What Kind of Contractor Do You Need?

Here are some guidelines to use when you begin searching for state-licensed contractors. Using s licensed contractor could help your avoid financial risk and other problems associated with unlicensed operators.

What is illegal contractor activity?Who is considered an illegal contractor?

It is illegal for an unlicensed person to perform contracting work on any project valued at $500 or more in combined labor and material costs. Besides being illegal, unlicensed contractors lack accountability and have a high rate of involvement in construction scams. They also are unfair competition for licensed contractors who operate with bonds, insurance, and other responsible business practices.

What is CSLB doing to stop illegal activity?CSLB’s Statewide Investigative Fraud Team (SWIFT) monitors and combats illegal

activity. SWIFT has teams around the state that conduct stings on a regular basis and sweep construction sites.

SWIFT also conducts joint operations and sweeps with other state agencies dedicated to combating underground activity. Partnerships with other agencies help raise the penalties and fines for violators by increasing the scope of violations to include taxes, illegal payrolls, workers’ compensation insurance, and worker safety.

SCAMMER ARRESTED!

A California contractor, whose license was taken away, and her husband may have thought moving to Arizona would save them from having to answer for hundreds of thousands of dollars they allegedly took from unsuspecting homeowners in a sunroom scheme.

Constance Ruth Gabriel (51) and William Ernest Gabriel (65) were both returned to California this morning after their being arrested on August 9, 2018, at their home in Maricopa, Arizona by Pinal County Sheriff’s Office deputies. The arrests came after a Santa Clara County Superior Court judge signed criminal arrest warrants with bail amounts set at more than $580,000 for each suspect.

The couple will now face at least 79 charges, including 33 felonies. The felony charges are for grand theft (Penal Code (Pen) §487(a)) and elder abuse (Pen Code §368(d)). Also included are aggravated white collar enhancements because the two allegedly took more than $500,000 from victims and damaged or destroyed property with a value exceeding $200,000.

The charges are related to a CSLB investigation of home improvement jobs the couple took in the San Francisco Bay Area under the company names Sunrooms America, Inc. (CSLB #1009268), Sunrooms America Direct (CSLB #950078), and Gabriel Construction Company (CSLB #1004259).

It’s alleged that the two stole more than $855,000 from at least 33 victims in a scheme to contract for the construction of sunrooms. In most cases, the two collected illegally large down payments, then either never did any work or did very little work before abandoning the jobs. Earlier this year, the

Contractors State License Board revoked the three company licenses based on the same investigation.

“Contractors should never think that leaving California frees them from facing the consequences of their law-breaking actions here,” said CSLB Registrar David R. Fogt. “Our law enforcement partners in Santa Clara County and Pinal County, Arizona share CSLB’s commitment to consumer protection and worked closely with us to make this arrest.”

“The Pinal County Sheriff’s Office will always support any agency that needs help getting criminals off the streets,” said Sheriff Mark Lamb. “Our deputies worked hard to track down and arrest Mr. and Mrs. Gabriel and are thankful we’re able to bring justice to their victims.”

Both Constance and William Gabriel were arraigned August 31, 2018 in Courtroom D-23 at the San Jose Hall of Justice, 190 W Hedding Street, San Jose, CA 95110.

The Santa Clara County District Attorney’s Office believes it is likely more people fell victim to this sunroom scheme. Any possible victims are encouraged to contact Santa Clara County District Attorney Bureau of Investigations Investigator Dave Hewitt at (408) 808-3713.

The Contractors State License Board operates under the umbrella of the California Department of Consumer Affairs. CSLB licenses and regulates almost 290,000 contractors in California and is regarded as one of the leading consumer protection agencies in the United States. In fiscal year 2017-18, CSLB helped recover over $50 million in ordered restitution for consumers.

The California Contractors State License Board (CSLB) is urging consumers to be aware of home improvement offers by individuals who use unethical business practices to gain entry into their homes, and then use illegal, high-pressure sales or scare tactics to up-sell unneeded services or equipment.

Service advertisements are common from the heating, ventilating, and air-conditioning industry, especially during hot or cold weather, said former CSLB Registrar Steve Sands. “We’re noticing a significant number of consumer complaints related to this sector, but we also believe it’s important to protect and uphold the reputation of more than 11,000 licensed and honest contractors in the HVAC industry and other trades.”

