1.1Meanings: IntheseTerms&Conditions,theseparticularexpressionshavethefollowingmeanings:

•"Baggage" or "baggage" means yourpersonal property accompanying you in connection withyour trip. Unless

otherwisespecified,itincludesbothyour CheckedandUncheckedBaggage;

•"BaggageCheck"meansa documentissuedto Passengerby usas areceiptfor CheckedBaggageandwhichrelateto the

carriageofCheckedBaggageand includesthe BaggageIdentificationTag.

•"BaggageIdentificationTag"meansa documentissuedby ussolelyfor identificationofCheckedBaggage.

•"CheckedBaggage"meansbaggageof whichwe takecustodyandforwhichwe have issueda BaggageIdentification

Tag;itisalso sometimesreferredtoas "registeredbaggage".

•"Conditions of Contract"meansthosestatements contained in or delivered withthe Itinerary,identified as such and

whichincorporatebyreference,theseTerms&Conditionsandnoticesavailableatour officesandcheck-incounters.

•"Damage" includesdeath, bodily injury to a passenger,delay, loss, partial lossor other damage,arising outof or in

connectionwithcarriage orotherservicesincidentaltheretoperformedbyus.

•"ElectronicCoupon"meansanelectronicflightcouponor othervaluedocumentheldinour database.

•"ElectronicTicket"meansthe Itineraryissuedby usor onour behalf,the Electronic Couponand if applicable,a boarding

document.

•"FlightCoupon"meansthatportion oftheTicketthat bearsthenotation"goodfor passage"or inthe caseof anElectronic

Ticket,theElectronicCoupon,andindicatestheparticularplacesbetweenwhichyou areentitledtobe carried.

•"Itinerary" or“TravelItinerary”meansthe document we issue to Passengerthatincludes thePassenger'sname,flight

information,bookingnumber,ConditionsofContractandnotices.•"Passenger"," you","your"and "yourself"meansanyperson,except membersofthe crew,carriedor tobe carriedin an

aircraftwithourconsent.

•"Route"meanstheflightfrom theairportat thepointof origintothe airportat thepointof destination.

•"Seat"meansa seatinour aircraft.

•"Tariff"meansour faresandchargespublishedelectronicallyor onpaper.

•"Ticket"meanstheItineraryandincludestheElectronicTicketandElectronicCouponissuedby usor onourbehalfand

includingthe Conditionsof Contractandnoticescontainedinit.

•"Terms& Conditions"meanstheseTermsandConditionsofCarriage.

•"UncheckedBaggage",meansany baggageother thanChecked Baggageincludingall itemsbroughtby youinto the

aircraftcabin.

•"We","our","ourselves","us"and"Carrier"meansAirAsiaBerhad.

•"Website"means theinternetsite www.airasia.com provided by us for thepurposeof Passengers making online

bookingsandto accessinformationaboutus.

1.2Captions: Thetitleor captionofeachArticleoftheseTerms& Conditionsisforconvenienceonlyandis nottobeused

Article2 Applicability

2.1General: TheseTerms& Conditionsapply tothe carriageby airor byother meansof transportationincludingsurface

transportationof PassengersandBaggageperformedbyusor onourbehalfandtoany liabilitywe mayhaveinrelation

tothatcarriageand transportation.

2.2Terms&ConditionsPrevail:Exceptas providedin theseTerms& Conditions,in theevent of inconsistencybetween

theseTerms& Conditionsandour Conditionsof Contractor anyother regulationswemay havedealingwithparticular

subjects,theseTerms& Conditionsshallprevail.

2.3Language: Thelanguageof theseTerms& Conditionsis Englishandeven thoughtheremaybe translationsof these

Terms& Conditionsin other languages,Englishshallbe thesolelanguageused inthe interpretationof theseTerms &

Conditions.Article3Tickets/Itinerary 

3.1Prima Facie Evidence Of Contract: The Itineraryis prima facie evidence of the contract forcarriagebetween

passenger andus.TheItinerary,theseTerms & Conditionsand ourConditionsof Contract(including applicableTariffs)

togetherconstitutethetermsandconditionsofthe contractofcarriagebetweenyou andus.

3.2Transferability: Thecontractfor carriage is onlytransferableas provided in theseTerms& Conditions andour

Conditionsof Contract.

3.3Validity: TheItineraryisonly validforthe Passengernamedandthe flightspecifiedtherein.

3.4Identity:Wewill providecarriageonly tothe Passengernamedin theItineraryor ElectronicTicket.Youwillbe required

toproduceappropriateidentificationatcheck-in.

Article4Fares

4.1General:Faresapplyonlyto carriagefromtheairportat thepointoforiginto theairportat thepointof destination.

Faresexclude groundtransport servicesbetween airportsand betweenairports and townterminals unlessotherwise

specificallystated byus.We arestrictlya point-to-pointcarrierandshall notbe responsibleto youfor anyconnecting

flights.Weshallnot beliableto youfor yourfailureto meetanyconnectingflights.

4.2Infants: Thefeesfor infantsunder theage of two(2) years(on thedateof travel)butaboveeight(8) days oldare

providedforin thefeeschedule.Aninfantmaytravelprovidedhe sitson anadult'slap.Onlyone(1)infantisallowedfor

one(1) adult.Noperambulatorsare allowedonboard theaircraft.

