The

date

for

submission

and

opening of the tender document/bid was fixed on 16.02.2011. However, no proposal/bid was

received from any firm/consultant. Therefore, the Department, on behalf of the Governor of Sikkim,

re‐issue this Notice Inviting Expression of Interest‐cum‐Proposal from reputed firms/consultants. The

details of the tender process and the nature of the service required are as mentioned in the website:

www.sikim.nic.in.

The tender forms/documents can be availed from the Office of the Chief Accounts Officer,

TENDER DOCUMENT

Dear Sir,

Subject: Proposal for Structural Design for the project “Construction & Installation ofstatue of Chenrezig at Sanga Choeling Monastery Complex in Pelling, West Sikkim” - Inviting

sealed tenders for consultancy service from reputed firms/structural engineer / institutes,

regarding.

The Buildings & Housing Department, Government of Sikkim, proposes to engage a

consultant for structural design for the above mentioned project. The implementing agency is

Buildings & Housing Department, Government of Sikkim. All structural designs have to be

done as per the relevant IS Code and National Building Code.

1. SCOPE OF WORK: The purpose of the assignment is planned to obtain

a) Structural Design for the foundation and the super structure of the captioned project.

b) Preparation of Structural drawings for the foundation and the super structures of the

captioned subject.

c) Periodical visit by the structural engineer to ensure quality and construction as per the

approved design, plan and specification. Such engineers should have required

qualification and sound knowledge of the design and implementation of such projects.

d) Attending various review meetings at the site as required by Buildings & Housing

Department, Govt. of Sikkim.

e) Visits to the site as required, for monitoring progress and quality issues.

f) To take up the responsibility of periodical inspection of works at different stages of

construction and as required by the Buildings & Housing Department. (A minimum of

24 numbers (twenty-four) site visits are required after the commencement of the

construction work)

g) Submission of structural details in soft copy and hard copies incorporating all changes

wherever necessary.

h) Detailed schedule of services is enclosed as Annexure-II.

2. The following documents are to be enclosed to enable the consultants to submit their

proposal.

a. Terms of reference (TOR) (Annexure-1),

b. Supplementary information for consultants, including a suggested format of

Curriculum vitae (Annexure - III, Form F-5)

c. Conditions of Contract (Annexure-IV) and

d. Form of contract for Consultants Services under which the services will be performed

(Annexure - V).

3. In order to obtain first hand information on the assignment and the local conditions, it

is considered desirable that a representative of their firm visits the Buildings &

Housing Department, before the proposal is prepared and submitted.

The representative may meet the following officials:

For site inspection: Superintending Engineer (S/W) at Jorethang and Divisional Engineer

(West), Buildings & Housing Department, Gyalzing.

Please ensure that advance intimation regarding the consultants visit is required to enable

them to make appropriate arrangements.

4. The prospective consultant will have an opportunity to obtain clarification regarding the

scope of work, terms of reference, contract conditions and any other pertinent

information during visits to these offices. The consultant intending to apply should

essentially have adequate experience in designing and executing such projects. The

firm/consultant/institutes shall give details of such projects, their costs and the time

duration.

The outstation Consultants (i.e. outside Sikkim) should give the undertaking to locate

the Regional Office in Sikkim if the work is awarded to them.

5. Tender document Processing Fee :

The tender document for Expression of Interest (EOI) cum Proposal for detail

structural design shall be availed from the Chief Accounts Officer on production of a

Demand Draft for Rs. 10,000.00 ( Rupees Ten thousand) only drawn in favor of Chief

Accounts Officer, Buildings & Housing Department, Government of Sikkim, Gangtok-

737101, Sikkim on 21.03.2011 and 22.03.2011 during office hours.

6. Submission of proposals: The Intending consultant is expected to examine the

project in detail and carryout such studies required to submit detail structural design of

the project. The proposals shall be submitted in two parts viz., Technical & Financial.

7. The Technical and Financial proposals must be submitted in two separate sealed

envelopes (with respective marking in bold letters) following the formats/Schedules

given in the supplementary information for Consultants. The first envelope marked

"Technical proposal" should include the description of the firm/organization, the firm

general experience in the field of assignment, the qualification and competency of the

personnel proposed, for the assignment, and the proposed work plan methodology

and approach in response to suggested terms of reference. The second envelope

marked 'Financial Proposal' must also be sealed with sealing wax and should

contain the detailed price offer for the Consultancy Services. Both the sealed

envelopes should again be placed in a sealed cover and the address of the recipient

should be clearly written in bold letters. The same will be received in the office of the

Additional Chief Engineer (S/W), Buildings & Housing Department, Government of

Sikkim, Nirman Bhawan, Gangtok, Sikkim up to 1200 hrs on 25.3.2011. No proposal

after the time and date as indicated shall be entertained and the tender documentsshould be submitted in person or by the authorized representative of the

firm/consultant at the time and place as indicated.

