10 Validity of Tender Period 240 days from the date of opening of tenders.

Note:

1. The bidders (small scale units) who are registered with National Small Scale Industries Corporation under Single Point Registration scheme are exempted from the cost of tender form and earnest money Deposit subject to the following:

A proof regarding current valid registration with NSIC valid on the date of opening of tender will have to be attached along with the bid.

The enlistment certificate issued by NSIC will not be permanent and should be renewed within two years of its

presentation.

Affidavit will be given by the contractor in which he will submit the details of cost of tender form and EMD Cost for

which he has availed NSIC exemption by participation in all tenders from the date of issue of certificate.

2. The contractor shall obtain / provide at his own cost all easements, permits and licenses necessary to do the work. No extra charges will be paid to the contractors for pursuance of easements, permits etc. It shall be the responsibility of the bidder to quote the rates for execution of the work keeping in view such aspects.

3. Since the work is of top priority and to be carried out in stipulated time, only contractors having sufficient resources to complete the work in time need to participate.

4. Successful bidder may be asked to carry out additional 25% of the estimated work at any site under the jurisdiction

of the GMTD, BSNL, Khammam at the approved rates with mutual consent

Section-II 1. Eligibility of Bidders:

1.1 Experienced contractors, who have maintained at least 50 Kms of OFC route in the past Seven years for

Telecom operators for BSNL/MTNL/PSU/Govt. Department / Reputed Private Sector Telecom Service

Providers/ Infrastructure Provider . The experience certificate should be issued by the authority who should not be below the rank of AGM or of equal rank of any PSU organization like BSNL/ PGCIL/ BBNL/ Rail Tel, etc.

and in case of private Telecom service providers, by an Officer authorized to issue such experience certificate.

1.2 Tenderer should be an EPF code holder and shall have a minimum annual turnover of Rs. 15 Lakhs in any one of the past Five years.

2. Description of Work: Outsourcing of OFC Route Maintenance with connected OFC patch works in the

route/sections in Various Transmission Maintenance Divisions as per Annexure-I in the Jurisdiction of the General Manager Telecom District, BSNL, Khammam.

Section IV

INSTRUCTION TO BIDDERS

1. DEFINITIONS

a. BSNL authority: The BSNL authority means the Bharat Sanchar Nigam limited, which invites the tenders on behalf of

Accounts Officer Junior Accounts Officer (Including other officers in the BSNL, whatever designations assigned to them from time to time, who may be the in-change of direction, supervision, testing, acceptance and maintenance including their successor(s) in the office appearing in various clauses shall be taken to mean the BSNL)

b. I) The General Manager means the Head of Maintenance Area (Name) and his successors.

II) Representative of the General Manager : Representative of the General Manager means the Office and the officer time being deputed by the General Manager for inspecting or supervising the work or testing etc.

c. Engineer– in-charge: The Engineer–in-charge means the Engineering Officer nominated by the BSNL to supervise the work, under the contract (minimum Divisional Engineer level officer).

d. Site Engineer: Site Engineer shall mean an SDE/JTO of the BSNL who may be authorized by the General Manager KHM as in-charge of the work at site at any particular period of time.

e. A/T Unit: A/T Unit shall mean Acceptance and testing unit of the BSNL/Officer nominated to conduct A/T by the General Manager KHM.

f. A/T Officer: An officer authorized to conduct A/T. g. Contract : The term contract means, the documents forming the tender and acceptance thereof and the formal

agreement executed between the competent authority on behalf of the BSNL and the contractor, together with the documents referred to therein including the conditions, the specifications, designs, drawings and instructions issued from time to time, by the engineer in-charge and all these documents taken together shall be deemed to form one contract and shall be complementary to one another in the contract, the following expressions shall, unless the context otherwise requires, have the meaning, hereby respectively assigned to them. The expression works or work shall unless there be something either in the subject or context repugnant to such construction, be construed and taken to mean the works by or by virtue of the contract contracted to be executed whether temporary or permanent, and whether original, altered, substituted or additional.

h. Contractor: The contractor shall mean the individual, firm or company enlisted with BSNL in accordance with procedure for enlistment of contractor, whether incorporated or not, undertaking the works and shall include the legal personal representative of such individual or the persons composing such firm or company, the successors of such firm or company and the permitted assignees of such individual, firm or company.

i. Work : The expression “works” shall unless there be something either in the subject or context repugnant to such construction be construct and taken to mean the works by or by virtue of the contract contracted to be executed whether temporary or permanent and whether original, altered, substituted or additional.

j. Schedule(s) : Schedule(s) referred to in these conditions shall mean the relevant schedule(s) or the standard schedule of rates mentioned in the document.

k. Site: The site shall mean the land / or other places on, into or through which work is to be executed under the contract or any adjacent land, path or street through which, the work is to be executed under the contract or any adjacent land, path or street which may be allotted or used for the purpose of carrying out the contract.

l. Normal time or stipulated time : Normal time or Stipulated time means times specified in the work order to complete the work.

m. Extension of Time: Extension of Time means the time granted by the BSNL to complete the work beyond the normal time or stipulated time.

n. Date of Commencement of work: Date of Commencement of Work means the date of actual commencement of

work or 7th day from the date of issue of work order, whichever is earlier. o. Due date of Completion: Due date of completion shall be the date by which the work shall be completed at site

including clearance of site.

p. Duration of completion of work: The duration of completion of work or completion time shall be time specified in the work order plus extension of time granted, if any.

q. Excepted risk: Excepted risk are risks due to war (whether deduced or not ), invasion, act of foreign enemies, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power, any acts of Government damages from aircraft, acts of God such as earth quake, lightning and unprecedented floods and other causes over which, the contractor has no control and the same having been accepted as such, by the Accepting Authority or causes solely due to use or occupation by the government of the part of the work, in respect of which a certificate of completion has been issued.

r. Near Relative: - The near relatives are defined as: • Members of Hindu Undivided family, • They are husband and wife, • The one is related to the other in the manner as father, mother, son(s) and son’s wife (daughter-In-law), daughter(s) and daughter’s husband (son-In-law), brother(s) and brother’s wife (sister-In-law), sister(s) and sister’s husband (brother-In-law).

2. Eligibility of Bidders: 2.1 Experienced contractors, who have maintained at least 50 Kms of OFC route in the past three years for

Telecom operators for BSNL/MTNL/PSU/Govt. department / Reputed Private Sector Telecom Service Providers/ Infrastructure Provider department. The experience certificate should be issued by the authority who should not be below the rank of AGM or of equal rank of any PSU organization like BSNL/ PGCIL/ BBNL/ Rail Tel etc. and in case of private Telecom service providers, by an Officer authorized to issue such a experience certificate.

3. BID DOCUMENTS: 3.1 The OFC route maintenance, OF Cable Strengthening by Scheduled and Planned Works to be carried out, goods required,

3.1.2 Financial Bid

Schedule of rates for OF Cable route Preventive & Corrective Maintenance, OF Cable strengthening by Scheduled Planned maintenance works.

a. The Bidder is expected to examine all instructions, forms, terms and specifications in the bid documents. Failure to

furnish all information required as per the Bid Documents or submission of bids not substantially responsive to the Bid Documents in every aspect will be at the bidder’s risk and shall result in rejection of the bid.

4. QUERIES ON BID DOCUMENTS:

A prospective bidder, requiring any clarification of the Bid Documents shall notify the BSNL in writing or by fax at the BSNL’s mailing address indicated in the invitation for Bids. The BSNL shall respond in writing to any request for clarification of the Bid Documents, which it receives not later than 7 days prior to the date for the opening of the bids. Copies of the query (without identifying the source) and the clarifications by the BSNL shall be sent to all the prospective bidders who have purchased the bid documents and all such clarifications issued by the BSNL will form part of the bid document.

5 AMENDMENT OF BID DOCUMENTS: At any time, prior to the date for submission of bids, the BSNL may, for any reason whether sue motto or in response to a clarification requested by a prospective bidder, modify the bid documents by amendments. The amendments shall be notified in writing /FAX/post to all prospective bidders on the address intimated at the time of purchase of bid document from the BSNL and these amendments will be binding on them. In order to afford prospective bidders reasonable time to take the amendments into account in preparing their bids, the BSNL may, at its discretion, extend the deadline for the submission/opening of bids suitably. 6. Cost of Bidding: The bidder shall bear all costs associated with the preparation and submission of the bid. The BSNL, will in no case, be responsible or liable for these costs, regardless of the conduct or outcome of the bidding process.

7. DOCUMENT ESTABLISHING BIDDER’S ELIGIBILITY AND QUALIFICATIONS:

The bidder shall furnish, as part of his bid documents establishing the bidder’s eligibility, the copies of following documents:

(i) Cost of the tender document in the form of DD drawn in favour of Accounts Officer (Cash) O/o GMTD, BSNL,

Khammam from any nationalized bank, if the tender document is downloaded from

https://apbsnl.etenders.in. If the Tenderer/firm is registered with National Small Scale Corporation (NSIC), he/it is exempted from the cost of the tender document. However the tenderer should enclose the latest and valid enlistment registration certificate of NSIC.

(ii) Attested Copy of valid current EPF Registration. (iii) Experience certificates with regard to at least 50 Kms of OFC route maintenance in the past Seven years for

Telecom operators BSNL/MTNL/PSU/Govt. Department/ Reputed Private Sector Telecom Service Providers/ Infrastructure Provider Department. The experience certificate should be issued by the authority that should not be below the rank of AGM of any PSU organization like BSNL/ PGCIL/ BBNL/ Rail Tel etc. and in case of private Telecom service providers, by an Officer authorized to issue such an experience certificate.

(iv) Documentary evidence in support of at least minimum annual turnover of Rs. 15 Lakhs in any one of the past Five years.

(v) Bid Security in accordance to clause no. 8. (vi) Tender document (s), in original, duly filled in and signed by tenderer or his authorized representative along

with seal on each page. All corrections and overwriting must be initialed with date by the tenderer or his authorized representative.

(vii) Attested copy of PAN Card copy & Latest income tax return of the firm/proprietor. (viii) (a) Attested copy of The registration of the firm.

(b) Authenticated copy of partnership deed in case of partnership firm. (c) Attested copy of Articles of Associations duly registered with Registrar of Company affairs, in case of

Limited/Pvt. Limited Company (d) Attested copy of Proprietor certificate from the Proprietor of the firm that he is the sole Proprietor of

the firm on firm letter head or the same certificate issued by the notary public on non-judiciary stamp paper, in case of Proprietary firm.

No Interest shall be paid by the BSNL on the bid security for any period, what so ever.

8.2 The bid security is required to protect the BSNL against the risk of bidders conduct, which would warrant the security’s forfeiture, pursuant to Para 8.6.

8.3 Bid Security shall be paid in the form of Demand Draft issued by a scheduled bank, drawn in favour of Accounts Officer (Cash) O/o GMTD, BSNL, Khammam. The bidder is required to deposit section/route wise separate EMD for only those sections/routes for which he is submitting his bid or intending to participate in the route. DDs of EMD as specified in the above table and cost of tender document must be submitted along with Technical Bid. The bidders (Small Scale Units) who are registered with ‘National Small Scale Industries Corporation’ under Single Point Registration Scheme are exempted from cost of tender form and earnest money subject to the following: (1) A proof regarding current registration with NSIC for the tendered items will have to be attached along with

the bid. (2) The enlistment certificate issued by NSIC will not be permanent and should be renewed within two years of

its presentation. (3) The Bidder/firm claiming concession of NSIC is required to submit its monthly turn over in support of the

claim for meeting the delivery schedule. (4) The SSI units registered with NSIC for the tendered item may be given exemption from payment of Bid

Security to the extent of their approved 'Monetary Limit' or ` 50 (Fifty) lakh, whichever is lower. However, in case of purchase of tender document, if the value of tender is more than their monetary limit, they are not entitled to free tender document.

8.4 A bid not secured in accordance with Para 8.1 & 8.3 shall be rejected by the BSNL as non-responsive. 8.5 The bid security of unsuccessful bidder will be refunded as promptly as possible as, but not later than 30 days after the

expiry of the period of bid validity prescribed by the BSNL. The successful bidder’s bid security will compulsorily be converted to part Performance Security Deposit.

8.6 The bid security shall be forfeited: 8.6.1 If a bidder/firm withdraws his bid during the period of bid validity specified in the bid document or submits false

and fabricated documents in tender bid. 8.6.2 If the bidder makes any modifications in the terms and conditions of the tender before acceptance of the

Tender, which are not acceptable to the BSNL or 8.6.3 In case of a successful bidder, if the bidder fails:

i. to sign the agreement in accordance with relevant clause or ii. to furnish Material Security in accordance with clause 9.

9 Material Security: 9.1 The Successful tenderer will have to deposit material security for Rs. 1 lakh in the form of bank guarantee valid upto 30

months from the date of agreement from a scheduled bank. Material security can also be submitted in the form of Crossed Demand Draft drawn in favour of BSNL in the similar manner as specified for EMD. The Material security will be a non-interest bearing deposit, for any period what so ever.

9.2 The contractor at any point of time will not be issued stores costing more than materials security deposit. If due to any reason more store has to be issued to the contractor, then the material security will be suitably enhanced. In this regard the decision of the Additional/Deputy General Manager Maintenance shall be final and binding.

9.3The proceeds of the material security shall be payable to the BSNL as a compensation for any loss resulting from the contractor’s failure to handle properly the material issued to him under the contract.

9.4 The Material security shall be released/refunded after the payment of the last and final bill of the work under the contract or final settlement of material account whichever is later on production of ‘no dues certificate’ from “Engineer-In-Charge’.

12 10. BID PRICES:

10.1 The bidder shall give the total composite price inclusive of all levies and taxes, packing, forwarding, freight and insurance in case of materials to be supplied and inclusive of all taxes & duties except GST, which will be paid on work amount at applicable rates subject to the condition that contractor has

a) Valid GST registration & b) Submits an undertaking of depositing the received GST with GST department.

The contractor shall be responsible for transporting the materials, to be supplied by the BSNL (the Telecom Store) or otherwise to execute the work under the contract, to site at his/their own cost.

10.2 Prices shall be quoted by the bidder as percentage below/above/at par the schedule of rates given in schedule of rates (Financial Bid). Prices quoted at any other place shall not be considered.

10.3 The price quoted by the bidder shall remain fixed during the entire period of contract and shall not be subject to variation on any account. A bid submitted with an adjustable price quotation will be treated as non-responsive and rejected.

10.4 Discount, if any, offered by the bidders shall not be considered unless they are specifically indicated in the schedule of rates (financial bid). Bidders desiring to offer discount shall therefore modify their offers suitably while quoting and shall quote clearly net price taking all such factors like Discount, free supply, etc. into account.

11. PERIOD OF VALIDITY OF BIDS:

11.1 Bid shall remain valid for 180 days from date of opening of the bid (Qualifying Bid). A BID VALID FOR A SHORTER PERIOD SHALL BE REJECTED BY THE BSNL AS NON-RESPONSIVE.

11.2 The BSNL reserves the right to request the lowest 3 bidders as per read out list on the opening day to extend the bid validity for a period of further 120 days and the bidder has to necessarily extend the bid validity. Refusal to extend the bid validity will result in forfeiture of the bid security. A bidder accepting the request and extending the bid validity will not be permitted to modify his bid.