4.3GovernmentTaxes,Chargesand InsuranceSurcharge:Anygovernmenttaxes,charges or insurance surcharge

imposedon airtravel bytheGovernment,relevantauthorityor theairportoperatorin respectof your useofany ofour

servicesor facilitieswill bein additionto ourfares,administrationfeesand chargesand shall be borne by you,unless

otherwisespecificallystatedby us.Suchgovernmenttaxes,chargesand insurancesurchargeimposed on air travelmay

changefrom time to time andcan beimposedevenafterthe date that your bookinghas beenconfirmed.Youshall

neverthelessbear such government taxes, charges or insurancesurcharge as and when they fall dueprior to

departure.Pleaserefertoour feescheduleforamountsontaxes,chargesandInsuranceSurcharge.

4.4Currency: Fares andchargesare payablein thecurrency prescribed withour published fares unlessotherwisespecificallystatedby us.

4.5Ac:curacy:Allfares,prices,flightschedules,routespublished,prebookedproductsand servicesare correctat thetime

ofpublicationandare subjecttochangeatany timeandfrom timetotime withoutpriornotice.

4.6ApplicableFares:Applicablefaresarethosepublishedby usor onour behalf,whetherelectronicallyor byway ofother

medium.Faresmay exclude administrationfees,servicechargesandother chargesunlessotherwisespecificallystatedby

us.

Article5BookingofSeats

5.1ConfirmationofBooking: Thebookingofa Seatisconfirmedafterfullpaymentofthefareismadeandafterweissue

youa bookingnumberand/or theItinerary.Onceconfirmed,thebooking cannotbe cancelledandpaymentsmade are

notrefundable.

5.2GroupBookings: Thesearegovernedbyspecific termsthatvaryfrom timetotime.Pleasecontactusfor furtherdetails.

5.3FlightChange:Oncea bookingnumberhas beenissued,flightchangesare subjectto thefollowingterms:Insideof 

forty-eight(48) hoursprior tothe scheduledflight departuretime,nochangesare allowed.The chargesfor flightchange

outsideof forty-eight(48) hoursprior tothe scheduledflight departure timeare providedfor inthe feeschedule,subject

tothe followingconditions:(a)ifa lowerfare is available,the difference infares willnot berefundedto thepassenger;(b)if 

thenewflightbookedis ina higherfareclassthanthatofthecancelledbookedflight,thedifferenceinfaresshallbe paid

bythe passengerbefore thecancellationorchangecan bemade;(c)thechangeisnot confirmeduntilweissueyou anew

Itineraryand/or bookingnumber.(d)changesonroute(s)are notallowed.

5.4Promotional Fares:Article5.3 regarding FlightChangerulesand Article5.5 regardingNameChangedo notapply to

certainselectedpromotionalfares.

5.5NameChange: Onceabookingnumberhasbeenissued,youareallowedto substitutethepassenger

namedinthe confirmedbookingwithanotherpassengername subjecttoa paymentofa chargeasprovidedfor inthe

feescheduleandthe followingterms:a)the requestismadeoutsideof six(6)hours priorto thescheduledflight

departuretime;b)theoriginalas wellas thesubstitutedpassengers'identitiesareauthenticated.Howeverifthe requestis

madelessthantwentyfour (24)hoursbeforethe scheduledflightdeparturetime,namechangescan onlybe madeat

oursalesoffice orairport salescounters(openinghoursdependfrom airporttoairport).

5.6Payment: Faresmustbepaidinfullwhenabookingismade.Intheeventthatthefarehasnotbeenpaidinfullforany

reasonwhatsoever,wereservetherightto cancelthebookingprior tocheck-inand/orto disallowyouto boardthe

aircraft.

5.7Personal Data:Youherebyacknowledgeandagree thatyourpersonaldata hasbeen givento usfor thepurposesof 

makingbookingsfor carriageand providingyou withconfirmationof thatbooking,providingand developing ancillary

servicesand facilities,facilitatingimmigrationand entryprocedures,accounting,billing and auditing,checking creditor

otherpaymentcards,security,administrativeand legalpurposes,creditcard issuance,systemstesting,maintenanceand

development,statisticalanalysis,andhelpingus inany futuredealingswithyou.For thesepurposes,byenteringintoa

contractof carriagewithus youauthorize usto retainanduse your personaldataandto transmit itto ourownoffices,

authorizedagentsand thirdpartybusinessassociates,governmentagencies,othercarriersor theprovidersof theservices

mentionedabove.

5.8Seating: Wedonotguaranteetoprovideanyparticularseatintneaircraftandyouagreetoacceptanyseatthatmay

beallotted oris otherwisemadeavailableon theflight.Youwill beallocateda seatuponcheck-in.Wereservethe rightto

re-assign seats at any time, including after boarding of the aircraft.Thismay be necessaryfor operational, safety,

governmentregulatory,healthorsecurityreasons.

