert under Columbia West River Road, including a new concrete wall. The work is located about 0.3 miles south of Sprague Road. The Engineer’s estimate of construction cost is $190,886. Lorain County intends and requires that this project be completed no later than October 31, 2018. All materials and equipment shall meet the specifications of the Ohio Department of Transportation; and work shall be performed under the inspection of the Lorain County Engineer. All contractors and subcontractors involved with the project will, to the extent practicable, use Ohio products, materials, services and labor in the implementation of their project. Additionally, contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123 is required.

Official bid documents and specifications may be obtained at the office of the Lorain County Engineer, 247 Hadaway Street, Elyria, Ohio between the hours of 8:00 A.M. and 4:00 P.M., Monday through Friday. Only bids prepared on the official documents obtained from the County Engineer will be accepted. A $50.00 non-refundable deposit is required for each set of bidding documents.

Each proposal must contain the full name of the party or parties submitting the proposal, and all persons interested therein. Each bidder must submit evidence of its experiences on projects of similar size and complexity. Each bidder is required to furnish with its proposal a Bid Guaranty and Contract Bond in accordance with Section 153.54 of the Ohio Revised Code. The Ohio Department of Transportation has reviewed the study and is in agreement with the recommended 35 MPH speed but is recommending that Marian Road also be included as part of the posted speed limit. Eaton Township and the Lorain County Engineer are in agreement with this recommendation.

Mr. Cordes said the bonds were priced yesterday for the Justice Center refinance and the council save around $805,000 in reissuance. He thanked Budget Director Hobart, Underwriters and Bond Counsel. He will be making a trip to New York to meet with the rating groups to try to get an upgrade.

Mr. Cordes has a resolution from Community Development on several contracts with homeowners for CDBG. There were many invitations to bid sent out but were continue to get very few and not many locals. He will be sitting down with our County Chamber as an outreach event to see what the issues are bidding on these jobs from local companies. Commissioner Kalo said many are busy. Mr. Cordes said he believes it could be the paperwork and regulations that the state requires for such jobs, such as being lead certified. Commissioner Lundy said this is very frustrating. Mr. Romancak said these do have to be awarded today.

Don Romancak, Director – Lorain County Community Development Department explained Zone Opportunities. He stated that this submission had to be by March 2. Its part of the new federal tax act, a new economic tool but still waiting to see what the regulations are and incentive is to reduce tax liability on tax gains, max out 10 years.

WHAT ARE OPPORTUNITY ZONES? This program uses low-income community census tracts as the basis for determining areas eligible for Opportunity Zone designation. The chief executives of  every U.S. state and territory have 90-120 days from December 22, 2017 to designate up to 25 percent of the total number of low-income census tracts in a state as Opportunity Zones. 

WHAT ARE OPPORTUNITY FUNDS? Opportunity Funds are private sector investment vehicles that invest at least 90 percent of their capital in Opportunity Zones. U.S. investors currently hold trillions of dollars in unrealized capital gains  in stocks and mutual funds alone— a significant untapped resource for economic development. Opportunity Funds provide investors the chance to put that money to work rebuilding the nation’s left-behind communities. The fund model will enable a broad array of investors to pool their resources in Opportunity Zones, increasing the scale of investments going to underserved areas.

WHAT ARE THE INCENTIVES THAT ENCOURAGE LONG-TERM INVESTMENT IN LOW INCOME COMMUNITIES? The Opportunity Zones program offers investors the following incentives for putting their capital to work in low-income communities:

A temporary tax deferral for capital gains reinvested in an Opportunity Fund. The deferred gain must be recognized on the earlier of the date on which the opportunity zone investment is sold or December 31, 2026.

A step-up in basis for capital gains reinvested in an Opportunity Fund. The basis of the original investment is increased by 10% if the investment in the qualified opportunity zone fund is held by the taxpayer for at least 5 years, and by an additional 5% if held for at least 7 years, excluding up to 15% of the original gain from taxation.

A permanent exclusion from taxable income of capital gains from the sale or exchange of an investment in a qualified opportunity zone fund, if the investment is held for at least 10 years. (Note: this exclusion applies to the gains accrued from an investment in an Opportunity Fund, not the original gains).

Mr. Romancak said there were possible 30 eligible and Government can nominate up to 25% in lmi. The county submitted 12 being in Lorain, Elyria and Oberlin.

Mr. Cordes said great work and thanked Commissioner Kalo’s son who works in the banking industry and they were notified of these zone but there was not much time for submission. Commissioner Kalo asked when the Governor will submit, Mr. Romancak said he has until March 24 /25 but can get an extension and the county prioritized the zones to get a more favorable submission.

Jeff Baxter, Elyria said there are many ways elected officials address the public such as state, city and school addresses, what about Lorain County. Residents of Lorain County desire this communication annual speech allows everyone to know where we are going, what will be happening. He does not come here to complain, just find solutions. Are there good things happening here are we going in right direction. He stated Mr. Cordes gave a brief look at some finances today with the bonds. He said you need to be transparent and the same with voters, voters communicate in November

Rosa Gee, Sheffield Lake said April 3, Goodwill will open up in Sheffield Lake. Also April 9 at 6:30 pm., Civic Center will have a round table to get input on what the center should be and there is also a poll on facebook

Joe Gee, Sheffield Lake thanked the Commissioners for their support of the Veterans and the Treatment Court. They continue to receive a lot of donations of equipment, furniture etc and wanted to know if there is any storage buildings available. Mr. Cordes said he thought this was taken care of on the East 28th Street, Lorain property. He will be getting with Mr. Romancak and Mr. Metzger to define his expectations and thanked Mr. Gee for his service.

Jason Monschein, Eaton Township Trustee distributed to the Commissioners Appendix N – technical checklist for Expedited 2 annexation from County Commissioners handbook. He has received information that another possible annexation will be coming to Eaton Township. He has requested the Engineer office to look at the facts and offer an opinion and the office have said no. He respects opinions and wants facts until he is proven wrong. There are many things that are not checked on this list and an Eaton Township resident spoke last week stating that he is now completely surrounded by the city. He does not believe Elyria needs another 36 acres and Columbia Township is growing fast but Eaton Township is just right behind them and the township does not need to continue to loose property because of sewers. He sent an email to County Engineer Carney to review the map and legal what was presented is wrong, or have a 3 rd party and as an elected officials he provides the truth and this one was done in errors. It’s the power of the commissioners to ask the engineer to do and he will stand correct if wrong but just needs to be done. _____________________(discussion was held on the above)