8. Opening of proposal: The proposals (First envelope containing technical proposal

only) will be opened by the committee in the office of the Additional Chief Engineer

(S/W), Buildings & Housing Department, Government of Sikkim, Nirman Bhawan,

Gangtok, Sikkim and in presence of such Structural Engineers or their authorized

representative who may choose to be present at 1300 hrs on 25.03.2011. It may

please be noted that the 2nd envelope containing the detailed price offer will not be

opened until technical evaluation has been completed and the result approved by the

Committee or by the competent authority.

9. The bidder should submit the required / prescribed non refundable tender document

processing fee of Rs.10, 000.00 (Ten Thousand) only in the form of Demand Draft

drawn in favour of Chief Accounts’ Officer, Buildings & Housing Department,

Government of Sikkim along with tender form.

10. The consultant firm should have minimum experience of 10 (ten) years.

11. The firm should have provided Structural Consultancy services of value 20(twenty)

crores in a single project in the last 5 (five) years, in construction of multistoried

buildings / monuments.

12. The firm shall give details of these projects, their costs, the time duration.

13. Deciding Award of Contract: -A two stage procedure will be adopted in evaluating

the proposals.

13(a): In the 1st Stage, technical evaluation will be carried out by the evaluation

committee of the Department on the basis of the information submitted by the

firms/consultants as per the forms enclosed. Only those technical proposals, which

score at least 75 points out of 100, shall be considered for financial evaluation in the

2nd stage.

13(b): In the 2nd

Stage, evaluation of Financial Bid will be carried out by the EvaluationCommittee of the Department. The lowest financial bid (FM) will be given a financial

score of 100 points. The financial score (SF) of other proposals will be computed as

under:

SF= 100 x FM /F

Where,

SF is the financial score of the proposal.

FM is the price of the lowest price bid.

F is the price of the proposal.

13(c): The firm will be ranked using combined technical and financial scores. The

weightage of the technical bid (T) shall be 60 percent and weigtage of financial bid

shall be 40 percent.

14. The Buildings & Housing Department may reject any or all of the proposals received

without assigning any reason thereof. Further, as the selection is on the quality cum

cost based system, the Buildings &Housing Department does not bind itself in any

way to appoint the firm offering the lowest price.

15. The consultants are requested to hold their proposal valid for 90 (ninety) days from

the date of submission without change in the personnel proposed for the assignment

and their proposed price. The Buildings & Housing Department will make its best

efforts to select a Consultant firm within this period. The firm should submit the

willingness & commitment of personnel proposed for the assignment.

16. The cost of preparing proposals and of negotiating a contract including visits to the

office of Buildings & Housing Department and any other places including site visits,

survey etc., for submission of proposals, if any is not reimbursable as a direct cost of'

the assignment. If anybody wants to visit site before submission of the tender

conducting site visits and any quarries related to the project, survey, the consultantsshall contact the Officers as indicated above who will show the site allotted for the

project.

17. The consultants shall have to take up/ commence the assignment within 5 (five) days

from the date of issue of the order after approval.

18. Proposal Preparation Cost: The consultant shall be responsible for all of the costs

associated with the preparation of his proposal and his participation in the bidding

process. The Buildings & Housing Department will not be responsible for such costs,

regardless of the conduct or outcome of the bidding process.

19. The remuneration, which the consultants receive from the contract, will be subject to

normal tax liability in India. Kindly contact the concerned tax authorities for further

information in this regard if required.

Annexure-I

TERMS OF REFERENCE

a. BACKGROUND: - The Govt. of Sikkim has approved the project for Installation of

“Chenrezig Statue at Sanga Choelling, Pelling in West Sikkim. The height of the statue

is 92’-4” which will be seated on a R.C.C pedestal of 36’11” and the section showing

different components of the structure and other drawings can be found enclosed at

Annexure –I, II, III & IV. All structural designs have to be done as per the IS Code and

National Building Code and any other relevant codes.

b. OBJECTIVES:- The consultants are required to design the foundation and the super

structure of the project.

c. The design submitted by the Consultant is considered approved, if the same is

technically vetted by a recognized engineering institute as decided by the department.

d) TASKS TO BE CARRIED OUT- by the consultants are as under:

i). Design of foundation and super structure of the statue and designs of any other

facilities provided in the project.

ii). working drawings: -

1. Structural drawings and design details: The specifications and structural

designs & drawings should be supported by design details for each proposed

building/ structure in both hard and soft copies.