5.8.1Advanceseatrequest(ASR): Subjecttoavailabilityyoumaypaya feeforanadvanceseatrequest(ASR)at thetime

ofreservationor upto24 hourspriorto thescheduledtimeofdepartureforan advanceseatassignment. Pleasereferto

ourfeescheduleforthefeeforanASR. WhereanASR ispurchased,wereserveour rightto assignorreassignseatsat any

time,evenafter boarding of theaircraft.This maybe necessary foroperational,safetyor securityreasons. Wedo not

guarantee anyspecific seatreassignments,whetherfor anaisle,window,exit row,or othertype of seat.Wewill,however,

makereasonableeffortstohonourpaid seatassignments.

5.8.2Ifat anytime aftersuccessfully purchasingan ASRand ourschedulesare changed,terminated,delayedor merged

dueto circumstanceswhichwe reasonablyconsiderto bebeyondourcontrolor forcommercial reasonsor reasonsof 

safety,weshallatour option,either:(a)carryyouon thesameASR onthenextavailableflight;or(b)carryyouon anASRof 

equivalentvalueon thenextavailableflight;or(c)carryyou onany randomlyassignedseaton thenextavailableflight

wherebywewill thenrefundyoutheASR payment. Theoptionsoutlinedin this Article5.8.2arethe soleandexclusive

remediesavailableto youandwe shallhaveno furtherliabilitytoyou.

5.9.1In-flight products: The provisionof in-flight products,services or advertised programmes is subjectto availability.

In-flightproductsor servicesarenon-refundableand non-transferableonce purchased.Wedonot acceptanybookingsor

changestoin-flightproductsor serviceswithin48 hours fromthescheduledflight departure time.AirAsia reserves the

right,withoutprior notice,to amend/changetheprices orsubstituteanycomponentfor in-flightproductsor services.The

boardingpassis proofof purchaseof yourpre-bookedin-flightproductsor servicesandmust bepresentedto thecabin

crewonboardto redeemthe pre-bookedin-flightproductsor services.All pricesand savingsmadefromyourin-flight

prebookedproductsorservicesare validatthe timeofbooking.

5.9.2Meals:Mealselectionsare subjectto variationfromtime totime.Foodmay containnuts,dairyand/orgluten.Wedo

notacceptanybookingsor changestoyourmeal selectionswithin48 hoursfromthescheduledflightdeparturetime.

AirAsia reserves the right, without prior notice,to amend/changethe prices for prebookedmeals,substitute any

component of thepre-bookedmeal withan itemof similarvaluesubject to availabilityand/oraircraft suitability.The

boardingpassis proof of purchaseof your pre-booked meal andmustbe presented to thecabin crewonboard to

redeemyourpre-bookedmeal.Allpricesand savingsmadefromyourprebookedmealsare validatthe timeofbooking.

 Artice6Check-inandOtherRequirementsofCarriage

6.1.1Check-In,Deadlines and Conditions:Ourcheck-in countersare opentwo (2)hoursbeforethe scheduledflight

departuretime*.Thecounterscloseforty-five(45) minutesbefore thescheduledflightdeparturetime.Check-indeadlines

mayvary at different airportsand forparticular flights.It is yourresponsibility to ensurethat youcomplywith these

deadlinesparticularsof whichwill beavailableat thetimeyou makeyourbooking.In anyevent,withoutderogatingfrom

thegenerality ofotherprovisionsof theseTerms& Conditionsgoverningtherightof refusalof carriage,we reservethe

rightnotto allowyou tocheckinwithoutanyliabilityto youandwithouthavingto refundtoyou anyfarepaid:(a)ifyou

attemptto checkininside forty-five(45)minutes*beforeyourscheduledflightdeparturetime;(b)ifyoufail tohave proper

identificationor failto identifyyourselfto ourstaff;(c)ifyou fail tohave theproper documents,permits,visa,necessaryfor

traveltoa particularplaceorcountry;(d)ifyouhavenotfullypaidanyfareor otherfeesor chargesduetous;(e)ifyouhave

beenviolentto ourstaff orcaused disturbanceat ourcounteror haveabusedour staffwhetherphysicallyor verbally;(f)if 

theGovernmentorother authoritiesprohibitsyour checkinginor boardingtheaircraft;(g)ifin ourjudgment,youare not

fitto traveldue todrunkennessor anyobvious adversemedical condition;and/or;(h)ifin ourjudgment,you arenot

medicallyfitto travelor yourmedicalconditionposesor couldposea dangeror threattothehealthof otherpassengers. *

For AirAsia flightsto andfromAustraliaourcheck-incounterswillopen3 hoursand close60 minutespriorto the

scheduledflightdeparturetime.

6.1.2OffCounterCheck-in:Self Check-in:Weoffer a selfcheck-infacility forselected flights.The facilityis subjectto

specificrequirementswhichmaybe viewedonour websiteunderSelfCheck-in.

6.1.3UnavailabilityofSeat:  Thereis a chancea seatmay notbeavailablefor youonyourflightevenifyourbookingisconfirmed.Thisis dueto thecommonpracticein theairline industryof overbooking.Inthe eventof suchunavailabilityof 

seat,weshall atour option,either:(a)carryyou atthe earliestopportunity onanother ofour scheduledservices on which

spaceis availablewithoutadditionalcharge and,wherenecessary,extendthevalidity of yourbooking;or (b)should you

chooseto travelatanother time,retainthevalueof your fareina creditaccountfor your futuretravelprovidedthatyou

mustre-bookwithinthree(3)monthstherefrom.

