PART IPRELIMINARY PROVISIONS

1. This Act may be cited as the Written Laws(Miscellaneous Amendments)(No.2) Act, 2011.

2. The written laws specified in various Parts of this Actare amended in the manner provided for in their respectiveParts.

3. This Part shall be read as one with the HigherEducation Students' Loans Board Act, hereinafter referred toas the "principal Act".

Amend-ment ofsection 5

4. The principal Act is amended in section 5, by-(a) deleting subsection (1) and substituting for it the

following subsection:"(1) The Board shall consist of not less than nine andnot more than fourteen members as follows:

(a) the Chairman;(b) the Director of Higher Education;(c) a representative of the Ministry

responsible for Finance;(d) the Director of Technical Education;(e) a law officer nominated by the

Attorney-General;(f) one member representing the

Employers' Association of Tanzania;(g) a representative of the financial

institutions;(h) one member nominated by an organ

representing the public higher educationinstitutions;

(i) one member nominated by an organrepresenting the private higher educationinstitutions;

G) one member representing the Ministerresponsible for finance in theRevolutionary Government of Zanzibar;

(k) one member representing the TanzaniaCommission for Universities;

(1) one student representing public highereducation institutions;

(m) a student representing private highereducation institutions; and

(n) one eminent person having knowledgeand experience in the management ofhigher learning institutions."

(b) inserting the word "First" between the words "the"and "Second" appearing in subsection (3).

(a) designating section 7(1) as section 7;(b) deleting paragraph (i) and substituting for it the

following paragraphs:"(i) to determine the maximum number of

eligible students to be granted loans ina particular year depending on thebudget allocation; .

G) to issue grants, bursaries andscholarships, subject to availability offunds and under the terms andconditions as the Board may determine;

(k) to liaise and seek information orparticulars from the Tanzania RevenueAuthority, Business Registration andLicencing Agency and social securityfunds for the purposes of recoveringloans granted by the Board to thebeneficiaries. "

(c) re-naming paragraphs G) to (u) as paragraphs (1)t~ (w) respectively.

6. The principal Act is amended in section 16, by addingimmediately after subsection (4) the following newsubsections:

"(5) A loan referred to under this section shall begranted to a student who is directly enrolled to aninstitution of higher education after completion ofsecondary education.

(6) The in-service students shall not be eligiblefor grant of loan under this Act.

(7) Notwithstanding the provisions of sub-sections (5) and (6), a person with equivalentqualifications in the field of national priority shall beeligible for loans.

(8) Subject to the provisions of this Act, the Boardshall charge interest on loans and other financial assistancegranted to students at the rate and manner to be determinedby the Minister."

(a) deleting the marginal note and substituting for itthe following:

"Eligibility for loan" ;(b) deleting the words "an Accredited Institution"

appearing in paragraph (b) and substituting forthem the words "provisional or full accreditedinstitution"; and

(c) adding immediately after subsection (2) thefollowing subsections:

"(3) In determing application for grant ofloan, the means testing shall -

(a) be guided by-(i) applicant academic

performance, neednesss andadmission into programmesof national priorities;

(ii) past record of school fees insecondary schools;

(iii) financial ability of the parentor guardian of thebeneficiary,

(iv) family background in termsof orphanage, physicaldisability.

(4) Notwithstanding subsection (3), theBoard shall, in granting loan, give priority toapplicants admitted to the national prioritycourses prescribed in the Second Schedule tothis Act.

(5) Without prejudice to the provision ofsubsection (4), the Minister may vary thepriority courses specified in· the SecondSchedule.

8 The principal Act is amended in section 20, bydeleting paragraphs (b) and (c) of subsection (l) andsubstituting for them the following:

"(b) deduct 8% of the basic salary for employee who is aloan beneficiary and remit the same to the Board in themanner as the Board shall describe"

9. The principal Act is amended by-(a) renaming the present "Schedule" as the "First

Schedule"; and

(b) inserting immediately after the "First Schedule"as renamed the following new Schedule:

PART VIIAMENDMENT OF THE TANZANIA REVENUE AUTHORITY ACT,

19. This Part shall be read as one with the TanzaniaRevenue Authority Act, hereinafter referred to as the"principal Act".

20. The principal Act is amended in section 8, byinserting immediately after subsection (2) the following-

"(3) Without prejudice to subsections (1)and (2), the Revenue Commissioner or any otherCommissioner or a person employed to carry outthe provisions of this Act, shall, upon request bythe Higher Education Students' Loans Board,

Cap. 178 supply particulars of a taxpayer who is thebeneficiary of the loan under the HigherEducation Students' Loans Board Act.

(4) The Revenue Commissioner or anyother Commissioner, or a person employed toperform functions of discharge duties .under thisAct shall, within thirty days from the date ofrequest by the Higher Education Students' LoansBoard, supply particulars of a tax payer who isthe beneficiary of a joan granted under theHigher Education Students' Loans Board Act."

21. This Part shall be read as one with the BusinessActivities Registration Act, hereinafter referred to as the"principal Act".

