We will get down to business by the ‘numbers’ as a contractor discovers he may “B” off the mark in getting that general license. What happens to the contractor’s license when a business is ‘dead’? Does the license ‘live on’ to cause problems in the future? Not knowing may be an expensive lesson to learn… Q: I either want to add a “B” classification to my existing license or create a new corporation with a “B” license. I have been active in business continuously for 15 years with several classifications “C-2” (Insulation), “C-9” (Drywall), “C-33” (Painting) and “C-35” (Lathing/Plaster). Do I qualify for a “B” class and do I need to take the exam. Which scenario would be easier? A: To qualify for a "B" license the CSLB requires that you show 4 years experience (within the past 10) in the building trades. By their evaluation standards this usually includes two or three of the following PLUS STRUCTURAL FRAMING OR CARPENTRY: concrete, roofing, electrical, plumbing, HVAC. Simply showing a background in insulation, drywall, etc. will not be enough to qualify. If you do qualify, the trade test WILL be required. Adding the new class to an existing license is likely the easier scenario. Q: I am a long time fan of your column. I am the Responsible Managing Officer (RMO) for a recently issued license number 9xxxxx. This is my new company and my only current business focus. I also have a couple of other licenses. One of which is number 8xxxxx, a sole owner license that is expired. In the near future I will probably bring this license to current and active status and just keep it there in case I ever need it. This seems to me to be a prudent idea just in case anything happens to our new corporation. My real concern is license number 7xxxxx, an expired license of which I am also the RMO. My old partner and I are no longer conducting any business. He disassociated from this license and now I would like to also, but I'm not sure of the ramifications since there would be no Qualifier left.

Can you give me an idea as to whether or not there would be any negative impact to my new license or in keeping my sole owner license alive? Thank you in advance for your help and keep up the good work. A: Thank you for your kind words and for reading the column. If this old corporate license is never going to be used again, I would recommend filing a "License Cancellation Request Form" with the CSLB. In most instances this would require the signature of two officers; however, as the only remaining officer, your signature should be sufficient. As an alternative, I do not see any problem disassociating from the license; however, you would not be able to make any changes or adjustments should you change your mind. If you have not already done so, I suggest filing final dissolution documents with the Secretary of State so the corporation does not continue accruing taxes and penalties (at least $800 per year). Canceling or disassociating from the license should have no impact on your remaining two licenses. Please contact me if you have further questions. Heads Up Alert: I have received several calls recently from contractors who have used an internet-based firm to help them draft and file documents for a California Limited Liability Company (LLC). The problem is this company apparently does not realize that a LLC cannot obtain a CA contractor’s license. Period. The callers typically end our conversation with either: “Why didn’t they tell me” or “I just wasted hundreds of dollars”. ‘Caveat Emptor’, or buyers beware. Knowledge is power. Labor Law Corner - Calchamber Employer Has Right to Assign Employee Unused Vacation Time

We ask that all employees submit their vacation requests by March 1, but most do not. Can we assign vacation time to employees who do not sign up to take vacation?

The employer has the right to schedule vacations. Labor Code Section 227.3 provides, in brief, that vacation is vested and requires unused vacation to be cashed out at termination. Further, there can be no forfeiture, such as a “use it or lose it” policy. The employer does have the right to manage the vacation program by setting vacation dates.

The Labor Code section states the following:

“Unless otherwise provided by a collective-bargaining agreement, whenever a contract of employment or employer policy provides for paid vacations, and an employee is terminated without having taken off his vested vacation time, all vested vacation shall be paid to him as wages at his final rate in accordance with such contract of employment or employer policy respecting eligibility or time served; provided, however, that an employment contract or employer policy shall not provide for forfeiture of vested vacation time upon termination. The Labor Commissioner or a designated representative, in the resolution of any dispute with regard to vested vacation time, shall apply the principles of equity and fairness.”

Send Out Requests

One suggestion is to send out requests around the first of the year, giving the employees two choices of dates and make it clear that in any case of conflict, seniority or any non-discriminatory method will be used to determine who gets their preference. Also make it clear that company needs will prevail.

If an employee fails to respond, the company has the right to assign vacation dates. Managing vacation programs in this manner will help to alleviate end-of-the-year problems and high vacation balances.

Exempt employees can be required only to take vacation in full week increments. The State Labor Commissioner takes the position that exempt employees should be given at least 90 days notice of mandatory vacation. Exempt employees can voluntarily take vacation for shorter periods without notice with employer approval, however.

Exemptions

Employees may have been scheduled for vacation, but events occur such as Pregnancy Disability Leave, Family Medical Leave Act, California Family Rights Act and Paid Family Leave. Depending on the timing, this could affect vacation schedules. These acts have to be complied with. Chapter 17 in the 2010 California Labor Law Digest from the California Chamber of Commerce covers vacations, holidays and paid time off. This information is also online at HRCalifornia.com.

State Compensation Insurance Fund For nearly every activity in construction, there’s a tool designed to do the job. Using the right tool makes it easier and safer for you to do each job. Unfortunately, many workers routinely use tools and don’t consider them dangerous, so accidents continue to happen. The greatest hazards posed by tools are from misuse and improper maintenance. It’s up to you to select the right tool for the job, use it the way it was designed, and care for it properly. A well-designed tool is easy to identify. It has just the right grip, proper weight and balance, proper fittings, dimensions, and size. There’s also a right way to use each tool which may require you to apply certain movements or pressure and specific angles or slants for the tool to perform most efficiently. If the tool is sharp, heavy or if it could generate any flying objects, proper personal protective equipment should be worn such as hand, eye or face, and foot protection. Also, when using a tool it important to be aware of workers around you, so an accident doesn’t injure them. When using any type of tool, there are some general safety practices to follow.

• Select the right tool for the job. • Inspect the tool for defects before and after use. • Keep tool guards in place. • Replace or repair broken tools and parts. • Keep tools in good condition and properly stored.

Although there are many different kinds of hand tools used in construction, here are safety tips for some of the most common tools used:

• Hammers - Use the hammer designed for the job. Use a claw hammer for carpentry work and a machinist’s hammer for machine work. Keep in mind that sledge hammers and mauls require plenty of clearance room around you, so always look behind you before beginning a back swing.

• Wrenches - When using a wrench, it’s usually safer to pull it rather than push it. When pulling down on a wrench from overhead, stand to one side so you won’t get hit or hurt if it slips coming down. If pushing the wrench is necessary, do it with an open palm. If you’re using an adjustable wrench, exert pressure toward the movable jaw. It’s safer for you to avoid using pipe extensions. It’s better to use the proper size wrench instead. Never hammer on a wrench. It could cause it to break unexpectedly.

• Saws - Keep your saw sharp and free of rust. A sharp, clean saw is less likely to bind or jump.

• Files - Never use a file without a handle. Because a file is brittle it can easily break, so don’t use a file as a pry. It’s not worth the accident risk.

•Pry bars - Make sure your feet and body are well balanced before exerting full force on the bar. Good balance can prevent you from falling and injuring yourself if the pry should slip. Whenever you’re not familiar with a tool, ask your supervisor to show you how to use it correctly. If you don’t have the right tool for a job, wait until you can get one. Improvisation may be fine for a comedian’s work but not for safe construction work.
