PRESIDENT’S MESSAGE It may be true that “there is nothing new under the sun,” but the beginning of a Bar Association year without our erstwhile Executive Director, Jean Keary, feels like a very new thing to us, your Executive Board. We took great pride in honoring Jean in January with the dedication of the Bar office. We ask for your patience as we work to accomplish the myriad tasks ahead of us this year, from the mundane (tracking and entering contact data for each new and renewing member) to the sublime (avoiding the potholes and pitfalls that potentially await each of our decisions and actions). We are particularly mindful that our most important task this year – and the one upon which our service to the Bar will be judged in the fullness of time – is our choice for a new Executive Director. Nobody can fill Jean’s shoes, of course, but we nonetheless need to find a highly motivated and effective person to do their best impression of her. To guide us, we have developed a Vision Statement and a Mission Statement for our organization: vbbarassoc.com/mission-and-vision , which allowed us to reflect upon what we do and why we do it. From there, we developed a detailed job description: www.vbbarassoc/executive both to capture our aspirations and to fairly depict to interested persons the type of skills we envision in an Executive Director. You can do your part by forwarding the job posting to anyone you know who might be interested, and asking them to send their resume and a brief statement of interest to us at [email protected]. To guide the Board in this important decision, we have asked Judges Glenn Croshaw, Lisa Hodges and Kevin Duffan – along with Past President Judy Rosenblatt – to serve with us on the interview panel. With their wise counsel, we hope to have a new Executive Director in place soon. We also plan increased dialogue and interaction with our Past Presidents’ Council, in the hopes of being mindful of our history as we move forward into this new era. Our hope is that this committee will assist the Board in identifying and developing relevant CLE topics and networking events that better serve our transactional practice attorneys, a group that has traditionally been undeserved by our litigator- heavy organization. Our two newest board members, Ed Booth and Ryan Ferguson, are hard at work planning this year’s CLE slate. The plan, as always, is to offer no-additional cost CLEs to our members that cover an entire year’s required credit hours in interesting and useful topics, with social and networking opportunities immediately following each event. We hope you will join us Thursday, April 26, 2018 for our first CLE of the year, when we present “Practice Tips for Effective and Ethical Negotiation in Complex Family Law Cases” with recently retired Virginia Beach J&DR Judge Winship Tower. Please save that date and be on the lookout for details. A hearty thank you to our sponsors, Veteran Reporters and The McCammon Group, for their generous contributions toward these and other events. The Honorable Will Taylor recently retired after over thirty years of distinguished judicial service. He first

served on the bench of the General District Court and then was elected as a Judge of the Circuit Court

Virginia Beach Bar Association Las Vegas CLE Sept. 27-30, 2018

The Virginia Beach Bar Association is pleased to announce their 7th annual fall CLE getaway. The CLE is to be held at the luxurious Palazzo all suites hotel in Las Vegas. The Palazzo is a 5 star hotel and is among the hottest Vegas hotels on the strip. Enjoy cocktails and sunshine at one of seven pools or check out Tao Beach at the Venetian, the Palazzo’s sister resort.

Nightlife is plentiful at the Palazzo. You can enjoy some of the best restaurants Las Vegas has to offer or take a short walk to any of the other resorts located on the Strip. Along with your trip you will be able to take advantage of dinning discounts and drink specials the Association was able to negotiate as part of your CLE in Las Vegas.

The Association will be offering 4 CLE hours broken into two 2 hour sessions so as to not interfere with your activities. Be sure to register for your player’s card. The cost of the trip is $1,175.00, per room with an option to upgrade to Prestige Level for an additional $450.00 (plus any applicable tax). The trip does not include airfare so as to give you the option of when you leave and return, or your use of frequent flyer miles. Feel free to add nights or adjust your stay accordingly (resort limitations may apply). Included in the cost of your trip are accommodations, resort fee, cocktail reception, pool bar refreshments on non-cabana day, cabana party at the pool club, breakfast CLE’s and transportation from the airport (dependent on arrival time of the majority of travelers) to Palazzo. REMINDERS: ORIGINAL SIGNATURES NEEDED ON ALL COURT DOCUMENTS AND ORDERS; NEED CURRENT VERSION OF § 20-60.3(5)

“Paperless” isn’t the same as “electronic filing,” so original signatures are still necessary As most of you are probably aware, the Virginia Beach Circuit Court Clerk’s Office went “paperless” for cases commenced after Jan. 1, 2018. This means that those cases will not exist in the form of a paper file, but will be scanned in and maintained electronically. Thus, paper still exists and is required, it is just turned into an electronic document after filing. As a result, pleadings, motions, and orders that are submitted still need to have original signatures, not electronic, stamped, photocopied, or faxed signatures. Please be sure the documents you file contain original signatures.

Reminder: need to use § 20-60.3(5) as amended in two different places in 2015 Failing to include the full text of the current version of § 20-60.3(5), when support notices are re-quired, continues to be problem spot for many domestic relations orders. Many orders manage to include the additions that were made after “(a)” in the last part of § 20-60.3(5). However, changes made just prior to that portion often are missed, namely “the court may also order the continuation of that support be paid or contin-ue to be paid for any child over the age of 18 . . .” (alterations indicated by strike out and highlighting). The easiest approach is probably just to block copy the entire notice, which can be done by visiting the free, state-hosted web site https://law.lis.virginia.gov/vacode/.

Pursuant to Section 17.1-258.3:1 of the Code of Vir-ginia as stated below, the Chesapeake Circuit Court Clerk’s Office WILL begin collecting the $5.00 per paper document fee EFFECTIVE MARCH 15, 2018.

§ 17.1-258.3:1. Electronic filing of land records; paper form.

B. Any clerk of a circuit court with an electronic filing system established in accordance with this section may charge a fee not to exceed $5 per instrument for every land record filed by paper. The fee shall be paid to the clerk’s office and deposited by the clerk into the clerk’s non-reverting local fund to be used exclusively to cover the operational expenses as defined in § 17.1-295.

For clarification, please visit the deed calculator on the state website, www.courts.state.va.us beginning March 15, 2018.

EFFECTIVE MARCH 15, 2018, the Chesapeake Circuit Court Clerk’s Office will assess an additional $5 fee for every civil case initially filed by paper pursuant to Virginia Code §17.1-258.3.

§17.1-258.3. Electronic filing in civil or criminal proceedings. Any clerk of circuit court with an electronic filing system established in accordance with the Rules of Supreme Court of Virginia may charge an additional $5 fee for every civil case initially filed by paper, except that a person who is determined to be indigent pursuant to § 19.2-159 shall be exempt from the payment of such fee. 15, 2018.
