    In exercise of the powers conferred by section 65 of theWorkplace Safety and Health Act (Cap 354A), the Minister forManpower hereby makes the following Regulations:

    PART I

    PRELIMINARY

    Citation and commencement

    1. These Regulations may be cited as the Workplace Safety andHealth (Scaffolds) Regulations 2011 and shall come into operationon .

    Definitions

    2. In these Regulations, unless the context otherwise requires

    "approved scaffold contractor" means any firm or companyapproved by the Commissioner, by a certificate in writing,to carry out the erection, installation, re-positioning,alteration, maintenance, repair or dismantling of anyscaffold;

    "base plate" , in relation to a metal scaffold, means a plate fordistributing the load from a standard;

    "bay" , in relation to a scaffold, means the portion of thescaffold between vertical supports (whether standards orsupports from which that portion is suspended) which are

    adjacent longitudinally;brace or bracing means a member incorporated in a

    scaffold for stability;

    "building under construction" means a building in respect ofwhich building operations are carried on;

    "climber" means a lifting equipment through which asuspension wire rope, the lower end of which is notanchored, passes and which is controlled either by frictiongrips or by turns of the rope around drums within theequipment;

    "frame or modular scaffold" means a scaffold manufactured insuch a way that the geometry of the scaffold is pre-determined and the relative spacings of the principalmembers are fixed;

    "guard-rail" means a horizontal rail secured to uprights anderected along an open or exposed side of any structure toprevent persons from falling;

    "hanging scaffold" means a scaffold suspended by means oflifting gear, ropes, chains or rigid members and notprovided with means of raising or lowering by a liftingappliance or similar device;

    "independent tied scaffold" means a scaffold, the work

    platform of which is supported from the base by 2 or morerows of standards and which, apart from the necessary ties,stands completely free of any building, ship or otherstructure;

    "ledger" means a member which spans horizontally and ties ascaffold longitudinally and which acts as a support forputlogs or transoms;

    "lift" , in relation to any scaffold, means

    (a) the vertical distance between (i)

    the base of a scaffold and its first ledger; or

    (ii)any 2 consecutive ledgers; or(b) any level at which a platform is constructed;

    "outrigger" means a structure which projects beyond thefacade of any building, ship or other structure with the innerend being anchored and includes a cantilever or othersupport;

    "professional engineer" means a person registered as aprofessional engineer under the Professional Engineers Act(Cap. 253);

    "putlog" means a horizontal member on which the board,plank or decking of a work platform are laid;

    responsible person, in relation to a person who carries outany work involving the erection, installation, re-positioning,alteration, maintenance, repair or dismantling of a scaffold,means

    (a) his employer; or(b) the principal under whose direction he carries out any

    work involving the erection, installation, re-

    positioning, alteration, maintenance, repair ordismantling of a scaffold.

    "reveal tie" means the assembly of a tie tube and a fitting usedfor tightening a tube between 2 opposing surfaces;

    "right angle coupler" means a coupler, other than a swivel orputlog coupler, used for connecting tubes at right angles;

    "scaffold" means any temporary structure

    (a) on or from which persons perform work in anyworkplace; or

    (b) which enables persons to obtain access to or whichenables materials to be taken to any place at whichsuch work is performed,

    and includes any suspended scaffold, hanging scaffold,tubular scaffold, trestle scaffold, work platform, gangway,run, ladder or step-ladder (other than an independent ladderor step-ladder which does not form part of such a structure)together with any guard-rail, toe-board or other safeguardsand all fixings, but does not include a lifting appliance, alifting machine or a structure used merely to support suchan appliance or such a machine or to support other plant orequipment;

    "ship" includes any vessel used in navigation, a floating rig, a

    barge or other platform used in any form of operation at sea;"shipyard" means any premises in which ships are constructed,

    reconstructed, repaired, refitted, finished or broken up andincludes any dock, wharf, jetty or quay in or at which anyship is berthed;

    "sole plate" means a member used to distribute the load fromthe base plate or the standard of a scaffold to the supportingsurface;

    "standard" means a member used as a vertical support orcolumn in the construction of a scaffold which transmits a

    load to the ground or any other solid construction;

    "suspended scaffold" means a scaffold suspended by means ofropes or chains and capable of being raised or lowered butdoes not include a boatswains chair or other similarappliance;

    "swivel coupler" means a coupler used to connect 2 tubes atany angle other than a right angle;

    "tie" means an assembly used to connect a scaffold to a rigidanchorage;

    "timber scaffold" means any scaffold which uses a timberroller as any of its member or component;

    "toe-board" means a member fastened above a work platformor workplace to prevent persons or materials from fallingfrom the work platform or workplace;

    "transom" means a member placed horizontally and used to tieone ledger transversely to another, or one standard toanother, in an independent tied scaffold;

    "trestle scaffold" means a scaffold in which the supports forthe platform are any of the following which are self-

    supporting:(a) split heads;(b) folding step-ladders;(c) tripods; or(d) other similar movable contrivances;

    "tubular scaffold" means a scaffold constructed from tubes andcouplers;

    "work platform" means a platform which is used to supportpersons or materials and includes a working stage.

    Application

    3. These Regulations shall apply to any workplace in which anyscaffold is erected, installed, used, re-positioned, altered,maintained, repaired or dismantled.

    PART II

    GENERAL PROVISIONS

    Only approved scaffold contractor to erect, install, re-position,

    alter, maintain, repair and dismantle scaffold

    4.(1) It shall be the duty of every person not to erect, install, re-position, alter, maintain, repair or dismantle any scaffold in aworkplace unless he is an approved scaffold contractor.

    (2) Paragraph (1) shall not apply to

    (a) a tower scaffold and trestle scaffold; and(b) a scaffold (other than a suspended scaffold, hanging

    scaffold or a scaffold erected on cantilevered or jib

    support) which, when completed and excluding thehandrails and their supports at the uppermost lift of thescaffold, is less than 4 metres in height.

    Scaffold erectors

    5. It shall be the duty of the responsible person to ensure that noperson shall erect, install, re-position, alter, maintain, repair ordismantle a scaffold in a workplace unless the person has

    successfully completed a training course acceptable to theCommissioner, to equip him to become a scaffold erector.

    Scaffold supervisor

    6.(1) It shall be the duty of the responsible person to appoint a

    scaffold supervisor before any erection, installation, re-positioning,alteration, maintenance, repair or dismantling of a scaffold in aworkplace.

    (2) The responsible person shall not appoint any person as ascaffold supervisor unless the person is one

    (a) who has successfully completed a training courseacceptable to the Commissioner, to equip him to becomea scaffold supervisor; and

    (b) whom the responsible person reasonably believes iscompetent to perform the functions and duties of a

    scaffold supervisor.

