Environmental Lawsand RegulationsIn addition to NEPA,
Section 106 of the National Historic Preservation Act
(NHPA) requires projects receiving federal funds to consider theeffect of the activity on significant historic structures and
archeological resources. Section 4(f) of the Department of Transportation Act provides
special protection for publicly-owned public parks, recreationareas, wildlife and waterfowl refuges, or significant historicsites.
Section 404 of the Clean Water Act prohibits discharge ofdredged or fill material into wetlands and waterways.
Section 7 of the Endangered Species Act requires thatfederally assisted actions do not jeopardize the existence ofthreatened or endangered species or their habitat.
Title VI of the Civil Rights Act ensures that no person on thegrounds of race, color, or national origin be excluded fromparticipation in, be denied the benefits of, or be subjectedto discrimination under any program or activity receiving
federal funds. Executive Order 12898, Environmental Justice requires
agencies to ID and address, as appropriate, anydisproportionately high and adverse human health orenvironmental effects of the project on minority populationsand low-income populations.