22. The principal Act is amended by adding immediatelyafter section 13 the following-

"(1) The Director may, by notice in the Gazette,appoint a person to be a public prosecutor from otherdepartments of the Government, local governmentauthorities, private practice or any lawyer to prosecuteany case on the Director's behalf."

33. The principal Act is amended in section 21, byinserting the phrase "or officer-in-charge" immediately afterthe words "Council Director" appearing in subsection (2).

(a) adding immediately after item (ii) of paragraph(a) the following:"(iii) the District Planning Officer, in the

case of Tanzania Zanzibar;" and(b) adding immediately after item (ii) of paragraph

(b) the following:"(iii) one of the councillors mentioned under

PART XIIIAMENDMENT OF THE PROCEEDS OF CRIME ACT,

35. This Part shall be read as one with the Proceeds ofCrime Act, hereinafter referred to as the "principal Act".

(a) deleting the words "the offence" appearing inparagraph (b) of the definition of the term"tainted property" and substituting for them theword "crime";

(b) deleting the definition of the term "property"and substituting for it the following:

"property" includes:(a) assets of every kind, whether

corporeal or incorporeal, movable orimmovable, tangible or intangible;

(b) legal documents or instruments inany form, including electronic ordigital, evidencing title to or interestin such assets; or

(c) bank credits, travelers cheques,bankers cheques, money order,shares, bonds and other securities,drafts and letters of credits, and anyinterest, dividends or other incomeon or value from or generating bysuch assets whether situated in oroutside the United Republic".

37. The principal Act is amended in section 5 bydeleting the phrase "except section 4" appearing in the firstline.

38. The principal Act is amended in section 12 by -(a) inserting the following new paragraph:

"(a) a person was under investigation for theoffence";

(b) re-numbering paragraphs "(a)" and "(b)" asparagraphs "(b)" and "(c)" accordingly.

39. The principal Act is amended by addingimmediately after section 13 the following new section:

"Confisca- 13A.-(l) Where a person dies whiletion order under investigation or after being chargedwere aperson has but before a conviction, the Attorneydied General may apply to the court for a

confiscation order.(2) The court may grant an

application for confiscation order where itis satisfied, on balance of probabilities,that -

(a) a person was underinvestigation when he diedand reasonable steps havebeen taken to conductinvestigation of an offencealleged to have beencommitted;

(b) a person has been chargedbut dies before theconclusion of the trial,

and there are reasonable grounds tobelieve that a confiscation orderwould have been issued againstthat person ifhe was alive."

40. The principal Act is amended in section 30, bydeleting paragraph (a) appearing in subsection (1) andsubstituting for it the following:

"(a) for any reason to bring the person before thecourt on a charge for any serious offence; or"

(a) deleting subsection (1) and substituting for itthe following:

"( 1) Where, the Attorney Generalor the Director of Public Prosecutionsmay apply to the court for a restrainingorder in terms of this section against allor any specified property of the personis under investigation for a seriousoffence or has been charged with orconvicted of a serious offenceincluding the property acquiredfollowing issuance of restraining orderand property of a person other than theperson who is under investigation orhas been charged with or convicted of aserious offence."

(b) inserting immediately after subsection (5) thefollowing:

"(6) In appointing a trustee interms of subsection (2)(b), the courtshall have regard to the qualificationsof a trustee of the property which isunder restraining order."

42. The principal Act is amended in section 39, bydeleting subsection (4) and substituting for it the following:

"(4) Where the application is madebefore a person is charged, the court shall notissue a restraining order unless the court issatisfied that having regard to the matters

contained in the affidavit, the reasonable stephas been taken to investigate the offenceconcerned. "

PART XIVAMENDMENT OF THE PREVENTION OF TERRORISM ACT,

(CAP.19)

43. This Part shall be read as one with the Prevention ofTerrorism Act, hereinafter referred to as the "principal Act".

44. The principal Act is amended in section 3, byinserting in its appropriate alphabetical order the followingnew definitions:""funds" includes-

(a) assets of any kind, whether tangible or intangible,movable or immovable by whatever meansacquired;

(b) legal document or instrument in any form,including electronic or digital, evidencing title to,or interest in such assets; and

(c) bank credits, traveller's cheque, bankers cheque,money orders, shares, bonds and other securities,draft and letters of credits;"

"property" has the same meamng as ascribed to it III theProceeds of Crime Act;".

45. The principal Act is amended in sections 45 and 46,by deleting the phrase "the Director of Immigration"wherever it appear and substituting for it the phrase "thePrincipal Commissioner of Immigration."

47. The principal Act is amended in section 23, bydeleting subsection( 11) and substituting for it the following:

"(11) For the purpose of this section:""owner" includes a person who has interest in thatproperty and include a third party;"property" includes the property originally in the

possession or under the control of the accusedperson or any property into or for which thatoriginal property is converted or exchange, oranything acquired by such conversion orexchange, whether before or after the accusedwas apprehended;".

17A means subordinate court; and(b) in respect of offences under sections 16, 18, 19,

20,21 and 23 means the High Court".

