Ms. Nerison observes that it’s easy to go through life feeling as if you and your work are insignificant in the grand scheme of things. However, I suspect you are largely unconscious of the effect you have on those around you. The root of the word litigation means “to carry on strife.” If you litigate, you encounter in the course of a case many “choice points.” One choice may be between complicating matters (creating more work for yourself or the opposing party) and resolving a problem (satisfying both parties’ needs as efficiently as possible). Another choice may be between behaving with dignity or hollering at clients, staff, and opposing counsel. Your choices have a profound influence on costs, stress levels, and how calm or angry people feel at the end of any given day. Consider your staff, if you have one. To what extent do your employees feel respected and valued? How do you provide opportunities for them to improve their skills? What will they remember about the years they’ve spent working in your office? If they left today, how would they describe you as a boss? As a person? Consider your clients. How would they describe you? How do you demonstrate that you have their best interests at heart and that you work diligently on matters they’ve entrusted to you? How often do you remember how vulnerable they feel and, in fact, are? To what extent do you demonstrate pa- tience, return their calls, keep them informed, and treat them with kindness and respect? From the courthouse clerk to your spouse, you are enormously powerful in the lives you touch each day. Your attitudes and behavior create an atmosphere. You make choices about the use of your pow- er each time you open your mouth or write a sentence. Everything you do makes a difference to some- one. You can use your power for good or for ill. You can make the world a better place by conducting yourself in ways that enhance the lives of those around you. This isn’t idealism—it’s reality. However, you can’t give what you don’t have. You will pass along exactly who and what you are with each interaction. You can create health, prosperity, and security for others only if you possess them yourself. I believe that you really can be a happy, decent, and successful lawyer despite the systemic and per- sonal obstacles you may encounter. By attending to your own health, business acumen, purpose, and people skills, you will make the world a better place. I encourage you to take advantage of the many resources available to you. You’ll have no regrets.

PBA PUBLIC UTILITY LAW SECTION HONORS HERBERT R. NURICK

The PBA Public Utility Law Section recently honored Herb Nurick with the Christianson Award at their annual Bench Bar Conference on May 30. Herb became the first mediation coordinator for the PUC 1n 1996 and significantly expanded the use of mediation at the PUC after retiring from private practice with the firm of McNees Wallace & Nu-rick. He has served in numerous leadership roles at the PBA and DCBA, was active with continuing legal education at PBI, a member of the Board of Overseers for Widener Law and very involved in the Harrisburg community. In 2011 Herb received the Sir Francis Bacon Award from the PBA ADR com-mittee. We offer our congratulations to Herb for this most recent award and also upon his retire-ment. Herb’s last day in the office was July 11th and he is pleased to say that he will now be spending as much time as possible with his wife Donna and growing family. Best wishes from all of us at the DCBA to Herb!

JAMES P. DEANGELO TO BEGIN SERVING AS MID PENN LEGAL SERVICES BOARD PRESIDENT

MidPenn Legal Services is pleased to announce that James P. DeAngelo of McNees Wallace & Nurick will begin serving as President of the Board for MidPenn Legal Services. Jim will serve a term of three years in this role. As Chair of the McNees Litigation Practice group, Jim manages 30 litigators but still finds time to devote to pro bono service. He has been a champion of this cause for many years and had has taken on numerous pro bono cases. While serving as DCBA President in 2010, he made pro bono his platform and worked with the Bar and leadership to in-crease participation in the Bar. Jim has been a dedicated member of the MidPenn Board serving faithfully and taking on positions of Treasurer, Fi-nance Committee Chair and he contributes financially to MidPenn. His list of accomplishments for this cause is long. We congratulate Jim on this new position and are certain he will do an outstanding job.

IMMIGRATION AS A PRO BONO OPTION

ANOTHER PRO BONO OPPORTUNITY - THE PENNSYLVANIA INNOCENCE PROJECT

At the DCBA Pro Bono Program, we promote a variety of pro bono options because we understand that each attorney has unique interests and skills. Here is yet another pro bono opportunity that might interest you. The Pennsylvania Innocence Project (http://www.innocenceprojectpa.org/ or 215-204-4255) is a not-for-profit organization based at Temple Uni-versity Beasley School of Law in Philadelphia. The Innocence Project works to exonerate those convicted of crimes they did not commit and to prevent innocent people from being convicted. The Innocence Project’s mission is to:

1. Secure the exoneration, release from imprisonment, and restoration to society of persons who are innocent and have been wrongly convicted; 2. Provide clinical training and experience to students in the fields of law, journalism, criminal justice, and forensic science; 3. Collaborate with law enforcement agencies and the courts to address systemic causes of wrongful convictions; and 4. Strengthen and improve the effectiveness of the criminal justice system in Pennsylvania through public education and advocacy.

Here in Harrisburg, Justin McShane, of the McShane Firm, LLC, takes time out of his busy schedule to work with the Innocence Project. Justin is currently representing a gentleman who was convicted thirty-five years ago for arson which unfortunately involved a death. His conviction, however, is being re-examined based on the scientific conclusion at trial that the fire was intentionally set. Thirty-five years ago, experts believed that an intentionally-set fire burned much more quickly than an accidental fire. However, more recently, scientists have proved that the earlier conclusion is false and that, depending on circumstances, both intentional and accidental fires burn at the same rate. With that new knowledge and after reviewing the 35-year-old evidence, Justin believes that his client is innocent and deserves a new trial. Justin will continue to fight to get a new trial for his client. Hopefully, thanks to Justin, modern scientific methods will right this wrong. Sarah Pregler, Public Service Intern

ANOTHER PRO BONO OPTION - LAWYERS FOR THE ARTS  Are you interested in helping local artists and arts groups? Are you curious and want to learn more? Please join us September 9, 2014 from Noon to 1 PM for a one-hour CLE “Lawyers for the Arts presents: Legal Issues Facing Artists and Small, For-Profit Arts Organizations’” with Professor Juliet M. Moringiello of the Widener University School of Law and the Widener Institute of Dela-ware Corporate & Business Law, and Liz Laribee, the Director of the MakeSpace in Harrisburg. The interactive and entertaining CLE will be presented at the Dauphin County Bar Association with a luncheon buffet available beginning at 11:30 AM. The CLE will emphasize that artists and arts groups need representation on more than just intellectual property issues like copyrighting their hit song. The presenters hope that attorneys will leave with a better understanding of how representing an artist or arts group is similar to representing any small business. The business law issues facing an artist or arts group may include insurance law, premises liability, real property rights, sales tax, contracting, permitting, and licensing, among others. The interactive CLE will include hypothetical questions and will also be an issue spotter to some extent. Liz Laribee will present hypothetical questions to Professor Moringiello while artistic visuals will depict scenes fraught with legal risks. CLE mate-rials will provide information about case law and statutes controlling the issues artists may face. Even better, the CLE will be FREE to any attorney willing to take a pro bono case for a qualifying artist or arts group. This sure-to-be popular CLE will be recorded for future use.
