One of the few trump cards that Canada holds in its trading relationship with the U.S. is oil and gas. If the sale of Terasen Gas to Houston based Kinder Morgan is allowed to go through we will be handing over our strategic advantage to the Americans. No other country in the world would be so foolish to allow this to happen.This deal will increase U.S. energy security at the expense of our own. Terasen which at one time was a public utility was privatized in 1988 by Bill Vander Zalm's Social Credit gov't, there were restrictions placed on it. Foreign investment couldn't exceed 20%,the head office would remain in B.C. and the company couldn't be sold or merged. In 2003 Gordon Campbell and his gov't removed these provisions leaving Terasen vulnerable to takeover. This sale must be stopped, the volatility that we are now experiencing in the oil and gas markets is just the tip of the iceberg as demand continues to outstrip a supply that has now peaked. Proponents of this deal will say Terasen's 875,000 customers will be protected by the B.C. Utilities Commission. As Rafe Mair has pointed out the BCUC has no power to order Kinder Morgan to increase pipeline capacity to domestic users or to upgrade infrastructure. Under NAFTA Canada foolishly committed itself to export 58% its oil and gas to the U.S., this applies even during times of shortages. Mexico wisely refused to sign on to this part of NAFTA. It is time for Canadians to stand up and say enough is enough and there is no better place to do it than by stopping the sale of Terasen Gas to Kinder Morgan. Dear Sir/Madam, I am writing in order to share my deepest concern regarding the sale of Terasen Inc. to Kinder Morgan Inc., which you will soon be asked to approve. Since the implementation of the Canada-U.S. Free Trade Agreement, I have witnessed the increasing loss of control over the country’s energy resources and its infrastructures. From the elimination of the 25-year contingency reserve provision, to the implementation of the proportional sharing provision, most of Canada’s energy decisions have resulted in our country losing sovereignty over our resources. This sale will undoubtedly rob B.C. communities of the power to influence future energy decisions in the province. It will also reinforce the view that Canadians are, in effect, becoming tenants in their own land. And already Terasen is asking for a 13% increase in rates... what will Kinder Morgan be asking and will B.C. residents have any control over their actions? I urge you to prevent this deal by refusing to ratify it until such time as an exhaustive evaluation of Canada’s energy situation is completed and provincial – and national – energy strategies are drafted and adopted. As the U.S. Administration is keen to highlight, control of energy resources will be the struggle of the future. I am one of the fools that was talked into switching from the heating system I had to B.C natural gas to heat my home here in Powell River. I was told of coarse was that if I would switch to Natural gas it would be far less expensive and so much more efficient. So good for the environment etc. It wasn't that long after I did switch that I found out that everything said to convince me was not true at all. Only a sales pitch. Then B.C. Gas was privatized and sold to Treason Gas. I was stunned with the news of this sale. To top that off we the tax-payers paid through the nose for pipelines. But this! I just cannot wrap my head around the news that Treason Gas is being sold to Kinder Morgan an American company. This company is now being run by ex-Enron top executives! Why on earth would an outrageous decision like this even be considered. To give away another precious resource to American big business. Haven't they heard about this American company's record on the environment. Or really how much in American big business the almighty dollar rates over their own people? How could giving away this CANADIAN RESOURCE be in any stretch of the imagination be good for British Columbians? Why? Especially the way world's fuel prices are going. Rate increases for Terasen Gas already in the news! Geographically because of where we are on the map we all know that the people in B.C need heating fuel more than the people in California. We all know with this sale that fact will not matter. I can barely breath I am so horrified. PLEASE I URGE YOU do not go through with this sale. I am dismayed that such a proposal could even get this far and urge the commission to have the wisdom to stop the sale and keep control of this vital energy resource in the hands of Canadians, where it belongs.

As the softwood debaucle has shown, no one in Canada can count on NAFTA , or even the WTO for fairness when it comes to US interests.