50. The principal Act is amended in section 12, bydeleting the words "manufactured drugs" and the phrase "orany preparation containing any manufactured drugs"appearing in paragraph (d).

·51. The principal Act is amended in section 16 by-(a) deleting paragraphs "(a)" and "(b)" and

substituting for them the following:"(a) found in possession or does any act

or omits to do any act or thing inrespect of narcotic drugs or anypreparation containing anymanufactured drugs commits anoffence and upon conviction shallbe sentenced to life imprisonmentwithout parole remove; and

(b) traffics in any narcotic drug orpsychotropic substance commits anoffence and upon conviction shallbe sentenced to life imprisonmentwithout parole remove."

(b) deleting subsection (2).

52. The principal Act is amended by adding immediatelyafter section 17 the following new section:

"Penalty inrespect ofsmoking,inhalingsniffing orotherwiseusingnarcoticdrugs

17A. A person who-(a) smokes, inhales, sniffs, or

otherwise uses any narcoticdrug or psychotropicsubstances;

53. The principal Act is amended in section 17, byadding immediately after subsection (3) the following -

"(4)(a)

Any person who -smokes, inhales, sniffs or otherwise uses anynarcotic drugs or psychotropic substances;without lawful and reasonable excuse, is foundin any house, room or place for the purposes ofsmoking, inhaling, sniffing or otherwise usingnarcotic drugs or psychotropic substances;being owner or occupier or concerned in themanagement of any premises, enclosure orconveyance, permits it to be used for thepurpose of-

(i) preparation of opium for smoking orsale or the smoking, inhaling, sniffingor otherwise using any narcotic drugsor psychotropic substances;

(ii) manufacturing, producing, selling orsmoking, inhaling, sniffing orotherwise using any narcotic drug orpsychotropic substances; or

is in his possession any pipe or other utensilfor use in connection with the smoking,inhaling, sniffing or otherwise using of opium,cannabis, heroin or cocaine or any utensil usedin connection with the preparation of opium or

57. The principal Act is amended in section 17A(2) bydeleting paragraph (a) and substituting for it the following:

This Bill makes legislative proposals for amendments of lawsspecified in Parts II to Part XVIII with a view to remove shortfallsthat have been experienced in the course of administration of thelaws. Addition of various provisions is intended to either smoothenor harmonizes the provisions of the amended laws and other existinglaws, or to facilitate effective implementation of the amended laws.

Part I provides for preliminary provisions which include theshort title and a statement underlying the purposes of the Bill.

Part II intends amend the Higher Education Student's LoansBoard Act, Cap 178. Clause 4 of the Bill makes amendment tosection 5 of that Act with the view to include, in the composition ofthe Board, a representative from Tanzania Commission forUniversities (TCU). Currently the TCU has no representative in theHigher Education Student's Loans Board.

Clause 5 of the Bill proposes amendment to section 7 of theAct with the view to enhance and facilitate the tracing of the loans toenable the Board to recover its debts through Tanzania RevenueAuthority (TRA) which registers all tax payers, Social SecurityFunds which cater for social security.

Hence, section 7 is amended by deleting paragraph (i) byinserting a new provision which determines the maximum number ofeligible students to loans in a particular year. The loans granted tostudents depend on the budget allocated to the Board in that

particular year. It further provides that loans' may be granted tostudents depending on the past records of school fees payment insecondary and primary.' This section also provides that the Boardmay issue grants, bursaries and scholarship, subject to availability offunds under the terms and conditions as the Board may considerfrom time to time. It further empowers the Board to liaise with andseek from the TRA, the Business Registration and LicensingAuthority and Social Security Funds for the purposes of tracing andaccessing particulars on loans beneficiary for the purposes ofrecovering loans granted by the Board to the beneficiariesto traceand access particulars of the loans beneficiaries so as to recoveryloans granted to the former beneficiaries.

Clause 6 of the Bill proposes amendment to section 16 of theAct. This section deals with the provision of students' loans. Thelaw, states that a students shall be eligible for consideration for aloan if he has been admitted to an accredited institution. Theeligibility does not consider whether a student is directly enrolled toan institution of higher education after completion of secondaryeducation or is a pre-service student. The law also shows that loansare provided to cover six segments, whereby three of them aredetermined by use of means testing" and remain three are grantedwithout being tested. The proposed amendment is to the effect thatloans shall be granted particularly to the students who are directlyenrolled to an institution of higher education after completion of.secondary education, the pre-service students shall not be eligible forconsideration for loans under this Act.

Clause 7 of the Bill proposes amendment to section 17 of theAct. This section deals with the eligibility for assistance. Under thissection, loans are granted to students admitted to an accreditedinstitutions and partial accredited/ temporary accredited no interest isimposed on the loans although the law confer on the Board thepower to determine interest on loans granted. In determining the

granting of loans of different categories, the criteria shall be a meanstesting. The granting of loans according to the law depends onacademic performance and areas of National preference. Theamendment is intended to cure the following:

(a) loans be granted to students who are admitted to a fullor provisional registered accredited institution;

(b) loans granted be imposed of interest at the rate the boardmay determine;

(c) grounqs for granting loans shall be performance of thest"d~nt at the passing rates of divisions one and two,together with the historical background of a studentseeking for a loan;

(q) loans at the rate of 100% shall be granted to studentstaking priority courses in agricultural and livestocksciences, engineering science, medical science andscience and mathematical teaching.