Many of the complaints CSLB is receiving are from older adults who are falling victim to unscrupulous operators who make promises of low-cost equipment service over the phone, only to have onsite technicians make false statements that persuade them to increase their purchase. (Only the licensed contractor or salespeople for a contracting company who are registered with CSLB are authorized to sell additional services or work.)

In one case, an elderly woman was persuaded to sign over her home to the company. In a different case, an older property owner was convinced that all of her home’s ductwork needed replacing but, when a second opinion was obtained, it was determined that repair work was unnecessary.

CSLB asks California property owners to stay vigilant about low-cost home improvement offers for cooling, electrical, plumbing or any other similar tune-up offers that may not be what they seem.

• Be wary of telemarketers offering special deals for air duct cleaning or seasonal HVAC tune-ups. Many are calling from boiler room operations or call centers that pretend to be different types of service and repair companies, and make multiple calls until a homeowner takes the bait for a service call.

• Always ask for the state contractor license number before considering any offer.

• Make informed decisions about hiring a contractor or company by first checking CSLB’s website and review

the contractor’s detail page to assure the license is in good standing.

• If you’re not sure about a company’s offer, get a second opinion from a different, licensed contractor or company.

• Talk to your utility company to verify the accuracy of costs and potential savings the telemarketer offers for HVAC systems.

• Make sure the contract contains the notice about the three-day right to cancel.

It is equally important for consumers to pay attention to the work contract. If your home’s operating systems happen to fail and you call a company for immediate service, remember that your three-day right to cancel the contract is different depending on if it is a service and repair contract or a standard home improvement contract.

SERVICE AND REPAIR CONTRACT• The work requested is for an emergency replacement or fix; contact is initiated by the customer on short notice.

• The total price for labor and materials is $750 or less.

• The contract document should be printed with the title �Service and Repair Contract.�

• The contract document includes room for a signature, the date and a statement that reads: YOUR RIGHTS TO CANCEL BEFORE WORK BEGINS.

• The three-day right to cancel ends as soon as the contract is signed and work begins, unless the contractor fails to comply with any of the specified requirements.

• The contractor must not sell goods or services beyond what is reasonable and necessary to take care of the problem being repaired.

• No payment is due or should be accepted by the contractor until the work is completed. The service and repair contractor may charge only one service fee.

• Any work beyond the initial replacement or repair may not be done without negotiation of a standard home improvement contract.

• Any parts that were replaced by the contractor must be offered to the customer.

• A customer may request that the contractor sign a release from lien claim for work that is done.

STANDARD HOME IMPROVEMENT CONTRACT

• The contract is not for urgent service and repair, and negotiations to enter into a contract can be initiated by the contractor or the customer.

• The total price for labor and materials is $500 or more. (The work is not for an emergency replacement or repair of $750 or less.)

• A home improvement contract is an agreement between a contractor and a property owner or tenant that includes descriptions of all labor, services, and materials to be furnished and performed.

• The customer has until midnight of the third business day after signing the agreement or purchase to cancel the contract.

• The down payment may only be 10 percent of the total contract price or $1,000, whichever is less. Only pay for portions of the home improvement project as they are completed.

• For repairs in a state or federally declared disaster zone, the customer has seven days to cancel the contract with no obligation for payment.

What is a Contract?A contract is a legal agreement between two or more people. A written

agreement is one of the most important communication tools for both the contractor and consumer. It insures there are no misunderstandings about what a job will include. A thorough contract tells how the work will be done, when it will be done, what materials will be used and how much it will cost.

In California, there must be a written contract for all home improvement projects over $500. By law, that contract must include specific information about your rights and responsibilities. The Contractors State License Board outlines the information for you on their website www.cslb.ca.gov.

A home improvement contract and any changes made to that contract must be in writing, be legible, be easy to understand, and inform the consumer of their rights to cancel or rescind the contract. If you are promised something orally make sure that it is included in writing.

Disagreements over home improvement projects can cost time and money. Besides producing bad feelings, they can also lead to lawsuits or other legal action. A well-written contract prevents that.

Anatomy of a ContractA contract should contain everything agreed upon by the consumer and

contractor. It should detail the work, price, when payments are made, who gets the necessary permits, and when the job will be finished. It should also identify the contractor, give their address and contractor license number.

A good contract also has warnings and notices about the right to cancel, mechanic’s liens, and permissible delays.

Don’t sign anything until you understand the contract and agree to the terms.