12 SIGNING OF BID:

12.1 The bidder shall submit, as a part of his bid, the bid documents (in original) duly signed on each and every page, establishing the conformity of his bid to the bid documents of all the works to be executed by the bidder under the contract.

(Note: The tenderer is advised to keep a photocopy (at his own cost) of the bid documents for his own reference) 12.2 The tenderer will be bound by all terms, conditions & specifications as detailed in the tender documents. 12.3 Any tender with conditions other than those specified in the tender document is liable to be summarily rejected. No

modification by the contractor in any of the conditions will be permitted after the tender is opened.

13. SUBMISSION OF BIDS:

13.1 The bidder can apply / quote for one route/section or more than one route/section or for all the routes/sections separately in the tender quotation form specified for each route/section under financial bid.

a) Tenders shall be submitted in the prescribed forms placed in sealed covers superscripted as Tender for Outsourcing

of OFC route Maintenance with connected OFC allied works in the jurisdiction of GMTD BSNL Khammam SSA. The full name and address of the bidder shall be written on the bottom left hand side corner of the sealed cover. The address given merely as post office number shall not be entertained.

b) The tender should be submitted in TWO Envelope system consisting of Technical and Financial Bids. The said two

envelopes must be wax sealed and placed in another sealed cover superscripted as Tender for Outsourcing of OFC route Maintenance with connected OFC allied works in the jurisdiction of GMTD BSNL Khammam SSA. The Technical Bid Envelope superscripted as ‘Technical Bid’ should contain the EMD, cost of the tender document if downloaded from www.ap.bsnl.co.in in the form of Demand Draft and documents as called for in Section-XII and the envelope of the Financial bid be superscripted as ’Financial Bid’ should contain the percentage of the rate Quoted as

detailed in the Section - XVI.

c) The financial Bids of the technically qualified bidders will only be opened. The time, date and venue for opening of the Financial Bid will be intimated after the completion of the Technical Evaluation.

d) The Bidders can drop their sealed tender documents in the tender box provided at the Chamber of AGM(Planning),

% GMTD, BSNL, BSNL Bhavan, Burhanpuram, Khammam.

13.2 The envelope containing tender shall be sealed with sealing wax or adhesive tapes, properly fixed on the envelope. Closing the envelope merely by gum will not be treated as sealed cover. Tenders received in envelopes not sealed will not be opened or considered. Tenders received in unsealed envelops will be opened only when the Tenderer makes a request for return of any Demand Draft/Bank's Pay order

enclosed as EMD. In such cases, only the Demand Draft/Bank's Pay order will be returned and the “BSNL” will retain the rest of the document.

a) Tender if sent by post, must be in double covering and may be posted to AGM(Planning), % GMTD, BSNL,

BSNL Bhavan, Burhanpuram, Khammam. The tenders received after due date and time may be summarily rejected and BSNL will not be responsible for any postal delay in transit. It is desirable to seal the inner envelope also and super scribe as stipulated in the above Clauses, contained in this Section of the Tender Document.

b) BSNL reserves the right to postpone the date of opening of tender or to cancel the tender notice without giving any reasons. Any request from Tenderers to postpone or to change the date of opening of the tender due to any reason whatsoever shall not be considered.

b) BSNL is not bound to accept the lowest tender and reserves the right to reject any or all without assigning any reasons whatsoever.

d) Tenders will be accepted and Contracts will be finalized only with those of the Tenderers, who, in the opinion of the competent authority, are having the capacity and resources to provide the service/execute the work assigned in the prescribed time as per the terms, conditions and specification of the Tender Document.

e) The Tenderers or his authorized signatory by holding “Power of Attorney”, shall certify and affix his

signature on each and every page of the tender document, and return it along with his tender offer, as a token of his acceptance of each condition specified on each page of the Tender Document. If the tender is not duly signed, or is deficient or is incomplete in any of the requisite matters or particulars or formalities, it will be rejected summarily.

f) Any attempt for negotiation direct or indirect on the part of the Tenderer with the authority to whom he

has submitted the tender or the authority who is competent finally to accept it after he has submitted his tender or endeavors to secure interest for actual or prospective tender or to influence by any means the acceptance of the particular tender will render the tender liable to be excluded from consideration. The competent authority may take necessary action to BLACK-LIST THE TENDERER.

g) The Tenderers will be bound by all terms, conditions and specifications detailed in this Tender Document.

The Tenderers shall not have any right to modify the conditions or specifications contained in the Tender Document at any occasions. Any tender submitted with conditions other than those specified in the tender document will be summarily rejected.

h) Any tenderer, who likes to deliver the tender in person shall deposit the tender in the box kept at the

Office of AGM(Planning), % GMTD, BSNL, BSNL Bhavan, Burhanpuram, Khammam i) The tender box will be sealed immediately after the specified time as per the timings of the office clock

for receipt of tender. Any tender presented in person by any Tenderer or his representative after the tender box is sealed will not be received either by AGM(Plg)) or by any of the staff with him. Any attempt to forcibly deposit the tender after the sealing of the tender box will attract action as per the law.

j) Tenders received either by post or Courier service or in person after the specified date and time will be

rejected.

k) Postponement of Tender opening: Whenever it is considered necessary to postpone the opening date of tenders,

quick decision will be taken and communicated to the tenderers through notification posted on

https://apbsnl.etenders.in and will be at least one day before the original date of opening. The reasons for postponing the tender will be recorded in writing. If the date of opening of bids is declared as holiday, the bids will be opened on the next working date at the same time and venue.

l) Government of India if subsequently declares the date fixed for opening of bids as holiday, the revised schedule will be notified. However, in absence of such notification, the bids will be opened on next working day, time and venue remaining unaltered.

14 14 LATE BIDS:

14.1 Tenders will not be received after the specified time of closing of the tender and same shall be rejected and returned

unopened to the bidder. It is the sole responsibility of the tenderer that he should ensure timely submission of tender.

15. OPENING OF BIDS :

15.1 The BSNL shall open the bids in the presence of bidders or his authorized representatives who choose to attend, at prescribed time in NIT on due date at the Any tenderer, who likes to deliver the tender in person shall deposit the tender in the box kept at the Office of AGM(Planning), % GMTD, BSNL, BSNL Bhavan, Burhanpuram, Khammam. The bidder’s representative, who is present, shall sign on attendance register. The bidder shall submit authorization letter to this effect before they are allowed to participate in the bid opening (A format is given in section-XI).

15.2 A maximum of two (2) representatives for any bidder shall be authorized and permitted to attend the bid opening. 16. EVALUATION:

16.1 The evaluation of technical bids will be done based on the submission of the documents called as part of technical bid

vide Section XII by the tenderer. Any technical bid short in any of the documents called for as part of technical bid will be summarily rejected.

16.2 The financial Bids of the technically qualified bidders will only be opened. The time, date and venue for opening of the Financial Bid will be intimated after the completion of the Technical Evaluation.

16.3 BSNL shall evaluate the bids to determine whether they are complete, whether any computational errors have been made and whether documents have been properly signed and whether bids are generally in order.

16.4 If there is a discrepancy between words and figures the amount in words shall prevail prior to detailed evaluation, BSNL will determine the substantial responsiveness of each bid to the bid document. A substantially responsive bid is one, which confirms to all the terms and conditions of bid documents without material deviation. A bid determined as substantially non-responsive will be rejected by BSNL.

16.5 BSNL shall evaluate in detail and compare the substantially responsive bids on the percentage deviation (above/below/at par) offered and indicated in schedule of rates of the bid documents.

16.6 BSNL may waive any minor infirmity or non-conformity or irregularity in a bid which does not constitute a material deviation, provided such waiver does not prejudice or affect the relative ranking of the bidder.

16.7 Evaluation Method: Lowest based on financial bid. L1, L2 ….is financial rating of bidders in ascending order. L1 is the lowest bidder.

16.8 In case rates quoted by two or more contractors are the same, the criteria for selection and ranking depend on the quantum of experience based on the documents submitted along with the bid. The contractor with more experience will be given preference. BSNL reserves the option to induct additional contractors at a later date (during the currency of the contract period) from the qualified bidders, in case of contingencies like poor performance of the approved contractors. All the

successful tenderers are required to submit the agreement duly signed on every page and in addition signed by two witnesses with address before taking up the works.

17 CONTACTING THE BSNL:

17.1 No bidder shall try to influence the BSNL on any matter relating to its bid, from the time of bid opening till the

time the contract is awarded. 17.2 Any effort by the bidder to modify his bid or Influence the BSNL in the BSNL’s bid evaluation, bid comparison or

the contract award decisions shall result in the rejection of the bid. 18. BSNL RIGHT TO ACCEPT ANY BID AND TO REJECT ANY OR ALL BIDS :

The BSNL reserves the right to accept or reject any bid and to annul the bidding process and reject all bids, at any time prior to award of contract without assigning any reason what-so-sever and without thereby incurring any liability to the affected bidder or bidder on the grounds for the BSNL’s Action.

19. ISSUE OF LETTER OF INTENT:

19.1 The issue of letter of intent shall constitute the intention of the BSNL to enter in to the contract with the bidder.

Letter of intent will be issued as offer to the successful bidder.

19.2 The bidder shall within 21 days of issue of letter of intent, give his acceptance along with performance security as per clause 5 section V, and material security in conformity with clause 9 section-IV, provided with the bid documents.

20. SIGNING OF AGREEMENT:

20.1 The signing of agreement shall constitute the award of contract on the bidder. The agreement with the successful

bidder shall be signed by the BSNL within a week of submission of material security and performance security as per clause 19.2 above.

20.2 As soon as the tender is approved by the competent authority, the bid Security deposited by the successful bidder may be converted into the performance security deposit which will be held by the BSNL till the completion of contract period.

21. ANNULMENT OF AWARD:

Failure of the successful bidder to comply with the requirement of clause 20 shall constitute sufficient ground for the annulment of the award and forfeiture of the bid security, in which event; the BSNL may award the contract to any other bidder at the discretion of the BSNL or call for new bids.

22. If a contractor fails to start the awarded work/complete the work in stipulated period, the same work will be rescinded

and straightaway given to other approved contractor at his risk and cost.

SECTION V

GENERAL (COMMERCIAL) CONDITIONS OF THE CONTRACT

1. APPLICATION:

The General conditions shall apply in contracts made by the BSNL for execution of O.F cable Route Maintenance works and OF Cable Strengthening by Scheduled and Planned maintenance Works.

2. STANDARDS:

The works to be executed under the contract shall conform to the standards prescribed in the OF Cable Route Maintenance practices

3. PRICES:

3.1 Prices charged by the Contractor for the works performed under the Contract shall not be higher from the prices

quoted by the contractor in his bid.

3.1 Prices once fixed will remain valid for the period of contract. Increase & decrease of taxes/duties will not affect

the price during this period.

3.3 The rates should be inclusive of all State & Central taxes (like WCT, TDS etc.). 4 SUBCONTRACTS:

The contractor shall not assign, sub contract or subject the whole or any part of the works covered by the contract, under any circumstances.

5 PERFORMANCE SECURITY:

a. The contractor shall deposit an amount to the tune of 10.0 % of approved cost in form of DD or Bank

guarantee in favour of Accounts Officer (Cash), % GMTD, BSNL, Khammam at the time of agreement. The Contractor may convert the sum already deposited as EMD (2.5%) into security deposit & deposit the additional 7.5% amount totaling 10.0% as Security Deposit.

b. The proceeds of the security deposit shall be payable to the BSNL as compensation for any loss resulting from the contractor’s failure to complete its obligations under the contract.

c. The security deposit shall be refunded after expiry of warranty period of last work executed provided there are no recoveries to be made arising out of poor quality of work, incomplete work and/or violation of any terms and conditions of the contract as stipulated in the bid document.

d. No interest will be paid to the contractor on the security deposit. e. Security Deposit(s) that is (are) due for refund to the Contractor/Supplier and remain unclaimed for three

years, after its/their refund become(s) admissible (for instance, after the contractor/supplier fulfils his contract) shall be dealt with in accordance with the provisions contained in the rules of the BSNL.

6. AWARD OF CONTRACT:

6.1 The BSNL shall consider award of contract only to those eligible bidders whose offers have been found technically,

Commercially, and financially acceptable. In case the bidder Quotes for more than one route/section, awarding the work to the successful bidders will be restricted to a maximum of 3 route/sections. However BSNL reserves the right to award the work in any number of routes/sections to the successful bidders at the lowest accepted rates if qualified bidders are not available.

6.2 The work order shall be issued so as to include all items of works for the route/section allotted to the contractor as put in the NIT.

6.3 The work orders shall be issued by the Divisional Engineer in-charge of O.F cable R o u t e maintenance works and existing overhead normalization works after examining the technical and planning details of the works to be executed.

6.4 A covering work order may be issued for Temporary/ Emergency restoration of Faults, for which w ork execution instruction / intimation given By Phone / SMS / Fax.

6.5 If due to any reason partial work order is to be issued then the same shall be issued with the approval of an officer not below the rank of Deputy General Manager.

6.6 The Divisional Engineer shall mention the time limit to execute the work order after seeing the quantum of work, store availability position, climate condition, prevailing condition of the area (Political and regional), odd hours time and approachability to the fault site.

6.7 The BSNL reserves the right to cancel or modify the scope of work stipulated to be carried out against the work order in the event of change of plan necessitated on account of technical reasons or in the opinion of work order issuing authority or the GMTD-KHM if the contractor is not executing the work at the required pace.

6.8 The Contractor shall not undertake or make any change or do any work under this contract unless he has received

written instructions from Engineer-in-charge.

6.9 The Contractor shall not be entitled to any compensation in addition to the contract price for the performance of any work not envisaged under the contract, unless prior to the performance of such work he has received from Engineer-in-Charge written authorization to perform such work.

6.10 For extra work which is not covered within the scope of this contract, the Contractor will receive extra

compensation on the basis of lump sum unit price as may be agreed upon in advance in writing between the Engineer-in-charge and the Contractor.

6.11 In cases, of such of the works, where an interpolation of the rates are possible such rates shall be accepted by both the parties.

6.12 If the altered, additional or substituted work includes any work for which rates are not specified in the contract for the work and cannot be derived from similar class of work in the contract, then such work shall be carried out at the rate determined by the Engineer-in-charge on the basis of prevailing market rates where the work was done & this rate shall be communicated in writing.

6.13 If the rate for altered, additional or substituted work cannot be determined in the manner specified above, then the Contractor shall within seven days of the date of receipt of order to carry out the work, inform the Engineer-in-charge of the rate which in his intention to charge for such class of work supported by analysis of the rate or rates claimed, and the Engineer-in-charge shall determined rates on the basis of prevailing market price & pay the Contractor accordingly. However, the Engineer-in-charge by notice in writing will be at liberty to cancel his order to carry out such class of work and arrange to carry out it in such manner, as he may consider advisable.

6.14 Any extra quantity of work already awarded will not come within the scope of 'Extra work'. 6.15 It is stressed that the Contractor shall not resort to stoppage of work pending an agreement of rates for extra

work. 6.16 SETTING OUT OF WORKS: The Site Engineer shall furnish the Contractor with only the center line of the trench to be

excavated and the Contractor shall set out all other works relevant as directed by the Engineer-in-Charge and shall provide sufficient staff for the purpose and shall be solely responsible for the accuracy of such setting out.

