Introduction:

TheDrugFreeSchoolsandCampusesRegulations(34CFRPart86)oftheDrug-FreeSchoolsandCommunitiesAct(DFSCA)requireaninstitutionofhighereducation(IHE)suchasMillersvilleUniversitytocertifyithasimplementedprogramstopreventtheabuseofalcoholanduseordistributionofillicitdrugsbothbyMillersvillestudentsandemployeesonitspremisesandasapartofanyofitsactivities.Ataminimumeachinstitutionofhighereducationmustannuallydistributethefollowinginwritingtoallstudentsandemployees:

• Standardsofconductthatclearlyprohibittheunlawfulpossession,useordistributionofillicitdrugsandalcoholbystudentsandemployees;

• Adescriptionofthelegalsanctionsunderlocal,state,orfederallawfortheunlawfulpossessionordistributionofillicitdrugsandalcohol;

• Adescriptionofanydrugoralcoholcounseling,treatment,orrehabilitationorreentryprogramsthatareavailabletoemployeesorstudents;and

• Aclearstatementthattheinstitutionwillimposesanctionsonstudentsandemployeesandadescriptionofthosesanctions,uptoandincludingexpulsionorterminationofemploymentandreferralforprosecution,forviolationsofthestandardsofconduct.

Thelawfurtherrequiresthattheinstitutionconductabiennialreviewofitsprogramwiththefollowingobjectives:• Determiningtheeffectivenessofthepolicyandimplementingchangestothealcoholandotherdrug

programsiftheyareneeded;and• Toensurethatthesanctionsdevelopedareenforcedconsistently.

MillersvilleUniversityacknowledgesitslegalobligationtoconductabiennialreviewofcompliancewiththeDrug-FreeSchoolsandCommunitiesActandauthorizedanadministrativereviewtobeconductedtodetermineifthecollegefulfillstherequirementsofthepreviouslymentionedFederalregulations.Thepurposeofthisreportistocomplyasbestaspossible,usingdatacollectedoverthepasttwoyears.Thefollowingcampusunitsprovidedinformationforbiennialreports:

DrugandAlcoholPolicy TheUniversitycomplieswithfederal,stateandlocallawsincludingthosethatregulatethepossession,saleanduseofalcoholicbeveragesandcontrolledsubstances.MillersvilleUniversitystudentswhouse,sell,exchange,consume,orpossessalcoholicbeveragesorillegaldrugsordrugparaphernaliaonUniversitypropertyoratUniversityfunctionswillbedealtwithinaccordancewiththeUniversityjudicialpolicyaswellasCommonwealth,federalandlocallaws.NonStudentsandemployeeswhoviolatetheUniversity’spoliciesandwhoseactionsarenotincompliancewiththeorderlyoperationoftheUniversitywillbeprosecutedinaccordancewithCommonwealth,federalandlocallaws.NonStudentsinvolvedinon-campusviolationofthesepoliciesmaybebannedfromUniversityproperty.MillersvilleUniversitystudentsneedtobeawareoflocal,stateandfederallaws,asviolationsmayhavelong-termeffectsontheirlives.Examplesinclude:

1. PennsylvaniaAct31concernsunderagedrinkingincluding:misrepresentationofagetosecureliquor;purchase,consumption,possessionortransportationofintoxicatingbeverages;carryingafalseidentificationcardandusingsametoobtainorattempttoobtainliquor.Inadditiontofinesforconvictionoftheseoffenses,thecourtwillorderthemotorvehicleoperatingprivilegesofthepersonsuspended,andacopyoftheorderwillbesenttotheDepartmentofTransportation.Thesuspensionwillbe90daysforthefirstoffense,oneyearforthesecond,twoyearsforanyoffensethereafter.