6.1.4Soleremedies: Theoptionsoutlinedin Article6.1.3(a) to(b) arethe soleand exclusiveremediesavailableto youand

weshallhave nofurtherliabilityto you.

6.2.1Boarding:Youmustbeat theboardinggateat leastforty(40)minutesbeforethe scheduledflightdeparturetime.

6.2.2Passengerswhohavepurchaseda HotSeatunderourASR servicewillbe givenpriorityqueuingfromthe general

boardingwhichwill allowthem toproceed tothe aircraftfirstOnce generalboardinghas commenced,passengerswho

havepurchasedourHotSeat shalljointhe generalboardingqueue.

6.3No-show: Ifyoufailtocheckinontimeorfailtoboardtheaircraftbythetimetheaircraftdeparts,thefareyoupaidwill

notbe refundedto youforany reasonwhatsoever.

6.4Compliance:Youaresolely responsiblefor complyingwith alllaws,regulations,orders,demandsandrequirementsof 

countriesflown from,intoor overand withour Terms& Conditions,noticesand instructionsgiven byus relatingthereto.

Weshallnotbe liablein anywaywhatsoever toyouin connectionwithobtainingnecessarydocuments orcomplying

withsuch laws,regulations,orders,demands,notices,requirementsor instructions,whether givenorally or in writingor

otherwise,or fortheconsequencesto youresultingfrom your failuretoobtainsuchdocumentsor tocomplywithsuch

laws,regulatio ns,orders,d emands,notices,r equirementso r instructions.

6.5TravelDocuments:Youare responsible for obtainingand mustpossess andhave availablefor presentationas

required bythe relevant authoritiesall entry andexit,healthand other documentsrequired bylaw,regulations,order,

demandsor requirementsof thecountries flownfrom,into or over.We reserve theright to refuse carriage to any

Passenger who hasnot compliedwith,or whose documents do notappear to comply with, suchapplicable laws,

regulations,orders,demandsorrequirements.

6.6DocumentsAdvisory DomesticRoutes:Adultsarerequiredtoproducetheir originalidentitycards*orpassportfor alldomesticflights.Copiesof 

children’sbirthcertificatesoridentitycard**are requiredbeforetheyareallowedto board.

Malaysiachildrentravelingto Sabahor Sarawak:

i)Childrenundertheage of12 areallowedtoboardby producingeitheroriginalorphotocopiesof theirbirthcertificates

or identitycards.ii) Childrenabove theageof 12shallbe requiredtoproducetheir originalbirthcertificatesor identity

cards.

International Routes:Allpassengerstraveling oninternationalroutesmustpossessvalidpassportswith atleastsix(6)

months’validityandthe applicablevalidvisas.Suchpassengersshallpossesa returnonan onwardjourneyticket.

*Identitycardsare valididentificationonlyin theircountriesofissuance.

**Thefollowingshallqualify asidentitycardsfor children:MykidforMalaysia,ThainationalID cardforThailandandthe

KartuKeluargaforIndonesia.

*** Theproductionofan originalpassportqualifiesasvalididentificationunderthisarticles.

6.7Refusalof Entry: You agreeto paytheapplicablefareand/orpenalties orfineswheneverwe,on orderof any

Governmentor immigrationauthority,are required toreturnyou toyour point of origin or elsewhere,owingto your

inadmissibilityintoa country,whetheroftransitor destination.Insuchcircumstanceswewill notrefundthefare toyou.

6.8PassengerResponsibleforFines,DetentionCosts,etc.:Ifwe arerequiredtopay ordepositany fineorpenaltyorto

incur any expenditureby reason of yourfailure to comply withlaws,regulations,orders, demandsor other travel

requirementsof thecountriesflownfrom,intoor overor to producethe requireddocuments,you shall on demand

reimburseto usanyamountsopaid orexpenditureso incurredorto bepaid.Wemayapplytowardssuchpaymentor

expenditurethevalueof anycarriageunusedbyyou,or anyfundsdueto youin ourpossession.

6.9SecurityInspections: Youshallsubmittoany securityorhealthchecksby Governmentor airportofficialsor byus.

 Article7RefusalandLimitationofCarriage

7.1Rightto refusecarriage: Wemayrefusecarriage ofyou oryour baggageforreasonsof safetyorif,in theexerciseofour

reasonablediscretion,wedeterminethat:

a.suchactionisnecessaryforreasonsof safetyorsecurity;b.suchactionisnecessaryinorder tocomplywith anyapplicable

laws,regulationsor ordersof anystateor countrytobe flownfrom,intoorover;c.yourconduct,status,ageor mentalor

physical condition orthe physical condition of your baggageis such:(i)as tocausereasonable fear of harm,to other

havenotobserved,or arelikelytofailto observe,ourinstructions;f.youhaverefusedtosubmittoa securitycheck;g.the

applicablefareor anychargesor taxespayablehavenotbeenpaid;

h.thepaymentofyour fareis fraudulent;i.you donot havetheproper documentsfor travel;j.thebookingof ourSeat has

beendonefraudulentlyor unlawfullyor hasbeenpurchasedfroma personnot authorizedby us;k.thecreditcardby

whichyou paidfor thefare hasbeen reportedlostor stolen;l.theItinerary orbooking or ElectronicTicket iscounterfeitor

fraudulently obtained;m.the Itinerary hasbeenaltered byanyoneother thanusor ourauthorized agent,or hasbeen

mutilated(in whichcasewe reservetherightto retainsuchdocumentation);and/orn.thepersoncheckinginor boarding

cannotprovethathe isthe personnamedasthe passengeron theItinerary(wereservethe righttoretainsuch Itineraryin

thisci rcumstance).