7. Time of Completion & ROW

(b) The time of completion for Preventive and Corrective OFC route maintenance will be based upon the SLA

conditions under clause 12 of Section-VII. (c) For OF Cable Strengthening by Scheduled and Planned Works, it will be on the basis of formula given below:

(i) 4(four) weeks time will be provisioned for ROW/permissions and organizing initial setup to start the work. (ii) The total time for completion of the existing overhead cable normalization work, would be the within

three months from the date of work order issued. (d) Right of Way (ROW) is to be obtained by the contractor from the concerned Road/ Forest/ Civic authorities etc,

including permission for working form Police/ District/ Civic authorities. For this, the contractor shall have to coordinate with various authorities on behalf of BSNL. No separate rates will be applicable for getting permission. However, the payment of ROW/ Permission charges for reinstatement to Government agencies concerned will be made by BSNL.

8. Progress of work:

(a) Progress of work for OFC route maintenance (preventive and corrective) will be based upon the SLA conditions

under clause-12 of Section-VII. (b) Progress of work for OF Cable Strengthening by Scheduled and Planned Works, ie, OFC improvement will be as

per following: i)

The time allowed for carrying out the work as entered in the tender shall be strictly observed by the Contractor.

ii) If the contractor fails to start the work by the due date, after the issue of work order, or does not maintain the progress as mentioned above, the tender is liable to be terminated by BSNL.

9. BSNL’s RIGHT TO VARY QUANTUM OF WORK:

b. Weekly report on activities to prevent OFC damages c. Monthly stock position along with consumption of inventory issued by BSNL d. Monthly report of faults attended along with the photos of faults (soft copy and hard copy

with date and location details) taken before and after restoration of these. e. Monthly reports of Fibre losses with OTDR and Power meters f. Preparation of route diagram (soft and hard copy) with full updation along with longitude and

latitude of joint chamber and indicators. 2. Any Recovery for contractor’s fault will also be taken into account as per SLA.

3. Divisional Engineer shall exercise the prescribed checks on the bills and accord necessary certificates of the

bills. The Divisional Engineer shall retain the third copy along with photocopies of documents and record it in a file maintained in his office and send first and Second copies with all documents to relevant higher office for processing of bills and release of payment.

4. The Accounts officer O/o GMTD BSNL Khammam, dealing with bills payment shall process the bill in the file of the concerned work and scrutinize the bills vis-à-vis Fault record register and certificates by Divisional in charge. The bill shall be passed, after necessary scrutiny by Works Section, by the officer competent to pass the bill. Statutory taxes (Income Tax, GST etc,.) applicable to contract shall be deducted at the time of payment from each Monthly bill.

5. RTGS payment for the amount passed in the bill will be issued only after the contractor gives a stamped

receipt for the amount, if the bills are not pre-receipted.

11.2 Procedure for preparation of Existing overhead cable normalization(trenching)/OFC strengthening work bill:

1. The contractor shall prepare the bill after completion of all the sections of overhead cable/OFC strengthening works awarded to him in the entire outsourcing section.

2. The bill should be in triplicate, duly certified by the Divisional Engineer in charge for its completeness 3. The certificate of designated AT authority should be enclosed along with offset measurement sheet of

the length of the cable grounded. 4. The OTDR, Power meter readings of the all the fibers end to end the section grounded is to be

attached. 5. All the overhead cable normalization works to be completed in the first quarter of the contract

period. 6. All the other procedures remaining is as mentioned in clause 12.1

12 PENALTY CLAUSE:

12.1 Penalty clause for Preventive and Corrective OFC maintenance works: As per SLA penalty clause no 13 under Section-VII

12.2 Penalty for causing inconvenience to public:

9.1 The BSNL, at the time of award of work under the contract, reserves the right to decrease or increase the work by up to 25% of the total quantum of work specified in the schedule of requirements without any change in the rates or other terms and conditions.

9.2 Duration of outsource tender :- This Tender is Rate Running Contract (RRC) valid for two Year from the date of final acceptance of Tender. The period of Tender /Rate Running Contract (RRC) may be extended up to next six months on the basis of performance of the vendor / Contractor with same rates and Terms and conditions of Contract.

10 WARRANTY:

The contractor shall warrant that the material supplied for the work shall be new and free from all defects and faults in material, workmanship and manufacture and shall be of the highest grade and consistent with the established and generally accepted standards for materials of the type ordered and shall perform in full conformity with the specifications and drawings. The contractor shall be responsible for any defects that may develop under the conditions provided by the contract the under proper use, arising from faulty materials, design or workmanship such as corrosion of the equipment, inadequate quantity of materials etc. and shall remedy such defects at his own cost when called upon to do so by the BSNL who shall state in writing in what respect the stores are faulty.

11 PAYMENT TERMS: 11.1 Procedure for Preparation and settlement of Preventive and Corrective Maintenance works bills:

1. The contractor shall prepare the Monthly bills for maintenance activity undertaken for work under SOR in triplicate ensuring execution work in its Completeness, correctness of rates and quantum of work and submit the bills to Divisional Engineer, in-charge of work. The Divisional Engineer concerned shall record the certificate on the Monthly bill after scrutinizing the bills and submit the Monthly bills along with the documents as mentioned below to the Divisional Engineer, in-charge of Route:

a. Daily patrolling report

12.2.1 To ensure progress during the execution of work and to cause minimum inconvenience to the public, the contractor shall not dig a trench of more than 200 meters at a stretch in a route at a time. He shall cause to lay cable and close such trenches expeditiously. Under any circumstances a stretch of trench of maximum 200 meters shall not be kept open for more than 2 days in case of cable laying by digging paved surfaces. In the event of contractor failing to comply with these conditions, a penalty of recovery up to Rs. 300/- per day the trench is kept open beyond the time limit allowed may be imposed by the BSNL. This penalty will be in addition to that payable for delay or slow work.

12.2.2 The contractor shall not be allowed to dump the empty cable drums/waste materials in Govt/public place, which may cause inconvenience to Govt/ Public.

12.2.3 If any such penalty is levied on a contractor for more than 2 occasions, then his/her contract could be terminated. In this regard the decision of GMTD Khammam shall be final and binding.

13 Penalty for cutting/damaging the old cable :

13.1 During excavation of trench utmost care is to be taken by the contractor, so that the existing underground

cables are not damaged or cut. In-case any damage/ cut is done to the existing cables, a penalty as per the schedule given below will be charged from the contractor or the amount will be deducted from his running bills;

Besides the above penalty, the contractor shall carry out such repairs for restoration of the damaged cable free of charge. The cost of jointing kit shall also be borne by the contractor. If contractor fails to repair the damage, the cost of repair (including cost of labour + jointing kit) shall be recovered from the contractor.

13.2 Penalty to damage stores/materials supplied by the BSNL while laying :

13.2.1 The contractor while taking delivery of materials supplied by the BSNL at the designated place shall thoroughly

inspect all items before taking them over. In case of execution of the work, if any material is found damaged/working unsatisfactorily, then a penalty equivalent to the cost of material + 10% as penalty shall be recovered from the contractor’s payments/securities.

13.2.2 However, contractor will not be penalized for any defect in workmanship of the materials, which shall be taken up separately with the supplier of the stores.

13.3 Penalty for cutting/damaging the old Pipeline/Cable/OF Cable of other Agencies:

In case of the damage to Pipeline/Cable/OF Cable of any other Agency/Authority (other than BSNL) during excavation of trench, the Contractor will be responsible to pay on demand any Damage charges/Repair Charges levied by such Agency/Authority on BSNL.

14 Rescission/Termination of contract

14.1 Circumstances for rescission of contract: Under the following conditions the competent authority may rescind

the contract :

a) If the contractor commits breach of any item of terms and conditions of the contract. b) Loss or damage to BSNL’s property due to the acts of Contractor. c) In the event of BSNL receiving notice from any statutory authorities or from external agencies on account

of loss/damage to their property due to the acts of Contractor. d) If the contractor suspends or abandons the execution of work and the engineer in-charge of the work

comes to conclusion that work could not be completed by due date for completion or the contractor had already failed to complete the work by that date.

c) If the contractor had been given by the officer-in-charge of work a notice in writing to rectify/replace any defective work and he/she fails to comply with the requirement within the specified period.

d) If the Contractor being a company shall pass a resolution or the court shall make an order that the company shall be wound up or if a receiver or a manager on behalf of a creditor shall be appointed if

circumstances shall arise which entitle the court or creditor to appoint a receiver or a manager or which entitle the court to make a winding up order

14.2 Upon rescission of the contract, the security deposit of the contractor shall be liable to be forfeited and shall be absolutely at the disposal of the BSNL as under :

14.2.1.1 For OFC route maintenance works: the measurement of works executed since the date of last measurement and up to the date of rescission of contract shall be taken in the presence of the contractor or his authorized representative who shall sign the same in the log book.

14.3 The unused material (Supplied by the BSNL) available at site shall be transported back to the BSNL STR store at the risk and cost of the contractor. If any such material is found damaged/lost then the penalty shall also be recovered from the contractor as per conditions in tender documents, ibid.

14.4 The un-executed work shall be got executed through the qualified bidder from amongst the bidders, who participated in the bidding process, by giving them offers in their order of ranking L2, L3 ----) at the approved rate of that section. If the work was awarded on single tender basis then the BSNL shall get the unexecuted work completed through any other contractor approved by competent authority, at the approved rates of that particular section or to execute the work departmentally, as is convenient or expedient to the BSNL at the risk and cost of the contractor. In such an event no compensation shall be payable by the BSNL to the contractor towards any inconvenience/ loss that he may be subjected to as a result of such an action by the BSNL. In this regard the decision of the competent authority shall be final and binding. In all these cases, expenses which may be incurred in excess of the sum which would have been paid to the original contractor if the whole work had been executed by him shall be borne & paid by the original contractor and shall be deducted from any money due to him by the BSNL under the contract or any other account whatsoever anywhere in the BSNL or from a security deposit.

14.5 The certificate of the Divisional Engineer in–charge of work as to the value of work done shall be final and conclusive

against the contractor, provided always that action shall only be taken after giving notice in writing to the contractor. 14.6 In the event of any one or more of the above courses being adopted by the Engineer-in-charge, Contractor shall have

no claim to compensation for any loss sustained by him by reason of his having purchased or procured any materials or entered into, any engagements or made any advances on account or with a view to the execution of work or performance of contract. And in case action is taken under any of the provisions aforesaid, the Contractor shall not be entitled to recover or be paid any sum for any work thereto or actually performed under this contract unless and until the Engineer-in-charge has certified in writing the performance of such work and the value payable in respect thereof and he shall only be entitled to be paid the value so certified.

15 Termination for Insolvency:

15.1 The BSNL may at any time terminate the Contract by giving written notice to the Contractor, without

compensation to Contractor if the contractor becomes bankrupt or otherwise insolvent as declared by the competent court provided that such termination will not prejudice or affect any right or action or remedy which has accrued or will accrue thereafter to the BSNL

16. Optional Termination by BSNL (other than due to default of the Contractor):

16.1 The BSNL may, at any time, at its option cancel and terminate this contract by written notice to the contractor,

in which event the contractor shall be entitled to payment for the work done up to the time of such cancellation and a reasonable compensation in accordance with the contract prices for any additional expenses already incurred for balance work exclusive of purchases and/or whole of material, machinery and other equipment for use in or in respect of the work.

16.2 In the event of the termination of the contract, the contractor shall forthwith clear the site of all the contractor’s materials, machinery and equipments and hand over possession of the work/ operations concerned to the BSNL or as the BSNL may direct.

16.3 BSNL may, at its option, cancel or omit the execution of one or more items of work under this contract and may part of such items without any compensation whatsoever to the contractor.

16.4 The action of the Divisional Engineer as per the above sub-clauses shall not be construed as Breach of the contract

17. Issuance of Notice :

17.1The Divisional Engineer in-charge of work shall issue show cause notice giving details of lapses, violation of terms

and conditions of the contract, wrongful delays or suspension of work or slow progress to the contractor directing the contractor to take corrective action. A definite time schedule for corrective action shall be mentioned in the show cause notice. If the contractor fails to take corrective action within the stipulated time frame, the Divisional Engineer In-charge route shall submit a draft of final notice along with a detailed report to the competent authority who had accepted the contract.

17.2The final notice for rescission of contract to the contractor shall expressly state the precise date and time from which the rescission would become effective. The following safe guards shall be taken while issuing the final notice: a) During the period of service of notice and its effectiveness, the contractor should not be allowed to

remove from the site any material/equipment belonging to the BSNL. Signature of the Tenderer with seal

b) The contractor shall give in writing the tools and plants he would like to take away/remove from the site. Such of the materials as belong to him and which may not be required for future execution of balance work may be allowed by the Divisional Engineer in-charge of work to be removed with proper records.

c) No new construction beneficial to the contractor shall be allowed. d) Adequate BSNL security arrangement in replacement of the contractor watch and ward shall be made

forthwith. Expenses on this account are recoverable from the security deposit or any amount due to the contractor.

17.3 "Any notice order or other communication sought to be served on the Contractor with reference to the contract shall without prejudice to any other mode of service, be deemed to have been served if delivered by hand or sent by registered post to the office of Contractor at site or to the Contractor's head-office, while any notice or order or communications by the contractor to be served on Divisional Engineer with reference to the contracts shall be valid if same is served/delivered by hand or through registered post to the office of Divisional Engineer at his head quarters."

18. INDEMNITIES :

18.1The contractor shall at all times hold the BSNL harmless and indemnify from against all action, suits, proceedings,

works, cost, damages, charges claims and demands of every nature and descriptions, brought or procured against the BSNL , its officers and employees and forthwith upon demand and without protect or demur to pay to the BSNL any and all losses and damages and cost (inclusive between attorney and client) and all costs incurred in endorsing this or any other indemnity or security which the BSNL may now or at any time have relative to the work or the contractors obligation or in protecting or endorsing its right in any suit on other legal proceeding , charges and expense and liabilities resulting from or incidental or in connection, with injury, damages of the contractor or damage to property resulting from or arising out of or in any way connected with or incidental to the operations caused by the contract document. In addition the contractor shall reimburse the BSNL or pay to the BSNL forthwith on demand without protect or demur all cost, charges and expenses and losses and damages otherwise incurred by it in consequences of any claim, damages and actions which may be brought against the BSNL arising out of or incidental to or in connection with the operation covered by the contractor.

18.2The contractor shall at his own cost at the BSNL request defend any suit or other proceeding asserting a claim covered by this indemnity, but shall not settle, compound or compromise any suit or other finding without first consulting the BSNL.

19. FORCE MAJEURE:

a. If any time, during the continuance of this contract, the performance in whole or in part by either party or any

obligation under this contract shall be prevented or delayed by reason of any war, or hostility, acts of the public enemy, civil commotion sabotage, fires, floods, explosions, epidemics, quarantine restrictions, strikes, lockouts or act of God (Here in after referred to as events) provided notice of happenings, of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof, neither party shall by reason of such event be entitled to terminate this contract nor shall either party have any such claim for damages against the other in respect of such non-performance and work under the contract shall be resumed as soon as practicable after such event may come to an end or cease to exist, and the decision of the BSNL as to whether the work have been so resumed or not shall be final and conclusive, provided further that if the performance, in whole or part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days either party may, at his option terminate the contract.

b. Provided also that if the contract is terminated under this clause, the BSNL shall be at liberty to take over from the

contractor at a price to be fixed by the BSNL, which shall be final, all unused, undamaged and acceptable materials, bought out components and stores in the course of execution of the contract, in possession of the contractor at the time of such termination of such portions thereof as the BSNL may deem fit excepting such materials bought out components and stores as the contracts may with the concurrence of the BSNL elect to retain.