2. PennsylvaniaHouseBill1139requirespublicandprivateschools,intermediateunitsandareavocational-technicalschoolstorequireprospectiveemployeestosubmitwiththeiremploymentapplicationareportofcriminalhistoryrecordinformationfromthePennsylvaniaStatePoliceorastatementfromtheStatePolicethatthecentralrepositorycontainsnosuchinformationrelatingtothatperson.ManyMillersvilleUniversitystudentsintendtobecomeeducatorsandneedtobeawareoftheseprovisions.

3. Pennsylvanialawnowrequiresparentalnotificationforallalcohollawviolationswheretheoffenderislessthan21yearsofage.

Inadditiontothelifeimpactrelatedtoacriminalrecord,theUniversitywishestoremindemployees,studentsandothermembersofthecampuscommunityofthemanypsychologicalandphysicalrisksassociatedwiththeabuseofalcoholandothersubstances.Alcoholabuseisclearlyassociatedwithimpairmentofacademicfunctioningandstudentsoftenfinditdifficulttomaintaintheiracademicfocusandmeettheirresponsibilities.Alcoholisfrequentlyrelatedtopooracademicachievement,lowGPA orthedecisiontoleaveschoolwithoutadegree.Thefollowinglistincludessomeadditionalinformationabouttherisksassociatedwithdrugandalcoholuse.

• Anydrug,evenover-the-counteroradoctor’sprescription,haspossiblesideeffectsthatcancauseimpairments.Therearenoguidelinesfortheuseofillegaldrugs,andonecanneverbesureoftheirstrengthorpurity.

• Cocaineisahighlyaddictivedrug--bothpsychologicallyandphysically.• Alcoholisadepressantdrug;itslowsthecentralnervoussystem.Impairsjudgementandinhighdoses

canbefatal.• THC,theactiveingredientinmarijuana,remainsinyourbodyforonemonthfollowinguse.THC

concentrationhasbeenincreasinginmarijuanawhichincreasestheriskofharmfuleffects.• Marijuanasmokeproducesalloftheharmfuleffectsoftobaccosmokeandcontains50percentmoreof

thecancer-causingchemicals.• Alcoholisfrequentlyassociatedwithsexualviolence,daterape,poorsexualdecisionsaswellas

accidentalinjuryanddeath.Alcoholisassociatedwith the death ofover1,700collegestudentseachyear.

StaffmembersatHealthServices,theCenterforHealthEducation&PromotionandtheCenterforCounselingandHumanDevelopmentcanprovideadditionalinformationandservicesrelatingtosubstanceabuseproblemsincluding:

• Accidentsduetoimpairedjudgment• Unwantedsexualactivity• Physicaldamagetoincludeheart,lungandliverproblems• Physicalandpsychologicaldependence

• Difficultyinlearningandattention

Drug-FreeWorkplacePolicy PAStateSystemofHigherEducationBoardofGovernorshadadoptedadrug-freeworkplacepolicy(1989-02).Itstates,TheStateSystemofHigherEducation,CommonwealthofPennsylvania,herebydeclaresasitspolicythattheunlawfulmanufacture,distribution,dispensation,possessionoruseofacontrolledsubstanceisprohibitedatanyworkplaceundertheauthorityoftheBoardofGovernors.AnyemployeeviolatingthepolicywillbereferredtotheCommonwealth’semployeeassistanceprogramand/ordisciplined,inanappropriatemanner,uptoandincludingtermination.Discipline,whenappropriate,shallbetakenunderrelevantprovisionsofcollectivebargainingagreements,CivilServiceCommissionpolicy,orotherhumanresourcepoliciesadoptedbytheBoardofGovernors.

