Dear Friends,

Since the beginning of the 115th Congress and the swearing in of Donald Trump and Mike Pence nearly two years ago, we have seen attack after attack on the LGBTQ community. From banning transgender people from serving in the military to advancing a license to discriminate, the Trump-Pence Administration has used every opportunity to undermine the rights of LGBTQ people.

Nevertheless, when anti-LGBTQ members of Congress, led by Rep. Vicky Hartzler (R-MO), tried to join in by offering an amendment to ban access to transition-related health care for military service members and their families, HRC was able to work with our allies in Congress to defeat the amendment on the House floor.

While the Hartzler Amendment was the only vote this Congress that specifically targeted LGBTQ people, it was not the only action—or inaction—by Congress that impacted the LGBTQ community. The fact of the matter is our community is as diverse as the fabric of this nation. We are women. We are Muslim. We are Jewish. We are black, white, Latinx, Asian, and Native American. We are immigrants and we are people with disabilities. And so, when Congress fails to protect Dreamers, that impacts LGBTQ people. When Congress votes to allow states to refuse to provide Title X family planning grant funds to Planned Parenthood—one of the largest providers of

trans-competent care in the country and a vital source of healthcare for women, especially low-income women—that impacts LGBTQ people. When Congress tries to repeal core provisions of the Affordable Care Act, thereby making it more difficult for vulnerable populations, including people living with HIV, to acquire health insurance, that impacts LGBTQ people. And that is why we are scoring votes related to all of those key issues, in addition to a discharge petition that would have paved the way for a vote on the Dream Act.

We know Congress, specifically the Senate, plays a key role in administration personnel, and if there was any doubt that this Administration is no friend to the LGBTQ community, we simply need to look at who Donald Trump has nominated to key positions. Among his anti-LGBTQ cabinet members, two have especially stood out in their efforts to undermine the rights of LGBTQ people: Attorney General Jeff Sessions and Secretary of Education Betsy DeVos. In fact, one of their first joint actions was targeting some of the most vulnerable members of our community by rescinding critical guidance on the rights of transgender students under Title IX. Unfortunately, their anti-LGBTQ actions have come as no surprise to our community, which is why HRC opposed their nominations and is continuing to oppose their dangerous agendas.

Yet, it’s not just anti-LGBTQ cabinet members that Trump has nominated. Over the past two years, he’s put forward many anti-LGBTQ nominees for lifetime judicial positions, including Stuart Duncan to the Fifth Circuit and Neil Gorsuch and Brett Kavanaugh to the Supreme Court. The confirmation of these judges will have a lasting impact on the rights of LGBTQ people, long after Trump and Pence leave office.

The past two years have been difficult for our community and our country. The 115th Congress has done little to advance LGBTQ equality, while allowing a great deal to be done that undermines the rights of the most vulnerable members of our community. We hope this scorecard will aid you in understanding your elected officials’ records on issues impacting the LGBTQ community and will inspire you to take action to ensure that your elected officials embody the pro-equality values we all hold dear.

U.S. Senate

A Affordable Care Act Repeal (S. Amdt. 667) Sen. Mitch McConnell (R-KY) introduced the Health Care Freedom Act, also known as “Skinny Repeal,” as an amendment to the American Health Care Act (H.R. 1628), to repeal core provisions of the Affordable Care Act, which would make it more difficult for vulnerable populations, including LGBTQ people and people living with HIV, to obtain healthcare. The Senate defeated the amendment on July 28, 2017, by a vote of 49-51 (Roll Call Vote No. 179, 1st Session, 115th Congress). Democrats – 0 yes, 46 no, 0 not voting; Republicans – 49 yes, 3 no, 0 not voting; Independents – 0 yes, 2 no, 0 not voting. HRC opposed the amendment.

B Resolution to Nullify Rule Ensuring Provider Access to Title X Family Planning Program (H. J. Res. 43)Rep. Diane Black (R-TN) introduced a joint resolution to nullify a Department of Health and Human Services rule that sought to ensure no qualified provider is excluded from eligibility for federal funding under the Title X family planning program for reasons unrelated to their ability to provide family planning services. The rule would have prevented Title X family planning grant recipients from banning abortion providers, like Planned Parenthood, from receiving Title X funds. The Senate passed the resolution on March 30, 2017, by a vote of 51-50, with Vice President Mike Pence casting a tie-breaking vote (Roll Call Vote No. 101, 1st Session, 115th Congress). Democrats – 0 yes, 46 no, 0 not voting; Republicans – 50 yes, 2 no, 0 not voting; Independents – 0 yes, 2 no, 0 not voting. HRC opposed the resolution.