20. ARBITRATION :

20.1In the event of any question, dispute or difference arising under this agreement or in connection there-with except

as to matter the decision of which is specifically provided under this agreement, the same shall be referred to sole arbitration of the Chief General Manager Telangana Telecom Circle, Hyderabad or in case his designation is changed or his office is abolished then in such case to the sole arbitration of the officer for the time being entrusted whether in addition to the functions of the Chief General Manager Telangana Telecom Circle, Hyderabad or by whatever designation such officers may be called (hereinafter referred to as the said officer ) and if the Chief General Manager Telangana Telecom Circle, Hyderabad or the said officer is unable or unwilling to act as such to the sole arbitration or some other person appointed by the CGMT, Hyderabad or the said officer. The agreement to appoint an arbitrator will be in accordance with the Arbitration and Conciliation Act, 1996. There will be no objection to any such appointment that the

arbitrator is Government Servant or that he has to deal with the matter to which the agreement relates or that in the course of his duties as Government Servant he has expressed views on all or any of the matter under dispute. The award of the arbitrator shall be final and binding on the parties. In the event of such arbitrator to whom the matter is originally referred, being transferred or vacating his office or being unable to act of any reasons whatsoever such CGMT, Hyderabad or the said officer shall appoint another person to act as arbitrator in accordance with terms of the agreement and the person so appointed shall be entitled to proceed from the stage at which it was left out by his predecessors. In the event of any dispute or difference relating

to the interpretation and application of the provisions of commercial contract(s) between Central Public Sector Enterprises (CPSEs) port trusts inter se and also between CPSUs and Government Departments/ Organizations (Excluding disputes concerning Railways, Income Tax, Customs and Excise Departments) such disputes or difference shall be taken up by either party for resolution through AMRCD as mentioned in DPE OM No.4(1)/2013-DPE(GM)/FTS/1835 dated 22.05.2018

20.2 The arbitrator may from time to time with the consent of parties enlarge the time for making and publishing the award, Subject to aforesaid Indian Arbitration and Conciliation Act 1996 and the Rules made there under, any modification thereof for the time being in force shall be deemed to apply to the arbitration proceeding under this clause.

20.3 The venue of the arbitration proceeding shall be the Office of the Chief General Manager Telangana Telecom Circle, Hyderabad or such other places as the arbitrator may decide. The Following procedure shall be followed:

20.3.1 In case parties are unable to reach a settlement by themselves, the dispute should be submitted or arbitration in accordance with contract agreement.

20.3.2 There should not be a joint submission with the contractor to the sole Arbitrator. 20.3.3 Each party should submit its own claim severally and may oppose the claim put forward by the other party. 20.3.4 The onus of establishing his claims will be left to the contractor. 20.3.5 Once a claim has been included in the submission by the contractor, a reiteration or modification thereof will be

opposed. 20.3.6 The “points of defense” will be based on actual conditions of the contract. 20.3.7 Claims in the nature of ex-gratia payments shall not be entertained by the Arbitrator as these are not

contractual. 20.3.8 The question whether these conditions are equitable shall not receive any consideration in the preparation of

“points of defense”. 20.3.9 If the contractor included such claims in his submission, the fact that they are not contractual will be

prominently placed before the Arbitrator. 20.3.10 The award of the sole Arbitrator shall be final and binding on all the parties to the dispute.

21. SET OFF :

21.1Any sum of money due and payable to the contractor (including security deposit refundable to him) under this

contract may be appropriated by the BSNL or any other person or persons contracting through the BSNL and set off the same against any claim of the BSNL or such other person or persons for payment of a sum of money arising out of this contract made by the Contractor with BSNL or such other person or persons contracting through BSNL.

SECTION VI

SPECIAL CONDITIONS OF CONTRACT

1. GENERAL :

1. The work shall be accepted only after testing carried out by BSNL team, designated by the BSNL, as per prescribed schedule and work/material passing the test successfully.

2. The BSNL reserves the right to disqualify such bidders who have a record of not meeting contractual obligations against earlier contracts entered into with the BSNL.

3. The BSNL reserves the right to black list a bidder for a suitable period in case he fails to honour his bid without sufficient grounds.

4. The BSNL reserves the right to counter offer price(s) against price (s) quoted by any bidder.

5. Any clarification issued by BSNL, in response to query raised by prospective bidders shall form an integral part of bid documents and it may amount to amendment of relevant clauses of the bid documents.

6. Tender will be evaluated as a single package of all the items given in the price schedule.

7. All work to be executed under the contract shall be executed under the direction and subject to the approval in all respects of by the Divisional Engineer or Site Engineer in- charge of work site who shall be entitled to direct at what point or points and what manner they are to be commenced, and from the time to time carried on.

8. If the contractor shall desire an extension of time for completion of the work on the grounds of unavoidable hindrance in execution of work or on any other ground he shall apply in writing to the Divisional Engineer within 3 days of the date of hindrance on account of which he desires such extension as aforesaid. In this regard the decision of GMTD Khammam shall be final.

9. If at any time after the commencement of the work, the BSNL may feel that execution of whole or part of work, as

specified in the tender is not required to be carried out, then the BSNL shall give notice in writing of the fact to the contractor who shall have no claim to any payment of compensation whatsoever on account of any profit or advantage which he might have derived in consequence of the full amount of the work not having been carried out neither shall he have any claim for compensation by reason of any alterations having been made in the original specifications, drawing, design and instructions which shall involve any curtailment of the work as originally contemplated.

10. Whenever any claims against the contractor for the payment of a sum of money arises out of or under the contract, the BSNL shall be entitled to recover such sum by appropriating in part or whole the security deposit of the contractor, and to sell any Government promissory notes etc. forming the whole or part of such security or running/ Final bill pending against any contract with the BSNL. In the event of the security being insufficient or if no security has been taken from the contractor, then the balance or the total sum recoverable as the case may be, shall be deducted from any sum then due or which at any time there after may become due to the contractor under this or any other contract with BSNL Should this sum be not sufficient to cover the full amount recoverable the contractor shall pay to BSNL on demand the balance remaining due.

11. No official of Gazetted rank or other Gazetted officer employed in BSNL or administrative duties in an Engineering

department or any other department of the Government of India is allowed to work as a contractor for a period of two years after his retirement from Government service without the previous permission of Government of India. This contract is liable to be cancelled if either the contractor or any of his employees is found at any time to be such a person who hadn’t obtained the permission of Government of India as aforesaid before submission of the engagement in the contractor’s service as the case may be.

12. In the event of the contractor being, adjusted insolvent or going voluntarily into liquidation of having received order or other order under insolvency act made against him or in the case of company, of the passing of any resolution, or making of any order for winding up whether voluntarily or otherwise, or in the event of the contractor failing to comply with any of the conditions herein specified, The GMTD Khammam shall have the power to terminate the contract without any notice.

13. Without prejudice to any of the rights or remedies under this contract, if the contractor dies, the GMTD

Khammam on behalf of the BSNL can terminate the contract without compensation to the contractor. However the GMTD Khammam at his discretion may permit contractor’s heirs to perform the duties or engagements of the contractor under the contract, in case of his death. In this regard the decision of GMTD, Khammam shall be the final.

14. In the event of the contractor winding up his company on account of transfer or merger of his company with any other, the contractor shall make it one of the terms and stipulations of the contract for the transfer of his properties and business, that such other person or company, shall continue to perform the duties or engagement of the contractor under this contract and be subject to his liabilities there under.

15. Interpretation of the contract documents :

15.1 The authorized representative of GMTD Khammam and the contractor shall in so far as possible by mutual consultation, try to decide upon the meaning and intent to the contract document. In case of disagreement the matter shall be referred to the GMTD Khammam whose decision shall be final. Any change in the contract document shall be set forth in writing by the representative of the parties hereto. It shall be the contractor’s responsibility to thoroughly familiarize all of his supervisory personnel with the contents of all the contract documents.

15.2 The Contractor shall be an independent Contractor and shall have complete charge of the men/women engaged in the performance of the works to be performed hereunder and shall perform the work in accordance with this own methods and at his own risk subject to compliance with contract documents. The Contractor shall through the Scope of the work under the contract and execute the work in the best and most substantial workman like manner and both as regards material and otherwise in respect, in strict accordance with the contract document or such additional particulars, instructions and drawings as may be found requisite to be given during carrying on of the works any unit person or any one not capable or not properly qualified to properly perform the work assigned to him. The Contractor shall also not employ in respect of the works any employee that the Divisional Engineer/Site Engineer may for any reason object to.

16. Notification :

The contractor shall give in writing to the proper person or authority with a copy to the Divisional Engineer such notification as may be mandatory or necessary in connection with the commencement, suspension, resumption, performance and/ or completion of the contracted work. All notice shall be given sufficiently in advance of the proposed operation to permit proper co-relation of activities and the contractor shall keep all proper persons or authorities involved and advised of the progress of operations throughout the performance of the work and/or with such other information and/ or supporting figure and data as may from time to time as directed or required.

17. Shut down on account of weather conditions :

The contractor shall not be entitled to any compensation whatsoever by reason of suspension of the whole or any part of the work made necessary by the BSNL or deemed advisable on account of bad weather conditions or other Force majeure conditions.

2. L1 Bidder: Lowest bidder based on financial bid.

3.STORES SUPPLIED BY THE BSNL

3.1 At no point of time the contractor shall be issued stores of value more than the contractor’s material security as

per clause number 9 (i) of section IV. If at all the work requires more amount of materials to be issued to the contractor, then the security shall suitably be revised before the issue of the store and the contractor will not have any objection to it.

3.2 The contractor shall transport (including loading and unloading) all stores issued to him from MM Stores,

Khammam to the site of work at his own cost. The BSNL shall not pay any transportation charges to the contractor.

3.3 All materials supplied to the contractor by the BSNL shall remain the absolute property of BSNL and shall not be

removed from site of the work except for use in the work and shall be at all times open to inspection by the Representative of GMTD Khammam. In case the materials like cable and accessories are taken delivery of by the contractor and stored at the site office/ store of the contractor such site office/ store will also be treated “as site” for this purpose, Any such materials remaining unused at the time of the abandonment, completion or determination of the contract shall be returned to the BSNL at a place informed to him by the BSNL, failing which the cost of the unused materials shall be deducted from the contractor’s material security or any of his pending bills or from any other security.

3.4 The contractor shall be responsible for the transportation of store, storage and safe custody of all material

supplied to him by the BSNL, which in the contractor’s custody whether, or not installed in the work. The contractor shall satisfy himself regularly the quantity and quality of the materials supplied to him and he will be responsible for any subsequent deterioration and discrepancy (inclusive of theft) in the quantity/ quality of the materials.

3.5. The contractor shall submit a proper account every month of all the materials supplied to him by the BSNL and

those consumed for items of work. Any discrepancy of difference between the materials issued to the contractor and those consumed in the work as per the BSNL calculation (which shall be final) will be charged to the contractor or deducted from his bills at 1.5 times of prevailing standard price including freight, handing charges, storage charges etc.

3.6 The contractor shall ensure that only the required materials are issued to him. Upon completion of work, the contractor shall return to the BSNL at the later designated store in good condition, free of charges, any unused materials that were supplied by the BSNL. The contractor should return the recovered material If any during the course of work to the BSNL, as and when recovered, and it also be submitted in the monthly reports.

3.7 The contractor should handover the recovered material such as OF Cable, joint kits, and other materials arising out of the corrective, OF Cable Strengthening by Scheduled and Planned Works, to the BSNL stores under acknowledgement from the Officer-in-charge of BSNL.

4. EASEMENTS, PERMITS, LICENCES AND OTHER FACILITIES: 4.1 The contractor shall obtain / provide at his own cost all easements, permits and license necessary to do work except

for the following for which the payment to the concerned authorities shall be provided by BSNL against the demand note/estimate raised by the concerned department but the liasoning with such agencies will be responsibility of the Contractor.

4.1.1 Right of User” easements and permits. 4.1.2 Railway, Highway, State road, Municipal, Grampanchayat, Forest and other Authorities crossing permits

including bridge. 4.1.3 Canal/stream crossing permits.

No extra charges will be paid to the contractors for pursuance of easements, permits etc. from the different local authorities. It shall be responsibility of the bidder to quote the rates for execution of the work keeping in view such aspects.

4.2 The approved bidder shall obtain way leave permission (right of way) from the concerned road authorities, including

permission for working, from the concerned authorities. This will include the works of preparing the requisition for permission along with the necessary drawings as required by the highway authorities, get the same duly signed by the Divisional Engineer (Maintenance) in charge of the work, and submit the same to the road authorities. They shall pursue the case on a continuous basis and get the permission in the shortest time. The rate quoted for trenching shall also include the charges for undertaking the work to get permission. No separate rates will be applicable for getting permission.

4.3 The contractor shall forthwith start the process of survey, preparation and submission of application on behalf of

BSNL along with relevant drawings to the concerned authority, co-ordination for getting permission.

4.4 The permission should be obtained in the most cost effective method for BSNL. The contractors should pursue to get

the least restoration/reinstatement charges, and get the lowest BT cutting charges. The permission shall be applied under the supervision of the SDE-in-charge, and after satisfaction of the DE-in –charge

4.5 The Contractor shall be fully responsible for handling and obtaining all necessary easements, permits and licenses, for

moving all construction equipment, tools supplied materials and men across Railways and Highways, across public or Private road as well as premises of any public utility within the right of user and for bearing all costs that may be incurred in respect of the same.

4.6 The contractor is to confine his operation to the provided construction “Right of User” unless it has made other

arrangement with the particular property owners and/or tenants such other arrangements shall be entirely at the responsibility of the contractor as to cost and arrangement as also breach and claim and shall be entitled with a copy to the Divisional Engineer.

4.7 The contractor will not be entitled to extra compensation for hardship and increase in cost by the cable trench being

routed adjacent to or across other pipeline, Highways, Railways, telephones or poser poles and wires or GI wires, embankments, cliffs, streams or other obstacles which may physically or otherwise in any manner, restrict or limit the use of the construction “Right of User”. Some construction and such contingency shall be deemed to have been providing for in the rates.

4.8 At location where the OF Cable trench is routed across or along railways or roads the contractor shall without extra

cost provide and maintain such detours and road controls as are required by the railways or BSNL or local agencies having jurisdiction.

4.1 QUALITY OF WORK : The BSNL shall be the final judge of the quality of the work and the satisfaction of the BSNL in respect there of set forth in the contract document. Laxity or failure to enforce compliance with the contract documents by the BSNL and/ or its representative shall not manifest a change or intent of waiver, the intention being that, notwithstanding the same , the contractor shall be and remain responsible for complete and proper compliance with the contract documents and the specification there in. The representative of GMTD Khammam has the right to prohibit the use of men

and any tools, materials and equipment which in his opinion do not produce work or performance to meet the requirement of the contract documents.

5. TAXES AND DUTIES: Contractor shall pay all rates, levies, fees royalties, taxes and duties payable or arising from out of, by virtue of or in connection with and/or incidental to the contract or any of the obligations of the parties in terms of the contractor documents and/or in respect of the works or operations or any part thereof to be performed by the contractor and the contractor shall indemnify and keep indemnified the BSNL from and against the same or any default by the contractor in the payment thereof.

