Should Contractors Be Required to Report Settlements and Judgments to CSLB?

On June 16, 2015, a balcony at Library Gardens Apartments in Berke-ley, CA collapsed, killing six students and injuring seven others. The company that constructed the apartment complex, Segue Construc-tion Company, had a history of questionable work. Notably, over the past three years, the company paid out $26.5 million dollars in construction defect settlements.

State law, however, does not require contractors to report defect settlements to the Contractors State License Board (CSLB). In relation to other trade professions, licensees such as architects and engineers are required to report settlements and judgments to their appro-priate regulator. While the Board for Professional Engineers, Land Surveyors, and Geologists receives roughly 60 settlement reports per year, the California Architects Board receives 29 settlement reports per year. Both boards underscore that there are minor, absorbable costs associated with this enforcement measure and underline that they conduct their own independent analysis of the settlement reports.

In response to the Berkeley balcony collapse and in recognition of the requirements of other trade professions, Senators Jerry Hill and Lon-nie Hancock introduced SB 465, which is currently pending in the As-sembly Committee on Business and Professions on reconsideration (it didn’t have the votes last year and reconsideration has been granted). Among other things, the bill would require a licensee to report to the registrar within 90 days of the date that the licensee has knowledge of a felony or any other crime substantially related to the qualifica-tions, functions, and duties of a licensed contractor or any civil action settlement or administrative action resulting in a settlement worth $50,000 or more, or a binding arbitration or administrative action resulting in binding arbitration worth $25,000 or more. Failure to comply with this requirement would be grounds for disciplinary ac-tion, including suspension or revocation of the license.

What Would the CSLB do with the Information? Similar to other regulatory entities, in order to determine whether a complaint is appropriate for investigation, the CSLB would review the information on a case-by-case basis, looking at such factors as the severity of the allegations, and whether a licensee has a history of complaints or discipline. Complaints involving a threat to the public’s health and safety, and cases where consumers have suffered a signifi-cant financial injury are given the highest priority. According to the authors, “this bill increases transparency so that consumers have the

tools necessary to make an informed decision about the quality of the contractor they hire.” “The bill also establishes greater account-ability for contractors by ensuring the public has critical information about licensees.”

As a result, only those settlements or arbitration awards that are investigated, and would subject a Licensee to suspension, revoca-tion, or criminal prosecution, not merely just a citation, would be made available to the public, which is the type of information that is already disclosed. In addition, licensees are already required to report unsatisfied final judgments to the CSLB, and are required to disclose convictions when applying for licensure. For licensees that have already been fingerprinted by the CSLB, the CSLB will receive notifications from the Department of Justice when that licensee is the subject to additional criminal action; however, not all licensees have submitted their fingerprints to the CSLB; hence, the reason for disclosure of felonies and other substantially related crimes.

In certain instances the need for this bill be appropriate, but the BIG question is, is there such a HUGE problem out there or is this really just an excuse for the applicant attorneys to gain access to a plethora of new ‘work’ that would now be disclosed for them to ‘pick and choose from? Interestingly, it was noted during the informational hearing this past Monday that attorneys typically receive two thirds of MOST settlements!!! Makes you want to go, hmm!

Obviously, there’s a lot more to discuss on this matter. Stay tuned for next week’s continuing discussion. There are two sides to every story, but I’m concerned the attorneys are ‘circling the water smelling blood!’

Concrete is a common building material that can be used in a variety of ways. It’s generally made by combining cement, sand, aggregate (small stones) and water. When these materials are mixed in the correct amounts and if they’re further strengthened by adding re-bar, fiberglass strands or plastic rods, the concrete can be used to build roads, bridges, buildings, septic tanks, floors, concrete blocks, and even countertops for homes. How-ever, anyone who uses or works around concrete and cement should understand the potential health hazards and follow safe handling procedures to prevent harmful exposures.

There are some applications of concrete that necessitate the addition of other materials that could adversely affect health if improperly handled. Additions may include alkaline compounds (such as lime) that are corrosive to human tissue, small amounts of crystalline silica that are abrasive to skin and causes damage to lungs or small amounts of chromium that can cause allergic reactions. The risk of illness or injury from these additions in the concrete depends on the level and length of exposure and the sensitivity of the individual.

Adverse health effects from concrete or cement are generally the result of exposure through skin contact, eye contact or inhalation.•Skin Contact – getting cement dust or wet concrete on your skin can cause burns, rashes, and skin irritations. Sometimes workers become allergic if they’ve had skin contact with cement over a long period of time.•Eye Contact – getting concrete or cement dust in your eyes may cause immediate or delayed irritation of the eyes.

Depending upon how much and for how long you get the dust in your eyes, effects to your eyes can range from redness to painful chemical burns.•Inhalation – inhaling cement dust may occur when workers empty bags of cement to make concrete. When sanding, grinding, cutting, drilling or breaking up concrete, the dust generated has the same hazards as the dust from cement. Exposure to cement or concrete dust can cause nose and throat irritation. Long term exposure to concrete dust containing crystalline silica can lead to a disabling lung disease called silicosis.

There are ways to prevent or control negative health effects when working with concrete and cement. First of all, dress for protec-tion. Wear alkali resistant gloves, long sleeves and pants to reduce skin exposure to concrete or cement dust, and waterproof boots that are taller than the concrete is deep. Wear safety glasses with side shields to protect the eyes or if it’s very dusty, goggles. Don’t wear contact lenses. When dust can’t be avoided, wear employer-approved respiratory protection. And remember to wash your hands and face before eating, drinking, smoking or using the toilet at the end of the day.

Secondly, follow all safe work practices and procedures. Work in ways that minimize the release of cement dust. Stay out of dusty areas, when possible. Mix dry cement in well-ventilated areas. Wet down the work to keep dust out of the air and use wet cut rather than dry cut masonry products. If it’s necessary to kneel on fresh concrete, use a dry board or waterproof kneepads. Finally, if wet or dry concrete gets on your skin, wash it off as soon as possible.