StudentCodeofConduct MillersvilleUniversitywantstoensurethatallofourstudentsandstudentorganizationshavearichandworthwhileeducationalexperienceinacivilenvironment.Inordertomaintainsuchanenvironment,MillersvilleUniversityhasadoptedthisStudentCodeofConductinsupportofitsmissiontopreparestudentstobecomewell-roundedindividualswhobecomeinvolvedinproductiverolesascivicandcommunity-engagedleadersandcitizens.TheStudentCodeofConductreflectstheUniversitycommunity’sconcernthatstudentsandstudentorganizationsonourcampusandinourcommunitiesmaintainthehigheststandardsofconduct.Itguaranteesdue processandprotectstheindividualfreedomsofourstudentswhileholdingstudentsaccountableforconductthatviolatesthetermsoftheCode.Disciplinaryactionmaybeimposedonastudentwhoseconductviolatesthe Code,whetherthatconductoccursonoroffcampus.TheStudentCodeofConductdetailstherulesandregulationsforstudentsandstudentorganizations.ItisreviewedannuallybytheOfficeofJudicialAffairs,andamendmentstotheCodemustbeapprovedbyMillersville University’sPresidentandCouncilofTrustees.

MillersvilleUniversitystudentsaregovernednotonlybylocal,stateandfederallaws,butalsobyregulationsoftheMillersvilleUniversityCodeofConduct.“Student”forthepurposesoftheCodeofConductreferstoanypersonwhoacceptsanofferofadmissionindicatingintentiontoenrollattheUniversity,includingparticipationinacourseorparticipationinaUniversity-sponsoredprogram.Apersonwhoisnotenrolledforaparticularsemesterbutwhootherwisehasacontinuingrelationship,includingstudentswhoareonaMedicalLeaveofAbsencewiththeUniversityisconsideredtobea“student”forthepurposeoftheCode.ViolationofthoseregulationsmayleadtoUniversityjudicialactioninadditiontoanyactiontakenbycivilorcriminalcourts.

• Knowinglybeinginthepresenceofunauthorizeduse,possessionordistributionofdrugs(V.3.A)• TheuseofcounterfeitsubstancesunderthissectionisalsoaviolationoftheCodeofConduct(V.3.B)

ResponsibleActionPolicy

TheUniversitywilltakeintoconsiderationactionstakenbystudentstoobtainaidforafellowstudentintheeventofanemergencyasaresultofexcessivealcoholconsumption.Astudentcomingtotheaidofafellow studentwillbeconsideredduringsanctioningaspartofthejudicialprocessshouldthestudentdemonstratethefollowing:

1. TheonlywaylawenforcementofficersorUniversityofficialsbecameawareoftheperson’sviolationoftheStudentCodeofConductisbecausethepersonplaceda911call,oracalltocampussafety,policeoremergencyservices,ingoodfaith,basedonareasonablebeliefandreportedthatanotherpersonwasinneedofimmediatemedicalattentiontopreventdeathorseriousinjury.

2. Thepersonreasonablybelievedtheywerethefirstpersontomakea911calloracalltocampussafety,policeoremergencyservices,andreportthatapersonneededimmediatemedicalattentiontopreventdeathorseriousinjury.

3. Thepersonprovidedtheirownnametothe911operatororequivalentcampussafety,policeoremergencyofficer.

4. Thepersonremainedwiththepersonneedingmedicalassistanceuntilemergencyhealthcareprovidersarrivedandtheneedfortheirpresencehadended.

PotentialConsequencesofBeinginViolationofAlcoholand/orDrugPolicy ThefollowingaregeneralUniversitysanctionswhichmaybeimposeduponastudentoranorganizationthatisfoundresponsibleforaviolationoftheStudentCodeofConduct.Thislistisnotintendedtobeexhaustive,andtheUniversityanditsagentsreservetherighttoimposeadditionalsanctionstoensurethehigheststandardsofconduct.TheUniversitymayimposeanycombinationofthefollowingsanctions:

Enforcement/Violations: TheprimarysourcesoncampusthatenforcethealcoholanddrugpoliciesaremembersoftheMillersvilleUniversityPoliceDepartmentandthestaffofHousingandResidentialPrograms.ItistheprimaryresponsibilityoftheOfficeofJudicialAffairstoassessinstancesofinfractionsoftheCodeofConductbystudentsandtodetermineappropriatesanctions.