Part III proposes the amendment to the Public ServiceRetirement Benefits Act, Cap. 371. The provisions of the Act do notallow the Fund to disclose or supply particulars of its contributors toany person. The amendment is intended to insert a section whichallows the Board upon request by the Higher Education Student'sLoan Board to disclose or supply the particulars of its contributorswho are beneficiaries of loans in order to facilitate recovery of loans.

Part IV proposes the amendment to the ParastatalOrganizations Pensions Scheme Act, Cap. 372. The Act does notallow the Fund to disclose particulars of its contributors to anyperson. The amendment is intended to insert a new section whichallows the Board upon request by the Higher Education Student'sLoans Board to disclose or supply the particulars of its contributorswho are beneficiaries of loans in order to facilitate recovery of loans.

Part V proposes the amendment to the Local GovernmentAuthorities Provident Fund Act, Cap. 407. The Act does not allowthe Fund to disclose particulars of its contributors to any person. Theamendment is intended to insert a new section which allows theBoard upon request by the Higher Education Student's Loans Boardto disclose or supply the particulars of its contributors who arebeneficiaries of loans in order to facilitate recovery of loans it furtherimposes sanction for non compliance of the request by the HigherEducation Student's Loans Board.

Part VI proposes the amendment of the National SocialSecurity Fund Act, Cap.50. Under this Act, there are no anyprovisions which allow the Fund to provide particulars of the insuredperson; hence the purpose of this amendment is to insert a provisionwhich instructs the Fund on request to provide particulars to theHigher Education Students'Loans Board.

Part VII proposes amendment to the Tanzania RevenueAuthority Act, Cap 399. Under this Act, section 8 deals withconfidentiality in relation to documents and information relating tothe income, expenditure or other financial dealings or status of anytax payer. Since this section restricts supplying any information toany other party, then amendment is proposed to allow someparticulars requested by the Higher Education Student's Loan Boardbe supply for recovery loans.

Part VIII proposes the amendment to the Business ActivitiesRegistration Act, Cap. 208. In this Act, there is no a provisionwhich allows the Chief Registrar to disclose or supply particulars ofapplicants for registration, hence the purpose of this amendment is toinsert a section which allows the Chief Registrar upon request by theHigher Education Student's Loans Board to disclose or supply theparticulars of its contributors who are the beneficiaries of the loan inorder to facilitate recovery of such loans.

Part IX intends to make amendment in section 18 of theNational Prosecution Services Act, Cap.430. Section 18 of this Actempowers the Director of Public Prosecution to issue Orders,guidelines and instructions for the observance of all offices in theservice, but such provision is silent as to whether such such order,guidelines and instructions have to be published in the Gazette. Thepurpose of this amendment is to introduce a provision in section 18which shall require that the orders, guidelines and instruciions issuedby the Director may be published in the Gazette.

Part X proposes amendment to the Police Force and AuxiliaryServices Act, Cap.322. Section 8 of this Act empowers theInspector-General of Police to make orders for the generalgovernment of Force in the discharge of its duties. There is nospecific provision which requires such orders to be published in theGazette. The purpose of this amendment is to introduce a provisionwhich requires that orders issued by the Inspector-General of Policemay be published in the Gazette.

Part XI intends to amend the Road Traffic Act. Clause 27 ofthe Bill proposes amen dement to section 25 of the Road Traffic Act,Cap.168. The purpose of this amendment is to introduce a newsection which shall be dealing with licence point system. Thisintroduction of a new section is intended to impose liability to alicence holder to adhere to the driving licence conditions in order toreduce accidents.

Part XII proposes amendments of various provisions of theConstituencies Development Catalyst Fund Act, (Cap.96). Theamendments are intended to be effected in sections 3, 4, 21 and 22.The amendment in section 3 is aimed to widen the definition of theterm Minister which shall extends to the Minister incase of Zanzibar,the Minister of State in Vice President's Office-Union Affairs. The

amendment is also intended to be effected in section 4 whereby theofficer incharge will be recognized under this Act as theadministrator of the Constituency Development Catalyst Fund inTanzania Zanzibar. This Part further proposes amendment to section21 whereby the officer incharge in the case of Tanzania Zanzibarshall be the Accounting Officer of the Constituency DevelopmentCatalyst Fund of every elected Constituency which is situated in hisarea. Lastly the amendment is intended to be effected in section 22by adding the District Planning Officer and one of the Councilorsmentioned in section 1O( 1)(c), in the case of Tanzania Zanzibar assignatories from groups A and B respectively.