7.2Unaccompanied Child:Childrenbelow age12 willnotbe accepted forcarriage unlesstheyare accompaniedby a

personofatleast18yearsofage.

7.3Passengerswithreducedmobility/medical condition:For safety reasons AirAsia cancarry only a maximumof 4

passengersper flightwho havereducedmobility*providedthat quadriplegicpassengersare limitedtonot morethan 2

perflight.Undercertain circumstanceswe mayrequire thepassenger totravelwitha companion.Pleasereferto 7.3.1

(Travelwitha Companion).*“reducedmobility”refersto paraplegicor quadriplegicpassengers.Passengerswithillnesses

ora medicalconditionarerequiredtoproducea medicalcertificateat checkin confirmingthattheyare fittofly.Forthe

safetyof other passengerswe reservethe right to deny boarding passengerssuffering frominfectious,contagious or

chronicdiseases.Passengerswith specificrequirementsrequiring special assistance and passengers with illnesses are

requestedto contact ourcallcentreat least48 hoursbefore thescheduledflightdeparture date tomakea prior

arrangement withus for thetype of special assistance required. Failureto notify us will result in theservice being

unavailableupon yourarrivalat theairportand youbeingrefusedcarriage.Forhealth andsafetyreasonspassengerswith

specificrequirementsmustcheck-inattheairport.

7.3.1Travelwitha companion: Wemayrequirethatyoutravelwithacompanionif:-(a)it isessentialforsafety;or(b)the

passengeris unableto assistinhis ownevacuationfromthe aircraft;or (c)thepassenger isunabletounderstandsafety

instructions.

7.3.2Seating: We will make reasonable seating accommodations for Passengers with specific requirements in

accordancewith applicablelaws.Wereservetherightto re-assignseatsat anytime,includingafter boardingofthe aircraft.

 Thismaybe necessaryfor operational,safety,governmentregulatory,healthor securityreasons.

7.4Pregnant Passengers: Itis thedutyof pregnantpassengerstoadviseus ofthe progressof their pregnancyat the

pointof bookingof Seatandat thecheck-incounter.Ourcarriageof pregnant passengersare subjecttothe following

conditions:(a)Pregnancyup to27 weeks(inclusive): wewill acceptwithouta doctor'scertificatesubjecttothe passenger

signingaLimitedLiabilityStatement. (b)Pregnancybetween28 weeksto 34weeks (inclusive): passengershallproducea

doctor'scertificateconfirmingthenumber ofweeksof pregnancyandthatsheis fittotravelwhichcertificateshallhave

shallhavebeen issuednotmore thanseven(7) daysfrom beforethescheduledflight departure date.The passengerwill

berequiredto signa LimitedLiabilityStatement.(c)Pregnancy35 weeksandabove:wewill refusecarriage.

7.5Infantslessthan 8days-old: Wereserve therightnot tocarry infantslessthaneight(8) days-old.We mayin our

absolutediscretiondecideto carrysuchinfantsonour flightswhensuchcarriageisexpresslysanctionedinwritingbya

medicalpractitionerand whentheparentof theinfantsignsa LimitedLiabilityStatement.

 Article8Baggage

8.1ItemsUnacceptableas Baggageor tobe CarriedInsideBaggage:Wereserve therightto refusecarriage ofsuch

baggageor suchitemsfoundin baggageasfollows:(a)Itemswhichare notproperlypacked insuitcasesor othersuitable

containersin order toensuresafecarriage withordinarycare andhandling;(b)Items which arelikelyto endanger the

aircraftorpersonsorproperty onboardtheaircraft,suchas thosespecifiedin theDangerousGoodsRegulationsof the

InternationalCivil AviationOrganization(ICAO) andthe InternationalAir TransportAssociation(IATA)and in ourTerms&

