CSLB Sponsors Fee Increase Bill

First and foremost, several weeks ago we discussed that the CSLB staff had reported during their December board meeting that 50% of licensed contractors have a work-ers’ compensation exemption on file claiming they have no workers. The board’s staff proposed that additional license classifications besides roofing be mandated to maintain a workers’ compensation policy since these classes typically require more than one person to perform the work. For example, one of the license classes they proposed is the A General Engineering contractor.

We argued (with unofficial concurrence by many people) that it may be time to mandate that ALL license classifi-cations be required to maintain at least a basic workers’ compensation policy? We have been in active discussions with many of major decision makers in Sacramento who are currently in the process of vetting other possible alternatives, as well as the total mandate option. Stay tuned for further updates.

Last Friday February 19th was the deadline for new bill introductions. As we reported several months ago, the staff received approval from the board to sponsor several bills this session which were all introduced by last Friday. Over the next several weeks we will be discussing all of the board’s sponsored bills, along with several other contractor-related bills of importance.

First up is AB 2286 (Mullin): License Fee Increases – This bill would authorize fee increases for all CSLB functions. These proposed increases are maximum amounts, mean-ing that if the bill were to pass, any future increases would first have to be approved by a majority of the 15 board members and it would likely be for an amount less than they are authorized to charge through the legisla-

tion. In other words, since authorization to raise the fees requires legislation, the board’s legislation provides for enough ‘space’ so that it would likely be many years be-fore they ever reached these ceiling amounts. So too, any proposed increases would have to go through the CSLB’s committee process during which the public would have a chance to voice their opinions; AND, the increases would ultimately have to be approved by the full board at a pub-lic hearing where the public would again have a chance to ‘weigh-in’ with their opinions.

Remember, the increases are only proposed at this junc-ture. The bill will have to pass through both houses of the Legislature and then be signed into law by the governor. That’s just to give the board the authorization! Lots can happen during this legislative process! Stay tuned.

February 22, 2016 WALL STREET HAS ITS BEST WEEK OF 2016 Across four trading days, the S&P 500 rose 2.84% and the Dow Jones Industrial Average, 2.62%; the Nasdaq Composite beat them both with a 3.85% gain. The Friday settlements: Dow Jones, 16,391.99; Nasdaq, 4,504.43; S&P, 1,917.78. WTI crude settled at $29.64 on the NYMEX Friday and gold at $1,230.80 on the COMEX.1

WHOLESALE PRICES OUTPACE CONSUMER PRICES Core producer prices rose o.4% in January according to the Bureau of Labor Statistics, with the headline Producer Price Index up 0.1%. The Consumer Price Index was flat in January, with the core index up 0.3%; core consumer prices rose 2.2% across the 12 months ending in January.2

BUILDERS STARTED FEWER PROJECTS LAST MONTH January saw a 0.2% decline in building permits and a 3.8% dip in housing starts. Permits are still outpacing starts, so both Commerce Department indicators could see gains in February.3

INDUSTRIAL OUTPUT IMPROVES 0.9% IN JANUARY This was the largest monthly increase reported by the Federal Reserve since November 2014, and it included a 0.5% advance for the manufacturing sector. Prior to January, five months had passed without a gain in industrial production.3

Thursday offers reports on initial claims and January capital goods orders, plus earnings from AMC Networks, Baidu, Best Buy, Campbell Soup, Domino’s, Gap, Health Net, Healthways, Icahn Enterprises, iHeart Media, Ingram Micro, Intuit, Kohl’s, Kraft Heinz, Live Nation, Monster Beverage, Pinnacle Foods, Sears Holdings, Palo Alto Networks, and Sprouts. January personal spending figures, the second estimate of Q4 GDP, and the University of Michigan’s final January consumer sentiment index arrive Friday, plus earnings from Berkshire Hathaway, Foot Locker, Hilton Worldwide Holdings, J.C. Penney, KBR, and Sempra Energy.

As we say goodbye to 2015, we look forward to a more prosperous and successful 2016. New goals, new projects, and of course, some new laws that have your lawyers' wheels spinning. The following is a brief recap of some changes in the laws as they apply to contractors or the business:

• License Bond: The contractor's license bond amount has increased from $12,500 to $15,000. When a claim is made on the bond, qualified claimants are still limited to recouping the amount of $7,500, but residential owner may claim the entire bond amount of $15,000. Most surety companies have a blanket endorsement in place with the CSLB.