Part XIII proposes amendments to the Proceeds of Crime Act,Cap.256. The amendments are intended to be effected in differentsections to wit; section 3, the definitions of the terms "taintedproperties" "property" and "trustee" are re-defined to widen itsscope so as they may cover the intended intention this Act. This partproposes the amendment of the section 5, whereby the phrase"except section 4" which appears in section 4, leaves section 4(1)( c)redundant, therefore this phrase is proposed to be deleted. Aproposal to amend section 12 is intended to cure the situationwhereby a person who is under investigation, if he abscond, then thecourt may issue an order of confiscation of property. This part alsocures a situation that, when the matter is still pending in court, andan accused person dies, then the amendment is intended to allow theAttorney General may be allowed to apply to the court for a'confiscation order. Proposal to amend section 30 is intended toempower the Attorney General to file an application for forfeituremay be made against a person who can not be charged in court. Thispart further proposes amendments to sections 38 and 39 to allow thecourt to issue restraining order to be issued during investigation inorder to prevent the accused not to hide or dispose of properlyinvolved or derived from the commission of a crime. Section 38 isfurther amended to provide for guidance to court when appointing a

trustee who will take care and keep in custody the property whichare under restraining orders.

Part XIV proposes amendments to the Prevention ofTerrorism Act, Cap.19. The amendment is proposed to be effectedin the definition of the terms "property" and "fund". The purposes ofthese amendments are to bring inconformity the provisions of thisAct and other Acts, such as the Proceeds of Crime Act, Cap.256.

Part XV proposes amendments to the Economic andOrganized Crime Control Act, Cap.200. The amendment isintended to be effected in section 23. This section provides forforfeiture of property used in facilitating the commission of aneconomic offence. The provision protects the interest of owners ofproperty, the person who has interest in that property and includes athird party. The interests of these people are not protected under theAct, hence the term "owner" is defined to include "a person who hasinterest in that particular property and include a third party".

Part XVI proposes amendment to the Drugs and Prevention ofIllicit Traffic in Drugs Act, Cap.95. The proposed amendments isintended to be effected in section 2 by defining the term "Court" inorder to categorise the offences triable by the subordinate courts andthe High Court. Section 12 deals with cultivation of plants whichproduces drugs and psychotropic substance, but the content inparagraph (d) mixed with the words "manufacture drugs" and thephrase "or any preparation containing any manufactured drugs",these offences are triable by the High Court, hence the words and thephrase seems to be misplaced, therefore proposed to be deleted.Section 16 deals with criminalization to a person who is found inpossession or trafficking of drugs in large quantities. The purpose ofamendment is to cure the mischief and confusion amongst judicialofficers regarding the quantity of drugs found in possession.Amendment is further made by inserting a new section 17A which

provides for an offence and penalty to a persons found smoking,inhaling sniffs of narcotic drugs or psychotropic substance, or beingan occupier if a premise, enclosure or conveyance permits suchpremise, enclosure or conveyance to used as a preparation area ormanufacturing point of narcotic drugs or psychotropic substances.

Part XVII deals with the proposed amendment to theEvidence Act, Cap.6. Section 34B provides for a situation where awitness can not be procured to testify in court. Under this section,the witness statement may be produced and admitted in court asevidence but subject to some conditions set under this section.Among the condition is that, there shall not an objection from theother parties within ten days from the day of service of notice toproduce the statement. Under this condition, the court is notrequired to determine the merits to the objection, hence, the courtmay decide on its own either to accept the statement or to reject it. Itis now proposed that the court shall have power to determine theobjection and see weather the objection has merit or not. Therefore,section 34B(2)(e) is amended by inserting a proviso which shallrequire the court to determine the merits of the objection.

Part XVIII intends to amend the Cashewnut Industry Act,Cap. 203. Section 17A empowers the Tanzania Revenue Authorityto compute and collect export levy for any exported raw cashewnuts.The amount of levy collected under this section is distributed at therate of sixty five (65%) be remitted to the cashewnuts Industry.Development Trust Fund, and thirty five (35%) be remitted to theConsolidate Fund. The purpose of the amendment is to show thatthe 65% of the levy collected shall be divided amongst districtcouncils which are cashewnuts producers and not to be remitted tothe Cashewnuts Industry Developemnt Trust Fund.

Sheria ilivyo kwa sasa inaelekeza mikopoitolewe kufuatana na vigezo vya ukopeshaji vilivyowekwa naSerikali ambavyo vinaruhusu wanafunzi wengi kukopeshwa bilakuzingatia ukomo wa bajeti na pia hakuna ukomo wa kiasi chamkopo unaotolewa kwa kila mwanafunzi. Sheria pia haijabainishamuda na uwezo wa mwanafunzi wa kurejesha mikopo. Kutokana namapungufu hayo, kifungu cha saba kinafanyiwa marekebisho kwakufuta aya (i) na kuiandika upya ili kubainisha kuwa mikopo kwawanafunzi wanaostahili itatolewa kulingana na ukomo wa bajeti yaSerikali katika mwaka wa fedha husika kwa kuzingatia uwezo wakiuchumi wa wazazi au walezi wa mwanafunzi. Kifungu hiki kinahusiana na utoaji wa mikopo kwa wanafunzi.Sheria kwa sasa inaonyesha kuwa mikopo hutolewa kwa wanafunziwote wanaopata udhamini kwenye taasisi za elimu ya juu bila kujalikama amejiunga kwa sifa linganishi, ametoka kazini au shuleni mojakwa moja. Sheria pia inaonyesha Serikali inatoa mikopo katikavipengele sita, miongoni mwa vipengele hivyo, vipengele vitatuhavifanyiwi "Means Testing". Mapendekezo ya Marekebisho hayayanalenga kuondoa mapungufu yanayojitokeza kwa kuongezavifungu vidogo vinavyoonyesha kuwa, kwa sasa mikopo itakuwainatolewa hasa kwa wanafunzi wanaotoka mashuleni moja kwa