6. PROTECTION OF LIFE AND PROPERTY AND EXISTING FACILITIES:

6.1 The contractor is fully responsible for taking all possible safety precaution during preparation for and actual performance of the works and for keeping the construction site in a reasonable safe condition in compliance with the Laws of the Land. The contractor shall protect all life and property from damage or losses resulting from his construction operations and shall minimize the disturbance and inconvenience to the public.

6.2 If the excavation of trench alters the contours of the ground around road and highway crossing in such locations

dangerous to traffic, the contractor shall at his own cost, take all necessary precautions to protect public and shall comply with all the BSNL regulations and Local Authority Regulations as to placing of warning boards (minimum size 3’ x2’0, traffic signals, barricades, flags etc.), at such location. If the contractor does not put the warning signal as per above directions, then a penalty of Rs 500/- per day shall be levied on the contractor, till the directions are complied by the contractor. The contractor shall take due precautions to avoid damages to other pipe lines, water mains, sewers, telephones, telegraphs and power conduits, laid wires poles and GI wires, railways, highways, bridges or other underground or above ground structure and/or property crossing or adjacent to the cable trench being excavated. Any damage caused to public/Pvt. property will be at the expense of the Contractor.

6.3 Attention of the contractor is drawn to the rules regarding laying of cables at road crossing, along Railways Bridges, highways safety precautions while working in Public Street. The contractor in writing shall obtain the detailed engineering instructions from the Divisional Engineer of the area.

6.4 The contractor shall be solely responsible for locating the fault/laying OF pipe and cable through approved non-destructive means and ensuring the safety of all existing underground pipeline, electrical cables, and or other structures. "No diagrams, details and/or any other relevant documents anyway related with the existing and/or overhead pipe lines, Telecom cables, Electric cables and/or other structures will be provided by BSNL to the Contractor."

6.5 The contractor shall be solely liable for all expense for and in respect of repairs and/or damages occasioned by injury of or damage to such underground and above structures or other properties and under take to indemnify the BSNL from and against all actions, cause of actions, damages, claims and demands what-so-ever, either in law or in equity and all losses and damages and costs (inclusive between attorney and client), charges and expenses in connection therewith and/ or incidental thereto. The contractor shall take all responsibilities and risk in crossing other pipelines and cables and shall be responsible for protecting all such existing pipelines, poles, electric lines, sewers, cables or other facilities from damage by the contractor’s operation in connection with the work. The contractor without cost of the BSNL shall promptly repair any damage incurred.

6.6 The current market value of any commodities lost as a result of any damage to the aforesaid existing facilities shall be paid by the contractor together with such additional sums necessary to liquidate the personal of property damages, resulting there from.

7. LABOUR WELFARE MEASURES AND WORKMAN COMPENSATION :

7.1Obtaining License before commencement of work : The contractor shall obtain a valid labour license under the Contract Labour (R &A) Act 1970 and the Contract Labour (Regulation and Abolition) Central Rules 1971, before commencement of the work, and continue to have a valid license until the completion of work. The contractor shall also abide by the provisions of the Child Labour (Prohibition and Regulation) Act 1986. Any failure to fulfill this requirement shall attract the penal provisions of the contract arising out of the resultant non-execution of work.

7.2Contractors Labour Regulations : 7.2.1. Working Hours

The Contractor/Service Provider will abide by all the laws of the land in respect of the working hours, overtime and minimum wages to the workers. Any failure to fulfill this requirement shall attract the penal provisions of this contract arising out of resultant non-execution of the work and liable for the termination of this agreement and forfeiture of the Security Deposit.

7.2.2 Display of Notice Regarding Wages Etc.

The contractor shall, before he commences his work on contract, display and correctly maintain and continue to display and correctly maintain, in a clear and legible condition in conspicuous places on the work, notices in English and in local Indian languages spoken by the majority of the workers, giving the minimum rates of the

wages fixed under Minimum Wages Act, the actual wages being paid, the hours of work for which such wage are earned, wages periods, dates of payments of wages and other relevant information.

7.2.3 The contractor shall obtain from the site Engineer or any other authorized representative of the Engineer-in-

Charge, as the case may be, certificate under his signature at the end of the entries in the “Register of Wages” or the “Wage-cum-muster Roll” , as the case may be, in the following form:-

“Certified that the amount shown in the column No……..has been paid to the workman concerned in my presence on ………….at ……………..”

7.2.4 Fines and deductions, which may be made from wages

7.2.4.1 No fines should be imposed on any worker in respect of such acts and omissions on his part as have been

approved of by the Labour Commissioner.

7.2.4.2 No fine shall be imposed on a worker and no deduction for damage or loss shall be made from his wages until

the worker has been given an opportunity of showing cause against such fines or deductions.

7.2.4.3 Every fine shall be deemed to have been imposed on the day of the act or omission in respect of which it was

imposed.

7.2.5. Labour records

7.2.5.1 The contractor shall maintain a Register of Persons employed on work on contract in Form XIII of the Contract

Labour (R &A) Central Rules 1971.

7.2.5.2 The contractor shall maintain a Muster Roll register in respect of all workmen employed by him on the work

under contract in from XVI of the CL (R & A) Rules 1971.

7.2.5.3 The contractor shall maintain a Wage Register in respect of all workmen employed by him on the work under

contract in Form XVII of the CL (R & A) Rules 1971.

7.2.5.4 Register of accidents - The contractor shall maintain a register of accidents in such form as may be convenient

at the work place but the same shall include the following particulars:

a) Full Particulars of the labourers who met with accident. b) Rate of wages. c) Sex d) Age e) Nature of accident and cause of accident f) Time and date of accident g) Date and time when admitted in hospital h) Date of discharge from the hospital i) Period of treatment and result of treatment j) Percentage of loss of earning capacity and disability as assessed by medical officer k) Claim required to be paid under Workmen’s Compensation Act. l) Date of payment of compensation. m) Amount paid with details of the person to whom the same was paid n) Authority by whom the compensation was assessed o) Remarks.

7.2.5.5 The contractor shall maintain a Register of Fines in the Form XII of the CL (R &A) Rules 1971 The contractor shall

display in a good condition and in a conspicuous place of work the approved list of acts and omission for which fines can be imposed.

7.2.5.6 The contractor shall maintain a Register of deductions for damage or loss in Form XX of the CL (R &A) Rules

1971.

7.2.5.7 The contractor shall maintain a Register of Advances in Form XXIII of the CL (R & A) Rules 1971. 7.2.5.8 The contractor shall maintain a Register of Overtime in Form XXIII of the CL (R & A) Rules 1971. 7.2.6 Attendance card cum wage slip 7.2.6.1 The contractor shall issue an Attendance card cum wage slip to each workman employed by him. 7.2.6.2 The card shall be valid for each wage period. 7.2.6.3 The contractor shall mark the attendance of each workman on the card twice each day, once at the

commencement of the day and again after the rest interval, before he actually starts work. 7.2.6.4 The card shall remain in possession of the worker during the wage period under reference.

7.2.6.5 The contractor shall complete the wage slip portion on the reverse of the card at least a day prior to the disbursement of wages in respect of the wage period under reference.

7.2.6.6 The contractor shall obtain the signature or thumb impression of the worker on the wage slip at the time of disbursement of wages and retain the card with him.

7.2.7 Employment card The contractor shall issue an Employment Card in the Form XIV of CL (R & A) Central Rules 1971 to each worker within three days of the employment of the worker.

7.2.8 Service certificate On termination of employment for any reason whatsoever the contractor shall issue to the workman whose services have been terminated, a service Certificate in the Form XV of the CL (R & A) Central Rules 1971.

7.2.9 Preservation of labour records The labour records and records of Fines and deductions shall be preserved in original for a period of three years from the date of last entries made in them and shall be made available for inspection by the Engineer-in-Charge or Labour Officer or any other officers authorized by the Ministry of Communication in this behalf.

7.3 Power of Labour officer to make investigations or enquiry

The labour officer or any person authorized by the Central Government on their behalf shall have power to make enquiries with a view to ascertaining and enforcing due & proper observance of fair wage clauses and provisions of these Regulations. He shall investigate into any complaint regarding the default made by the contractor in regard to such provision.

7.4 Report of Investigating officer and action thereon

The Labour Officer or other persons authorized as aforesaid shall submit a report of result of his investigation or enquiry to the Engineer in-charge indicating the extent, if any, to which the default has been committed with a note that necessary deductions from the contractor’s bill be made and the wages and other dues be paid to the labourers concerned. The Engineer in-charge shall arrange payment to the labour concerned within 45 days from the receipt of the report from the labour Officer or the authorized officer as the case may be.

7.5 Inspection of Books And Slips

The contractor shall allow inspection of all the prescribed labour records to any of his workers or to his agent at a convenient time and place after due notice is received or to the Labour Officer or any other person, authorized by the Central Government on his behalf,

7.6 Submission of Returns

The contractor shall submit periodical returns as may be specified from time to time. 7.7 Amendments

The Central Government may from time to time add to or amend the regulations and on any question as to the application/interpretation or effect of those regulations.

8.0 INSURANCE: 8.1 Without limiting any of his other obligations or liabilities, the contractor shall, at his own expense, take and keep

comprehensive insurance including third party risk for the plant, machinery, men, materials etc. brought to the site and for all the work during the execution. The contractor shall also take out workmen’s compensations insurance as required by law and under take to indemnify and keep indemnified the BSNL from and against all manner of claims and demands and losses and damages and cost (including between attorney and client) charges and expenses that may arise in regard the same or that the BSNL may suffer or incur with respect to end./ or incidental to the same. The contractor shall have to furnish originals and/or attested copies as required by the department of the policies of insurance taken within 15 (fifteen) days of being called upon to do so together with all premium receipts and other papers related thereto which the BSNL may require.

9. COMPLIANCE WITH LAWS AND REGULATION:

During the performance of the works the contractor shall at his own cost and initiative fully comply with all applicable laws of the land and with any and all applicable by-laws, rules, regulations and orders and any other provisions having the force of law made or promulgated or deemed to be made or promulgated by the Government, Governmental agency or BSNL municipal board, Government of other regulatory or Authorized body or persons and shall provide all certificates of compliance therewith as may be required by such applicable law, By-laws, Rules, Regulations, orders and/or provisions. The contractor shall assume full responsibility for the payment of all contributions and pay roll taxes, as to its employees, servants or agents engaged in the performance of the work specified in the contractor documents. If the contractor shall require any assignee or subcontractor to share any portion of the work to be performed hereunder may be assigned, sub-leased or sub-contracted to comply with the provisions of the clause and in this connection the contractor agrees as to undertake to save and hold the BSNL harmless and indemnified from and against any/all penalties, actions, suits, losses and damages, claims and demands and costs (inclusive between attorney and client )charges and expenses whatsoever arising out or occasioned, indirectly or directly, by failure of the contractor or any assignee or sub-contractor to make full and proper compliance with the said by-laws, Rules, Regulations, Laws and Order and provisions as aforesaid.

29 10. TOOLS AND PLANTS

The contractor shall provide at his own cost all tools, plants appliances, implements, measuring instruments etc. required for proper execution of works. The contractor shall also supply without charge the requisite number of persons with the means and material necessary for the purpose of setting out works, counting, weighing and assisting the measurements for examination at any time and from time to time. The contractor shall be responsible to make all arrangements, at his own cost for dewatering of trenches/ducts and de-gasification of the ducts before carrying out the work. The contractor shall also be responsible to make arrangements at his own cost for water required for carrying of works at sites including curing of CC/RCC works. Falling his so doing the same may be provided by the Engineer-in charge at the expense of the contractor and the expenses shall be deducted from any money due to the contractor under this contract or otherwise.

IMPORTANT INSTRUCTIONS

1. After the work commences the contractor or his authorized representative(s) shall be present at the site. The

representative shall be authorized by the DE concerned based on the contractor’s request. 2. Work shall be recorded in the site register by the site Engineer. The contractor or his authorized representative shall sign in

the site register held by the site Engineer. 3. Since the time provided for the work is only a few days/weeks, all the communication shall be done at the site. If the

contractor or his authorized representatives shall not sign the register, then it shall be considered that nobody is present at the site. Then only written communication shall be sent through registered post.

4. If the contractor does not provide the barricades, warning cones, warning tapes and work notice board, 5% additional penalty shall be levied. The same shall be provided by BSNL and 150% of the cost of the items shall be recovered from the contractor.

5. Any additional work, road crossings in the neighborhood of the work, when assigned by the DETM in charge shall be carried out by the contractor.

6. Due to underground utilities, if the manhole/joint chamber cannot be constructed at the site shown, the decision of the site engineer shall be final and binding on the contractor. If it is decided to shift the manhole within the neighborhood, the contractor shall construct at the place shown by the site engineer.

7. The work will be executed as per direction and condition mentioned in clause 4 of section-VI with the conditions imposed by the corporation or traffic police. In general, the permission may be available for working at night only in municipal area of city. The probable time for allowing trench less/ HDD/ open trench is from 10PM to next day 6AM. Delay in the work and non-commencement of the work due to these reasons shall not be entertained.

8. If the work extends beyond the time given in the work order. BSNL shall not provide the Right of Way. The permissions from Corporation and Police shall be obtained by the contractor. If the contractor finds the time allowed for completion of work to be less, he may accordingly deploy more men/machines to complete the work in time.

9. If the work is not progressing as per the schedule, the work may be either restricted or terminated. 10. If the manhole work is abandoned after commencing, the work may be either restricted or terminated. 11. BSNL reserves the right to disqualify such bidders who have a record of not meeting the contractual obligations against

earlier contracts entered into with the BSNL. 12. In both the cases where the work is either restricted or terminated, apart from invoking necessary tender clauses, the

contractor shall be barred for similar type of works under GMTD BSNL Khammam SSA, for a period of six months from the date of termination/ restriction of work.

13. Rate should be quoted in figures as well as in words and corrections should be attested, otherwise tender shall be rejected. 14. The contractor shall restore the cut portions of BT/Concrete roads to their original conditions immediately on completion

of the pipe laying works. If the restoration work is not satisfactory with reference to the standards prescribed by the Corporation / Highways, the amount equal to the charges as claimed by the Corporation/Highways will be recovered from the contractor.

15. The contractor shall deploy as many machines/workmen as required for the timely completion of the work. 16. The fact that the contractor is working simultaneously in one or more sections, the same Division/other Divisions will not

absolve him from the responsibility of completing the work in time. 17. The contractor may be asked to carry out 25% of the estimated work at any SSA location/site under the jurisdiction of the

GMTD Khammam of concerned area at the approved rates with mutual consent.

SECTION VII SCOPE OF WORK AND JURISDICTION OF CONTRACT

1. SCOPE OF WORK Scope of work of the contract includes: To provide man power/ machines for

1 Protection work of Cable during Road widening / Drainage / Canal / pipeline/other digging works as assigned. 2 Temporary / Permanent Restoration of O.F Cable during OF Cable faults due to Road widening/ Drainage /

Canal / pipeline/ rat bite/ant bite/ other digging works works 3 Normalization (grounding) of existing overhead OF cable/OFC Patch sections.

3.1. Excavating trench at 165 cms depth, laying of PLB pipe, blowing/pulling of Cable, splicing and arranging OF Cable Joint chambers and associated works

4 Making existing cable over head for protection / restoration of faults. 5 Permanent reinstatement of damaged / over head cable / patches developed during the tender contract period &

associated civil works. 6 Recovery of over head OF cable after completion of reinstatement work.