Description of Work to be Done (The Sign of a Well-Built Contract)

The best way to avoid disputes over what is or isn’t expected from a home improvement job is to write out the details in a contract.

The contract should be as specific as possible regarding all materials to be used, such as the quality, quantity, weight, color, size, or brand name as it may apply.

For example, the contract should say “install oak kitchen cabinets, manufactured by Company XYZ, model 01381A, as per the plan,” not just “install kitchen cabinets.”

Describing the job - the good, the bad and the ugly

Swimming pool contracts must include a plan and scale drawing showing the shape, size dimensions, and construction and equipment specifications.

Make sure the contract includes everything that is agreed to, up to and including complete cleanup and removal of debris and materials, and special requests like saving lumber for firewood or saving certain materials or appliances.

Complaints and WarrantiesBe sure to get any warranty offered by the contractor for labor and materials

in writing. It should specify which parts of the work are covered and the duration of the warranty. You should also request any written warranties

offered by the manufacturers of materials or appliances installed by the contractor.

Consumers generally have 4 years to file a complaint about a faulty project with the CSLB. That deadline can be extended if there are additional warranties written into the contract.

Money - The Bottom LinePrice - All contracts must include the price that was agreed upon for the work. Any job $500 or more needs a written home improvement contract. And by law, the job must be completed for the agreed upon contract price.

If the contract price needs to be changed, it MUST be done with a written “Change Order”, which then becomes a part of the contract.

Down Payment - If the contract calls for a down payment before work starts, the down payment can not be more than one thousand dollars ($1,000) or 10 percent of the contract price, whichever is less, for a home improvement job or swimming pool, excluding finance charges. There are no exceptions for special order materials.

Schedule of Payments - A home improvement contract must include the payment schedule. It should show the amount of each payment and explain what work, materials or services are to be performed for that particular payment.

Payments to the contractor cannot exceed the value of the work performed.

Swimming Pools - With swimming pool contracts, the final payment may be made at the completion of the final plastering phase of construction (Provided that any installation of equipment, decking, or fencing required by the contract is also completed). Finance Charges - Must be laid out separately from the contract amount.

Sales Commission - If the contract provides for a payment of a salesperson’s commission out of the contract price, that payment shall be made on a pro rata basis in proportion to the schedule of payments made to the contractor.

Salespersons - A salesperson cannot legally sign a home improvement contract for the contractor unless they are registered with the CSLB.

Mechanics LiensConsumers are required to receive a “Notice to Owner” warning about

property liens. Anyone who helps improve property, but who is not paid, may place what is called a mechanics’ lien on the property. A mechanics’ lien is a claim made against the property and recorded with the county.

Even if the contractor is paid in full, unpaid subcontractors, suppliers, and laborers involved in the project may record a mechanics’ lien and sue the property owner in court to foreclose the lien. A property owner could be forced to pay twice or have the court sell their home to pay the lien. Liens can also affect a consumer’s personal credit along with the ability to borrow and refinance.

Consumers can protect themselves from liens by getting a list from the contractor of all the subcontractors and material suppliers who will work on the project along with the dates when they will start. After 20 days it is possible to get suppliers and subcontractors to sign lien releases when their portion of the work is completed.

Another option for consumers is to pay with a joint check. Write a joint check payable to both the contractor and the subcontractor or material supplier.

r Are decks, balconies, stairs and railings secure and free of damage?

r Check ceilings and attics for any signs of roof leaks or pest damage. A professional home inspection can find hidden damage early – before costs get out of control.

r Are the roof and gutters clear of debris? Are your skylights properly sealed? Are shingles warped?

r Are persistant water leaks creating a mold hazard, sanitation problem or costly water bill?

r Call a licensed electrician if a fuse blows frequently or circuit breaker trips frequently.

r Know the location of the main electrical disconnect or breaker in your home. Mark and label circuits.

r Know the location of the main emergency shut off switch for your heating system.

r Have your air-conditioning/heating unit serviced now, rather than on a high-priced emergency call.

r Have the heat/air-conditioning ducts & filters been cleaned lately?

r Is clutter creating safety hazards in your home? It’s time to call a professional to build storage space or haul junk away.

r Replace batteries in your smoke/carbon monoxide detectors and test them annually. Are fire extinguishers are fully charged.

CancelingThe Three-Day Right to Cancel - The Home Solicitation Sales Act requires

a seller of home goods or services to give the buyer three days to think about whether or not to buy the offered goods or services.