moja, wanafunzi wanaotoka makazini hawatakuwa na sifa yakufikiriwa kupata mikopo na mwisho, utoaji wa mikopo kwawanafunzi kwa vipengele sita vilivyotajwa katika kifungu hiki nilazima vipengele vyote vifanyiwe "means testing".

Marekebisho yanapendekezwa kufanyika katika kifungu cha17. Kifungu hiki kinahusiana nahaki ya wanafunzi ya kupatamikopo. Mikopo kwa sasa kwa mujibu wa Sheria hutolewa kwawanafunzi wa Taasisi na vyuo vyote vya Elimu ya luu hata vyenyeusajili wa muda. Mikopo inayotolewa kwa wanafunzi wa Elimu yaluu haitozwi riba pamoja na kwamba Sheria hii inaruhusu Bodi yaMkopo kutoza riba katika mikopo inayotolewa. Kwa mujibu waSheria, vigezo zinavyotumika ili kung'amua na kupanga madaraja yamikopo ni vingi na vinahitaji taarifa nyingi ambazo wakatimwingine inakuwa vigumu kuzihakiki, hivyo sehemu kubwahutegemea taarifa ashiria. Mikopo hutolewa kwa wanafunzi wotewenye ufaulu wa daraja la I na II na pia hutolewa kwa kiwango chaasilimia mia moja (100%) kwa wanafunzi waliodahiliwa kwamasomo ya Sayansi bila kujali wanafunzi hao wanatoka kwenyefamilia zenye uwezo wa kiuchumi kupewa mikopo na kupunguzaidadi ya wanafunzi wanaotoka familia duni. Kutokana namapungufu hayo, Kifungu hiki kinarekebishwa ili kubainisha kuwa-

(a) mikopo itatolewa tu kwa wanafunzi wanaodahiliwakatika vyuo vya Elimu ya luu vyenye usajili wa mud ana usajili kamili (provisional and full registration);

(b) mikopo itakayokuwa inatolewa kwa wanafunzi, itozweriba kwa kiwango cha kulinda thamani ya fedhailiyotolewa kama mkopo;

(c) kigezo cha ufaulu wa daraja la I na II kwa wanafunziwaliohitimu kidato cha Sita kizingatie uwezo wakiuchumi na mwombaji na ubaini wa wahitaji wamkopo uzingatie vigezo vinavyopimika kwa urahisikama vile ada za shule alikosoma, uyatima na ulemavu;

(d) utoaji mkopo kwa asilimia mia moja uwe ni kwawanafunzi wanaodahiliwa kwenye fani kipaumbelekama vile ualimu katika masomo ya sayansi, mahesabu,madaktari wa binadamu, wataalam wa kilimo namifugo.

Sehemu ya III inapendekeza kufanya marekebisho kwenyeSheria ya Mfuko wa Mafao ya Wastaafu Watumishi wa Umma, Suraya 371. Katika Sheri a hii, hakuna kifungu kinachoruhusu Mfukokutoa taarifa maalum za wachangaji wa Mfuko. Lengo laMarekebisho haya ni kuingiza kifungu kipya cha Sheriakinachoiruhusu Bodi kutoa taarifa maalum za wanachama wa mfukoambao walikuwa wanufaika wadaiwa wa Bodi ya Mikopo wa Elimuya juu, ili kurahisisha urejeshaji wa mikopo hiyo.

Sehemu ya IV inapendekeza kufanya marekebisho katikaSheria ya Mafao ya Watumishi wa Mashirika ya Umma, Sura ya372. Katika Sheri a hii, hakuna kifungu kinachoruhusu Mfuko kutoataarifa maalum za wanachama wa Mfuko. Lengo la Marekebishohaya ni kuingiza kifungu kipya cha Sheria kinachoiruhusu Bodikutoa taarifa maalum za wanachama wa mfuko ambao walikuwawananufaika wadaiwa wa Bodi ya Mikopo wa Elimu ya juu, ilikurahisisha urejeshaji wa mikopo hiyo.

Sehemu ya V inapendekeza kufanya marekebisho katikaSheria ya Mfuko wa Mafao kwa Watumishi wa Serikali za Mitaa,Sura ya 407. Katika Sheria hii, hakuna kifungu kinachoruhusuMfuko kutoa taarifa maalum za wachangaji wa Mfuko. Lengo laMarekebisho haya ni kuingiza kifungu kipya kinachoiruhusu Bodikutoa taarifa maalum za wanachama wa mfuko ambao walikuwawanufaika wadaiwa wa Bodi ya Mikopo ya Elimu ya juu, ilikurahisisha urejeshwaji wa mikopo hiyo.

