As a result, you will be assigned a caseworker, who will assess your needs in order to support you in your reintegration. Supervision aims at ensuring that you adopt law-abiding behavior and that this is your last encounter with the judicial system.

What Is a Conditional Sentence Order? A conditional sentence order is a sentence imposed by the judge as the result of the offence that you committed. It is served in the community as long as you are law-abiding and comply with the conditions imposed. The order provides for supervising you to ensure you are maintaining good behavior and to prevent you from committing further offences.

It is subject to mandatory conditions, including reporting to your surveillant and following his or her instructions. The surveillant may be a probation officer, a correctional officer, or a community caseworker.

An order generally imposes punitive conditions that restrict your freedom, such as a curfew or house arrest.

If curfew or house arrest conditions have been imposed, you may be called or visited at any time by supervisory correctional officers charged with ensuring that you comply with these conditions. They will inform your surveillant of the outcome of their verifications.

The conditional sentence order can include conditions that help you reintegrate into society and that you must comply with for a specific period of time (e.g. : therapy, job seeking, etc.).

Under the provisions of your order, you must also keep the peace and maintain good behavior. Indeed, these responsibilities are incumbent upon all citizens.

Why a Conditional Sentence Order?The judge considered that the offence for which you were sentenced deserved a term of imprisonment. Yet, after ana-lyzing your situation, the judge believed that you would be able to serve your sentence in the community by complying with the conditions imposed.

The conditional sentence order will allow you to assume your obligations with those closest to you, continue your educa-tion, or hold a job. The order provides an opportunity for you to demonstrate that you can function appropriately in soci-ety. By complying with your obligations and embarking on a reintegration process, you are assuming the consequences of your actions.

You will regularly meet with your surveillant to take stock of your situation. You will benefit from his or her advice and support.

Stakeholder Responsibilities

Mandate of Services correctionnelsServices correctionnels have the responsibility of supervising you while you are in the community. In practical terms, this means:

Assess you to have a more accurate idea of your needs. Establish an intervention plan adapted to your needs and that you will comply with.

Support you in your progress. Refer to of appropriate resources. Check for compliance with all the imposed conditions, in particular, your house arrest, and inform the court of any observed breaches of your order.

Failure to comply with one of your obligations or commit-ting a new criminal offence automatically results in a notice of breach being sent to the criminal and penal prosecuting attorney. This generally results in you appearing before the court again. You could therefore lose the privileges granted by the judge and serve part or the remainder of your sentence in custody.

Your ResponsibilitiesYou are the most important person in ensuring that your conditional sentence goes smoothly.

Your motivation and the quality of your cooperation will make it possible for this to continue to take place in the community.

In signing your order, you have made a commitment to:

Comply with all your conditions. Appear for all appointments.

Cooperate with your surveillant by answering his or her ques-tions, providing the information requested, and following his or her instructions.

You can increase your chances for success by keeping an open mind about your surveillant and by getting involved in your supervision.