This scope and specification covers the preventive maintenance, corrective maintenance, OF Cable Strengthening by Scheduled

and Planned Works, normalization of existing over head cable, strengthening of existing OF cable by attending of high loss fibers to bring down the loss within the permissible limit i.e 0.3dB/km, and break down corrective maintenance activities to be carried out by the contractor for OFC routes of BSNL. The route index drawings will be provided to the contractor by BSNL during the currency of the maintenance contract. However, the locations of the cable as reflected in the drawings/ details are indicative only and it is the responsibility of the contractor to determine the actual location along the routes. At certain sections multiple OFC cables have been laid on the same trench/ other side of the road. The bidder is required to visit the sites and ascertain the geographical conditions and its latest status. In view of road widening, some portion of OFC has come under tar surface of the road and at some place OF cable has been drawn on overhead temporarily.

The detailed scope of contract is as under:

1. Preventive Maintenance: Patrolling & Guarding/protection of OF cable:

1.1 The primary focus is to avoid the occurrence of OFC cuts with intensive patrolling and Surveillance along the OFC routes.

1.2 Contractor has to keep good rapport and co-ordination with the all Government and Non-Government bodies/

authorities/other Telecom operators and also farmers/ land owners to collect their plan of activities for the

routes, which may prevent damages to the OF Cables. 1.3 There shall be one patrolling team per stretch for distances up to 50 km cable route, for patrolling the allotted

stretches. Route length shall be in physical road length and not OFC length. The exact route length shall be ascertained by the Contractor after conducting a Joint inspection /Survey along with the designated officer of BSNL. The survey report shall be duly signed and submitted by the designated authorities from both the parties within 10 days from the date of LOI. The Contractor shall deploy the following manpower along the route of 50 Km for patrolling:

a) 1 No. of Patroller with Motorcycle.

1.4 Contractor shall arrange trained manpower to replace any regular member of the patrolling team who may be absent

on grounds of sickness/leave/emergency or as the case may be. Under no circumstances shall any stretch of the OFC route be left un-patrolled on any grounds whatsoever.

1.5 The Patroller of the Contractor has to patrol entire section of 50 km to and fro daily in any route as per field

requirement, irrespective of holidays. However the contractor shall carryout the additional patrolling whenever it is necessary as per the actual site conditions. The patrolling timings shall vary as per the actual requirements. The patrolling teams have to be vigilant in respect of O.F routes where road expansion/construction activates are in progress.

1.6 T h e patrolling teams shall be available on 24 hours basis on all the days in a week on Mobile phone for information about any potential activity that may cause damage to OFC along the route.

1.7 The patrolling team shall have two mobile phone connections from different service providers Out of which one shall

be from BSNL. This is required for ensuring the uninterrupted communication during unforeseen situations.

1.8 T h e patrolling team shall call from predetermined landline telephone numbers en-route to the designated officer of BSNL, for informing that the patroller has reached the locations and also to brief the events noticed during patrolling.

1.9 While patrolling, the Patroller has to keep a close watch on the OFC as well as activities going on around it and make all necessary observations. The Contractor shall also closely liaison with the following authorities so as to

update himself with the proposed works that may be executed by them in near future. The Contractor shall

safeguard BSNL OFC against any signs of damage or potential damages, which is required to avoid OFC cuts that may

arise during the execution of works by those authorities/ agencies. The Contractor shall take suitable precautionary

steps in consultation with designated officer of BSNL ahead of time, such as re-routing of OFC either underground or

overhead, providing additional protection to the existing alignment etc. The activities which are likely to cause

damages to OF cable are as under:-

ii) National Highway works such as widening of roads, embankment works, major bridge, sub-way, Flyover,

culvert works and tar melting work on the cable routes, which may cause damage to the cable. iii) State Highways, R&B Departments as mentioned above. iv) Water Supply Department works may trench on our cable route and as such extreme care is to be taken. v) Railway department works such as construction of over bridges/ under bridges, etc.

vi) Forest department works, such as plantation / removal of trees on the cable routes, which may cause

damage to cable.

vii) Electricity board works like trenching on our cable routes, erection /removal of electricity boards posts on cable routes, etc.

viii) Other Telecom Operators activities like trenching, HDD (Horizontal Directional Drilling), erection of Telegraph

posts etc., and the like by other local telephone/BSNL working parties. ix) Any and all Central / State / District / Municipal / Local / Panchayat/ Political Authorities / Agencies / Bodies,

etc. x) Putting up of pandals, by social organizations in connection with the visit of VIP meetings and functions. xi) Digging wells / pump sets by private parties near the brim of the Highways.

xii) Works carried out like storm water drain, diversion of rain water on the Highways concerned, by Village

Panchayat and Municipal Authorities of the area. xiii) Excavation / Renovation work being undertaken by private land owners through which BSNL OFC is passing.

xiv) Any other works/ activities which may damage the BSNL OF Cable. xv) OF cable damage due to rodent/ant bites and natural calamities.

1.10 Contractor has to keep a good rapport and effective coordination with local bodies/ agencies including those

mentioned above, of their proposed activities which may pose a threat to the OFC. On receipt of any such

information the Contractor must immediately inform the designated officer of BSNL and undertake all

precautionary measures including temporary/ permanent rerouting of cable either by underground or overhead

works that will prevent any harm or damage to the OFC and will save the revenue of the company.

1.11 If the Patroller observes that work is being carried out in and around the OFC route alignment by any Contractor/

Individuals, he must take charge of the situation, take preventive action immediately and inform the designated officer

of BSNL. He must proceed on his further patrolling duties after handing over charge of the situation to a Reliever from

the Contractor’s team.

1.12 Contractor also has to ensure that, the Route indicators already placed at regular intervals along the routes are not

stolen. The missing/ damaged indicators if any shall be planted by the contractor as per BSNL specifications for which the

indicators will be supplied by BSNL. 1.13 In certain situations where the weather does not permit patrolling by motor cycle, then a vehicle/ public transport

shall be engaged for the purpose of patrolling.

1.14 By Walking along the path where overhead OF cable is laid, the condition of the overhead OF cable shall be

monitored. In case of any sagging of the over head alignment, immediate action shall be taken by the contractor to

correct it as per the advice of designated officer of BSNL.

1.15 The contractor will provide vehicle for the joint visit of his supervisor and route in charge (SDE/JTO) for the

monitoring of the route twice a month during the period of tender.

1.16 Contractor has to maintain Management Information System (MIS) reports on a regular basis as per BSNL

approved formats and will submit to the Designated officer of BSNL within the specified time limits. 1.17 The Patrolling Team shall record it’s observations in the register kept at BSNL designated locations and shall also

convey the same to respective designated officer of BSNL.

1.18 Patrolling and supervision:-

The contractor should arrange to depute one supervisor on the report of patrolling person if there is any work going along the route which will be of long duration such as widening and leveling of road, sewerage works, highway digging and construction, uprooting of trees or large maintenance work on highways. The contractor should arrange to send the supervisor/team for the protection and keeping watch for the safety of BSNL of network during the duration of completion of work and ensure fault free network for the BSNL. The supervisor will be responsible for contacting the FRT(Fault Rectification Team) of contractor and arrange for restoration of the network as per tender

requirement in the event of any fault to the network. Regular information to the concerned BSNL Officer will be the responsibility of the supervisor arranged by the contractor.

2. Corrective Maintenance:

2.1 The OFC cuts can happen due to the activities of various agencies as listed at clause 1.9 above or due to any other

reason. In spite of the efforts of the contractor to prevent the cable cuts, if cable cuts occur, the contractor shall restore the fault within the permissible time period as specified at clause 12 under SLA. The fault restoration shall be done on a permanent basis.

2.2 However it may not be practical to do permanent restoration of all cases. Wherever it is not possible to restore the fault permanently, temporary restoration can be resorted to avoid traffic loss at contractor’s own cost and permanent restoration can be done subsequently by the contractor at his own cost. The Permanent restoration activity shall be carried out with prior approval of designated officer of BSNL. The shutdowns for carrying out the activity will be permitted by BSNL generally during 00:00 to 05:00 hours only on Saturdays and Sundays. But only in exceptional cases where the designated officer of BSNL is satisfied the shutdown will be given during day hours.

2.3 The corrective maintenance activities to be carried out by the contractor are broadly classified as under:

a) Localization of OFC breaks.

b) Obtaining permissions from the concerned local authorities. c) Excavation of earth to expose cable for fault rectification d) Identification of broken OFC ends and laying additional OFC e) Laying of required length of OFC with protection wherever required f) Testing of fibers g) Preparation of jointing pit and back filling of pit with Sand, soil etc. h) Splicing of OF cable i) Providing prefabricated RCC Chamber of 1 Meter diameter, 1 feet height and 3 inch thickness with

bottom and top covering plates for OFC joint Chamber and filling with clean sand. j) Providing precautionary rodent/ant pesticide. k) Planting of cable Route indicators and Joint indicators. l) Final Testing of OFC splices loss at the joint from the terminal station using power meter. m) Final updation of route index diagrams with longitude and latitude of joint pit/man holes.

2.4 On receipt of information of OFC fault, the Fault Rectification Team (FRT) shall move immediately for locating and

rectifying the fault as per the response time specified at clause 12.0, under SLA in this section.

2.5 After attending the fault, and ensuring the splice loss is within limits as specified above, the route index diagram shall

be updated by incorporating the new details like OFC coils used at the joint and other locations. The specification of

OFC splicing work is furnished at Section IX. 2.6 Response time is the time taken by the Contractor to mobilize (set in motion) all the necessary resources (like

materials, labour and equipment) required for attending the fault. It shall be maximum half-an-hour from the time

BSNL so advises, and the intimation to the contractor will be through SMS/ E-mail/ fax/ telephone.

2.7 Restoration of all systems / fibres in the OF cable shall be ensured within 6 hours and in extreme cases only where the

permanent restoration is not possible immediately, temporary restoration shall be made within 6 hours with the

approval of BSNL. However, permanent restoration shall be done during night hours after getting maintenance shut

down within 7 days of temporary restoration. The contractor has to submit a detailed report regarding the cause of

fault, restoration details within 24 hrs to the designated officer of BSNL. 2.8 During the corrective action by the contractor, in case other service cables/utilities like existing OFC, local

telephone copper cable, water pipes, electricity cables, any other pvt./ public Property etc. are damaged, the

penalty/ compensation if any, shall be borne by the Contractor only. The restoration of all such damages caused will

be rectified immediately by the contractor at his own cost. However this shall not hamper the BSNL OF cable

restoration activity.

2.9 The route index diagram with offset, along with route and joint indicators etc., details shall be prepared and

updated immediately after the rectification of OF cable fault by the contractor.

2.10 The FRT team will take photos at the fault site before restoration and after restoration of the cable fault and will hand over the print as well as digital version to the site in-charge at the time of submission of the bill on monthly basis.

2.11 Damages/ Theft of O.F cables:-

Incident Report for all damages/ theft of OF cables shall be submitted by the Contractor to the concerned Police station through the designated officer of BSNL and photos taken immediately on the spot and submitted to BSNL. FIR shall be taken from concerned police station and submitted to THE DESIGNATED OFFICER OF BSNL. The contractor shall own a camera with a provision for date and time stamp for the photos taken. The necessary

documentation required and compiled by the Contractor including investigation report is to be submitted to the DESIGNATED OFFICER OF BSNL.

2.12 If any service rendered by the contractor is found defective or abnormal delay, the same shall be got completed from

outside or BSNL source and the cost of any such work made by BSNL shall be deducted from the amount payable to the contractor.

2.13 The FRT team may be deployed at every 250 km for plain area which may vary as per the field requirement.

2.14 The permanent restoration activity shall be the excavation of new OF Cable trench, PLB laying, cable blowing, splicing to

the working cable, placing of OFC Joint chambers and reinstatement work is to be executed in the event of faults with the following activities.

a) Restoration of temporarily laid OF Cable, which has been laid to while Carrying out fault restoration or temporary

cable protection. b) Regularization of temporary OFC Joints which might have been done to restore the traffic. c) Check for rectification of fault to avoid repeat faults. d) Over head cable laid by the contractor while attending OFC faults or under preventive/corrective maintenance is

to be grounded by excavating new trench, PLB pipe laying, cable blowing and reinstatement work. e) Cable exposed due to soil erosion, to be grounded or to be protected with CC as per the instructions of

the designated BSNL Officer. f) Re-splicing of fibers for improving the fiber performance and over all fiber loss to be brought down to <0.3 dB/km. g) Verification of route and joint indicators. h) The fiber loss measurements shall be taken and submitted to the designated officer of BSNL by the contractor

as specified under clause 4.2 (Submission of Reports).

2.15 After permanent restoration of the cable fault the overall section loss should be within the permissible limit of 0.3 db/km or not more than the loss measured at the time of award of tender in that section.

2.16 It is the responsibility of the contractor to maintain or better fibre losses in each section of the OF route as

measured before awarding of contract. For this purpose the fibre loss measurements will be taken jointly by the

contractor and officer in-charge of BSNL before commencement of contract which will be attested by both.

2.17 Failure to perform the cable maintenance works on the part of contractor will lead to cancelation of the total contract and forfeiture of security deposit.

2.18 After attending to cable fault, it is the responsibility of the contractor to ensure that all systems working through the

cable route are get restored. The fault rectification time on any cable route will be measured up to the restoration of

all the systems working through that route.

3.0 Strengthening of OF Cable by Scheduled and Planned Maintenance works.

3.11 The OF Cable Strengthening by Scheduled and Planned Works is a planned activity for improving the quality of fibers in a OF cable for bringing the overall section loss within the permissible limits. The standard OF section loss specified per KM is 0.3 dB at 1550nm. The standard splice loss is specified as < 0.05dB for all joints/ tapings. The fibers in a section shall have continuity from end to end. This planned activity is required to be done at regular intervals with prior planning by BSNL and the contractor jointly. Though it is desirable to maintain the parameters as above, value of parameters with respect to that available in the first quarter of the contract period has to be maintained or bettered. However the GMTD Khammam decision is final in this regard.

3.12 The planned maintenance activity shall be carried out with prior approval of designated officer of BSNL. The shutdowns for carrying out the activity will be permitted by BSNL generally during 00:00 to 05:00 hours only on Saturdays and Sundays. But only in exceptional cases where the designated officer of BSNL is satisfied the shutdown will be given during day hours.

3.13 The OF Cable Strengthening by Scheduled and Planned Works activity caters to the following activities:-

a) Excavation of new OF Cable trench, PLB laying, cable blowing, splicing to working cable, placing of OFC Joint chambers

and reinstatement work for Over Head Cable grounding/ replacement of high losses in OF cable stretches/joints existing at the time of award of contract.

b) Re-splicing of High loss fibers/fiber breaks in the existing joints at the time of award of contract by opening existing joint pits and consolidation for improving the fiber performance and over all fiber loss to be brought down to <0.3 dB/km.

c) Replacement of OF cable stretches with high losses with new cable at the time of award of contract for improving the fiber performance and over all fiber loss to be brought down to <0.3 dB/km.

d) Transportation of material given by the BSNL to site. e) Excavation of test pits for pulling the cable for the above said works. f) The above works will be ordered under separate work orders and the same are to be executed by the contractor

apart from preventive/ corrective maintenance of the OF Cable Route outsourced.