    Personal protective equipment

    7.(1) It shall be the duty of the responsible person to provide asafety harness attached with a shock absorbing device to everyscaffold erector involved in the erection, installation, re-positioning, alteration, maintenance, repair or dismantling of anyscaffold in a workplace.

    (2) It shall be the duty of the person who carries out the workreferred to in paragraph (1) to use the safety harness attached with

    a shock absorbing device provided to him.(3) Any person who contravenes paragraph (2) shall be guilty of

    an offence and shall be liable on conviction to a fine not exceeding$1,000 and, in the case of a second or subsequent conviction, to afine not exceeding $2,000.

    Supervision of erection, installation, re-positioning, alteration,

    maintenance, repair or dismantling of scaffold

    8. It shall be the duty of the responsible person to ensure that noscaffold shall be erected, installed, re-positioned, altered,maintained, repaired or dismantled in a workplace except under theimmediate supervision of a scaffold supervisor.

    Construction and materials

    9.(1) It shall be the duty of the responsible person to ensurethat every scaffold and every member or component thereof shallbe

    (a) of sound material, good construction and adequatestrength;

    (b) free from patent defects; and(c) suitable and safe for the purpose for which it is intended.

    (2) It shall be the duty of the responsible person to ensure thatevery scaffold erected at a building under construction, as far aspracticable, be erected such that it precedes the construction of theuppermost permanent floor of the building by not less than 1 metreabove that floor.

    (3) Where the height of the scaffold referred to in paragraph (2)extends beyond the uppermost permanent floor by 2 metres ormore, it shall be the duty of the responsible person to ensure thatthe scaffold shall be adequately supported to prevent collapse.

    Foundation of scaffold

    10.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (5).

    (2) Every scaffold shall be erected or installed on structures orfoundations of adequate strength.

    (3) Where a scaffold is to be founded on soil, the soil shall bewell-consolidated.

    (4) In the case of a scaffold exceeding 15 metres in height orbeing erected on poorly drained soil, base plates shall bear uponsole plates of strength not less than 670 kgf per square metre and

    of a length suitable to distribute the load.(5) There shall be no cavity under the sole plate immediately

    below any standard.

    Designated access point for scaffold

    11.(1) It shall be the duty of the occupier of a workplace wherea scaffold is erected to ensure that every scaffold shall have at leastone designated access point from which a person may gain accessonto the scaffold.

    (2) It shall be the duty of the occupier of a workplace where a

    scaffold is erected to ensure that all designated access points shallbe

    (a) clearly marked with a sign or label; and(b) made safe for use by any person.

    Stairs and ladders

    12. It shall be the duty of the responsible person to ensure thatstairs or ladders shall

    (a) be provided to enable persons to gain access from onelevel of any scaffold to another; and

    (b) as far as reasonably practicable, be installed within thescaffold.

    Standards and ledgers

    13.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (8).

    (2) The standards of a scaffold shall be

    (a) plumb where practicable;(b) fixed sufficiently close together to secure the stability of

    the scaffold, having regard to all the circumstances;

    (c) spaced not more than 1.5 metres apart in the case oftimber scaffold; and

    (d) spaced not more than 2.5 metres apart in the case ofmetal scaffold.

    (3) No metal scaffold with standards spaced more than 2.5metres apart shall be used unless its use has been approved by theCommissioner in writing.

    (4) Subject to paragraph (5), a standard shall be placed on an

    adequate and secured sole plate in order that the foot of thestandard does not rest directly on the ground or supporting surfaceso as to prevent any vertical displacement of the foot.

    (5) Where the floor or supporting structure is of sufficientrigidity to evenly distribute the load imposed upon it by thestandard without causing any vertical displacement of the standard,the provision of a sole plate under the standard shall not benecessary.

    (6) The foot of a standard of any frame or modular scaffold shallbe secured to a base plate so that it does not rest directly on the

    ground or supporting surface.(7) The ledgers of a metal scaffold shall be spaced at vertical

    intervals of not more than 2 metres.

    (8) The ledgers of a timber scaffold shall

    (a) be, as far as possible, horizontal;(b) be spaced at vertical intervals of not more than 1.8

    metres; and

    (c) be securely fastened to the standards.Transoms

    14. It shall be the duty of the responsible person to ensure thattransoms shall be located at or near the intersections of standards

    and ledgers.

    Bracing

    15.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (8).

    (2) Every scaffold shall be effectively braced by means oflongitudinal and transverse bracing systems which shall extendfrom the base to the top of the scaffold.

    (3) The joints in bracing members shall be lapped or spliced.

    (4) Longitudinal bracing members shall be continuous and fixed

    at approximately 45 to the horizontal.

    (5) Each lift shall be crossed by at least one longitudinal bracingmember in every 10 metres length of the scaffold.

    (6) A transverse bracing system shall be provided at each end ofthe scaffold and at intervals of not more than 10 bays.

    (7) Notwithstanding paragraph (6), the transverse bracingsystem may be omitted where

    (a) vertical transverse frames are provided for the full heightof the scaffold and at each pair of standards; and

    (b) the frames are type tested by a recognised testing body inaccordance with a standard or specification acceptable tothe Commissioner.

    (8) Every frame scaffold shall be provided with horizontalbracings or lacings at intervals of not more than every 5 lifts.

    Work platforms

    16.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (6).

    (2) Work platforms shall be provided

    (a) at any place of work which does not afford a proper andsecure foothold.

    (b) in the case of a building under construction, around theedge of a building at every uppermost permanent floorwhich is under construction.

    (3) Notwithstanding paragraph (2), work platforms shall beprovided at intervals of not less than every alternate lift of anyscaffold, except a tower scaffold or a trestle scaffold, used in anypremises where building operations are being carried on and,unless approval is given in writing by the Commissioner, thevertical distance between any 2 work platforms shall not exceed 4metres.

    (4) Every work platform provided under paragraph (3) shallcover the lift of a scaffold throughout its entire length.

    (5) Every work platform provided under this regulation shall

    (a) be closely boarded, planked or decked;(b) be at least 500 millimeters wide; and(c) not have any opening except to allow access to that work

    platform.

    (6) The distance between a work platform and any building, shipor other structure shall be as narrow as practicable and shall notexceed 300 millimetres.

    Loading for persons and materials allowed in each bay

    17.(1) It shall be the duty of the responsible person to ensurethat signboards stating the maximum permissible weight of toolsand materials and the maximum number of persons permissible oneach bay shall be prominently displayed at suitable locations on thescaffold.