Conditionsand Conditionsof Contract.(c)Itemsthecarriageof whichare prohibitedby theapplicablelaws,regulationsorordersof anystate orcountrytobe flown from,to orover;(d)Itemswhichinour reasonableopinionareunsuitablefor

carriagebyreason oftheir weight,shape,sizeor character;(e)Fragileor perishableitems;(f)Live ordead animals;(g)Human

oranimalremains;(h)Freshorfrozenseafoodorothermeatsprovidedthatsuchitemsmay becarriedon boardas hand

luggageonlyif weare satisfiedthattheyhave beenproperlypacked.Strictly onlystyrofoam and/orcoolerboxesthat

containdryfood/non-perishablesareallowedto bechecked-inafterinspectionofcontentsbyrelevantauthorities.Should

passengersrefuseinspection,we havethe rightto rejectadmissionof luggage;(i) irearmsandammunition;(j)Explosives,

flammable or non-inflammable gas(suchas aerosol paints,butane gas,lighterrefills)refrigerated gas(such as filled

aqualungcylinders,liquidnitrogen),flammableliquids(such as paints,thinners,solvents) flammablesolids(suchas

matches,firelighters),organicperoxides(suchas resins),poisons,infectivesubstances(suchasviruses,bacteria),radioactive

material(suchas radium)corrosivematerials(suchas acid,alkali,mercury,thermometers),magneticsubstances,oxidizing

materials(suchas bleaches). (k)Weaponssuch as antique firearms,swords,knives andsimilar itemsprovidedthat such

itemsmaybeallowed ascheckedbaggageat ourabsolutediscretionforveryspecial reasons.Thesecannotbecarriedinto

theaircraftfor anyreasonwhatsoever.

8.2ValuableandFragileGoods:Passengersare strongly advisednot to check in such items as baggage.If they are

checkedinas baggage,passengersagreetheysendcarriageof suchitemsat theirown risk.Suchitemsincludemoney,

 jewellery, preciousmetals,silverware,electronic devices,computers,cameras,video equipment,negotiable papers,

securitiesor othervaluables,passportsandotheridentificationdocuments,titledeeds,artifacts,manuscriptsandthelike..

8.3RighttoSearch:Forreasonsof safetyandsecurity,wemayrequireyou toundergoa search,x-rayor othertypeof scan

onyourpersonor yourBaggage.Wereservetherightto searchyourBaggageinyourabsenceif youarenotavailable,for

thepurposeof determiningwhetheryouare inpossessionof orwhether your Baggagecontainsanyunacceptableor

prohibiteditems.If yourefuseto complywithsuchsearchesor scanswe reservetherighttorefusecarriageof youand

yourBaggagewithoutrefundof fareto youand withoutanyotherliabilityto you.Intheeventthata searchorscan causes

injurytoyou ordamagetoyourBaggage,weshall notbeliableforsuchinjuryor damageunlessthesameis duetoour

faultornegligence.

8.4CheckedBaggage:Upondeliveryto usof Baggagetobe checked,we shalltakecustodythereofand issuea Baggage

IdentificationTagfor eachpiece of Checked Baggage.Checked Baggage must haveyour nameor other personal

identificationaffixedsecurelytoit.CheckedBaggagewill becarried onthe sameaircraftas youunlesswe decideforsafety,

securityor operationalreasonsto carryit onan alternativeflight.Ifyour CheckedBaggageiscarried ona subsequentflight

wewill deliversame toyou within a reasonable time of arrival of that flightunlessapplicablelaw requiresyou tobe

presentforcustomsclearance.

8.5CheckedBaggage: A baggage fee ischargedforthecarriageof Checked Baggage,whichwillbe chargedat a

discountedrateif purchasedat timeof bookingor ata fullrateattheAirportCheck-incounters.A minimumof15kgof 

CheckedBaggagemaybe purchasedat firstinstanceandthenin incrementsof 5kg. Anypassengercheckinginbaggage

whichexceeds15kgs orthe amountpurchasedat time ofbookingwillbe chargedon a per kgbasis attheAirport

Check-incounters.Pleaserefertoour feeschedulefordetailson allrates. TheCheckedBaggageFeeis non-refundableand

non-transferable.Babybuggies,manualwheelchairs,mobilitydevicesandwalking framesare carriedfreeof charge.Thereisno baggageallowanceforinfants,althougha pram/buggywillbe carriedfreeof charge.Passengers maynotusethe

unusedCheckedBaggageof other passengersunless travellingon thesameItinerary.Passenger booked in thesame

itinerary anddoesnot travelmay nottransfertheirunused CheckedBaggage weightto theother passenger(s) inthe

same Itinerary.Forhealthandsafetyreasonsthe Carrier willnot acceptany individualitem exceeding32 kgand with

combined dimensionsof morethan81cmheight,119cmwide and119cmdepth.Thisweight limit doesnotapplyto

mobilityequipment.Sportingequipmentmay becarried inthe holdof theaircraftupon paymentof thefee setoutin the

feescheduleand atyour ownrisk.Youare therefore,advisedto purchase thenecessaryinsurancefor suchitems.Musical

instrumentwhichexceedourcabin baggagedimensionsprovideditis within75kgmaybe carriedinthe cabinif aseat for

ithasbeenpurchasedandtheappropriatefarepaid.Thereisno baggageallowanceassociatedwiththepurchaseof an

extraseat.

8.6UncheckedBaggage: Passengers(exceptinfants)are allowedthefollowingbaggage:Onlyone (1)itemof baggageis

allowedtobe carriedonboard providedthatitdoesnot exceedthedimensionsof 56cmX 36cmX 23cmandprovided

thatitdoes notweighmorethan 7kg.Suchbaggagemustfitundertheseatin frontofyou orin anenclosedstorage

compartmentinthe cabin.Itemsdeterminedbyus tobe ofexcessiveweightorsize orof anoffensivenaturewillnot be

permittedon board.

