REPORT OF THEVICE-PRESIDENT OF PUBLIC POLICY

I. The Vice President, Public Policy

The Vice President of Public Policy provides information, informed opinions and guidance to the Board of Directors and the membership on current and developing legislation, rules and regulations governing the practice of pharmacy at the state and national level. The position is nominated by the Board of Directors and is elected by the House of Delegates for a 2-year term. This position reports directly to the President.

II. Responsibilities

General and Ongoing Responsibilities External to the Council:1. Keeps current with laws, regulation and administrative policies governing the practice of pharmacy.2. Has direct responsibility for monitoring and reviewing legislative developments.3. Maintains liaison with other professional health care organizations on matters related to legislation, rules

and regulations affecting health care and pharmacy practice.4. Maintains contact with the New York State Education Department regarding regulatory changes and

interpretations. Maintains communications as needed.5. Attends and testifies at State Legislature and hearings as required.6. Maintains communications with key legislators as appropriate.

IV. New York State Legislation

Lobby Day was April 25th on a rainy day in Albany but also a huge success. We heard opening speeches from Senator Grifo, AM Englebright, and AM McDonald (all of whom sponsored our bills). Hundreds of pharmacy students and pharmacists were there to take meetings with legislators on three bills: intern immunization (S1043 Funke/A2857 McDonald), immunization expansion (which expands the vaccines that pharmacists can give to all CDC vaccines for adults) (S321 Robach/A455 Paulin), and technician registration and certification (S5584 Griffo/A4611 Englebright). The most remarkable part is that the chain pharmacists, PSSNY, The council, and all the pharmacy groups united to advocate for these bills and the profession.

NYSCHP Legislative Priorities for session beginning January 2017: Immunization for interns, national provider status, technician registration/certification, and CDTM

A. Immunization for interns – Assembly Bill A2857 (McDonald), S 1043 (Funke) - This bill authorizes pharmacy interns who have completed the same coursework and training to administer vaccines to adults under the immediate personal supervision of a licensed and certified immunizing pharmacist. We had workgroup ongoing and led by public policy committee member See-Won Seo and includes public policy student members, representatives from colleges of pharmacy, and representatives from public policy committee. The bill has been introduced (see below). The workgroup has written a letter of support to send to AM Glick, talking points for lobbying, etc.

B. Immunization expansion (S321 Robach/A455 Paulin) – This bill removes sunset and adds all CDC-recommended vaccines for adults.

a. Previous vaccines: influenza, pneumococcal, acute herpes zoster, meningococcal, tetanus, diptheria, and pertussis

b. Adds Hep A and B, varicella, HPV, and MMRc. Removes requirement that the physician or nurse practitioner who issues a non-patient-specific

order must be in the same or adjuoining county as the pharmacists who executes the order

C. Provider status – ASHP has put forth The Pharmacy and Medically Underserved Areas Enhancement Act (H.R. 592/ S. 109) is bipartisan legislation that will amend section 1861 (s) (2) of the Social Security Act to include pharmacists on the list of recognized healthcare providers. There are no current updates to this effort.

D. Technician Registration and Certification Bill a. The bill has been introduced: BILL NO A04611A (Engelbright) and S05584-A (Griffo)b. Last year’s version of the bill has been reformatted to State Education Department format c. Bill has been read, vetted, and approved by NYSCHP public policy committee, board, PSSNY,

and 1199. d. The public policy committee developed talking pointse. Now it’s time for grassroots efforts done on the chapter level – letter writing campaigns, etc.

a. A governor’s proposal was sent to us via Jim Lytle regarding CMM (comprehensive medication management) that allows all pharmacists to perform CDTM so long as they have continuing education in this area.

b. A workgroup met to discuss; larger board was included in final dialogue/decision Agreed that CDTM credentials should be incorporated into document Instead of “comprehensive medication management protocol” it should be called

cdtm (since that is what it is) Board of Pharmacy to review and implement Based on Jim Lytle’s advice, we drafted a letter with our stance – but did not

distribute widely because the proposal was not advanced in the house or senate.c. CDTM expansion will come up again next year. We need to be ready – should put together

documents, including ACCP White Paper on pharmacist credentialing, ACPE position statement, North Carolina credentialing requirements, Indian Health Service/VA credentialing requirements. Down the line, create a "how to get credentialed guide" outlining ways to do it (e.g. work with a COP faculty member who is credentialed, figure out which exam is right for you, etc).

The council also supports that the proposed reclassification of oral contraceptives shall be accompanied by coverage changes by third-party payers to ensure that patient access is not compromised and that pharmacists are reimbursed for the clinical services provided.