    (2) It shall be the duty of the occupier of the workplace to ensurethat the signboards referred to in paragraph (1) are displayed at alltimes until the scaffold is dismantled.

    (3) It shall be the duty of the occupier of a workplace where ascaffold is erected or installed therein to comply with paragraphs(3) to (5).

    (4) The maximum loading for persons and materials allowed onany work platform in any bay of a scaffold shall be

    (a) in the case of a timber scaffold, 75 kgf per square metre;or

    (b) (b) in any other case, 220 kgf per square metre.(5) The maximum number of persons allowed on any work

    platform in any bay of a scaffold shall be

    (a) in the case of a timber scaffold, not more than 2 persons;and

    (b) in the case of a metal scaffold, not more than 4 persons.

    (6) The maximum number of persons allowed in any bay of ascaffold shall be

    (a) in the case of a timber scaffold, not more than 4 persons;and

    (b) in the case of a metal scaffold, not more than 8 persons.Design by professional engineer

    18.(1) It shall be the duty of the responsible person to complywith paragraphs (2) and (3).

    (2) Subject to regulations 17(3) and 17(4), a work platform andany support thereof shall be constructed in accordance with thedesign and drawings of a professional engineer where the workplatform is used

    (a) to provide footing for more than 2 persons in each bay;or

    (b) to support tools or materials exceeding 25 kgf in eachbay.

    (3) Subject to regulation 17(5)(b), where a metal scaffold is usedto support more than 4 persons in any bay, the scaffold shall beconstructed in accordance with the design and drawings of aprofessional engineer.

    (4) It shall be the duty of a professional engineer who designs anywork platform or support referred to in paragraph (2) or any metalscaffold referred to in paragraph (3) to

    (a) take, so far as is reasonably practicable, such measures toensure that his design can be executed safely by anyperson who constructs or uses the work platform, supportor metal scaffold according to his design; and

    (b) provide to any person who is constructing or who is toconstruct the work platform, support or metal scaffold,all design documentation (including all relevantcalculations, drawings and construction procedures) as isnecessary to facilitate the proper construction of thework platform, support or metal scaffold according to his

    design.(5) It shall be the duty of the occupier of the workplace where a

    scaffold is erected therein to ensure that no work platform orsupport referred to in paragraph (2) or metal scaffold referred to inparagraph (3) shall be used unless a copy of the design anddrawings certified by the professional engineer is kept available atthe workplace for inspection by an inspector.

    (6) Any person who contravenes paragraph (5) shall be guilty ofan offence and shall be liable on conviction to a fine not exceeding$2,000.

    Boards, planks and decking

    19.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (4).

    (2) All boards, planks or decking used in the construction of workplatforms shall

    (a) be of uniform thickness;(b) be capable of supporting a load of 670 kgf per square

    metre with due regard to the spacing of the supports; and

    (c) be flushed along their lengths and secured.(3) Any metal decking which forms part of a work platform shall

    be provided with non-skid surfaces.(4) Any board or plank which forms part of a work platform shall

    project beyond its end support to a distance of not less than 50millimetres and not more than 4 times the thickness of the board orplank unless it is effectively secured to prevent tipping or uplift.

    Toe-boards and guard-rails

    20.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (6).

    (2) Every side of a work platform or workplace from which a

    person is liable to fall more than 2 metres shall be provided withtoe-boards and 2 or more guard-rails.

    (3) The toe-boards and guard-rails provided under paragraph (2)shall

    (a) be of good construction, sound material and adequatestrength to withstand the impact during the course ofwork;

    (b) be placed on the inside of the uprights and secured so asto prevent accidental displacement; and

    (c)

    be placed so as to prevent the fall of any person ormaterial.

    (4) The uppermost guard-rail shall be at least one metre above thework platform or workplace for which the guard-rail is provided.

    (5) The height of toe-boards shall not be less than 90 millimetres.

    (6) The vertical distance

    (a) between any 2 adjacent guard-rails; and

    (b) between any work platform or workplace and the guard-rail immediately above it,

    shall not exceed 600 millimetres.

    Overlay and screening nets

    21.(1) It shall be the duty of the responsible person to ensurethat overlay or screening nets shall be used to envelope any timberor metal scaffold which is erected on the outside of a building.

    (2) Paragraph (1) shall not apply to a tower scaffold.

    Scaffold not to be overloaded

    22.(1) It shall be the duty of the responsible person to complywith paragraphs (2) and (3).

    (2) A scaffold shall not be overloaded and, as far as practicable,the load thereon shall be evenly distributed.

    (3) When any material is transferred to or from a scaffold, thematerial shall be moved or deposited without imposing any violentshock.

    Scaffold to be free of material which endanger safety

    23. It shall be the duty of the occupier of a workplace where ascaffold is erected therein to remove any material, including wastematerial or debris from the scaffold, which may endanger thesafety of any person.

    Measures against electrical hazards24. It shall be the duty of

    (a) the employer of any person who uses any scaffold in aworkplace; or

    (b) the principal under whose direction any person uses thescaffold in the workplace,

    to ensure that all practicable measures shall be taken to protect anyperson working on a scaffold from electric shock by electricalwires or equipment.

    Inspection of scaffold

    25.(1) Subject to paragraph (4), it shall be the duty of theoccupier of a workplace where a scaffold is erected therein toensure that no scaffold shall be use unless it has been inspected bya scaffold supervisor

    (a) upon completion of its erection;

    (b) within the 7 days immediately preceding the use of thescaffold; and

    (c) after exposure to weather conditions likely to haveaffected its strength or stability or to have displaced anypart.

    (2) It shall be the duty of the scaffold supervisor to

    (a) enter the results of every inspection referred to inparagraph (1) into a register containing such details asmay be required by the Commissioner; and

    (b) provide a copy of the register to the occupier of theworkplace.

    (3) It shall be the duty of the occupier of the workplace where ascaffold is erected therein to

    (a) keep the register referred to in paragraph (2) at theworkplace; and

    (b) produce the register for inspection upon request by aninspector.

    (4) Paragraph (1) shall not apply to

    (a) a trestle scaffold; or(b) a scaffold, from no part of which a person is liable to fall

    more than 2 metres.

    (5) Any person who contravenes paragraph (3) shall be guilty ofan offence and shall be liable on conviction to a fine not exceeding

    $2,000.

    Labelling of scaffold after inspection

    26.(1) It shall be the duty of the scaffold supervisor who carriesout the inspection of a scaffold in accordance with regulation 25 toimmediately after such inspection, display a notice or labelindicating whether the scaffold is safe for use or otherwise.