3.14 The fiber loss measurements shall be taken and submitted to the designated officer of BSNL by the contractor

as specified under clause 4.2 (Submission of Reports). 3.15 The OF Cable Strengthening by Scheduled and Planned Works as assessed by BSNL shall be carried out by the contractor

with

the rates approved in the financial bid under OF CABLE STRENGTHENING BY SCHEDULED AND PLANNED

MAINTENANCE and bills will be paid separately for each work ordered.

3.16 Completion period will be specified in work orders as per site condition & nature of urgency. In the event of failure of Contractor to complete the work within the prescribed days in the work order from the BSNL, Penalty will be imposed as per SLA clause 13 of section VII

3.17 After completion of each scheduled work ordered fiber loss measurements will be taken in the specified cable stretch and loss should be within the permissible limit of 0.3 dB/km. Further, it is the responsibility of the contractor to maintain such level in the rest of the contract period.

3.18 After completion of OF Cable strengthening works on the OF Cable route, Fiber loss measurements will be measured in

all sections of the route jointly by the contractor and the Officer in-change of BSNL and attested by both. Further it is the

responsibility of the contractor to maintain such achieved levels throughout the rest of the contract period.

3.18 Failure to perform the cable strengthening works on the part of contractor will lead to cancelation of the total contract and forfeiture of security deposit.

4. THE CONTRACTOR’S OFFICE:

4.1 The Contractor’s office shall be equipped with the following facilities within 7 days from the issue of LOI: a) Fax, b) Land line and Mobile, c) PC with E-mail facility

The contractor’s office should be located at geographically convenient location on the route to move on the route for effective maintenance. Ho wever for operational convenience it is preferable that the contractor may have multiple offices falling under the jurisdiction of GMTD BSNL Khammam.

4.2 SUBMISSION OF REPORTS:

The contractor shall be responsible for submitting regular reports consisting of :

a. Daily patrolling report. b. Weekly report on activities to prevent OFC damages. c. Monthly stock position along with consumption of inventory issued by BSNL. d. Monthly report of faults attended along with the photos of faults (soft copy and hard copy

with date and location details) taken before and after restoration of these. e. Monthly report of OF Cable Strengthening by Scheduled and Planned Works (Normalization of over

head cables, and other allied patch works). f. Monthly reports of Fiber losses with OTDR and Power meters. g. Submission of route diagram on monthly basis (soft and hard copy) with full updation.

5. DETAILS OF MANPOWER TO BE DEPLOYED FOR:

5.1 The Contractor shall deploy Manpower for the following works:

a) Patrolling and Preventive Maintenance.

b) Corrective Maintenance. c) OF Cable Strengthening by Scheduled and Planned Works

The Manpower details are furnished in Para A) of Annexure- 1A. 5.2 BSNL shall be represented by the following Manpower for day to day interaction with the contractor: JTO/SDE/DE:

Person responsible for a portion of the route/routes. The GMTD Khammam is Final authority for all the routes in Khammam SSA for addressing any unresolved issues.

5.3 After award of the contract, within 7 days, Contractor has to furnish the Information about their staff i.e. name, designation, contact mobile / landline phone numbers, office and residence address at various locations.

5.4 BSNL shall give the names, designations, mobile/landline, e-mail, FAX Nos., of BSNL staff responsible for each section of O.F routes to the Contractor before commencement of the contract.

5.5 Supervisor:

The Contractor shall depute a supervisor for the awarded work who shall coordinate and manage all the maintenance activities. He shall keep a daily liaison with THE DESIGNATED OFFICER OF BSNL. The Supervisor shall have e x p e r i e n c e in OFC maintenance works. BSNL will issue an entry pass to the supervisor for entering BSNL premises for taking tests on OF cable whenever it so requires. However for taking tests at unmanned stations, the designated officer of BSNL will have to be contacted for making necessary arrangements.

6. The contractor shall not employ any working official of BSNL/ DOT. A certificate to this effect shall

be furnished by the contractor. 7. MATERIALS:

7.1 Issue of material by BSNL: All the essential critical materials will be issued by BSNL for stocking with the Contractor as an imprest stock per FRT (Fault Rectification Team), which will be replenished as per consumption. The transportation from BSNL offices is to be arranged by the Contractor at his own cost. The maximum quantities of items that can be issued are as below:

7.2 It shall be the responsibility of Contractor to maintain adequate (at least 50%) stock of above at his location and replenish

items before depletion. For this purpose, Contractor shall send requirements by the 1st

day of every month, in the

prescribed format. BSNL will make the materials available to the contractor within 15 days of receiving the request from the Contractor.

7.3 For the materials listed under this clause, Contractor shall maintain a record register on replenishment and consumption, with date and countersigned by the designated officer of BSNL on each incidence of consumption. (Fault restoration/ replenishment).

8. MATERIALS EQUIPMENT SUPPLIED / PROVIDED BY THE CONTRACTOR:

8.1 The list of equipment and material and civil items which shall be owned by Contractor and available with Contractor

during the contract agreement period is as per lists at A) and B) in Annexure-1A.

8.2 The tools and equipment available with the contractor shall be inspected every 15 days by the designated officer of BSNL

and materials shall not be moved by the contractor to any other sites/works without the permission of BSNL. The Contractor shall insure all the items supplied to him by BSNL against any un- toward incidence.

9.0 Contractor shall at all times maintain a multi utility vehicle with dust proof chamber (preferably air-conditioned) for each Fault Rectification Team. The vehicles used by the contractor shall be approved by the concerned Road Transport Authorities in all aspects.

10.0 INSPECTION AND TESTING:

a) For inspection of the works carried out by the contractor, the contractor shall arrange the required accessories like

testing instruments, man power, vehicle, ladders, lighting devices to the BSNL designated authority.

b) All results of inspection and test results will have to be recorded in the inspection reports, Performa of which shall be approved by BSNL.

11. EXAMINATION OF WORK DURING PREVENTIVE MAINTENANCE:

The Contractor shall give advance notice to designated officer of BSNL, whenever any work or materials are intended to be covered up in the earth, in bodies or walls or otherwise to be placed beyond the reach of measurement, in order that the work may be inspected or that correct dimension may be taken before being so covered, placed beyond reach of measurement. In default of such notice, the same shall, at the option of BSNL or its representative, be uncovered and measured at the Contractor’s expenses. The work shall again be covered up at the Contractor’s expenses.

12. Service Level Agreement (SLA) for Preventive, Corrective and OF Cable Strengthening by Scheduled and Planned Works:

Contractor shall ensure the following SLAs:

a) The permissible OFC cuts per 100 Km route per cable per month shall be within two cable cuts in normal circumstances. However in case of any road expansion/RWS/TDWSP pipe line works etc, exemption will be given to the Number of faults encountered in such circumstances without penalty based on the objective assessment of the situation. The decision of the GMTD Khammam of concerned area is final in this regard.

b) The fiber loss shall not exceed 0.05 dB per each splice. c) The cable loss shall be 0.3 dB/KM per section c) The mean time to restore (MTTR) OFC cut shall be within 6 Hours (averaged over a month from the time of OFC cut

occurrence). d) Patrolling of every route shall be carried out daily as per field requirement. Log books shall be placed at convenient

places by BSNL in the block, which need be signed by the designated agency representative.

14. Description of method for corrective and OF Cable strengthening by Scheduled and Planned Maintenance works (for permanent restoration):

14.1. The Optical Fibre Cable is laid through HDPE /PLB Pipes buried at a nominal depth of 165 cms. The steps involved in OF

Cable construction are as under:

i) Excavation of trench upto a nominal depth of 165 cms, according to Construction specification along

National/State Highways/ other roads and also in city limits as mentioned in the notice inviting tender.

ii) Laying of HDPE / PLB pipes/ Coils coupled by HDPE/ PLB sockets in excavated trenches, on bridges and culverts,

drawing of 6mm Polypropylene/Nylon rope (P.P. rope) through the HDPE pipes/ coils as per Construction Specifications and sealing of HDPE/PLB pipe ends at every manhole by end caps of suitable size.

iii) Providing of mechanical protection by DWC Pipes/GI pipes and/or concreting/ chambering according to

construction specifications, wherever required.

iv) Fixing of GI pipes/troughs with clamps at culverts/bridges and/ or chambering or concreting of G.I.

Pipes/troughs, wherever necessary.

14.2 Supply of Materials: There are some materials required to be supplied by the contractor for execution of work under this

contract like Bricks, Cement, Wire Mesh and Steel for protection, etc., besides using other consumables which do/don’t become the part of the asset. The contractor shall ensure that the materials supplied are of best quality and workmanship and shall be strictly in a accordance with the specifications.

14.3 COST OF WORK: The estimated cost of work is as mentioned in the Notice Inviting Tenders which has been worked out

based on standard scheduled rates mentioned in this tender document. The actual value of work may vary based on the actual requirement but generally being limited to +/- 25% of the indicated value.

ANNEXURE-1A RESOURCES TO BE DEPLOYED BY THE CONTRACTOR

Section - IX

Optical Fibre Cable laying and Splicing Specifications

1. Generally, the following steps are involved for jointing of the cable.

a) Preparation of cable for jointing. b) Stripping/cutting the cable. c) Preparation of cable and joint closure for splicing. d) Fibre splicing. e) Organizing fibres and finishing joints. f) Sealing of joint closure end. g) Placing joint in pit. h) Marking of cable end. i) Marking of fibres in tray.

2. PREPARATION OF CABLE FOR JOINTING:-

1 During the installation, a minimum of 10 meters of cable of each end is coiled in the jointing pit to provide for jointing to

be carried out at convenient location as well as spare length to be available for future use in case of failures.

2 The pit size must be chosen carefully to ensure the length of the way on which joint is mounted is greater than closure length plus twice the minimum bending radius of the cable. A pit length of 1.2 meter is sufficient for most of the cable and joint closures. Bracket to support the cable coil are also fixed on the wall of the pit.

3 The cable is then coiled on to the pit wall in the same position as required after the joint is complete. The marking is done on all the loops so that it will be easier to install it later.

4 The distance from the last centre to the end of the cable must be at least 1.8 meter. This is being the minimum to

be stripped for preparation of joint. 5 Sufficient cable at each end up to the jointing vehicle/enclosure is then uncoiled from the pit for jointing.

3. STRIPPING/ CUTTING OF THE CABLE:

1 The cable is stripped of their outer and inner sheath with each sheath, staggered approximately 10mm from the

one above it.

2 Proper care must be taken when removing the inner sheath, to ensure the fibres are not scratched or cut with the

stripping knife or tool. To prevent this, it is best to only score the inner sheath twice on opposite sides of the cable,

rather than cut completely through it. The two scores marking on either side of the cable are then stripped of the

inner sheath by hand quite easily.

3 The fibres are then removed from cable one by one and each fibre is cleaned individually using isopropyl solution to remove the jelly.

4. PREPARATION OF CABLE JOINT CLOSURE FOR SPLICING:

The type of preparation work performed on the cable prior to splicing differs on the type of joint closure and fiber organizer used. However, the following steps are usually common:

1 The strength member of each cable is to be fixed to the central frame of the joint.

2 The sealing compound or heat shrink sleeve is applied to the cables and closure or prepared for application

after splicing is complete.

3 The fibers are protected (usually with plastic tubing) in their run from the cable core to the fibre organizer

trays (particularly if cable construction isslotted core type). Two Nos of plastic tie shall be used to hold fibre

tubewith splicing tray.

4 Tags which identify the fibres numbers are attached at suitable locations on the fibres. 5 Splice protectors are slipped over each fibre in readiness for splicing over the bare fibre after splicing.

5. STRIPPING AND CLEAVING OF FIBRE:

1 Prior to splicing each fibre must have approximately 50mm of its primary protective U.V. cured coating

removed, using fibre stripper which are manufactured to fine tolerances and only score the coating without contacting the glass fibre.

2 The bare fibre is then wiped with a lint free tissue doused with ethyl alcohol. 3 Cleaving of the fibre is then performed to obtain as close as possible to a perfect 90 face on the fibre.

6. FUSION SPLICING OF THE FIBRE:- Some of the general steps with full automatic micro processor control splicing machine are as under:

1 Wash hands thoroughly prior to connecting this procedure.

2 Place the bare fibre inside ‘V’ groove of the splicing machine by opening clamp handle such that the end of fibre is

app.1 mm. over the end of the ‘V’ groove towards the electrodes. 3 Repeat the same procedure for other fibre, however first insert heat shrink splice protector. 4 Press the start button on the splice controller. 5 The machine will pre fuse, set align both in ‘X’ and ‘Y’ direction and then finally fuse the fibre. 6 Inspect the splice on monitor if provided on the fusion splicing machine and assure no nicking, bulging is there and

cores appear to be adequately aligned if the splice does not visually look good repeat the above procedure. 7 Slide the heat shrink protector over the splice and place in tube heater. Heat is complete when soft inner layer is

seen to be ‘oozing’ out of the ends of the outer layer of the protector. 8 Repeat the same procedure for all the other fibres.

7. ORGANISING FIBRE AND FINISHING JOINTS:-

1 After each fibre is spliced, the heat shrink protection sleeve must be slipped over the bare fibre before any handling

of fibre takes place, as uncoated fibres are very brittle and cannot withstand small radius bends without breaking.

2 The fibre is then organized into its tray by coiling the fibres on each side of the protection sleeve using the full tray

side to ensure the maximum radius possible for fibre coils. 3 The tray is placed in the position. 4 OTDR reading taken for all splices in this organized state and recorded on the test sheet to confirm that all fibres

attenuation are within 0.05 dB per splice. This OTDR test confirms fibres were not subjected to excessive stress during the organizing process.

5 The splice loss measurement on each to fibre is also to be taken from the terminal station using power meter to determine the splice loss of each fibre <0.05 db.

6 Only after satisfactory confirmation of the splice loss within limits i.e. 0.05 dB using power meter, the joint pit is to

be closed with proper sealing.

8. PLACING OF COMPLETED JOINT IN PIT:-

1 Joint is taken out from the vehicle and placed on the tarpaulin provided near the pit.

2 The cable is laid on the ground; coil the cable such that pen mark previously placed on the cable line up. Tape these loops together at the top of the coil.

3 The joint can now be permanently closed and sealed by heating heat shrinkable sleeve etc.

4 If required for attending to faults etc., manufacturers supply special kits for opening of the joint and the steps

to be followed. However the general steps are as under: a) Using suitable knife cut heat shrink sleeve longitudinally along its entire length.

b) Do not damage the smaller heat shrunk sleeve on the ends of the joint. c) Apply heat to the cut sleeve until it begins to separate.

d) Gently remove the cut sleeve from the joint. Now the joint can be opened. e) Protective sleeve/cover can be removed for attending to faults etc.

9. Fixing of Route Indicators / Joint Indicators :

Pits shall be dug 1 M. towards jungle side at every manhole and jointing chamber for fixing of Route/Joint Indicator. In addition, Route Indicators are also required to be placed where O.F. Cable changes directions like road crossing etc.

The pits for fixing the indicator shall be dug for a size of 60 cms. x 60 cms. and 75 cms. (depth). The indicator shall be secured in upright position by ramming with stone and murrum upto a depth of 60 cms. and concreting in the ratio of 1:2:4 (1: cement, 2: coarse sand, 4 stone aggregate 20 mm nominal size) for the remaining portion of 15 cms. Necessary curing shall be carried out for the concreted structure with sufficient amount of water for reasonable time to harden the structure.