Keep Canada Canadian, we already give the americans too much. Why would we we sell a natural resorce? Why feed the american war machine? They just want to conquer and dictate, meanwhile publically claiming democracy. Don't feed the american war machine. Regardless of ideals religious or political, the americans are hated around the world for a reason. Keep Canada seperate we are peacefull and loved around the world. Don't help the americans kill men,women, and children in other countries, by fueling their vehicals of war. Not to mention that we would have to buy our fuel from them at a price that they would dictate. We do what we must to keep them quiet and outside our borders. Don't sell Canada to them there is not enough money on the planet. If income is needed in BC lets go to the american courts or the world court if need be and get back to logging. Or what if we raise the price of power going to feed the american cities, or raise border taxes in our favor for a change. My point and request as a Canadian and a British Columbian is simply that there has to be a better way to generate income then selling our natural resorces.     Dear secretary of the BC Utilities Commission, I want to express my opposition to the proposed purchase of Terasen (our BC gas company) by Kinder Morgan, a U.S. company. This company is mainly interested in having the pipe lines from our Canadian gas fields, so that they can control the flow of natural gas to their markets. Terasen, or formerly BC Gas was established to provide natural gas to the homes and businesses within BC and to export our surplus to other markets. I believe that the new owners will not care whether we have a surplus, but will take what they can get, once they own the pipelines. He did the same with the (not so famous) energy company. He took the pipelines and then distanced himself from the remaining hollow shell of a bankrupt company. Already today we heard the news that Terasen is asking for approval of a major increase in our gas prices. It is not my custom to send copies to many people, but this is a serious matter and I ask my friends and relatives to voice their opposition. I would like to make you aware of my opinion regarding the proposed sale of Terasen Gas to an American company. I am totally opposed to such a sale. It seems that we in Canada have a lemming-like propensity towards disaster in regards to our natural resourses. Every interaction with the might of US corporations is fraught with danger and their recent and ongoing dishonesty with Canada in several key economic areas should serve as ample warning to anyone paying attention. It seems to me to be unconscionable that we should consider allowing American interests to have the control on quantity and costs to Canadian residents of natural gas from our own land. Please,- please- dont fool yourselves into thinking that down the line the BCUC will still have the power to control anything. Is recent history teaching us nothing? Dear Mr. Pallat, Secretary of B.C. Utilities Commission: I have major concerns with Canadian owned Terasen Gas (previously BC Gas), which delivers natural gas to about 875,000 homes and businesses in B.C. being sold to Kinder Morgan Inc. an American Company from Texas. According to Kinder Morgan’s chair and CEO Richard Kinder his company's main motive for the $6.9-billion take-over of Terasen Inc. (assets only worth $5 billion) is for its ownership of the pipeline links to the Alberta oil sands. The future plans are to expand the pipelines to the west coast and eventually ship crude oil to Asia from BC ports. Imagine having pipelines traversing BC, as well as our natural resources under the control of an American Company from Houston, Texas. The same company, that has a very poor safety record, has had problems being honest with regulatory agencies that govern the price of natural gas and was a major supporter of the Bush presidential campaign. Just two weeks ago (August 25, 2005) in what is being called one of the largest regulatory actions undertaken by the U.S. Department of Transportation's Pipeline and Hazardous Materials Safety Administration, Kinder Morgan was ordered to address a recent increase in accidents along its entire 3,900-mile Pacific Operations unit. The order requires restructuring of its inspection program, a third-party independent review of its operations and procedural practices and a thorough analysis of recent incidents, including one that killed five people. The federal order requires Kinder Morgan to come up with a plan within 120 days to deal with "integrity threats" to its western operations or face fines of up to $100,000 per day. The Transportation Department said that Kinder Morgan has experienced 44 pipeline accidents in its West Coast operations since January 2003. (Houston Chronicle, Aug. 26, 2005, The Business Journal (Phoenix), Aug. 26, 2005)

We have to consider that fines, penalties and clean-ups can never compensate for damage done to the environment and the health of people. While profits will go south, British Columbians will pay the price of any environmental damage.

Even though any price hikes in natural gas will have to be approved by the BC Utility Commission, Kinder Morgan has had problems with regulatory agencies that control the price of natural gas in the States.

