Sea AMS is available to carriers (MVOCC, NVOCC), secondary notify parties, port authorites and service centers. Port authorities and service centers can file and receive both manifest and cargo data for multiple carriers calling at multiple ports.

Using a unique bill of lading number, manifest data can be transmitted electronically for all cargo enroute to the United States prior to vessel arrival. This allows Customs an opportunity to review the submitted documentation and determine, in advance, whether the merchandise merits examination or whether to release it immediately upon arrival.

The carrier, upon receiving a provisional release from Customs, is able to make decisions on staging cargo and the importer can arrange for examination, release, and further distribution of the merchandise. All of this can be accomplished before the merchandise actually arrives.

Participation by MVOCC’s in Sea AMS is mandatory, per the implementation of the Trade Act of 2002. (Source)

4.　Automation – NVOCC　Are NVOCCs required to automate?

Answer: NVOCCs may choose to automate. NVOCCs who choose not to automate must give bill-level information to the carrier for transmission to CBP. If a question should arise as to whether or not an NVOCC is automated, the vessel carrier may contact its CBP client representative for verification.

6.　Authorized Transmitting Party

What is an authorized transmitting party?

Answer: Generally, an authorized transmitting party is an entity approved by CBP to transmit cargo declaration data via the Automated Manifest System. However, authorized transmitting parties vary depending on the mode of transport:

Filing by a third partySince the carrier is legally responsible for the lodging of an ENS and that it is lodged within the deadlines, a third party may only lodge the ENS instead of the carrier with the latter's knowledge and consent. Arranging for such an alternative third party ENS filing involves the following steps:

The 3rd party declarant and the carrier must contractually agree that the third party is to file the ENS instead of the carrier.

Once the 3rd party, with the carrier’s knowledge and consent, undertakes the responsibility of making the ENS filing, the content, accuracy and completeness of the ENS filing is the 3rd party’s responsibility.

Person responsibleArticle 36b CC establishes that the operator of the active means of transport on or in which the goods are brought into the customs territory of the Community is responsible for the filing of an ENS. The operator (or “the carrier”) is the person who brings, or who assumes responsibility for the carriage of, the goods into the customs territory of the Community.

F. Third Party Filings

While the CBP may be content at this time to let the various private interests sort out for themselves who will do the actual filing, the entities that may file the electronic cargo manifests are restricted to either the carrier, or a party specifically authorized by CBP. In this regard, one major consideration for vessel owners and operators is that the regulations do not provide any authority for a vessel's agent to file the required forms in its own name, or "as agent" for the carrier. Thus, it is quite clear that CBP will not accept filings directly from ship husbanding or protective agencies. Although such agencies may prepare the data for transmission, and may be permitted to transmit the data, they will not be permitted to use their own SCAC or other identifier in place of the carrier on any form. This does not mean, however, that the vessel operator or carrier must interface directly with CBP. Carriers may interface with the AMS through an approved service center (denominated by the CBP as an "authorized transmitting party"). A list of approved service providers is available at CBP's website at www.cbp.com. Carriers may, of course interface directly with the AMS. However, in order to do so, a carrier must either purchase software and communications programs from an approved software vendor, or program their own software interface. This is an involved process, which involves the filing of a letter of intent with CBP, trials and testing before implementation, and a public listing as an AMS participant. Accordingly, a direct interface is not recommended for carriers unless they already have automated documentation systems, or the volume of their manifest production makes this an attractive option.