    (2) The notice or label referred to in paragraph (1) shall

    (a) be understood by the persons employed in the workplace;and

    (b) be displayed at every designated access point.(3) It shall be the duty of

    (a) the employer of any person who uses any scaffold in aworkplace; or

    (b) the principal under whose direction any person who usesany scaffold in a workplace,

    to ensure that the person does not use any scaffold unless a noticeor label is displayed at the designated access point indicating thatthe scaffold is safe for use.

    (4) Paragraph (3) shall not apply to

    (a) a scaffold erector who is carrying out any repair on ascaffold under regulation 27; or

    (b) a scaffold supervisor who is carrying out any inspectionof a scaffold under regulation 25.

    Erection, maintenance, repair and dismantling

    27.(1) It shall be the duty of the occupier of a workplace wherea scaffold is erected therein to comply with paragraphs (2) to (8).

    (2) No scaffold or part thereof which is partially erected ordismantled shall be allowed to be used unless it is made safe.

    (3) Where any scaffold referred to in paragraph (2) is unsafe foruse, a prominent warning notice or signs understood by all personsindicating that the scaffold or part thereof is not to be used, isaffixed near any point at which the scaffold or part, as the casemay be, is liable to be approached for the purpose of use.

    (4) Every scaffold shall be properly maintained and every partthereof shall be fixed, secured or placed in position so as toprevent, as far as practicable, any accidental displacement.

    (5) Any scaffold and any member or component thereof that hasbeen damaged or weakened shall be repaired as soon as reasonably

    practicable.(6) No person shall be permitted on a scaffold that is damaged or

    weakened except for a scaffold erector who is carrying out therepairs thereto.

    (7) All reasonably practicable measures shall be taken to ensurethe safety of the persons carrying out the repairs.

    (8) Where ties of scaffold to the permanent structure have to beremoved, the portion of the scaffold from which the ties areremoved shall be dismantled unless adequate measures are taken toensure the stability of the scaffold.

    PART III

    METAL SCAFFOLDS

    Approved metal scaffold

    28.(1) It shall be the duty of the responsible person to ensurethat no metal scaffold shall be erected or installed unless it has

    been type tested by a recognised testing body in accordance with astandard or specification acceptable to the Commissioner.

    (2) Notwithstanding that the metal scaffold has been type testedas required under paragraph (1), the Commissioner may imposesuch conditions as he thinks fit.

    Design by professional engineer

    29.(1) It shall be the duty of the responsible person to ensurethat every metal scaffold

    (a) exceeding 15 metres in height in any shipyard; and(b) exceeding 30 metres in height in any workplace other

    than in a shipyard,

    be erected or installed in accordance with the design and drawingsof a professional engineer

    (2) It shall be the duty of a professional engineer who designs anymetal scaffold referred to in paragraph (1) to

    (a) take, so far as is reasonably practicable, such measures toensure that his design can be executed safely by anyperson who erects, installs or uses the scaffold accordingto his design; and

    (b) provide to any person who erects or install or is to erector install the scaffold, all design documentation(including all relevant calculations, drawings andconstruction procedures) as is necessary to facilitate the

    proper erection or installation of the scaffold according tohis design.

    (3) It shall be the duty of the occupier of a workplace where ascaffold is erected therein to ensure that no scaffolds referred to inparagraph (1) shall be used unless

    (a) the scaffold or support, as the case may be, has beenexamined after installation by the professional engineerand a certificate stating that the scaffold or support is safefor use has been obtained from the professional engineer;

    (b) a copy of the design and drawings certified by theprofessional engineer and the certificate referred to insub-paragraph (a) are kept available at the workplace forinspection by an inspector; and

    (c) the scaffold or support, as the case may be, has beeninspected by a professional engineer at least once every 3months to ensure that it is safe for use.

    (4) When the professional engineer discovers any defect in ascaffold or support in the course of his examination or inspectionreferred to in paragraph (3), he shall immediately inform theoccupier of the workplace in which the scaffold or support isinstalled.

    (5) The occupier referred to in paragraph (4) shall, upon beinginformed of any defect in a scaffold or support under thatparagraph, take action to rectify the defect before the scaffold orsupport is used.

    (6) Any person who contravenes paragraph (3)(b) shall be guiltyof an offence and shall be liable on conviction to a fine notexceeding $2,000.

    Ties for metal scaffold

    30.(1) It shall be the duty of the responsible person to comply

    with paragraphs (2) to (7).(2) Every alternate lift and every uppermost lift of an independent

    tied metal scaffold shall be effectively tied to the building orstructure by means of ties.

    (3) Ties shall be located no further than one bay from the ends ofthe scaffold and thereafter, at intermediate spacing of not morethan 3 bays or 7.5 metres apart, whichever is the lesser.

    (4) Ties other than tie tubes and couplers shall not be usedwithout the written approval from the Commissioner.

    (5) Every tie under this regulation shall conform with thefollowing:

    (a) tie tubes shall be attached by right angle couplers to theoutside ledger or standard, or in the case of anindependent scaffold, to both the inside and outsidestandards as close as possible to the junction of thestandards and ledgers; and

    (b) the ends of the tie tubes shall be attached to the buildingor structure by one of the following methods:(i) the tie tubes shall form part of a yoke constructed of

    tubes and couplers which passes around and bears

    hard against the sides of a column, pier, beam orsimilar structural members;

    (ii) each tie tube shall pass through the wall and besecured with 2 pieces of tube of minimum length of300 millimetres and shall be attached one on eachside of, and bear hard against, the wall;

    (iii) each tie tube shall be attached to a reveal tie notgreater than 1.5 metres in length but reveal ties shallnot be used where a horizontal diagonal planbracing is used; or

    (iv) each tie tube shall pass through ring bolts which

    shall be secured by casting in or being anchored inthe wall.

    (6) Every tie tubes shall be perpendicular to the longitudinalplane of the scaffold and where this is not practicable, thedeviation from the perpendicular shall not exceed 15.

    (7) Every tie shall be capable of withstanding a force of 1,000 kgfapplied in either direction along the length of the tie.

    Transoms for modular or tube-and-coupler scaffolds

    31. It shall be the duty of the responsible person to ensure that

    every modular scaffold or tube-and-coupler scaffold shall beprovided with transverse horizontal members or transoms for eachlift.

    Spigots, jointpins or sleeves

    32.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (6).

    (2) Spigots, jointpins or sleeves shall be used to connect onestandard to another.

    (3) Where spigots, jointpins or sleeves are used to locate and

    connect one standard to another, such spigots, jointpins or sleevesshall

    (a) permit full bearing over the whole bearing area at theends of the standards; and

    (b) have such external or internal dimensions that themaximum difference of mating diameters in any partbetween the spigot, jointpin or sleeve and the otherstandard does not exceed 1.6 millimetres.

