This eight-week program has been providing basic business education since 2008 and has had over 100 participants complete the academy program. Hot off the Presses! U.S. Dis-trict Judge Amos Mazzant is-sued a preliminary injunction on November 22 to block the U.S. Department of Labor from en-forcing costly and overreaching changes to the FLSA Overtime Rule. The new regulations are be-ing challenged in federal court in a case filed by 21 states and consolidated with a lawsuit filed by a coalition of Chambers, national business organizations and led by the U.S. Chamber of Commerce. Changes to the rule were to take effect Decem-ber 1. We will continue to follow this and share any updates we receive. Meanwhile, businesses can remain following the existing FSLA rules and regulations.

The passage of Proposition 206, the minimum wage increase/paid sick time law, will still go into effect onJanuary 1. We are fortunate to have members with expertise to break the verbiage down to an understandable narrative. Included in this news magazine is a summary of Prop 206 prepared by Laura Hamblin, Attorney and Human Resources Consultant. I would recommend you keep copy of this documents as a re-source to help you navigate the changes that are coming.

Thank you to everyone for a great Flying High Turkey Drive. I can say that I am very happy that the rain passed us by and we only had to deal with a little wind and cold. The weather did not dampen our spirits as a community came to-gether for the 13th annual Flying High Turkey Drive. We joined forces to collect turkeys for Thanksgiving dinner baskets for the less fortunate in our communities at our local Fry’s stores on Nov. 21. A total of 1299 turkeys were collected which included $2,906.77 collected to purchase turkeys and 6,825 lbs. of other food fixings were received.A huge thank you to Fry’s, the National Wild Turkey Federation-Yavapai Yelpers, Yavapai Broadcasting, Central Ari-zona Fire and Medical Authority, Prescott Valley Police Department, the Prescott Valley Ambassadors, Yavapai Food Bank, PV Chamber Board Members, Prescott Valley and Prescott Chambers, Prescott Area Young Professionals, Prescott Fire Depart-ment, Prescott Newspapers Inc, and our very own Turkey Mascot Matt Zurcher.

Summary* of 2016 Arizona Minimum Wage & Paid Sick Time Law

1/1/2017—Increases to $10.00 1/1/2018—Increases to $10.50 1/1/2019—Increases to $11.00 1/1/2020—Increases to $12.00 Tipped employee rate will remain $3.00 less than

regular minimum wage.

Arizona Mandatory Paid Sick Time Effective Date: 7/1/2017

Basic Requirements:• Employers with 15+ employees—employees accrue

up to 40 hours of sick pay annually.• Employers with 1 to 14 employees—employees

accrue up to 24 hours of sick pay annually.• Rate of accrual—1 hour of sick pay for every 30

hours worked beginning with first day worked; exempt employees are assumed to work 40 hours a week.

• Employers can require employees to wait 90 days after hire to use sick pay.

• Time off may be taken in the smaller of hour increments or increments that the payroll system uses to account for time off.

Employers: The law applies to all employers, except state and federal government, and “small employers”—those with annual revenue less than $500,000 and not engaged in interstate commerce (very few employers meet this test).

Employees: The law covers all employees; except babysitters and those working for a parent or sibling. There is no minimum hours worked requirement.

SAFETY FIRST - Distracted WalkingIncreasingly, people who text while they are walking

or who are playing games, listening to music or reading on their mobile devices are falling down stairs, tripping over curbs or stepping into traffic, according to recent reports.

Published articles regarding distracted walking has prompted an awareness campaign that was launched by the American Academy of Orthopedic Surgeons.

A year ago, market research company Ipsos conducted a national survey that asked participants their perceptions of distracted walking. Nearly 40% said they had witnessed a distracted walking incident, and 26% said theyʼve been in an incident themselves.

Emergency-room hospital visits for injuries involving distracted pedestrians on cellphones more than doubled between 2004 and 2010.

But while 76% of U.S. adults believe distracted walking is a “serious” issue, most place the blame on others. Some 74% of Americans say “other people” are usually or always walking while distracted, while only 29% say the same about themselves.

Because distracted walking has become a real thing,

some insurance carriers are suggesting that employers create formal policies to address distracted walking as part of a policy on the appropriate use of personal devices in the workplace.

Federal Court Blocks Department of Labor Rule Increasing Minimum Salary LevelFor Prescott Valley Chamber of Commerce, by Laura Hamblin, JD, SPHR (928-308-8394) 11/28/2016

Last week, a federal judge in Texas put the brakes on the Department of Laborʼs (DOL̓ s) new federal overtime rule, which would have more than doubled the minimum salary level for exemption from overtime pay to $47,476 per year and would have automatically adjusted it every three years beginning in 2020. The rule was supposed to go into effect December 1, 2016. The current minimum salary level of $23,660 ($455 week) will stay in place until the issue is resolved.

So, whatʼs an employer to do?At this time, employers do not need to implement

changes by the December 1, 2016 deadline. As the le-gal process unfolds, the court could allow the rule to go forward, it could be blocked permanently or revised by the legislature or incoming administration. Be aware, there is a risk that the rule could be applied retroac-tively to 12/1/2016.

Employers who have already complied with the rule might want to consider leaving their decisions in place. As a practical matter, it might create significant morale problems if employers withhold salary increases after communicating them to employees. In that case, itʼs probably best to proceed. But, if employees were go-ing to be changed from salaried to hourly-paid without otherwise affecting their net pay, employers should weigh the pros and cons of proceeding with the change or sticking with their current pay practice. Of course, be sure to promptly communicate any changes and the reason for the changes to the employees.