Sehemu ya VI inapendekeza marekebisho katika Sheria yaMfuko wa Taifa wa Hifadhi ya lamii, Sura ya 50. Katika Sheria hiihakuna kipengele chochote kinachoupatia mfuko haki ya kutoataarifa za wanachama wa mfuko. Hivyo basi, lengo la marekebishohaya ni kuifanyia Sheria marekebisho ili kiwepo kipengelekinachoutaka mfuko utakapoombwa kufanya hivyo na Bodi yaMikopo wa Elimu ya luu.

Sehemu ya VII, inapendekeza kufanya marckebisho katikaSheria ya Mamlaka ya Mapato Tanzania Sura ya 399. Katika Sheri ahii kifungu cha 8, kinahusiana na usiri wa nyaraka au taarifazinazohusiana na mapato, matumizi au shughuli nyingine za kifedhaau hadhi ya mlipa kodi. Kwa vile kifungu hiki kinakataza utoaji wataarifa kwa mtu mwingine, kifungu hiki kinarekebishwa ili kuruhusuutoaji wa taarifa zinazoombwa na Bodi ya Mikopo wa Elimu ya luukwa lengo la kurahisisha urejeshwaji wa mikopo ya elimu ya juu.

Sehemu ya VIII inapendekeza kufanya marekebisho katikaSheria ya Usajili wa Shughuli za Biashara, Sura ya 208. KatikaSheria hii hakuna kifungu kinachomruhusu Msajili Mkuu waBiashara kutoa taarifa za waombaji wa usajili. Kutokana namapungufu hayo, mapendekezo ya kuingiza kifungu kipyakitakachomruhusu Msajili Mkuu kutoa taarifa za waombaji wausajili kwa Bodi ya Mikopo wa Elimu ya luu kwa ajili yakurahisisha urejeshwaji wa mikopo.

Sehemu ya IX inapendekezwa kufanya marekebisho katikakifungu cha 18 cha Sheria ya Uendeshaji wa Mashitaka, Sura ya430. Kifungu cha 18 cha Sheria hii kinampa Mamlaka Mkurugenziwa Mashitaka kutoa amri, miongozo na maelekezo ambayo maafisawaendesha mashitaka wanapaswa kuyafuata. Kifungu hichohakielezi iwapo amri, miongozo na maelekezo hayo ni lazimayachapishwe katika Gazeti la Serikali. Lengo la marekebisho haya,ni kuweka kipengele katika Sheria hii kinachoelekeza kuwa amri,

miongozo na maelekezo yanayotolewa na Mkurugenzi wa Mashitakayanaweza kuchapishwa katika Gazeti la Serikali.

Sehemu ya X inapendekeza kufanya marekebisho kwenyeSheria ya Jeshi la Polisi na Huduma za Polisi Sura ya 322. Kifungucha 7 cha Sheri a hii kinampa mamlaka Inspekta Jenerali wa Polisikutoa amri mbalimbali, za jumla kwa lengo la kulisimamia Jeshi laPolisi katika kutekeleza majukumu yake. Katika Sheria hii hakunakipengele chochote kinachoelekeza endapo amri hizo ni lazimazichapwe kwenye Gazeti la Serikali. Lengo la marekebisho haya nikuingiza katika Sheria kipengele kinachoelekeza kuwa amrizinazotolewa chini ya kifungu cha saba zinaweza kuchapishwakatika Gazeti la Serikali.

Sehemu ya XI inalengo la kufanyamarekebisho katikakifungu cha 25 cha Sheria ya Usalama Barabarani, Sura ya 168.Madhumuni ya marekebisho haya yanalenga kuanzisha kifungukipya ndani ya Sheria hii cha kushughulikia na kusimamia leseni yaudereva. Kifungu hicho kinaweka utaratibu wa leseni za uderevakupewa alama maalumu kwa namba, na pale mwenye lesenianapotenda kosa, basi, alama hizo zitakuwa zikipunguzwa.Kuingizwa kwa kifungu hiki kipya kunalenga kuwawajibisha wenyeleseni za udereva kufuata masharti yaliyopo katika leseni zao zaudereva kwa lengo la kupunguza ajali za barabarani.

Sehemu ya XII inapendekeza marekebisho ya vifungu'mbalimbali vya Sheri a ya Mfuko wa Kuchochea Maendeleo yaJimbo (Sura ya 96). Marekebisho yanatarajiwa kufanywa katikavifungu cha 3, 4, 21 na 22. Marekebisho kwenye Kifungu cha Tatu(3) yanalenga kupanua tafsiri ya neno "Waziri" Hi kumhusishaWaziri Wa Nchi-Ofisi ya Makamu wa Rais- Masuala ya Muungano.Marekebisho pia yanakusudiwa kufanywa katika kifungu cha (4)kwa kumtambua Afisa Kiongozi kuwa Msimamizi wa Mfuko wakuchochea Maendeleo ya limbo kwa upande wa Tanzania Zanzibar.