    (4) Spigots and jointpins shall engage in the ends of the standardsby at least 70 millimetres.

    (5) Sleeves shall cover the end of the standard by at least 70millimetres.

    (6) The standards shall be securely held if they are connected bythe spigots, jointpins or sleeves.

    Adjustable base plates

    33. Where an adjustable base plate is used on a standard and theadjustment exceeds 150mm, it shall be the duty of the responsibleperson to ensure that the standard shall be tied longitudinally to theadjacent standard or standards at a height of not more than 460

    millimetres above the supporting surface by right angle or swivelcouplers.

    Frame or modular scaffolds to be erected in one plane

    34. It shall be the duty of the responsible person to ensure thatevery frame or modular scaffolds shall be erected such that everylift is horizontal and in one plane.

    Cross brace not to be used as means of access or egress

    35. It shall be the duty of

    (a) the employer of any person who uses a scaffold in aworkplace; or(b) the principal under whose direction any person uses a

    scaffold in a workplace,

    to ensure that no cross brace on frame scaffold shall be used as ameans of access or egress.

    PART IV

    TIMBER SCAFFOLD

    Timber scaffold not to be used in shipyard

    36. It shall be the duty of the occupier of a shipyard to ensurethat no timber scaffold shall be used in the shipyard.

    Materials for timber scaffold

    37.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (7).

    (2) Timber used for any scaffold

    (a) shall be of a suitable quality;(b) shall be in good condition;(c) shall have the bark completely stripped off; and(d) shall not be painted or treated in any way so that defects

    in the wood cannot be seen easily.

    (3) Timber used for any scaffold shall comprise --

    (a) Bintangor rollers; or(b) other species of timber rollers which are of similar

    strength, durability and resilience as Bintangor rollersand which are approved by the Commissioner.

    (4) Every standard of a timber scaffold shall be of a size having a

    diameter of at least 50 millimetres throughout its length.

    (5) Every timber roller used as a ledger or horizontal bracing,transom or putlog shall have a diameter of at least 38 millimetres atthe tip.

    (6) The members or components of a timber scaffold shall belashed using rattan strips or other material approved in writing bythe Commissioner.

    (7) The lashing required under paragraph (6) shall be done withstrips not less than 1.8 metres in length with a minimum of 6 turns

    per strip.

    Construction of timber scaffold

    38.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (5).

    (2) Every timber scaffold shall not exceed 15 metres in height.

    (3) No timber scaffold with a single row of standards shall beerected or used.

    (4) Every timber scaffold shall be

    (a)securely tied and braced at the corners; and

    (b) rigidly anchored to the building at regular close intervals.(5) Transverse and longitudinal braces of timber scaffold shall be

    securely placed and lashed to the standards.

    Ties for timber scaffold

    39.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (5).

    (2) A timber scaffold shall be tied to a building by horizontal ties.

    (3) Subject to paragraph (4), each tie shall --

    (a) pass through an opening or hole in the wall in thebuilding; and

    (b) be secured at a right angle to another pole which shall befixed firmly inside the building.

    (4) Where it is impracticable to install any tie referred to inparagraph (3), the timber scaffold shall be tied to a building

    (a) using ties which are constructed and installed inaccordance with the design and drawings of aprofessional engineer; or

    (b) by such other means which are approved in writing bythe Commissioner.

    (5) Ties made up of wires shall not be used.

    (6) It shall be the duty of a professional engineer who designs anyties of a timber scaffold referred to in paragraph (4)(a) to

    (a) take, so far as is reasonably practicable, such measures toensure that his design can be executed safely by anyperson who constructs, installs or uses the tie accordingto his design; and

    (b) provide to any person who is constructing or installing oris to construct or install the tie of the timber scaffold, all

    design documentation (including all relevantcalculations, drawings and construction procedures) as isnecessary to facilitate the proper construction orinstallation of the tie according to his design.

    (7) It shall be the duty of the occupier of a workplace where ascaffold is erected therein to ensure that no scaffold ties referred toin paragraph (4)(a) shall be used unless a copy of the design anddrawings certified by the professional engineer is kept available atthe workplace for inspection by an inspector.

    (8) Any person who contravenes paragraph (7) shall be guilty of

    an offence and shall be liable on conviction to a fine not exceeding$2,000.

    Duration for use of timber scaffold

    40. It shall be the duty of the occupier of a workplace where atimber scaffold is erected therein to ensure that the timber scaffoldshall be dismantled within a period of 9 months after erection.

    PART V

    SUSPENDED SCAFFOLD

    Suspended scaffold

    41.(1) It shall be the duty of the responsible person to ensurethat a suspended scaffold shall not be used unless

    (a) the outriggers or other supports are (i) of adequate length and strength;

    (ii) properly installed and supported;

    (iii) securely fixed to a building, ship or other structureby anchor bolts or other similar means, or wheresuch fixing is not reasonably practicable, adequatelyand securely anchored at the inner ends; and

    (iv) provided with rope guards of adequate strength atthe outer ends to prevent the ropes from beingdisplaced from the outriggers.

    (b) the points of suspension are at adequate horizontaldistances from the building face, the hull of the ship orany structure;

    (c) the suspension ropes are (i) of galvanised wire ropes;

    (ii) of good construction, sound material, adequate

    strength and free from patent defects;(iii) securely attached to the outriggers or other supports

    and if winch drums are used, to the winch drums;and

    (iv) of such length that the platform shall be capable ofbeing lowered to the ground or floor, and in the caseof winches, there are at least 2 turns of the roperemaining on each winch drum;

    (d) the platform is (i) at least 500 millimetres and not more than 750 millimetres in

    width unless measures have been taken to prevent transversetilting of the platform; and

    (ii) so arranged or secured that, at each workingposition, the edge of the platform is as close as practicable tothe work area and in no case shall the distance between theplatform and the work area be more than 460 millimetres;and

    (e) boards, planks or decking used as platforms shall becapable of supporting a load of 670 kgf per square metrewith due regard to the spacing of the supports.

    (3) Paragraph (2)(a)(iv) shall not apply when the primarysuspension wire-ropes are suspended from the outer end of theoutriggers or other supports by means which preclude thedisplacement of the wire-rope from its point of suspension.

    (4) It shall be the duty of

    (a) the employer of any person who uses any suspendedscaffold in a workplace; or

    (b) the principal under whose direction any person uses anysuspended scaffold in a workplace,

    to ensure that no person shall enter or leave the cradle of asuspended scaffold unless it is at rest on the ground or at any levelwhich affords a safe means of access or egress.