2. Site inspection: - Consultants shall inspect the works periodically to apprise

themselves of proper interpretation of designs, drawings and their

implementation. During construction the consultants shall visit the sites

periodically at different stages of constructions and at least once in a month

during finishing stages. Minimum of 24 (twenty-four) site visits after

commencement of the work, with prior intimation and confirmation from the

Engineer in charge, concerned. The site visits made before commencement of

work for survey or collecting any field data shall be at consultants cost, these

shall not be included in minimum site visits. The site visit report should be

furnished immediately after the site visit to the Superintending Engineer (S/W),

Buildings & Housing Department, at Jorethang and the concerned Divisional

Engineer at Gyalzing. The consultant shall furnish a site inspection certificate

obtained from the Engineer-in-Charge.

c) DATA, SERVICES AND FACILITIES TO BE PROVIDED BY THE CLIENT:

The following information and details will be furnished by this Buildings &

Housing Department, Government of Sikkim.

i) Soil Investigation Report submitted by Mines & Geology Department, Govt. of

Sikkim.

ii) Architectural details.

d) FINAL OUTPUTS (i.e. REPORTS, DRAWINGS ETC.):

The following final outputs shall be furnished to the client.

I. Submission of all working drawings four sets for approval

II. Sufficient numbers of sets of all approved final working drawings with detailed

cross sections and elevations etc.

III. Sufficient No. of sets of Structural Design works both in hard and soft copies to

be submitted to the Buildings & Housing Department, Government of Sikkim.

IV. All original tracings of approved structural drawings shall be submitted to the

Buildings & Housing Department, Government of Sikkim.

V. Any revision and reviewed in the architectural and structural design during thecourse of execution of the project of the structure will have to be accepted by

the consultant for necessary modifications in the structural design without any

additional cost thereof.

1. COMPLETION PERIOD: The Consultant has to submit the detailed structural design

works within 25 (twenty five) days from the date of issue of the Letter Of Intent.

2. STATUTORY COMPLIANCE:

a) The Consultant will abide by all statutory requirements of Workmen

compensation Act, Labor License, Sales Tax, Income Tax etc.,

b) The Consultant shall indemnify and legally protect Buildings & Housing

Department of Sikkim and / or its employees from all claims, demands, causes

or action or suits arising out of services provided by the consultants under this

agreement and the consultant have to submit an indemnity letter to this effect.

The Buildings & Housing Department of Sikkim reserves the right to cancel the

above contract and get it done by any other agency if at any stage it is felt that

the work is not done in accordance with the specifications and progress

schedule for reasons solely attributable to the Consultant/Firm and no claim

would be entertained for the payment of the work done till that stage. For the

same, Buildings & Housing Department of Sikkim will give at least 15 days

written notice to the Consultant/Firm.

Annexure - II

CONSTRUCTION PHASE:

a. The Structural Engineer shall make periodical visits to the site to determine whether

the construction works are proceeding in accordance with the said final working

drawings and specifications and conditions stipulated in the contract documents and

shall issue necessary and appropriate instructions to the site engineers in presence of

the contractor. A written record of such meetings / instructions shall be maintained by

the designer.

b. The main Consultant shall perform all the functions and duties required to be

performed by him in accordance with the agreement for the Project.

Annexure – III

SUPPLEMENTARY INFORMATION FOR CONSULTANTS PROPOSALS

1. Proposals should include the following information

A. TECIINICAL PROPOSAL

a) A brief description of the firm, organization and an outline of experience on

assignments/projects of similar nature executed. The details to be furnished are

mentioned in form F-2.

b) Any comments or suggestions of the consultant on the terms of Reference (TOR).

c) The composition of the team of personnel which the consultants would propose to

provide and the tasks which would be assigned to each team member in Form F-4.

d) Curriculum vitae of the individual key staff members to be assigned to the work and of

the team leader who would be responsible for supervision of the team. The curriculum

vitae should follow the attached format (Form F-5) duly signed by the concerned

personnel.

e) The consultant’s comments, if any, on the data, services and facilities to be provided

by Buildings & Housing Department, Govt. of Sikkim, indicated in the terms of

Reference (TOR).