The route and joint indicator shall be painted with primer before painting with oil paint. The material used should bear ISI mark. The size of each written letter should be at least 3.5 cms. The colors of painting and sign writing is as under :

(1) For Joint Indicator Yellow. (2) For Route Indicator Red. (3) For Letters White.

The numbering scheme for route indicators will be Joint No./Route Indicators No. for that joint. For example 2/6 indicator

means 6th route indicator after 2nd joint. Additional joints on account of faults at a later date should be given number of

preceding joint with suffix A, B, C and D. For example sign writing 2A on a joint indicator means, additional joint between Joint No. 2 and 3. The numbering existing route/ joint indicator should not be disturbed on account of additional joints.

11. OF Cable laying :

1. The depth of the trench form top of the surface shall not be less than 165 cms unless otherwise relaxation is granted by competent authority under genuine circumstances. In rocky terrain, the depth of the trench may be restricted to a depth of 100 to 140 cms. However, Engineer-in- charge in exceptional cases due to adverse site conditions encountered, may allow to lay HDPE/PLB pipes at a lesser depth with additional protection. In all cases, the slope of the trench shall not be less than 15 degrees with the horizontal surface. The width of the trench shall normally be 45 cms. at the top & 30 cms. at the bottom. In case, additional pipes (HDPE/GI/RCC Pipes) are to be laid in some stretches, the same shall be accommodated in this normal size trench.

2. When trenches are excavated in slopes, uneven ground, inclined portion, the lower edge shall be treated, as top surface of

land and depth of trench will be measured accordingly. In certain locations, such as uneven ground, hilly areas and all other Places, due to any reason whatsoever it can be ordered to excavate beyond standard depth of 165 cms to keep the bed of the trench as smooth as possible. Near the culverts, both ends of the culverts shall be excavated more than 165 cms. to keep the gradient less than 15 degree with horizontal. The depth of the trench is <165 cms., payment of pro rata basis shall be applicable.

3. If excavation is not possible to the minimum depth of 165 cms., as detailed above, full facts shall be brought to the notice of

the Engineer in charge in writing giving details of location and reason for not being able to excavate that particular portion to the minimum depth. Approval shall be granted by the competent authority in writing under genuine circumstances. The decision of the competent authority shall be final and binding on the contractor.

The Optical Fiber Cable is laid through PLB Pipes buried at a nominal depth of 165 cms. The steps involved in OF Cable

construction are as under:

i) Excavation of trench upto a nominal depth of 165 cms., according to Construction specifications along

National/State Highways/other roads. ii) Laying of HDPE/PLB pipes/coils coupled by sockets in excavated trenches, on bridges and culverts, drawing of 6

mm polypropylene rope (P.P. rope) through the HDPE/PLB pipes/coils as per Construction Specifications and sealing of HDPE/PLB pipe ends at every manhole by end caps of suitable size.

iii) Providing of mechanical protection by R.C.C. Pipes/GI pipes and/or concreting/chambering according to construction specifications, wherever required.

iv) Fixing of GI pipes/troughs with clamps at culverts/bridges and/or chambering or concreting of G.I. Pipes/troughs, wherever necessary.

v) Back filling and dressing of the excavated trenches according to construction specifications. vi) Opening of manholes (of size 3 meters x 1 meters x 1.65 meters depth), replacing existing 6mm P.P. rope by

8mm P.P. rope (from manhole to manhole) for ensuring smooth passage for pulling the cable. Pulling of Optical Fibre Cable with proper tools and accessories as per construction specifications. Sealing of both ends of the manholes by hard rubber bush of suitable size to avoid entry of rodents into the HDPE/PLB pipes, putting split HDPE/PLB pipes and split RCC pipes with proper fixtures over cable in the manhole to protect the bare cable in the pulling manhole. Back filling and dressing of manholes.

vii) Digging of pit of size 2 meter x 2 meter x 1.8 meter (depth) for construction of jointing chamber at approximately every two kilometers of internal size of 1.5 meter x 1.5 meter x 1.2 meter using bricks and mortar or fixing pre-cast jointing chamber of internal diameter of 1.2 meter filling of jointing chamber with clean sand, placing either pre-cast RCC cover or stone of suitable size on jointing chamber to protect the joint and back filling of jointing chamber with excavated soil.

viii) Digging of pits 1 meter towards jungle side at every manhole and jointing chamber to a depth of 60cms., fixing of route Indicator/joint indicator, concreting and back filling of pits. Painting of route indicators with yellow colour and joint Indicator by red colour and sign writing denoting route/joint indicator number, as per construction specifications.

ix) Documentation : Recording of offset measurements, location of joints, manholes and if any permanent

land Marks, should be entered in L-14 (offset book) book.

AGREEMENT PERFORMA

The successful tenderer shall have to execute the following agreement;

Whereas the contractor has offered to enter into contract with the BSNL for the execution of the work of preventive, corrective and OF Cable strengthening by Scheduled and Planned Maintenance works in the jurisdiction of GMTD BSNL Khammam on the terms and conditions herein contained and the rates approved by the BSNL (copy of Rates annexed) have been duly accepted and where as the necessary security deposits have been furnished in accordance with the provisions of the tender document vide No.______ and whereas no interest will be claimed on the security deposits. Now these presents witness and it is hereby agreed and declared by and between the parties to these presents as follows.

1) The contractor shall, during the period of this contact that is to say from ……..…………………..to ……………………………..or

completion of work for Rs _____________________(in words) _________________________whichever is earlier or until this contact shall be determined by such notice as is hereinafter mentioned, safely carryout, by means of labours employed at his own expenses and by means of tools, implements and equipment etc. to be supplied by him to his labour at his own expenses, for the execution of the work of preventive, corrective and OF Cable strengthening by Scheduled and Planned Maintenance works in the jurisdiction of GMTD BSNL Khammam and associated work as described in tender documents (annexed to the agreement), when the BSNL or (the GMTD Khammam)) or any other persons authorized by the GMTD Khammam in that behalf require. It is understood by the contractor that the quantity of work mentioned on the schedule is likely to change as per actual requirement as demanded by exigencies of service.

2) The NIT (notice inviting Tender), Bid documents (Qualifying and Financial), letter of intent, approved rates, annexed

hereto and such other additional particulars, instructions, drawings, work orders as may be found requisite to be given during execution of the work shall be deemed and taken to be an integral part of the contract and shall also be deemed to be included in the expression “The Agreement” or “The Contract” wherever herein used.

3) The contractor shall also supply the requisite number of workmen with means & materials as well as tools, appliances,

implements, vehicles for transportation, cartage etc. required for the proper execution of work within the time prescribed in the work orders.

4) The contractor hereby declares that nobody connected with or in the employment of the BSNL is not/shall not ever be

admitted as partner in the contract.

5) The contractor shall abide by the terms and conditions, rules, guidelines, construction practices, safety precautions etc.

stipulated in the tender document including any correspondence between the contractor and the BSNL having bearing on execution of work and payments of work to be done under the contract.

6) The contractor shall abide by the Labour Laws as under:

As per the existing guidelines on the provisions of EPF & Misc. Provisions Act. 1952 & Employees Provident Fund Scheme 1952, EPF is to be deducted for each labour engaged by the contractors. For this the contractor shall have to take EPF code from the EPF/RPF Commissioner and do necessary deductions.

To implement the said statutory requirements, the contractor should be registered with

EPF/RPF Commissioner. They would have to furnish an undertaking that within seven days of the close of every month, they will submit a statement showing recoveries of contribution in respect of employees with the certificate that the same has been deposited with PF Commissioner.

To comply the above provisions, each claim bill of contractors must accompany the i) The list showing the details of labourers/employees engaged ii) duration of their engagement iii) the amount of wages paid to such labourers/employees for the duration in question iv) amount of

58 Other Terms and Conditions:

1. It will be the responsibility of the contractor to obtain ROW/ Permission for this purpose the contractor shall have to liaison with various authorities on behalf of BSNL.

2. BSNL will supply PLB/HDPE/GI/RCC/DWC pipes, OF cable, Joint Closures, PLB couplers and end caps etc. 3. All the stores to be supplied by BSNL are to be transported by contractor from BSNL store of concerned DE OFC in-charge of

the work. 4. The contractor will have to lay either DWC split or RCC split or stone slabs as protection as per directions of the SDE in

charge of the route on the approval of the concerned DE OFC maintenance. 5. The contractor will have to provide the Route/Joint Indicators as per directions of concerned DE OFC maintenance. 6. Applicable DOT/ BSNL instructions regarding the subject matter are to be strictly followed.

7. The rates should be inclusive of all State & Central taxes (like TDS etc.)

8. The bill will be paid based on the length of the route outsourced. 9. Separate payment will be made for the OF Cable Strengthening by Scheduled and Planned Works based on the work

order.

10. Note:- 11. [A] The above rates are inclusive of all taxes and levies but except GST, loading & unloading of materials & tools

and tents, transportation, lodging & boarding of labour parties etc. [B] BSNL will supply ---

i] HDPE pipes/PLB Pipes, HDPE sockets, PP rope, End caps. ii] OF cable, Rubber bush, Split HDPE/PLB pipes. iii] Jointing Kits iv] RCC Full round/ Half round pipes v] GI Pipes [65mm & 50mm dia.] vii] Route/Joint Indicators [as per the given specification] viii] Weld wire mesh for RCC protection work [as per the given specification] [C] Materials required for concreting, curing of the CC / RCC work, sand and jelly anti rodent protection work shall be arranged by the contractor. All RCC/concreting work to be done as per the given specification. [D] Materials like tools & tents required for carrying out the work will have to be arranged by the contractor and cost of the same will be borne by the contractor. [E] The service tax/GST will be paid extra if the same is claimed separately in the bill with details of service tax/GST registration number and certificates.

given in the subsequent pages will over-rule the conditions stated in the tender documents,

wherever relevant and applicable.

After successful Registration on above mentioned portal you’ll get a link in auto generated e-

After that, you will be allowed to participate in the tenders floated by the department using the

Electronic Procurement System.

Viewing of Online Tenders: The contractors/Suppliers/bidders can view tenders floated on

online Electronic Procurement System (EPS) hereinafter referred as “eProcurement System”

through portal (website) at https://apbsnl.etenders.in. They can view the details like online

scheduled dates (Key Dates), Tender details, Terms and Conditions, drawing (if any) and any

other information. To download through workflow they need to login on to the above portal

and can download the tender documents of an eTender.

Online Schedule: The contractors/bidders/vendors can view the Online Scheduled dates of

eProcurement System (time schedule) for all the tenders floated using the online eProcurement

system on above mentioned portal (website) https://apbsnl.etenders.in.

The bidders are strictly advised to follow dates and time as mentioned in Schedule of a

particular tender. The date and time will be binding on all the bidders. The bidders are required

to complete the stage within the stipulated time as per the schedule to continue their

participation in the tender. All online activities are time tracked and the system enforces time

locks that ensure that no activity or transaction can take place outside the start and end dates

and time of the stage as defined.

The Schedule dates are subject to change in case of any amendment in schedule due to

any reason stated by the Department.

Obtaining a Digital Certificate and its Usage: On e-Tendering System the bids should be

Encrypted and Signed electronically with a Digital Signature Certificate (DSC) to establish the

identity of the bidder on online Portal. The Digital Signature Certificate (DSC) has two keys

i.e. Public Key and Private Key with two distinct certificate viz. Signing & Encryption (two

certificates). The Public Key is used to Encrypt (code) the data and Private Key is used to

decrypt (decode) the data. The Encryption means conversion of normal text into coded

language whereas decryption means conversion of coded language into normal text. These

Digital Signature Certificates (DSCs) should be purchased from our eProcurement Service

Provider. The information regarding details of DSC application forms and cost should be

enquired from our Service Provider.

The Bid (Online Offer) for a particular eTender may be submitted only using the Digital

Signature Certificate (DSC). In case, during the process of a particular eTender, the user loses

his Digital Certificate (i.e. due to virus attack, hardware problem, operating system problem),

he may not be able to submit the bid online. Hence, the users are advised to keep their Digital

Signature Certificates in safe custody.

In case of online Electronic Tendering, if the Digital Certificate issued to the authorized user of

a firm is used for signing and submitting an online bid, it will be considered equivalent to a no-

objection certificate/power of attorney to that User. The firm has to authorize a specific

individual via an authorization certificate signed by all partners to use the Digital Certificate as

per Indian Information Technology Act 2000 and its amendments. The Digital Signature of this

authorized user will be binding on the firm. It shall be the responsibility of management /

partners of the registered firms to inform the certifying authority or Sub Certifying Authority;

in case of change of authorized user and that a fresh digital certificate is procured and issued an

“Authorization Certificate‟ for the new user. The procedure for application of a Digital

Certificate will remain the same for the new user.

The same procedure holds true for the authorized users in a private/Public limited company. In

this case, the authorization certificate will have to be signed by the directors of the company.

Bidders participating in e-tendering shall check his/her validity of Digital Signature

Certificate before bidding in the specific work floated online at the eProcurement Portal

(website) through https://apbsnl.etenders.in.

Submission of Earnest Money Deposit:

Techno-commercial Bid shall accompany interest-free EMD through Demand Draft.

The details of EMD can be obtained from Tender document of respective Tender OR

from above eProcurement Portal through https://apbsnl.etenders.in.

Refund of Earnest Money Deposit to the unsuccessful/successful bidders will be made

as per the conditions given in the tender document.

A scanned copy of DD against EMD should be uploaded mandatory while Bid

Preparation stage (as per the Schedule mentioned in online eTender) and original D.D.

should be submitted to the designated BSNL office in the sealed envelope on or before

the due date mentioned in Schedule of respective eTender.

Submission of Tender Document Fees:

The Contractors/Suppliers/Vendors have to submit the Tender Document fees as

mentioned in Tender Document (if applicable). If the bidders are exempted from

Tender document fees then they have to upload copy of exemption certificate during

bidding process.

Tender Download: The Eligible Bidders can download the Tender Document online from

above eProcurement Portal https://apbsnl.etenders.in on or before the Schedule Dates

mentioned in the eTender floated.

Submission of online bids: The bidders are required to prepare their bids on online

eProcurement Portal as mentioned above. During bid preparation the bidders have to Map the

Key of DSC hence they are advised to procure DSCs at earliest to participate in the eTender.

They are required to upload the scan copies of Demand Draft for Tender Document Fees and

Earnest Money Deposit. Also bidders are required scan and upload any other documents

related to their credentials and submit wherever asked online. The bidders have to prepare their

commercial bid online during in this stage only and seal (Encrypt) the online bid with their

Digital Signature Certificates. The Bidders should take note of any corrigendum being issued

on the web portal on a regular basis. The bidders will not be able to change their technical

details and offer (rates) after expiry of due date and time on online portal.

Opening of Tender (Electronic offers): The authority receiving the tenders or his duly

authorized officer shall first open the "EMD Envelope" (if applicable) of all the

contractors/bidders and check for the validity of EMD and other Pre-Qualification Documents

( if any) submitted in the “EMD/Technical Envelope”, if any, as required by apbsnl.etenders.in

In case, the requirements are incomplete, the Technical Bid/Commercial (whichever is

applicable) of the concerned contractor received shall not be opened.

The authority shall then open the tenders submitted by the contractors online through the

apbsnl eTendering Portal (website). Shortlisting of Bids (Electronic Offers): After the evaluation (online/manual) of a specific

Envelope (i.e. EMD or Technical) and offers submitted by contractors, the shortlisting process will be executed on online eProcurement Portal only.