    Suspended scaffold raised or lowered by winches or climbers

    42.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (8).

    (2) No suspended scaffold raised or lowered by winches orclimbers shall be used unless

    (a) the suspended scaffold has been designed andconstructed in accordance with a standard or codeacceptable to the Commissioner;

    (b) the winches or climbers are properly maintained;(c) the winches or climbers are opened for inspection and

    servicing at least once in every 12 months to ensure thatthe drive mechanisms are in safe working order; and

    (d) records of such inspection and servicing are kept for eachclimber and winch.

    (3) The outriggers or overhead supports shall be spaced not morethan 3.2 metres apart measured from the longitudinal centre line ofone outrigger or support to such centre line of the adjacentoutrigger or support, unless prior written approval has been

    obtained from the Commissioner.(4) Wire ropes used to suspend the work platform shall be

    vertical and taut.

    (5) The winches or climbers shall be synchronised so that thework platform of the suspended scaffold is maintained level at alltimes.

    (6) In the case of a suspended scaffold manufactured outsideSingapore, the design of the suspended scaffold shall be endorsedby a professional engineer or a third-party inspection agencyapproved by the Commissioner.

    (7) Where the work platform of a suspended scaffold issupported by wire ropes, the outriggers or other overhead supportsfor the suspended scaffold shall be constructed in accordance withthe design and drawings of a professional engineer.

    (8) It shall be the duty of a professional engineer who designs anyoutrigger or overhead support for the suspended scaffold referredto in paragraph (7) to

    (a) take, so far as is reasonably practicable, such measures toensure that his design can be executed safely by anyperson who constructs or uses the outrigger or otheroverhead support for the suspended scaffold according tohis design; and

    (b) provide to any person who is constructing or who is toconstruct the outrigger or other overhead support for thesuspended scaffold, all design documentation (includingall relevant calculations, drawings and constructionprocedures) as is necessary to facilitate the properconstruction of the construction of the outrigger or otheroverhead support for the suspended scaffold according tohis design.

    (9) Where a suspended scaffold has been re-positioned or shiftedfrom one location to another within the same workplace, thesuspended scaffold and its attachments shall be installed inaccordance with the design and drawings endorsed by theprofessional engineer.

    (10) It shall be the duty of the occupier of a workplace where asuspended scaffold is installed therein to ensure that no outriggersor other overhead supports for the suspended scaffold referred to inparagraph (7) shall be used unless a copy of the design anddrawings certified by the professional engineer is kept available atthe workplace for inspection by an inspector.

    (11) Any person who contravenes paragraph (10) shall be guiltyof an offence and shall be liable on conviction to a fine notexceeding $2,000.

    Safety device for suspended scaffold

    43.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (4).

    (2) Subject to paragraph (4), every suspended scaffold raised orlowered by winches or climbers shall be provided at eachsuspension point with a safety rope with an automatic safety devicemounted on it.

    (3) The safety rope with the automatic safety device referred toin paragraph (2) shall be capable of supporting the platform in theevent of a failure of the primary suspension rope, winch, climberor any part of the mechanism used for raising or lowering thesuspended scaffold.

    (4) Paragraph (2) shall not apply if

    (a) the platform is supported on 2 independent suspensionwire ropes at or near each end such that in the event of a

    failure of one suspension wire rope, the other wire rope iscapable of sustaining the weight of the platform and itsload and preventing it from tilting; or

    (b) a system is incorporated which operates automatically tosupport the platform and its load in the event of a failure

    of the primary suspension rope.

    Inspection by authorised examiner before use

    44. It shall be the duty of the occupier of a workplace where asuspended scaffold raised or lowered by winches or climbersinstalled therein to ensure that the suspended scaffold has beentested by an authorised examiner before use.

    Gear for suspension of scaffold

    45.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (4).

    (2) Every chain, rope and lifting gear used for the suspension ofscaffold shall be of sound material, adequate strength, suitablequality and in good condition.

    (3) Any chain, rope and metal tube used for the suspension of ascaffold other than a suspended scaffold shall be

    (a) properly and securely fastened to safe anchorage pointsand to the scaffold ledgers or other main supportingmembers;

    (b) positioned so as to ensure stability of the scaffold;(c) approximately vertical; and(d) kept taut.

    (4) Every scaffold suspended by means of chains or ropes shallbe secured to prevent undue horizontal movement while it is usedas a work platform.

    Prohibition of overloading of suspended scaffold

    46. It shall be the duty of the occupier of a workplace where asuspended scaffold is installed therein to ensure that the suspended

    scaffold shall not at any time be loaded beyond the safe workingload except in a test in the presence of an inspector or authorisedexaminer.

    Suspended scaffold counter-balanced by counter-weights

    47.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (5).

    (2) Water or other liquids, earth, clay, sand, chippings or otheraggregates shall not be used as counter-weights.

    (3) Every portable counter-weight shall have its weightpermanently and distinctly stamped, engraved or embossedthereon.

    (4) Every counter-weight shall be securely attached at the innerend of the outriggers to prevent any accidental displacement ortampering by any person.

    (5) The counter-balancing weight on any outrigger shall not beless than 3 times the weight necessary to balance the load on theprojecting part of the outrigger when the suspended scaffold isfully loaded.

    Prevention of sway

    48. It shall be the duty of the responsible person to ensure that

    the work platform of a suspended scaffold shall be securelyfastened to the building or structure in such a manner and at suchintervals as to prevent the platform from swaying.

    Age limit of operator

    49. It shall be the duty of

    (a) the employer of any person who uses any suspendedscaffold in a workplace; or

    (b) the principal under whose direction any person uses anysuspended scaffold in a workplace,

    to ensure that no person shall permit, instruct or direct any personbelow the age of 18 years to operate a climber, winch ormechanism used for raising or lowering a suspended scaffold.

    Personal protective equipment

    50.(1) It shall be the duty of

    (a) the employer of any person who uses any suspendedscaffold in a workplace; or

    (b) the principal under whose direction any person uses anysuspended scaffold in a workplace,

    to provide a safety harness attached with a shock absorbing deviceto the person.

    (2) It shall be the duty of the person who uses any suspendedscaffold in a workplace to use the safety harness provided to him.

    (3) Any person who contravenes paragraph (2) shall be guilty ofan offence and shall be liable on conviction to a fine not exceeding

    $1,000 and, in the case of a second or subsequent conviction, to afine not exceeding $2,000.