StudentviolationsoftheUniversity’sAODpoliciesmaycometotheattentionoftheOfficeofJudicialAffairsthroughanonlinereportthroughthejudicialsoftware,Maxient.TheJudicialHandbookdetailsthejudicialprocessofviolationsoftheAODpolicies.Eachincidentisreviewedonacase-by-casebasisfollowingdueprocess.

Intervention MillersvilleUniversityhasseveraloptionsavailableforstudentsandemployeeswhoneedtoaddressalcoholandotherdrugabuseissues.StudentscanobtainassessmentandtreatmentofsubstanceabusedisordersattheCenterforCounselingandHumanDevelopment.StudentswhoviolatetheUniversityAlcoholPolicyparticipateinatwo-partBASICSinterventionprogramconsistingofagroupmeetingandanindividualpersonalizedfeedbacksession.TheCenterforCounselingandHumanDevelopmentcanassistinreferralstooff-campusservices. StaffmembersatHealthServices,theCenterforHealthEducation&PromotionandtheCenterforCounselingandHumanDevelopmentcanprovideadditionalinformationandservicesrelatingtosubstanceabuseproblems.

In 2014-2016, 49 students were refereed to BASICS, 42(85.7 percent)completedthetwo-partintervention.Recidivismratewas11.9 percent(fivestudents).

In 2014-2016, 63 students were referred to BASICS, and47(74.6 percent)completedthetwo-partintervention.Recidivismratewas6.4 percent(threestudents).

ResourcesforAssistance Allstudentsandemployeesareencouragedtoseekearlyhelpiftheyfeeltheyhaveaproblemwithalcoholand/orotherdrugs,andtolearnhowtoassistotherswithsubstanceabuseproblems.Withearlyassistanceitislesslikelythatseriousconsequenceswillresultfromanalcoholorotherdrugproblem.Thereareresourcesoncampusandinthecommunityforassistance.EmployeeswithquestionsaredirectedtoHumanResources,locatedintheDilworthAdministrationBuilding,Room105,717-871-4950.

• Outreachbythepeereducatorspertainingtothe“RedZone”high-riskperiodofthesemester.• AbystanderinterventionpaneldiscussionsponsoredbytheSociology,AnthropologyandWomen’s

StudiesDepartments.• LambdaChiAlphafraternitypresentedinformationontheIt’sOnUsprogram.• TheYWCAinpartnershipwiththeUniversitysponsoreda“WalkAMileinHerShoes”eventaimedat

increasingconsciousnessofsexualviolence.• NumerousPeerEducationprogramsofferedbytheCenterforHealthEducationandPromotion.• TheWellnessandSportsSciencesDepartmentsponsoredtheshowingofthedocumentaryRunRickyRun

– adocumentaryaboutaprofessionalfootballplayeraddictedtodrugs.• Escalationdatingviolenceawarenesspresentation.• TakeBacktheNight(sexualviolencepreventioncommunityevent).

SocialNormsMarketing MillersvilleutilizessocialnormsmarketingtoprovideincomingstudentswithaccurateinformationaboutAODuseamongMillersville Universitystudents.Anewprogram,It’sYourChoice,wasdevelopedbythepeereducatorstobefacilitatedbytheorientationleadersduringnewstudentorientation.FacultyandstafftrainedtheorientationleadersinAugust2015topresenttheprogramwithin their orientationgroupofnewstudents.Theprogramwasdesignedtosupplementthematerialsnotprovidedinthe Zombies, Alcohol and YouonlineportalandactivelyengagedparticipantsinconversationsaroundthenormsandexpectationsofcollegeAODuse.Additionally,Orientationleaders,residentassistantsandpeereducatorsworeMakeSmartChoicesshirtsonthesamedayduringnewstudentorientationtospreadtheMakeSmartChoiceseducationalcampaignmessage.AnextensiveSocialNormscampaignwasmountedwithposters,yardsignsandfloordecalsshowingstatisticsregardingstudentalcoholanddruguseweredisplayedacrosscampus.