Only a year ago (December 30, 2004) the Wyoming State’s Office of Consumer Advocate challenged rate increases of Kinder Morgan Inc. to its natural gas customers in Wyoming. It seems that even though the Wyoming Public Service Commission had earlier approved the rate hike (5-14%), Denise Parrish, Deputy administrator of the Office of Consumer Advocate issued a news release saying “Based upon our review of the rate increase applications, we determined that they are not in general compliance with the commission's rules governing wholesale commodity cost pass-on procedures. Further, the applications are not in compliance with the company's own tariff provisions." She went on to say that Kinder Morgan Inc. failed to provide the required financial information and other documentation demonstrating that the recently approved increases were just and reasonable, and that this has been an ongoing problem with Kinder Morgan. (Billings Gazette, January 2, 2005)

Earlier on November 27, 2004, Kinder Morgan Inc. was not cooperating with state regulators to determine if the utility was exceeding its authorized rate of return. Bryce Freeman, administrator of the Office of Consumer Advocate stated "We have hit the wall on this case." Freeman, in a news release, said the Kinder Morgan has stymied efforts to review its records by "in some cases, refusing to answer our questions, and in other cases by delaying their responses, effectively limiting our ability to properly analyze the data." (Billings Gazette, November 27,2004)

More recently a complaint filed by the state Office of Consumer Advocate accused Kinder Morgan of unlawful, deceptive and misleading advertising. It should be noted that in Wyoming customers can choose their gas suppliers each year so advertising by the gas companies is important. (Billings Gazette, May 1 & 27, 2005)

Kinder Morgan was formed by Richard Kinder and Bill Morgan, both former executives of the infamous energy giant Enron Corporation. Richard Kinder was the president of Enron until 1997.

The sale of Terasen Gas to Kinder Morgan Inc. shoould not be approved. It would be a breach of the public's trust to give approval to the sale.

RE : sale of BC Owned Terasen Gas to American company Kinder Morgan Inc. Once the American's own this resource we will have to buy it back from them and at what price. Just think about it for a minute here !!!!! They will own our natural resource. This action would further undermine Canadian Sovereignty ; similarily I refer you to the following website ( http://www.canadians.org/ ) which you should visit and which should also include issues :::: RE : sale of BC Owned Terasen Gas to American company Kinder Morgan Inc. as that will pave the way for other provinces to sell off our resources to the Americans::: T Bilash - a Canadian !!!

Dear Secretary--- I am writing with grave concerns over the proposed sale of Terasen gas to the American company, Kinder Morgan. What are we thinking to even be considering such a proposal??? Have we not learned anything about the U.S. from the softwood lumber fiasco or the mad cow crisis? They care nothing about Canadian interests and I'm sure they are just rubbing their hands in glee over this deal--taking over OUR pipelines and thus ensuring that these pipelines take OUR natural gas to the Americans. I have no problem with us selling some of our natural gas to the U.S., but this deal is like leaving the fox to guard the hen house- totally outrageous!! Please do not allow this deal to go through. If you allow this deal to proceed, and you live in BC, then you'd better be stockpiling lots of cash to pay your natural gas bills in the future. If you think that the U.S. will deal fairly with us, you're deluding yourself- They are already entitled to 58% of our natural gas through the NAFTA agreement--and we have seen, of late, that NAFTA regulations mean nothing to them--they will not stop at 58% if they need more. Please be the voice of reason for Canadians in BC--and do not sell out the natural gas rights for us and our children. Please do the right thing and do not let Terasen give in to greed. Dear Sirs: Just when Natural Gas shortages are making themselves apparent, and the cost of energy is heading for all time records - we are GIVING UP A VITAL CANADIAN resource to AN AMERICAN COMPANY. This company has DREADFUL record - and we will be killing British Columbia's economic prospects by giving Americans control of this VITAL resource. America has shown its willingness to cheat Canadians - ie. The Softwood Lumber dispute and other irritants. Why should we trust these people? The excuse that they have so many interests - that a few environmental 'mistakes' are just the cost of doing business. That's fantastic! This is a BAD deal - and it makes us second in line for OUR OWN FUEL!!!! The Americans don't care that YOUR MOTHER gets cold...they want the MONEY and they think they can fool those "rubes" in Canada to give it to them on a Silver Platter. [We have seen what MAXIMUS has done for our BC Health records - I could go on for weeks.] PLEASE - I am BEGGING. Canada FIRST - American CARPETBAGGERS LAST. Sirs: I do not want to see the sale of Terasen Gas to a foreign corporation. Obviously a natural monopoly such as the gas distribution system should not be in foreign hands. Kinder Morgan will clearly want to make a profit and recoup the large purchase price so they will adjust their books to show higher costs so as to be able to justify a rate increase for distribution. The profits will flow out of BC. Kinder Morgan also has a poor environmental record.