    Notice to be displayed in a suspended scaffold

    51.(1) It shall be the duty of the responsible person to

    prominently display a notice understood by any person in thecradle

    (a) stating the safe working load of the suspended scaffold;(b) stating the maximum number of persons allowed to be in

    the suspended scaffold; and

    (c) reminding the person to attach his safety harness to asecured anchorage at all times,

    (2) It shall be the duty of the occupier of the workplace to ensurethat the notice referred to paragraph (1) shall be displayed at alltimes.

    PART VI

    OTHER SCAFFOLDS

    Tower scaffold

    52.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (6).

    (2) The height of a tower scaffold erected on board a ship in a

    shipyard shall not exceed 4 times the lesser of the base dimensionsof the scaffold.

    (3) The height of a tower scaffold, other than a tower scaffoldreferred to in paragraph (2), shall not exceed 8 times the lesser ofthe base dimensions of the scaffold.

    (4) Where the height of a tower scaffold, excluding the handrailsand their supports at the uppermost lift of the scaffold, exceeds 3times the lesser of the base dimensions of the scaffold, the scaffoldshall be effectively tied to the building or a rigid structure so as toprevent toppling.

    (5) No more than 2 work platforms shall be used on a towerscaffold at any one time.

    (6) Any tower scaffold which can be moved on casters shall be

    (a) constructed with due regard to its stability, and ifnecessary, adequately weighted at the base;

    (b) used only on a firm and even surface; and

    (c) provided with a positive locking device on each caster tohold the scaffold in position.

    (7) It shall be the duty of

    (a) the employer of any person who uses any tower scaffoldin a workplace; or

    (b) the principal under whose direction any person uses anytower scaffold in a workplace,

    to ensure that (i) no tower scaffold shall be moved except by

    applying force at or near the base;

    (ii) the casters shall be locked to hold the tower scaffoldin position while person is on the tower scaffold;and

    (iii) no person shall remain on a tower scaffold when it

    is being moved.

    Scaffold and work platform erected on cantilever or jib

    supports

    53.(1) In this regulation, cantilever or jib support includesany structure, including a bracket or beam, that projects beyond afulcrum or point of attachment and that is not supported directlyfrom the ground or floor below.

    (2) It shall be the duty of the responsible person to comply withparagraphs (2) to (5).

    (3) The scaffold shall be adequately supported, fixed andanchored on the support to prevent displacement.

    (4) The cantilever or jib support used to support the scaffold shall

    (a) have outriggers of adequate length and cross section; and(b) be constructed in accordance with the design and

    drawings of a professional engineer.

    (5) No work platform resting on bearers let into a wall at one endand which does not have other support shall be used unless the

    bearers pass through the wall and are of adequate strength andsecurely fastened on the other side of the wall.

    Design by a professional engineer

    54.(1) It shall be the duty of a professional engineer whodesigns a cantilever or jib support referred to in regulation 53(4)(b)to

    (a) take, so far as is reasonably practicable, such measures toensure that his design can be executed safely by anyperson who constructs or uses the cantilever or jibsupport according to his design; and

    (b) provide to any person who is constructing or who is toconstruct the cantilever or jib support all designdocumentation (including all relevant calculations,drawings and construction procedures) as is necessary tofacilitate the proper construction of the cantilever or jibsupport according to his design.

    (2) It shall be the duty of the occupier of a workplace wherein ascaffold is erected on a cantilever or jib support in the workplace toensure that the scaffold shall not be used unless

    (a) the scaffold (including the cantilever or jib support) orsupport, as the case may be, has been examined after

    installation by the professional engineer and a certificatestating that the scaffold or support is safe for use hasbeen obtained from the professional engineer;

    (b) a copy of the design and drawings certified by theprofessional engineer and the certificate referred to insub-paragraph (a) are kept available at the workplace forinspection by an inspector; and

    (c) the scaffold or support, as the case may be, has beeninspected by a professional engineer at least once every 3months to ensure that it is safe for use.

    (3) When the professional engineer discovers any defect in ascaffold or support in the course of his examination or inspectionreferred to in paragraph (2), he shall immediately inform theoccupier of the workplace in which the scaffold or support isinstalled.

    (4) The occupier of the workplace referred to in paragraph (3)shall, upon being informed of any defect in a scaffold or supportunder that paragraph, take action to rectify the defect before thescaffold or support is used.

    (5) Any person who contravenes paragraph (2)(b) shall be guilty

    of an offence and shall be liable on conviction to a fine notexceeding $2,000.

    Scaffold supported by buildings or ships or structures

    55.(1) It shall be the duty of the responsible person to complywith paragraphs (2) and (3).

    (2) No part of a building, ship or other structure shall be used assupport for any part of a scaffold unless it is sufficiently stable andof sound material and sufficient strength to afford safe support.

    (3) Overhanging eaves gutters shall not be used as supports forany part of a scaffold unless they have been specially designed as

    walkways and are of adequate strength.

    Hanging Scaffold

    56.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (5).

    (2) A hanging scaffold shall be

    (a) erected before being hung into position on a ship,building or structure;

    (b) securely anchored to the hull or any other part of theship, building or structure to prevent lateral movement orsway;

    (c) constructed so that the work platform is in a horizontalplane; and

    (d) provided with safe means of access to and egress from itsplatform by means of stairs or ladders.

    (3) For the purposes of paragraph (2)(d), stairs or ladders

    (a) shall be placed in such a manner as to prevent any personfrom falling; and

    (b)shall not rise to a vertical distance of more than 3 metresbetween landings.

    (4) A hanging scaffold from which a person may fall more than 2metres shall be constructed and installed in accordance with thedesign and drawings of a professional engineer.

    (5) It shall be the duty of a professional engineer who designs ahanging scaffold referred to in paragraph (4) to

    (a) take, so far as is reasonably practicable, such measures toensure that his design can be executed safely by anyperson who constructs, installs or uses the hanging

    scaffold according to his design; and(b) provide to any person who is constructing or installing or

    who is to construct or install the hanging scaffold, alldesign documentation (including all relevantcalculations, drawings and construction procedures) as isnecessary to facilitate the proper construction andinstallation of the hanging scaffold according to hisdesign.

    (6) It shall be the duty of the occupier of a workplace where ahanging scaffold is constructed or installed therein to ensure thatno hanging scaffold referred to in paragraph (4) shall be usedunless a copy of the design and drawings certified by theprofessional engineer is kept available at the workplace forinspection by an inspector.

    (7) Any person who contravenes paragraph (6) shall be guilty ofan offence and shall be liable on conviction to a fine not exceeding$2,000.

