Executive Summary

The Tribunal Supremo Electoral (TSE) invited the International Foundation for Election Systems (lFES) to observe the November 26, 1995 referendum. Mr. Patricio F. Gajardo, IFES Program Officer for the Americas & Caribbean, was assigned to travel to Ecuador to observe this electoral process. The observation of this referendum provided IFES with valuable information on the present political reality of the country and of the electoral system, where IFES expects to work in the future.

IFES was authorized by the United States Agency for International Development (USAlD) in Washington, DC to observe the November 1995 referendum. The Project Officer assigned to observe these elections met with different key participants in the electoral process, such as election officials, representatives of political parties, and leaders of civic groups.

TIlls report will focus on the country's political reality, the activities developed and accomplished during the five-day visit, and on the future project activities that are needed to be done in preparation for the May 19, 1996 general elections and for a possible second-round schedule for July 7, 1996. TIlls report will also analyze different possibilities of working in Ecuador after the May elections.

IFES recommends that USAID consider assistance in the following areas:

Civic Education Campaigns

The TSE will assume the responsibility of organizing the electoral process, to look after its normal execution, and to guarantee the popular will. One of the main areas of work the TSE will focus on is in the preparation of a strong civic education campaign throughout the country. Due to the new legal reforms approved in a plebiscite in 1994 (e.i. Participation of independent candidates in all public posts) and the reform adopted by the TSE in renovating all Provincial Tribunals, the need for a strong civic education campaign is essential. IFES recommends to support these important endeavors by providing the TSE with technical civic education assistance along with the creation of electoral materials.

Civil and Electoral Registries

During the five-day observation mission, the IFES Program Officer met with various election and political authorities who stressed the urgent need of assistance in specific matters like depuration of the electoral registry. The lack of communication between the Civil Registry and the TSE is the main problem to solve in the near future, so that future voters' list can be brought up to date and modernized at the same time.

I. Introduction

On March of 1994, the government of Duran-Ball en announced plans for an eight-part plebiscite that included provisions for presidential reelection, compulsory voting, creation of an upper legislative chamber, and four-year terms for all representatives. However, the TSE called the proposal "illegal and impractical". The TSE also rejected a calion June 10, 1994 for a July plebiscite on formation of a constituent assembly to consider the proposals. Subsequently, a plebiscite was held on August 28. Somewhat unexpectedly, an unusually low turnout of voters approved most of the package, including a limitation on congressional power to determine public spending, authorization for nonparty candidates to stand for elective posts (independent representation), and reelection of elected officials, including the president. All of this led to another public consultation that took place November 26, 1995.

Ecuador is a divided country in many ways. The traditional rivalry between Quito (Sierra 0

mountain region) and Guayaquil (Guayas or coastal region) is a constant feature of the Ecuadorean political system. Another is the socio-economic division between the indigenous sector, comprising roughly half the population, and the small rich elite.

The referendum was also a reflection of the division within Ecuador. On the YES side, the principal rallying cry was for modernization and privatization of the country, while NO supporters focused on the exploitation of the poor and indigenous population by the rich elite as a result of the neo­liberal economic model being used with increasing frequency in Latin America. With the government of President Duran-Ballen campaigning strongly on the YES side and the opposition on the NO side, it soon became unclear whether voters were voicing support for or opposition to the referendum questions or the government.

Early in 1995, at the height of the Ecuador-Peru border conflict, the Duran-Ballen government achieved an 80 percent approval rating, its highest level of popularity, despite difficult economic conditions. Within a few months, however, corruption and bribery charges against Vice President Alberto Dahik and investigations into possible misuse of secret government accounts carried the government's approval rating to its lowest level. In the end, this was a significant factor in all eleven proposals being defeated during the referendum.

II. Observation Day

On Election Day, the TSE invited all international observers to join government and armed forces representatives at the opening ceremonies scheduled for 6:30 a.m. at the TSE's headquarters. At 8:30 a.m., Lic. Rodrigo Villacreces, a member of the TSE, and Mr. Patricio F. Gajardo, IFES Program Officer, left the TSE office heading south of Quito to Cotopaxi and the Tungurahua provinces, where Mr. Villacreces cast his vote. The observation lasted all day stopping in various places (Latacunga, Saguilisi, Ambato, San Miguel de Salcedo, San Bartolome de Pinllo, Salasaca, Pelileo, and Banos) to observe how the process was proceeding during the day. In Ambato, the president of the Provincial Tribunal ofTungurahua, Dr. Mario Pefia, was waiting and escorted Lic. Villacreces to the polling site where he voted.

According to the Ecuadorean Electoral Law, the three poll workers (president, Secretary, and Third Member) assigned to each polling table should open the voting process at 7 a.m. Political parties can send one representative per polling table to observe the voting procedure. The only people who are able to vote are Ecuadorean citizens who are 18 years or older, who are on the voting list, and have their original Identification Card. The closing of the polls is at 5 p.m.

The basic steps to be done by a voter when he/she arrives at the polling station are:

I. The voter shows hislher Identification Card and if it appears on the voters' list, he/she will be able to vote. 2. The voter receives the ballot from one of the three poll workers. 3. The voter secretly votes and deposits hislher ballot in the ballot box. 4. The voter returns to the polling table and signs by hislher name. If the voter is illiterate, he/she put a finger print on the side of his/her name. 5. One of the poll workers returns the Identification Card to the voter.

Among the observations made during the day-long electoral process, one of the most impressing was the voting of the indigenous community of Salasaca There, hundreds of people dressed in uniform­like outfits (black ponchos and white pants for the men and red or black dresses for the women). They looked very shy, but they were in charge of all the procedures at the polling stations.

