It is to submit that Environmental clearance of the project for upgradation and widening of the existing 2 lane to 4 lane of Panikoili - Rimuli Section (Connecting existing Chainage between Km.O.OOO to Km.163.000) having a designed length of 166.173 Km. was accorded by Ministry of Environment & Forest vide their notification No.S-20/2007-IA-1I1 dt. 16.05.2007. 2. This office vide letter dt.09.03.2012 has applied for extension of environmental clearance as per EIA notification 2006 for further period of 5 years. 3. Further, again this office vide letter NO.6074 dt. 29.04.2014 applied for : extension of Environmental Clearance giving full justification for delay in start of the project. 4. EAC in its meeting held on 19.05.2014 considered the project. However, the request of NHAI was not agreed and the Environmental Clearances was not extended. . .. 5. This office again vide letter NO.6277 dt. 18.07.2014 applied for extension for further period of 5 years. 1. It is to submit that Environmental clearance of the project for upgradation andwidening of the existing 2 lane to 4 lane of Panikoili - Rimuli Section(Connecting existing Chainage between Km.O.OOO to Km.163.000) having adesigned length of 166.173 Km. was accorded by Ministry of Environment &Forest vide their notification No.S-20/2007-IA-1I1 dt. 16.05.2007.

2. This office vide letter dt.09.03.2012 has applied for extension of environmentalclearance as per EIA notification 2006 for further period of 5 years.

3. Further, again this office vide letter NO.6074 dt. 29.04.2014 applied for :extension of Environmental Clearance giving full justification for delay in startof the project.

G. Physical Progress of StructureH.

(b) The project was delayed due to land acquisition, approval of GADs by RailwayAuthorities and Diversion of Forest land for 151.94 Ha.

(c) The project work commenced w.e.f. 02.05.2013 with the scheduled date ofcompletion as on 29.10.2015, as per the provision of Concession Agreement.However, owing to delay in Forest clearance (Diversion of 151.94 Ha ofProtected / Reserve forest). the progress of project work is not as per therequirement. The proposal has been recommended by FAC on dt. 13.02.2014.

(d) With a lot of difficulties the project construction activities is being implementedby the Concessionaire of the National Highways Authority of India in LWE areasof the State of Odisha.

(e) State Pollution Control Board, Odisha has extended the validity period ofconsent to Establish vide his order of office Memorandum NO.20158 Ind-II-NOC-4465 dt. 04.11.2013 for a period of five years i.e. till 24.11.2016 for theaforesaid project.

(f) As per Stage - I Forest Clearance received vide MoEF file No.8-01/2014-FC dt.06.05.2014, condition (vii) the user agency shall obtain Environment Clearanceas per Environment Protection Act 1986 & for compliance of Stage - IClearance, Regional Officer, MoEF is insistinq on extension of Environment·Clearance before the submission of compliance to Stage - I Clearance.

As per MOEF Gazette Notification, the EIA has been prepared based on the EIAnotification 1994 as amended on 10.04.1997. As per the said notification, publichearing is not required for liner project.

In view of above, as Environment clearance has been granted for the projectvide Notification No. No.5-20/2007-IA-11I dt. 16.05.2007 and the work is underprogress, exemption for public hearing may be granted.

The apptication shall be made in the proforma specified in Schedule-II of thisnotification and shall be accompanied by a project report which shall, interalia. include an Environmental Impact Assessment Report. EnvironmentManagement Plan and details of public hearing as specified in Schedule-IVprepared in accordance with the guidelines issued by the Central Governmentin the Ministry of Environment and Forests from time to time. (a) The reports submitted with the application shall be evaluated andassessed by the Impact Assessment Agency, and if deemednecessary it may consult a committee of Experts, having a compositionas specified in Schedule-III of this Notification, The Impact AssessmentAgency (IAA) would be the Union Ministry of Environment and Forests.The Committee of Experts mentioned above shall be constituted by theImpact Assessment Agency or such other body under the CentralGovernment authorised by the Impact Assessment Agency in thisregard,

(b) The said Committee of Experts shall have full right of entryand inspection of the site or, as the case may be, factory premises atany time prior to, during or after the commencement of the operationsrelating to the project