Subjecttotheprevalentapplicablelocallaws andregulationspassengersmaytakeliquidson boardintheir handluggage

providedtheymeetthefollowingrestrictions:1.Theliquidis ina containerwith amaximumvolumeof 100ml 2.Thatall

liquidcontainersmeetingthemaximumvolumeof 100mleachcan befittedcomfortablyintoa transparent,re-sealable1

litreplasticbag.The plasticbagshouldbe presentedseparatelyatsecurity.Youmay berequiredto disposeofliquids

whichdonot meettheaboverequirements.

8.7UncheckedBaggage: Only one(1) piece ofbaggageis allowedto be carriedon board providedthatit doesnot

exceedthedimensionsof 56cmX 36cmX 23cmand providedthatitdoes notweighmore than7kg.Suchbaggagemust

fitunder theseatin front ofyou orin anenclosedstoragecompartmentin thecabin.Itemsdeterminedby usto beof 

excessiveweightor sizeor ofan offensivenaturewill notbe permittedon board.

8.8CollectionandDeliveryof Baggage: YoushallcollectyourBaggageassoonasitis availableforcollectionatplacesof destination.Ifyou donot collectit withina reasonabletime andthe baggageneedstobe storedatour premises,we may

chargeastoragefee.If CheckedBaggageisnotclaimedwithin two(2) monthsof thetimeit wasmadeavailableto you,we

maydisposeof itwithoutany liabilitytoyou.Only thebearerof theBaggageIdentificationTagdeliveredto thePassenger

atthetime theBaggagewas checked,is entitled todelivery ofBaggage.If a personclaiming theBaggageis unableto

produceaBaggageIdentificationTagforidentificationof theBaggage,wewilldeliver theBaggagetosuch persononlyon

condition that he hasestablished to oursatisfaction hisrightthereto,andif requiredby us,suchperson shall furnish

adequate security to indemnify usfor anyloss,damage or expensewhichmay be incurredby usas a resultof such

delivery.AcceptanceofBaggageby thebearerof theBaggageIdentificationTagwithoutcomplaintatthe timeof delivery

isprimafacieevidencethattheBaggage hasbeendeliveredingood conditionand inaccordancewiththecontractof 

carriagebetweenus.

 Article9Schedules,Cancellations

9.1Schedules:Wewilluseourbesteffortstoavoiddelayin carryingyouandyourbaggage.Wewillendeavourtoadhere

topublishedschedules ineffecton thedateof travel.However,timesshownin timetables,schedulesor elsewhereare

subjecttochangeatany timeandfrom timetotime andwe shallnotbe liablein anywaywhatsoeverfor anylossincurred

bypassengersasa resultofsuchchange.

9.2Cancellation,Changesof Schedules: Atany timeafter a bookinghas beenmadewe maychange ourschedules

and/orcancel,terminate,divert,postponerescheduleor delayany flightwherewe reasonablyconsiderthis tobe justified

by circumstances beyondour control or forreasonsof safetyor commercial reasons.In the eventof such flight

cancellation,weshall atour option,either:(a)carryyou atthe earliestopportunityon anotherofour scheduledserviceson

whichspaceis availablewithoutadditionalcharge and,wherenecessary,extendthevalidityof yourbooking;or (b)should

youchooseto travelat anothertime,retainthe valueof yourfareina creditaccountfor your futuretravelprovidedthat

youmustre-bookwithinthree(3) monthstherefrom.

9.3Sole remedies: Upontheoccurrenceofanyof theeventssetoutinArticle9.2,theoptionsoutlinedinArticle9.2(a)to

(b)are thesoleand exclusiveremediesavailabletoyou andwe shallhaveno furtherliabilitytoyou.

 Article10ConductAboardAircraft 

10.1 Ifin ourreasonableopinionyou conductyourselfonboard theaircraftso asto endangerthe aircraftor anypersonor

propertyon board,orobstructor hinderthecrew inthe performanceof theirduties,orfail tocomplywith anyinstruction

of thecrew including butnot limitedto thosewith respectto smoking,alcohol,use of cellulartelephones,or useany

threatening,abusiveor insultingwords towardsthecrew orbehavein amannerwhich causesdiscomfort,inconvenience,

damageor injuryto otherpassengersof the crew,wemay take such measuresas wedeemnecessaryto prevent

continuationof suchconductincludingrestraint.Youmaybe disembarkedand refusedonwardcarriageat anypointand

maybe prosecutedfor offencescommittedonboard theaircraft.

10.2 Ifas aresultof yourconductwedecide,inexerciseof ourreasonablediscretion,todivert theaircraftfor thepurposeof 

offloadingyou,thenyoushallbeliableforallcostswhichwe incurof anynaturewhatsoeverasa resultofor arisingoutof 

thatdiversion.

10.3 Forsafetyreasons,we mayforbid or limitoperationon boardthe aircraftof electronicequipment,includingbutnot

limitedto,cellular telephones,laptop computers,portable recorders,portable radios,CD players, electronic games or

transmittingdevices,includingradio-controlledtoysand walkie-talkies.Operationof hearingaidsand heartpacemakersis

permitted.