Another observation made during the day was the absenteeism (between 30 and 35 percent) that some localities experienced, though this may be more a symptom of problems with the voters' list. Also, some voters may have been confused by recent changes in polling division boundaries in order to accommodate the growth in the electorate. In addition to this, the TSE president, Dr. Carlos Pardo, was quoted in El Universo (November 28, 1995) as saying that 97,000 people have not been eliminated from the voters' list due to a lack of information and coordination from the Civil Registry. Also, there are 1,500,000 Ecuadoreans outside the country who are still part of the Electoral Registry. These factors "inflate" the voters' list, making the absenteeism rate seem higher.

III. Ballot Questions

Some of the questions included in the II-question YES-NO ballot were:

Decentralization

Should the State gradually transfer resources to the provincial governments, especially in areas like education, health, housing, roads, and environment, to guarantee an effective administrative and financial decentralization?

Right to Choose a Social Security System

Should every person have the right to choose between the state-run Ecuadorean Social Security Institute and other public and private systems?

Equitable Distribution of Resources Between Provinces

Should the national budget be distributed and developed by each province, taking into account national priorities, population, and each province's development needs, with a focus on education, health, roads, housing, environment, and internal security?

Prohibition to Paralyze Public Services

Should it be illegal, even in the case of strikes, to paralyze health, education, transportation, water, electricity, fuel, telecommunication services, and the administration of justice?

Dissolution ofthe National Congress

Should the President of the Republic have the power, only once during hislher term, to dissolve the National Congress and simultaneously convoke early elections of deputies, which must take place within 60 days following the dissolution, with the outgoing Congress designating a Legislative Committee to legislate until the elections of the new Congress, whose members will serve until the end of the presidential term?

Election of At-Large and Single-Member-District Deputies Every Four Years

Should the Congress consist of one representative from each electoral district, with those districts established in each province on the basis of population, and one or two at-large representatives from each province, all on the basis of absolute majority of votes, with a term of four years, end eligible for reelection? .

Should the President and Vice President of the Congress be elected by secret ballot and majority vote every two years by the members of Congress?

Terms for Incorporation ofthe Laws Approved by Popular Vote

Should the Congress make the results of the referendum effective within 90 days of the proclamation of the results?

The other three questions dealt with the election of the Supreme Court justices by a National Judiciary Council and other judicial reform proposals, the elimination of privileges in the public sector, and the establishment of a constitutional tribunal. Question nine alone was over 600 words long and frequently cited existing legislation without providing the full text on it, thus highlighting the importance of extensive voter education prior to such a referendum.

IV. Conclusion

Ecuadoreans will go to the polls again on May 19, 1996 for general elections. Among the changes in those elections will be the participation of independent candidates in the process. To gain ballot access at the provincial or local level, independents will need to petition support from four percent of the registered voters of the jurisdiction and province. At the presidential level, independent candidates will need to gather signatures from four percent of the registered electorate in at least 10 provinces, including two of the most populous. The TSE will assign registered candidates a sequential number, which will be used throughout the political campaign and printed on the ballot.

The main objective of the IFES presence in Ecuador was to analyze the present electoral system and to explore possibilities of future technical assistance in preparation for the May 1996 general elections. Based on the observation done during the five-day visit, the TSE is well organized in the production of electoral materials and logistics. The armed forces and national police provided strong support (very traditional task in the majority of Latin American countries) in transporting the election material and safeguarding the cleanliness of the process.

On the other hand, the civic education campaign done by the TSE was rather weak and did not provide sufficient information to explain the II-question referendum. This caused confusion in the majority of the population. Political parties used this confusion to their own advantage sometimes changing the real meaning of the questions. Another problem related to the poor civic education campaign was the high absenteeism, especially in rural places. This can also be explained by the lack of confidence in the political system of the country.

The short-term assistance that IFES would like to provide to the TSE is in the area of voter and civic education. There is a very limited time-frame to develop and prepare a good civic education campaign. The Ecuadorean electorate needs abundant information on the participation, for the first time in their electoral history, of independent candidates. The population will have to be familiarize with the new names, symbols, and numbers that will identify the new candidates in each jurisdiction, province, and nationally. IFES will assist the TSE's Electoral Training Program (ETP) by training the new provincial electoral officials and the poll workers nationwide.

The ETP has the following objectives:

a) To advise the TSE in the execution of a training campaign for electoral officials from the Provincial Tribunals and poll workers, in order to provide correct ways of managing the electoral process.

b) To collaborate with the TSE's Training Commission in the creation of a Training Unit.

c) To formulate a specific and detailed work plan focused on training election officials, applying specific and concrete tasks needed to perform before, during, and after the electoral process.

d) To prepare and train Electoral Instructors, who will be training poll workers nationwide, on specific norm procedures based on the Constitution and Electoral Law.

e) To train poll workers so that they can be familiarized with all the documents and materials used on election day (e.i. ballot box, ballots, tally sheets, etc.). This training program will be beneficial for the process because they will be able to know the correct procedures for completing all the tasks.

The main long-term activity that IFES pretends to focus on is in the Civil and Electoral registries. Voters' lists need to be completely renewed and depurated after the May general elections. Dr. Guillermo Estrella, TSE Vice President; Dr. Carlos Larreategui, Secretary General of Public Administration; and other TSE and political party members, expressed the urgent necessity of assisting the Civil and Electoral registries. IFES is interested in giving special attention to this area and can start assisting the TSE on this matter after the May 19, 1996 general elections.