• Salesperson Registration: The requirements that a salesper-son register with each particular contractor that he/she is acting as a salesperson for is now eliminated. Under the new law, the salesperson will register once every two years, and the contractor can electronically notify the CSLB that a par-ticular salesperson is working for it. Additionally, the CSLB will require that the HIS have a current and valid registration filed with the CSLB before making sales calls on behalf of contractors; requires that a contractor notify the CSLB when they hire a registered HIS and also when that employment ceases; the CSLB will accept applications electronically (in-cluding signatures) from the HIS applicant; and registration will be valid for two years from the month of issue.

• Paid Sick Leave: To make sure as an employer you are in compliance, make sure that you create a policy address-ing the amount of leave provided to employees or else the mandated accrual rate of one hour of sick pay for every 30

hours worked will be allotted without a cap. This could be almost nine days of sick pay rather than the mandated three days. Additionally, an employer must provide an employee with a written notice setting forth the amount of paid sick leave available to the employee each pay period. The Wage and Employment Notice has been updated by the Labor Commissioner to contain information about an employee's right to accrue and use paid sick leave and about employee protections under the law, which can be found on the Labor Commissioner's website. A new poster is now required, and employers must also keep records for at least three years which document the number of hours that each employee worked and paid sick days accrued and used by each em-ployee.• Public Works: In order to bid or work on public works jobs, contractors must register with the Department of Industrial Relations (and renew that registration by June 30, of every year) and meet requirements. Contractors now face a penalty of $2,000 if they allow their registration to lapse. Further, contractors on public works must enter certified payroll records online at the Department of Industrial Rela-tions website if the project was awarded on or after April 1, 2015.

• Minimum Wage: The minimum wage in California has increased from $9.00 per hour to $10.00 per hour.For more information, including additional legislation, case law, and CSLB happenings, please be sure to order your copy of our firm's 2016 edition of the California Construction Law book.

Air, whether life sustaining or killing, is usually colorless, odorless, and tasteless. The atmosphere in a confined space, for example, may seem like any other. But that is one work place that must never be taken for granted. Confined spaces have fooled scores of workers killed or injured every year because they thought someone had checked for safety or because they “followed their noses” and guessed the air smelled OK. The air may look safe and smell safe, yet be filled with enough toxic contaminants to kill.

Be on guard for a lack of adequate oxygen, for the presence of asphyxi-ates, toxic gases and vapors, and remember that all of these can be present at the same time. This is especially true in sewers, pipelines, manholes, storm drains, tunnels, vaults, chemical and oil tanks, storage bins, farm silos, winery tanks, and brewery vats.

There are no set rules to avoid trouble in these confined places, because there are so many different types of hazards and kinds of toxic materials. Begin the safety check by knowing the substances that have been stored in the confined place and the processes that were most recently used there. It is important to understand the space’s use, whether for storage, fermentation or mixing. These facts will determine how to correctly test the space for safe entry.

Employers should have a “qualified person” determine if a confined space exists at the work site. This person should be able to identify the hazards workers may face in the space and be familiar with instruments and

procedures to test for oxygen levels, flammability, and exceeded limits of air contaminants or toxic substances.

Before allowing worker entry, the confined space should be tested from the outside to determine whether the confined space atmosphere is safe. The qualified person should decide on the necessary tools for safe work in the confined space. (Explosion-proof tools and equipment are essential if the atmosphere is combustible.) The confined space should be continuously monitored to determine whether the space has changed due to the work being performed. If testing can’t be done continuously, it should be done often enough to ensure that the space doesn’t get dangerously contami-nated or lack oxygen. Monitoring should be done with one instrument for lack of oxygen and another instrument for toxic and combustible hazards. Testing instruments should be regularly calibrated noting maintenance checks. The qualified person must also determine what type of ventilation should be used to draw air out of and blow fresh air into the space.

Never rush into a confined place to rescue a worker overcome by a poisonous atmosphere unless you’re wearing approved safety equipment, self-contained breathing apparatus, and a safety belt and line. A danger-ously low level of oxygen or the presence of toxic vapors and gases af-fects everyone, including those with the best of motives. Thoughtlessness and panic help no one, not even the selfless hero.

While observing precautions, it’s also wise to periodically re-check the air after working in a confined place for any length of time. Following the rules of safety can safeguard against the silent dangers of confined spaces.