B. FINANCIAL PROPOSALS:

The financial proposals should include the following:

a. Schedule of' price bid in Form No. F-6.

2. CONTRACT NEGOTIATIONS: The aim of the negotiation is to reach an agreement

on all points with the consultant and initiate a draft contract by the conclusion of

negotiations. Negotiations commence with a discussion of consultant’s proposals, theproposed work plan, staffing and any suggestions the consultants may have made to

improve the terms of reference.

3. TERMS OF PAYMENT:

The payment to the consultant shall be made according to the progress of work and

according to the availability of fund with the department.

NOTE:-

1. All payments shall be made on submission of pre-receipted bills by the consultants in

quadruplicate duly certified by the concerned Divisional Engineer / Assistant Engineer

and the Junior Engineer in-charge of the project.

2. The above fee includes all the costs related to carrying out the services, including

overheads, service tax and any other taxes imposed on time to time by the

government.

Annexure - IV

CONDITIONS OF CONTRACT

A. GENERAL

1. Interpretation:

a. In interpreting the Conditions of Contract, singular also means plural, male also

means female, and vice-versa. Headings have no significance. Works have their

normal meaning under the language of the contract unless specifically defined. The

Engineers-in-charge will provide instructions clarifying queries about the conditions

of Contract.

2. Decisions:

a. Except where otherwise specifically stated, the Secretary, Buildings & Housing

Department Govt. of Sikkim will decide the contractual matters between the

Department and the Consultant in the role representing the Department.

3. Delegation: The Secretary, Buildings & Housing Department Govt. of Sikkim may

delegate any of his duties and responsibilities to other officers and may cancel any

delegation by an official order issued.

4. Communications:

3.1. Communications between parties, which are referred to in the conditions, are

effective only when in writing. A notice shall be effective only when it is delivered (in

terms of Indian Contract Act)

5. Personnel: The Consultant shall employ the required Key Personnel named in the

Schedule of Key Personnel to carry out the functions stated in the Schedule or otherpersonnel approved by the Engineer-in-charge. The Engineer-in-charge will approve

any proposed replacement of Key Personnel only if their qualifications, abilities, and

relevant experience are substantially equal to or better than those of the personnel

listed in the Schedule.

B. TIME FOR COMPLETION

b. Programme:

The total period for consultancy services for the project is 30 months. However, the

time of completion can be revised or changed by the Buildings & Housing

Department, Govt. of Sikkim.

1. Delays and extension of time: No claim for compensation on account of delays or

hindrances to the assigned work from any cause whatsoever shall lie, except as

hereafter defined.

Reasonable extension of time will be allowed by the Secretary, Buildings & Housing

Department Govt. of Sikkim or by the officer competent to sanction the time extension,

for unavoidable delays, such may result from causes, which in the opinion of the

Engineer-in-charge, are undoubtedly beyond the control of the Consultant. The

Consultant shall lodge in writing with the Engineer-in-charge for any delay or

hindrance on their assignment within 7 days from its commencement, otherwise no

extension of time will be allowed. If for any unavoidable reasons the project period

extends beyond 30 days, the service of the consultant will be considered as continuing

till the final completion of the project. Whenever authorized alterations or additions

made during the progress of the assigned work are of such a nature in the opinion of

the Engineer-in-charge as to justify an extension of time in consequence thereof, such

extension will be granted in writing by the Engineer-in-charge or other competent

authority when ordering such alterations or additions.

2. Suspension of works by the Consultant:

a. If the Consultant shall suspend the works, or sublet the work without sanction of

the Engineer-in-charge, or in the opinion of the Engineer-in-charge shall neglect

or fail to proceed with due diligence in the performance of his part of the

Contract as laid down in the Schedule rate of progress, or if he shall continue to

default or repeat such default, the Engineer-in-charge can initiate action for

rescinding the contract.

b. If the Consultant has delayed the completion of works the Contract will be

terminated forthwith.

FINISHING THE CONTRACT

3. Termination:

8.1. The Buildings & Housing Department, Government of Sikkim may terminate

the Contract if the Consultant causes a fundamental breach of the Contract.

9. Payment upon Termination:

9.1. If the Contract is terminated because of a fundamental breach of Contract

by the Consultant, the Engineer-in-charge shall issue a certificate for the

value of the work done less advance payments received upon the date of

the issue of the certificate, less other recoveries due in terms of the

Contract, less taxes due to be deducted at source as per applicable law and

the percentage to apply to the value of the work not completed representing

additional cost for completing the works at the rate of 20 percent of balance

work. Additional Liquidated Damages shall not apply. If the total amount due

to the Department exceeds any payment due to the Consultant the

difference shall be a debt payable to the Buildings & Housing Department

Govt. of Sikkim .