Sehemu hii inapendekeza pia marekebisho katika kifungu cha 21kwa kumweka afisa kiongozi kwa upande wa Tanzania Zanzibarkuwa Muwajibikaji Mkuu wa Mfuko wa Kuchochea Maendeleo yaJLnbo. Mwisho marekebisho yanapendekezwa katika kifungu cha22 kwa Afisa Mipango wa Wilaya na mmoja kati ya Madiwaniwaliotajwa katika kifungu cha 1O(c) watakuwa ndio watia sainiwateule wa kundi A na B kwa pamoja kwa upande wa TanzaniaZanzibar.

Sehemu ya XIII inapendekeza marekebisho kwenye Sheria yaMapato kwa njia ya Uhalifu, Sura ya 256. Mapendekezo yamarekebisho yanayokusudiwa yanalenga vifungu mbalimbali, ikiwani pamoja na kifungu cha 3. Kifungu cha tatu (3) kinahusiana natafsiri ya baadhi ya maneno. Mapendekezo yanatarajia kurekebishatafsiri ya neno "tainted properties" "property" na "trustee". Lengo lamarekebisho haya ni kutoa tafsiri pana zaidi ili iweze kukidhimatumizi yaliyokusudiwa katika Sheria. Kifungu cha 5kinapendekezwa kifanyiwe marekebisho ili maneno "except section4" yaondolewe kwa kuwa uwepo wa maneno hayo unaondoa maanaya kifungu cha 4( 1)(c). Marekebisho yanapendekezwa kufanywakatika kifingu cha 12 ili kuondoa utata uliopo. Kwa sasa palemtuhumiwa anayepelelezwa anapotoroka,l mahakama haina uwezowa kutoa amri ya kufilisi mali ya mtuhumiwa huyo. Sehemu hii piainaondoa utata uliokuwepo wa mtuhumiwa anayepelekezwaaliyeshtakiwa na ambaye hukumu ha'ijatolewa anapofariki,mahakama, mahakam a ilikuwa haina mamlaka ya kutoa amri yakufilisi mali ya mtuhumiwa huyo. Mapendekezo ya marekebishoyanalengwa kufanywa katika kifungu cha 30 ambacho kin~husianana mamlaka ya kutaifisha mali. Kifungu hiki pia kinafanyiwamarekebisho ili kumpa Mwanasheria Mkuu wa Serikali mamlaka yakutaifisha mali ya mtu ambaye hawezi kushitakiwa mahakamani.Sehemu hii pia inapendekeza marekebisho katika vifungu cha 38 na39 ili kuruhusu amri ya zuio iweze kutolewa na Mahakama wakatiupelelezi unafanyika ili kumzuia mtuhumiwa kuhamisha au kugawa

mali iliyopatikana kwa njia isiyo sahihi. Kifungu cha 38kinafanyiwa marekebisho pia ili kiweze kutoa mwongozo ambaomahakama itautumia katika kumteua msimamizi wa maliiliyozuiliwa wakati tuhuma zikipelelezwa.

Sehemu ya XIV inapendekeza marekebisho katika Sheria yakuzuia Ugaidi, Sura ya 19. Mapendekezo yanalenga kurekebishakatika tafsiri ya baadhi ya maneno kama vile "property" na "fund" ilikutoa tafsiri inayofanana na sheria ya Mapato kwa Njia ya Uhalifu,Suraya 256.

Sehemu ya XV inapendekeza marekebisho katika Sheria yaUhujumu Uchumi, Sura ya 200. Mapendekezo yanalengakurekebisha kifungu cha 23 kinachohusu kutaifisha mali au kifaakilichohusika aukusaidia kutendeka kwa kosa la jinai kwa mujibuwa Sheria hii. Kifungu hiki kinamtambua mwenye mali aliyekutwanayo, bila kujali kuwa mali hiyo inaweza kuwa ya mtu mwingine.Marekebisho haya yanalenga kutoa tafsiri ya neno "owner" ililihusishe hata yule mtu wa pembeni, mmiliki lakini asiyehusika natukio (third party).

Sehemu ya XVI inapendekeza marekebisho katika Sheria yaKuzuia na Kusafirisha Madawa ya Kulevya, Sura ya 95.Marekebisho yanapendekezwa kufanyika katika kifungu cha 2 ilikutoa tafsiri sahihi ya neno "court" na kuonesha aina gani ya makosayatafunguliwa mahakama za kawaida na ni makosa gani'yatafunguliwa Mahakama Kuu. Kifungu cha 12 kinahusiana namakosa ya kulima mmea wowote unaohusiana na madawa yakulevya, katika kifungu hicho, neno "manufactured drugs" nakifungu cha maneno "or any preparation containing anymanufactured drugs", haya ni makosa yanayosikilizwa naMahakama Kuu, na sio mahakama ya Hakimu Mkazi, hivyo manenoyao ndani ya kipengele cha (d) yapo kimakosa, hivyo yafutwe ilikuondoa utata.