SocialProgramming,ExtracurricularandRecreationalOpportunitiesTheover150studentclubs,campusrecreationandintercollegiateathleticteamsprovideawiderangeofsocialandrecreationopportunitiesfortheuniversitycommunity.AlloftheseactivitiesandanyeventwithfundingfromStudentSenatearealcohol-free.

Millersville UniversityEmployeeWellnessProgram TheMillersvilleUniversityWellnessProgramhasbeendesignedtoeducate,encourageandinspirethefacultyandstafftoachieveandmaintainahealthylifestylebyprovidinginformationandresourcestopromotebetteroverallhealthandwellness.AnexampleofaninitiativeistheTakeaHikeprogram.

VilleAfterDarkProgramming ThemissionofVilleAfterDarkistoprovidestudentswithfrequent,safe,alcohol-freeandengaginglatenightactivitiesthattakeplaceontheweekends.VilleAfterDarkworksincollaborationwithstudentorganizations,campusdepartmentsandlocalbusinessestodevelopandsupportlatenightprograms.TheCenterforStudentInvolvementandLeadershipinpartnershipwithUniversityActivitiesBoardprovidesactivities,butseekstoeducateandempowerstudentstoplanandparticipateinsociallyresponsibleprogrammingbothonandoffcampus.

NewandTransferStudentOrientationAllstudentsnewtotheUniversityarerequiredtoparticipateina4-dayorientationprogramatthebeginningofthefallsemester,whichoffersprogramsandactivitiesthatprovideinformation,educationandassistanceintransitioningtoMillersvilleUniversity.SessionspresentedbytheOfficeofJudicialAffairsandtheMillersvilleUniversityPoliceDepartmentincludeinformationondrugandalcoholabuseandpolicies,theStudentCodeofConduct,relevantlocal,stateandfederallawsandviolationsandsanctionsoftheselawsandpolicies.AdditionalinformationregardingParentalNotificationofalcoholviolations,theResponsibleActionPolicy,preventionandpersonalsafetyisalsoprovided.

OpenContainerOrdinanceInaccordancewithPennsylvaniaStateLaw,MillersvilleUniversitydoesnotpermitanyopencontainersofalcoholinanypublicspaceoncampus,includingoutdoorareasandnon-residentialbuildings.AdditionallytheBoroughofMillersvilleandneighboringManorTownshiphaveopen-containerordinances.

FitnessCenter TheSMCFitnessCenteroffersatopofthelinefacilitydesignedtomeetthefitnessneedsofstudents,faculty,staffandalumni.GeneralUniversityenrollmentfeesprovidestudentswithaccesstotheCenterwhichisopenforexpandedhours.CommunitymembersnotaffiliatedwiththeUniversitycantakeadvantageofourservicesandequipment.

LateHoursBoththeStudentMemorialCenterandMcNairyLibraryhaveextendedtheirhoursofoperation(withtheexceptionofcertainholidays).TheLibrarylobbyisopenuntil3:00a.m.,SundaythroughFriday.Thisprovidesstudentswithanalcohol-freelocationoncampusforsocialgatheringsandquietstudy.

HousingandResidentialPrograms,LeadershipTrainingMillersville Universityprovidesleadershippositionsforanumberofstudentswithintheresidencehalls.Thesepositionsinclude:GraduateHallDirectors,ResidentAssistant,administrativeassistantsanddeskattendants.Allstudentleadersarerequiredtoattendanumberoftrainingsessionsbeforetheirleadershippositionsbeginandthroughouttheacademicyear.Thesetrainingsprovideinformationonhealthandsafety,includinginformationregardinguseofAOD.Itisrequiredthatallstudentleadershaveabasicknowledgeofandbeabletoreferotherstudentstoanappropriateresourceforanumberofissues,includingsubstanceuse.