10.4Passengersarenot allowedtoconsumetheirown foodon board.Nosmokingispermittedon anyof ourflights.

 Article11LiabilityLimitations

11.1Warsaw,MontrealConventionNotice: If thepassenger's journeyinvolves an ultimate destinationor stop in a

countryotherthanthecountryof departure,theWarsawConventionortheMontrealConvention1999maybe applicable

andtheWarsaw Conventionor theMontrealConvention1999 governsandin mostcaseslimits theliabilityof carriersfor

deathorpersonalinjury andin respectoflossof ordamageto baggage.

11.2Noticeof BaggageLiabilityLimitations:Liabilityforloss,delayor damagetobaggageis limitedunlessahighervalue

isdeclaredin advanceandadditionalchargesare paid.Liabilityfordomestictraveland liabilityforinternationaltravelvary

accordingtotherespectivelaw.

11.3WhereWarsawConventionisnotapplicable:Whereyourcarriageisnot subjecttotheliabilityrulesof theWarsaw

Convention,thefollowingrulesshallapply: (a)Anyliabilitywehave forDamagewill bereducedby anynegligenceonyour

partwhich causesorcontributestothe Damageinaccordancewith applicablelaw.(b)Wewillnot beliable forDamageto

Checkedor UncheckedBaggage unlesssuchDamage iscausedbyour negligenceandsuchBaggagewaswithinour

controlor custody.(c)Exceptin thecaseof anact oromissiondonewithintenttocauseDamageor recklesslyandwith

knowledgethat Damagewouldprobablyresult,our liabilityin thecase ofDamage toCheckedBaggage andUnchecked

Baggageshall belimitedto amountas providedforin thefeeschedule.If theweightof theBaggageisnot recordedon

theBaggageIdentificationTag,it is presumedthatthe total weight of theCheckedBaggagedoes notexceedthe

applicablefreebaggageallowancefor theclassof carriageconcerned.If inthe caseof CheckedBaggage,a highervalueis

declaredinwritingpursuantto anexcessvaluationfacility,ourliabilityshallbe limitedtosuchhigherdeclared value.(d)We

willnot beliable forany Damagearisingfrom ourcompliancewith applicablelawsor Governmentrulesand regulations

orfrom yourfailureto complywiththesame.(e)Exceptwhereotherspecificprovisionismade intheseTerms&Conditions,

weshallbe liable toyou onlyfor recoverablecompensatorydamages forprovenlosses andcostsin accordancewith

applicablelaw.(f)Weare notliableforany Damagecausedbyyour Baggage.Youshallbe responsibleforany Damage

causedbyyour Baggagetootherpersonsor property,includeour property.(g)Weshallhaveno liabilitywhatsoeverfor

Damagetoarticlesor itemsnotpermittedtobe containedin CheckedandUncheckedBaggageincludingbut notlimited

tofragile or perishable items,itemshaving a specialvalue,suchas money,jewellery,preciousmetals,computers,personal

electronicdevices,negotiablepapers,securities,or othervaluables,businessdocuments,passportsand otheridentification

documents,titledeeds or samples.(h)We are notresponsiblefor anyillness,or disability,includingdeath,attributable to

your physical condition or for theaggravation of suchcondition.(i)The contractof carriageincluding theseTerms&

Conditionsand exclusionsor limitsofliability,appliestoour authorizedagents,servants,employeesand representativesto

thesameextentas they apply tous.Thetotalamount recoverablefromus andfromsuchauthorized agents,servants,

employees andrepresentativesshallnot exceedthe amountof ourown liabilityif any.(j)Nothingin theseTerms&

Conditions of theConditions of Contractshall waiveany exclusion or limitationof our liability under theWarsaw

Conventionor anyotherapplicableConventionorapplicablelaws unlessotherwiseexpresslystatedbyus.

 Article12TimeLimitationonClaimsandActions12.1Noticeof Claims:Acceptance of Baggageby thebearer of theBaggage IdentificationTagwithoutcomplaintat the

timeof deliveryis sufficientevidencethatthe Baggagehasbeen deliveredingood conditionandin accordancewiththe

contract ofcarriage,unless youproveotherwise.If youwishto filea claim or anactionregardingDamage toChecked

Baggage,youmustnotifyusas soonasyoudiscovertheDamage,andat thelatest,withinseven(7)daysof receiptofthe

Baggage.If youwishto file a claimor anaction regardingdelay of Checked Baggage,youmustnotify uswithin

twenty-one(21)daysfromthe date theBaggagehas been placedat your disposal.Everysuchnotificationmustbe in

writingandpostedor deliveredtouswithinthe aboveperiods.

12.2Limitationof actions:Anyrightto damagesshallbeextinguishedif anactionis notbroughtagainstuswithintwo (2)

yearsofthe dateof arrivalatthe destination,orthedate onwhichthe aircraftwasscheduledtoarrive,or thedateon which

thecarriagestopped.Themethodof calculatingtheperiod oflimitationshallbe determinedby lawof thecourtwherethe

caseisheard.

 Article13ModificationandWaiver 

13.1Noneof ouragents,employees norrepresentativeshas authorityto alter,modifyor waive anyprovisions of these

 Terms&Conditions.