C McCain and Coons Amendment to the Schumer Amendment to the Broader Options for Americans Act Motion to Invoke Cloture (S. Amdt. 1955)

Sens. John McCain (R-AZ) and Chris Coons (D-DE) offered an amendment to the Schumer Amendment to the Broader Options for Americans Act (S. Amdt. 1958 to H.R. 2579) to provide Dreamers with conditional permanent residence and a pathway to citizenship if they have DACA status or meet the qualifications. The Senate defeated the amendment, which needed 60 votes to invoke cloture, on February 15, 2018, by a vote of 52-47 (Roll Call Vote No. 33, 2nd Session, 115th Congress). Democrats – 46 yes, 1 no, 0 not voting; Republicans – 4 yes, 46 no, 1 not voting; Independents – 2 yes, 0 no, 0 not voting. HRC supported the amendment.

D Elisabeth “Betsy” DeVos Confirmation On February 7, 2017, the Senate voted on President Trump’s nomination of Elisabeth “Betsy” DeVos to serve as U.S. Secretary of Education. J Do No Harm Act (S. 2918) (Co-Sponsorship)Senators were asked to co-sponsor legislation introduced on May 22, 2018, that would amend the Religious Freedom Restoration Act (RFRA) to exempt areas of law where RFRA has been used to bypass federal protections, including civil rights laws, thus restoring the original intent of the legislation and clarifying that RFRA is intended to protect religious freedom without allowing the infliction of harm on other people. The measure had 32 co-sponsors: Democrats 31; Republicans 0; Independents 1.

L Safe Schools Improvement Act (S. 2572) (Co-Sponsorship)Senators were asked to co-sponsor legislation introduced on March 20, 2018, that would amend the Elementary and Secondary Education Act (ESEA) to require school districts in states that receive ESEA funds to adopt codes of conduct specifically prohibiting bullying and harassment, including on the basis of race, color, national origin, sex, disability, sexual orientation, gender identity, and religion. M International Human Rights Defense Act (S. 3020) (Co-Sponsorship)Senators were asked to co-sponsor legislation introduced on June 7, 2018, that would build a framework into U.S. diplomacy to protect LGBTQ rights worldwide by making preventing and responding to discrimination and violence against the LGBTQ community a foreign policy priority and creating a Special Envoy within the State Department who would serve as principal advisor to the Secretary of State on LGBTQ issues. The measure had 37 co-sponsors: Democrats 36; Republicans 0; Independents 1.

N Voting Rights Advancement Act (S. 1419) (Co-Sponsorship)Senators were asked to co-sponsor legislation introduced on June 22, 2017, that would strengthen voting rights by expanding and strengthening the government's ability to respond to voting discrimination. The measure had 50 co-sponsors: Democrats 47; Republicans 1; Independents 2.

O Non-Discrimination Bills (Co-Sponsorship)Senators were asked to co-sponsor bills that would provide consistent and explicit non-discrimination protections for LGBTQ people in one of the key areas also covered by the Equality Act. Senators were given full credit for co-sponsoring at least one of the following:

I The Fair and Equal Housing Act (S. 1328), which was introduced on June 8, 2017, would provide consistent and explicit non-discrimination protections for LGBTQ people in housing by amending the Fair Housing Act to include actual or perceived sexual orientation and gender identity as protected characteristics. The measure had 35 co-sponsors: Democrats 32; Republicans 1; Independents 2.

The measure had 24 co-sponsors: Democrats 22; Republicans 1; Independents 1.

III The Jury ACCESS Act (S. 635), which was introduced on March 15, 2017, would provide consistent and explicit non-discrimination protections for LGBTQ people in jury selection in federal courts by amending the Jury Selection and Services Act to include sexual orientation and gender identity as protected characteristics. The measure had 17 co-sponsors: Democrats 15; Republicans 1; Independents 1.

IV The Student Non-Discrimination Act (S. 2584), which was introduced on March 21, 2018, would provide consistent and explicit non-discrimination protections for LGBTQ students by prohibiting any public school from discriminating against a student on the basis of actual or perceived sexual orientation or gender identity.