Zombies,Alcohol&YouTheUniversitycontractedwithStudentSuccess,Inc.toprovidetheonlineeducationprogram,Zombies, Alcohol & Youtoallincomingstudentsandselectstudentleadersforthe2014-2015and2015-2016academicyear.Pre-andpost-assessmentdemonstratedsignificantincreaseingeneralknowledgeaboutalcoholanditsassociatedrisks,andpositiveattitudestoresponsiblebehavior.Morespecifically,in2014-2015:1,296studentscompletedZombies,Alcohol&You.Theaveragemalepretestscorewas36 percentandtheaveragemaleposttestscoreimprovedto83 percent.Theaveragepretestscoreforfemaleparticipantswas36 percentwiththepost-testscoresimprovingto86 percent.In 2015-2016:1,126studentscompletedZombies,Alcohol&You,theonlinealcoholeducationportal.Theaveragepretestscorewas35 percentandtheaverageposttestscoreimprovedto83 percent. BystanderIntervention Preventionprogramminghasplacedanincreasedemphasison“BystanderIntervention”overthepastseveralyears.Thistrainingassistsstudentsindevelopingskillsandconfidencetoeffectivelyinterveneinriskysituations.

Wellness175CourseAsagraduationrequirement,allstudentsneedtoenrollinandsuccessfullycompleteWellness175course.Thiscourseencouragesstudentstothinkabouttheirphysicalandemotionalwell-beingasanimportantpartoftheiracademiclife.ThroughcollaborationbetweenAcademicandStudentAffairs/EnrollmentManagementacurriculumwasdevelopedtoprovidestudentswithusefulskillstoappraiserisk,reduceharmandunderstandtheeffectsofalcoholanddruguseespeciallyinthecontextofUniversitylife.

NCAAChoices ToaddressAODabusepreventioninthehighriskgroupofstudentathletes,theUniversitysuccessfullyproposedagranttotheNCAA.Thisthreeyeargrantfocusedonprovidingathletespecificsocialnormsinformationaswellasthedevelopmentofathlete/peerfacilitateddiscussiongroupsonalcoholandotherdrugsthroughouttheAthleticsDepartment.TheNCAAChoicesalcoholeducationgrant--endingJuly1,2016--reached1,175studentswithalcoholeducationprogramsandactivities.

PALiquorControlBoardGrant MillersvillesuccessfullypreparedagrantapplicationtothePALiquorControlBoardandreceivedfundsinthefall2015semester.The$40,000,2-yearaward,seekstoaddresshighriskdrinkingoncampuses.Effortsfocusonfirst-yearstudents,GreekLifeprogramming,theadministrationoftheNationalCollegeHealthAssessmentandthesubsequentdevelopmentofanextensiveSocialNormsMarketingCampaign.

AlcoholAwarenessWeekActivities ToaddresstheincreasedriskofdangerousdrinkinganddruguseassociatedwithHomecoming,overthepastthreeyearstheUniversitycoordinateditsAlcoholAwarenessWeekwithHomecomingevents.InpartnershipwiththeDepartmentofAthletics,Homecoming/AlcoholAwarenessWeekactivitiesprovidedharmreductionstrategies,andAODawarenessactivitiesforstudentsacrosscampus,withatag:"HaveaHomecomingyoucanremember!"

NationalCollegeHealthAssessment TheNationalCollegeHealthAssessmentwasadministeredintheSpring2016semester and 1,052undergraduatestudentscompletedtheassessment.Separatedatareportsforfirst-yearstudents,student-athletesandthoseinvolvedinGreekLifeweregeneratedtoassistwithgrantinitiativesandfocusprogrammingefforts.Thesocialnormscommitteewillworktoidentifywaystosharethedatacampus-widetoinformmembersofourcampuscommunityaboutthehealthneedsofourstudents.