10. Property:

All plans, drawings, original drawings, specification, designs, reports and

other documents or software submitted by the Consultants in performance

of the services, shall become and remain the property of the Government of

Sikkim, Buildings & Housing Department Govt. of Sikkim if the Contract isterminated because of Consultant’s default.

11. Release from Performance:

If the Contract is frustrated by the outbreak of war or by any other event

entirely outside the control of either the Buildings & Housing Department

Govt. of Sikkim or the Consultant the Engineer-in-charge shall certify that

and stop work as quickly as possible after receiving this certificate and shall

be paid for all works carried out before receiving it and for any work carried

out after wards to which commitment was made.

CONSULTING SERVICES

Consultant:

Subject: Proposal for Structural Design for the project “Construction & Installation

of statue of Chenrezig at Sanga Choeling Monastery Complex at Pelling in West

Sikkim”.

Set out below are the terms and conditions under which

agreed to carry out for Buildings & Housing Department Govt. of Sikkim the above

mentioned assignment specified in the attached Terms of reference.

1) For administrative purposes (The Engineer-in-charge, Buildings & Housing Department

Govt. of Sikkim ) has been assigned to administer the assignment and to provide the

Consultant with all relevant information needed to carry out the assignment. The

services will be required for the work “Construction & Installation of statue of Chenrezig

at Pelling in West Sikkim” for the entire construction period from the date of concluding

the agreement.

2) In course time, the Engineer-in-charge may find it necessary to postpone or cancel the

assignment and / or shorten or extend its duration. However, every effort will be made

to give the consultants, as early as possible; notice of any such changes in the event of

termination, the Consultants shall be paid for the services rendered for carrying out the

assignment to the date or termination. The firm based on the terms of payment and the

firm Consultants will provide the Engineer-in-charge with any reports or parts thereof,

or any other information and documentation gathered under this agreement prior to the

date of termination.

3) The services to be performed, the estimated time to be spent, and the reports to be

submitted will be in accordance with the attached form F–3, TOR & Supplementary

information for consultants proposals.

4) This agreement, its meaning and interpretation and the relation between the parties

shall be governed by the laws of Union of India.

5) The financial proposal shall include the cost of preparation of structural drawings, initial

site visits before start of work, discussions with the Buildings & Housing Department,

preparation of detail final structural drawings and minimum of 24 site visits during the

execution of works at regular intervals.

6) FEES

7.1 Payments for the services will be made on the amount of the works proposed to

taken up only as per the scope of work for which services are rendered including all

taxes applicable from time to time. The fees is inclusive of all the taxes and duties

including Income Tax etc.,) Provident fund, Insurance and all other statutory charges

applicable as per prevailing State and Central Government rules.

7.2 PAYMENT TERMS

Payment will be made by cheque payable at Gangtok (State Bank of Sikkim) after

deducting;

a. Amount of appropriate tax deduction at source under IT Act, 1961.

b. Any other tax payable by the consultants, for services rendered to the owner, to any

of Central Government or State Government Agencies.c. Any other recoveries as per Contract.

The Buildings & Housing Department Govt. of Sikkim will pay remuneration of Amount to

payable to Consultants on receipt of invoices depending upon the availability of the fund at

the disposal of the Department at the time of such claim by the consultant.

NOTE: All payments shall be made on submission of bills by the consultants in

quadruplicate duly certified by the concerned Assistant Engineer & Divisional Engineer /

Engineer-in-charge .

1. The above fee includes all the costs related to carrying out the services, including

overheads, service tax and any other taxes imposed on time to time by the

government.

2. The consultant agrees to visit the site periodically at different stages of construction

duly intimating to the Divisional Engineer, concerned or on the request of Divisional

Engineer concerned wherever necessary. Such site visits shall be minimum 24 Nos





9. All questions or disputes arising out of or in respect of this agreement except as to

any matters the decision of which are expressly provided for, shall be decided by the

Secretary, Buildings & Housing Department Govt. of Sikkim which will be final and

binding upon both the parties.

10. All disputes that may arise between the parties shall be resolved only by courts

situated in Gangtok and no other courts shall have jurisdiction to entertain any

petition, application or suit to resolve such disputes.
