กจการทไดรบการสงเสรมการลงทน

รฐบาล สปป.ลาวสงเสรมการลงทนในสาขาเกษตรกรรม อตสาหกรรม หตถกรรม และบรการ โดยจะแบงสทธประโยชนเปน 3 ระดบ ตามประเภทกจการทรฐบาลให ความส าคญ เชน กจการทชวยแกปญหาความทกขยากและชวยยกระดบคณภาพชวตของประชาชน โครงสรางพนฐาน และการพฒนาทรพยากรมนษยสทธประโยชนอน โดยทกๆ โครงการลงทนของวสาหกจตางชาตจะไดรบการสงเสรมการลงทนดงตอไปน

• ก าไรของวสาหกจทน าไปขยายกจการทไดรบอนญาต จะไดรบการยกเวนอากรก าไรในปบญชนนๆ

• วสาหกจตางชาตสามารถสงผลก าไร ทน และรายรบอนๆกลบประเทศของตน หรอประเทศทสาม โดยผานธนาคารทตงอยใน สปป.ลาวได ภายหลงทไดปฏบตตามพนธะทางภาษอากรและคาธรรมเนยมตางๆตามระเบยบกฎหมายแลว

• ไดรบยกเวนภาษน าเขาและอากรทเกบจากการน าเขาอปกรณเครองอะไหล พาหนะส าหรบการผลตโดยตรง และวตถดบทไมมอยภายใน สปป. ลาวหรอมแตไมเพยงพอ ผลตภณฑกงส าเรจรปทน าเขามาเพอแปรรปหรอประกอบเปนผลตภณฑเพอสงออก

• ไดรบยกเวนภาษขาออก ส าหรบผลตภณฑทผลตเพอสงออก

• ส าหรบสทธประโยชนดานภาษตามเขตการสงเสรมการลงทน ใน 3 เขต การลงทน โดยในแตละเขตการลงทนไดถกแบงออกเปน 3 ระดบ ดงน

o เขต 1: เขตทมพนฐานโครงสรางเศรษฐกจ - สงคม ทยงไมอ านวยความสะดวกแกการ ลงทน และภมประเทศสวนใหญเปนเขตภดอย หางไกลทรกนดาร เขตดงกลาวจะไดรบการสงเสรมการลงทนสงสด

o เขต 2: เขตทมพนฐานโครงสรางเศรษฐกจ - สงคม ทสามารถอ านวยความสะดวกแกการลงทน และภมประเทศไมทรกนดารเทากบเขต 1 เขตดงกลาว จะไดรบการสงเสรมการลงทนระดบกลาง

o เขต 3: เขตทมพนฐานโครงสรางเศรษฐกจ-สงคม ทสามารถอ านวยความสะดวกแกการลงทนไดด เขตดงกลาวจะไดรบการสงเสรมการลงทนในระดบต า

การท าธรกจคาสงและคาปลกในลาว

ชาวตางชาตสามารถลงทนในธรกจคาสงและคาปลกในลาวได โดยมทนขนต า 4,000 ลานกบ

การอนญาตและก าหนดสดสวนการถอหนของตางชาต

• ตางชาตถอหนไดไมเกน 50% ในกจการทมทนจดทะเบยนขนต า 4,000 ลานกบ (USD 0.5 ลาน)

• ตางชาตถอหนไดไมเกน 70% ในกจการทมทนจดทะเบยนขนต า 10,000 ลานกบ (USD 1.1 ลาน)

• ตางชาตถอหนได 100% ในกจการทมทนจดทะเบยนขนต า 20,000 ลานกบ (USD 2.3 ลาน)

การขอสงเสรมการลงทนม 2 รปแบบ 1. กจการทไดรบการสงเสรมการลงทนภายใตกฎหมาย

ใหม Myanmar Investment Law - ลกษณะการสงเสรม จะแบงเปนการขออนญาต

และการรบรองการลงทน โดย Myanmar Investment Commission (MIC)

1.1 กจการทตองขออนญาต (MIC Permit) ตองเขาขายตอไปน

มเงนลงทนสง เปนกจการทมความส าคญตอประเทศ เปนกจการทมอยใน Restricted List มผลกระทบตอสงแวดลอมหรอชมชน

1.2 กจการทตองไดรบการรบรองการลงทน (MIC Endorsement) MIC หรอรฐบาลทองถนจะเปนผพจารณาโครงการ สทธประโยชนของกจการทไดรบการสงเสรม เชน การยกเวนภาษเงนได การท าสญญาเชาระยะยาว ซงระยะเวลาอาจแตกตางกน

2. กจการทตงอยใน Special Economic Zone (SEZ) กรณทกจการตงอยใน SEZ สามารถไดสทธประโยชนตามกฎหมาย SEZ เชน การยกเวนภาษเงนได การท าสญญาเชาระยะยาว

Terms & Conditions 1. Sender must be a juristic person 2. It is applicable for transactions between Bangkok Bank Thailand and BBL overseas branches in Asia 3. For Export Bill under L/C and Outward Bill for Collection, Thai exporters will get result of document

checking and courier tracking reference same day once submitting accurate and complete set of export documents within cut-off time

4. For Issuing and Advising L/C same day, Thai importers must submit accurate and complete set of application and supporting documents within 12:00 except 11:00 for issuing L/C to Myanmar, China, Taiwan, Hong Kong and Japan. However, importer can submit issuing L/C until 16:00 as usual

5. For Import Bill under L/C and Inward Bill for Collection, Thai importers get notification of bills arrival and receive bills within same day if BBL receives export documents within 14:00

6. Time to deliver export documents depends on courier company and out of BBL responsibility 7. This service complies terms & conditions and fees with Bangkok Bank and Beneficiary Bank 8. Bangkok Bank reserves the rights to change or cancel the service without prior notice