To cancel, the buyer need only give the contractor written notice of his or her intent not to be bound by the contract — there is no penalty or obligation on the part of the buyer. Under the law when the contract is canceled the seller can be required to return the entire contract amount and, if a service has been provided, to return the consumer’s property to the way it was before the contract, and return any materials to the contractor that were applied to the project.

The purpose of the three-day right to cancel is to protect consumers from the pressure they often feel from door-to-door solicitors.

Unless the contract is negotiated at the contractor’s place of business, the buyer qualifies for the 3-day right to cancel.

The ExceptionService and Repair Contracts

One major exception to the “three-day right to cancel” is a ‘Service and Repair’ contract that covers emergency repairs or services that are requested by the consumer on short notice.The right to a three-day notice is automatically canceled the moment the contract

is signed and the contractor begins working on a service and repair contract.

Checklist for HomeownersCheck Out Your Contractor

• Did you contact the Contractors State License Board (CSLB) to check the status of the contractor’s license? Contact the CSLB at (800) 321-CSLB (2752) or visit our web site: www.cslb.ca.gov.

• Did you get at least three local references from the contractors you are considering?

• Did you call them and see the work the contractor completed?

Building Permits• Will the contractor get any needed permits before the work starts?

• Are the permit fees included in the contract?

Check Out The Contract• Did you read and do you understand your contract?

• Does the 3-day right to cancel a contract apply to you?

• Does the contract tell you when work will start and end?

• Does the contract include a detailed description of the work to be done, the material to be used, and equipment to be installed? This description should include a plan and scale drawing showing the shape, size, dimensions and specifications. It should include brand names, model numbers, quantities and colors. Specific descriptions now will prevent disputes later.

• Are you required to pay a down payment? If you are, the down payment should never be more than 10% of the contract price or $1,000, whichever is less.

• Is there a schedule of payments? If there is, you should pay only as work is completed and not before.

• Did your contractor give you a “Notice to Owner,” a warning notice describing liens and ways to prevent them? Even if you pay your contractor, a lien can be placed on your home by unpaid laborers, subcontractors, or material suppliers. A lien can result in you paying twice or, in some cases, losing your home in a foreclosure. Check the “Notice to Owner” for ways to protect yourself.

• Did you know changes or additions to your contract must all be in writing? Putting changes in writing reduces the possibility of a later dispute.

Board Reminds Contractors they must hold a license to work in ‘Natural Disaster Areas’

The Contractors State License Board (CSLB) reminds contractors that they must hold a valid California contractor license, in the appropriate classification, to perform most work on homes and other structures damaged or destroyed in a wildfire, flood, mudslide or other natural disaster.

Some out-of-state contractors and unlicensed California contractors want to help with rebuilding in disaster areas. However, it is illegal and punishable as a felony to perform contracting work in a declared disaster area without a California contractor license. Punishment may include up to 16 months in state prison or a fine of up to $10,000.

CSLB along with other agencies such as the Department of Insurance, local district attorney’s offices, sheriff’s departments, and the Governor’s Office of Emergency Services, to conduct undercover sweeps in disaster zones, and check the licenses of contractors working or soliciting work in these areas.

“Even if an unlicensed contractor has good intentions and wants to help homeowners rebuild, they are prohibited from doing so,” said CSLB Registrar David Fogt. “You must be tested and licensed by CSLB to legally work in these disaster zones.”

Anyone who contracts for or bids on a job that totals $500 or more (labor and materials) must hold a contractor license from CSLB. There are exceptions, including working as an employee of a licensed contractor or taking jobs that are valued at less than $500.

To become licensed, one must submit an application for review, verify four years of journey-level experience in the trade to be licensed (general, plumbing, etc.), pass a two-part examination (trade and business/law), secure a license bond, and provide workers’ compensation insurance for employees. The entire process can take up to six months.

A contractor license can be verified on CSLB’s website, www.cslb.ca.gov, to see if it is active and in the right classification for the work to be done. You can also check for legal complaints, the correct business name, address and workers’ compensation insurance coverage for employees.

The Contractors State License Board operates under the umbrella of the California Department of Consumer Affairs. CSLB licenses and regulates almost 290,000 contractors in California, and is regarded as one of the leading consumer protection agencies in the United States. In fiscal year 2016-17, CSLB helped recover just over $47 million in ordered restitution for consumers.