    Personal protective equipment

    57.(1) It shall be the duty of

    (a) the employer of any person who carries out any work ona hanging scaffold in a workplace; or

    (b) the principal under whose direction any person carriesout any work referred to in paragraph (a) in a workplace,

    to provide to the person (i) a safety harness attached with a shock absorbing device;

    and

    (ii) sufficient and secured anchorage by life line or othermeans.

    (2) It shall be the duty of the person who carries out any thework on a hanging scaffold to use the safety harness attached witha shock absorbing device provided to him.

    (3) Any person who contravenes paragraph (2) shall be guilty ofan offence and shall be liable on conviction to a fine not exceeding$1,000 and, in the case of a second or subsequent conviction, to afine not exceeding $2,000.

    Trestle scaffold

    58.(1) It shall be the duty of the responsible person to complywith paragraphs (2) to (5).

    (2) Subject to paragraph (3), no trestle scaffold shall be

    (a) constructed with more than 3 tiers; or(b) used if it has a work platform more than 4.5 metres above

    the ground or floor or other surfaces upon which thescaffold is erected.

    (3) Paragraph (2) shall not apply to a trestle scaffold constructedin accordance with the design and drawings of a professionalengineer.

    (4) It shall be the duty of a professional engineer who designs atrestle scaffold referred to in paragraph (3) to

    (a) take, so far as is reasonably practicable, such measures toensure that his design can be executed safely by anyperson who constructs or uses the trestle scaffold

    according to his design; and(b) provide to any person who is constructing or who is to

    construct the trestle scaffold, all design documentation(including all relevant calculations, drawings andconstruction procedures) as is necessary to facilitate theproper construction of the trestle scaffold according tohis design.

    (5) No trestle scaffold shall be erected on a scaffold platformunless

    (a) the width of the platform is such as to leave sufficientclear space for the transport of materials; and

    (b) the trestles or uprights are firmly attached to the platformand adequately braced to prevent displacement.

    (6) No trestle scaffold shall be erected on a suspended scaffold.

    (7) It shall be the duty of the occupier of a workplace where atrestle scaffold is constructed therein to ensure that no trestlescaffold referred to in paragraph (3) shall be used unless a copy ofthe design and drawings certified by the professional engineer iskept available at the workplace for inspection by an inspector.

    (8) Any person who contravenes paragraph (7) shall be guilty ofan offence and shall be liable on conviction to a fine not exceeding$2,000.

    PART VII

    APPROVED SCAFFOLD CONTRACTOR

    Application for approval to be approved scaffold contractor

    59.(1) A firm or company may apply to the Commissioner for

    his approval to act as an approved scaffold contractor.

    (2) An application under paragraph (1) shall be

    (a) accompanied by a non-refundable of fee of $150;(b) in such form and manner as the Commissioner may

    require; and

    (c) accompanied by such particulars, information, statementsand documents as the Commissioner may require.

    Certificate of approval

    60.(1) On receipt of an application under regulation 59(1), the

    Commissioner may (a) issue to the applicant a certificate of approval, subject to

    such conditions as the Commissioner may think fit toimpose; or

    (b) refuse to approve the application.(2) Where the Commissioner refuses to approve the applicant to

    act as an approved scaffold contractor, he shall give the applicantnotice in writing of the reasons for his refusal.

    (3) The Commissioner may at any time vary or revoke any of theexisting conditions imposed under paragraph (1) or impose newconditions.

    (4) A certificate of approval for a firm or company to act as anapproved scaffold contractor shall, unless the approval for the firmor company to act is earlier cancelled, be valid for a period of 2years from the date of the approval or for such shorter period as theCommissioner may specify in the certificate of approval.

    (5) A certificate of approval, on payment of a non-refundable feeof $150, be renewed by the Commissioner for such period as theCommissioner may determine, from the date immediatelyfollowing that on which, but for its renewal, the certificate ofapproval would have expired.

    Production of certificate of approval upon request

    61.(1) It shall be the duty of any approved scaffold contractorto produce his certificate of approval for inspection upon requestby an inspector.

    (2) Any person who contravenes paragraph (1) shall be guilty ofan offence and shall be liable on conviction to a fine not exceeding$2,000.

    Suspension or cancellation of certificate62.(1) The Commissioner may suspend or cancel the certificate

    of approval issued to any approved scaffold contractor if theCommissioner is satisfied that the approved scaffold contractor

    (a) has obtained his certificate of approval by means offraud, false representation or the concealment of anymaterial fact; or

    (b) is contravening or has contravened or has failed tocomply with any condition subject to which thecertificate was issued.

    (2) Where a certificate of approval is suspended under paragraph(1), the firm or company to which the certificate of approval was

    issued to shall, during the period of suspension, cease to be anapproved scaffold contractor.

    (3) Where a certificate of approval is cancelled underparagraph (1), the firm or company to which the certificate ofapproval was issued to shall immediately cease to be an approvedscaffold contractor.

    Notice of suspension or cancellation of certificate

    63.(1) When the Commissioner has suspended or cancelled thecertificate of approval under regulation 62, the Commissioner shall

    forthwith inform the approved scaffold contractor concerned bynotice in writing of such suspension or cancellation.

    (2) A notice of suspension or cancellation shall take effect on thedate of the service of the notice on the approved scaffoldcontractor.

    (3) An approved scaffold contractor whose certificate of approvalhas been suspended or cancelled by the Commissioner underregulation 62 may, within 21 days of the date of the service of thenotice of suspension or cancellation, appeal to the Minister whosedecision shall be final.

    (4) A notice of suspension or cancellation may be served on anyperson by delivering it to him, or by leaving it at, or sending it byregistered post to, his last known residential or business address.

    Surrender of certificate

    64. An approved scaffold contractor shall forthwith surrender tothe Commissioner his certificate of approval on receipt of thenotice of cancellation referred to in regulation 63.

    PART VIII

    MISCELLANEOUS

    Offence

    65. Any person who contravenes any provision of theseRegulations which imposes a duty on him for which no penalty isexpressly provided shall be guilty of an offence and shall be liable

    FOR CONSULTATION on conviction to a fine not exceeding $20,000 or to imprisonmentfor a term not exceeding 2 years or to both.

    Revocation

    66.(1) The Factories (Registration and Other Services Fees

    and Forms) Regulations (Cap. 104, Rg 3) are amended by deletingregulation 4C.

    (2) The Factories (Scaffolds) Regulations 2004 (S19/2004) arerevoked.

    Savings and transitional provisions

    67. Every person who, immediately before , wasan approved scaffold contractor appointed under regulation 5 ofthe revoked Regulations shall continue in such appointment as ifhe were approved as an approved scaffold contractor underregulation 60 of these Regulations, and his appointment shallexpire on the day his appointment would have expired if theseRegulations had not been enacted.
