63. *Shehryar Afridi:

Will the Minister for Water and Power be pleased to state:

(a) whether it is a fact that circular debt is surging again;

(b) if so, the steps being taken by the Government to combat thesaid problem?

Minister for Water and Power (Khawaja Muhammad Asif): (a) Surgein circular debt takes place mainly due to non-availability of required funds to payoff the liabilities of Power generators. Circular debt re-emerges due to shortremittance by DISCOs in the wake of less recovery and sort release of subsidy byGovernment of Pakistan. Moreover, heavy mounts have been stuck up with AJ&Kand all provincial Governments manly due to non-implementation of policy decisions.

The strength of Power Sector mainly depends upon the behavior of all thestake holders to meet their obligations relating to clear the liabilities of PowerSector alongwith the provision of administrative support. Disturbance in the Powersystem due to non-availability of Finance will definitely have economic implicationsfor the provinces. Smooth flow of Power according to energy need of the provinceswould lead to economic development which is ultimate objective of the Government.

(b) The strength of Power Sector mainly depends upon the behavior ofall the stake holders to meet their obligations relating to clear the liabilities ofPower Sector along with provision of administrative support. Disturbance in thePower system due to non-availability of Finance will definitely have economicimplications for the provinces. Smooth flow of Power according to energy need ofthe provinces would lead to economic development which is ultimate objective ofthe Government.

Elimination of circular debt depends upon the implementation of policydecisions regarding resolution of aforesaid issues.

236. *Jamshed Ahmad:

Will the Minister for Water and Power be pleased to state whether itis fact that the audit of payments made to the NEPRA has not beenconducted during the last five years; if so, the reasons thereof?

Minister for Water and Power (Khawaja Muhammad Asif): NEPRAis a quasi-judicial autonomous body. It generates its own funds and does notobtain any kind of financial support from Government of Pakistan. NEPRA’s financialaccounts are duly prepared and audited by the independent auditors firm. Further,it is also subject to Federal Audit conducted by Auditor General of Pakistan.

355. *Munaza Hassan:

Will the Minister for Water and Power be pleased to state:

(a) whether it is a fact that the reservoirs of potable water aredepleting at fast pace in the country;

(b) whether it is also a fact that no comprehensive policy/planninghas been formulated to control the shortage of potable water atnational level; and

(c) the steps being taken by the Government to preserve the saidreservoirs?

Minister for Water and Power (Khawaja Muhammad Asif): (a) Lossin storage capacity of reservoirs due to sedimentation is a natural phenomenon.The major reservoirs have lost almost 28% of their gross storage capacity by theend of year 2013(Annex-I).

Construction of new reservoirs would supplement this loss. WAPDA isundertaking several projects which are at various stages of implementation tomitigate the adverse effects of storage loss.

(b), (c) WAPDA has been vigilantly looking after the water scarcity issuein the country. Addition of 2.88 MAF to the existing capacity of Mangla DamProject is a step in this direction. Similarly Gomal Zam Dam and Darawat DamProjects have added another 1.0 MAF to the storage capability of the country.There are several other small, medium and large multipurpose projects which areat different stages of execution (list attached at Annex-II).

242. *Dr. Nisar Ahmad Jatt:

Will the Minister for Water and Power be pleased to state the month-wise progress made through the measures taken by the Governmentto control/reduce the difference between cost of the generation ofelectricity and determination of tariff since April, 2013 till date?

Minister for Water and Power (Khawaja Muhammad Asif): NEPRAdetermines the tariff based on cost of supply of each corporate entity. The tariffdetermined by NEPRA is charged to consumers after its notification by Governmentof Pakistan. Government however notifies less tariff than the tariff determined bythe National Electric Power Regulatory Authority. The difference between NEPRAdetermined and Government of Pakistan notified tariff is being paid by theGovernment as tariff differential subsidy. No Government can provide subsidy foridefinite period as provision of huge subsidy hampers the economic developmentof country. So, Government has increased consumer end tariff.

In addition to provision of subsidy to masses, Government has been makingefforts to control/reduce the difference between cost of the generation of electricityand determination of tariff for which following medium/long term efforts are beingmade.

- Installation of Hydel Power Plants.

- Conversion of existing oil based Power plants to coal based plants.

- Increase inefficiency of existing Power plants.

- Establishing the new coal based Power plants.

This Ministry assure that materialization of such efforts will bridge the gapbetween cost of supply and consumer end tariff.

363. *Tahira Aurangzeb:

Will the Minister for Water and Power be pleased to state:

(a) the reasons for not eliminating loadshedding in the country from2008 to 2013 by the Government;

(b) the responsibles therefor?

Minister for Water and Power (Khawaja Muhammad Asif): (a) Themain reasons, for not eliminating loadshedding in the country from 2008-2013are:—

• Unprecedented increase in electricity demand by domestic andcommercial consumers due to change in socio economic environmentof the country.

• Water indents/releases are allocated by Indus River System Authority,according to the agricultural demand of the provinces. Furthermore,the low level of Tarbela and Mangla Reservoirs results in lowgenerating capacity for the same water discharge as compared togenerating capacity at higher reservoir level, resultantly forced outageof generating units.

• Insufficient supply of gas to Thermal Power Plants of GENCOs andIPPs from SNGPL/SSGC due to increased demand of gas byDomestic, Commercial, CNG, Fertilizer and industrial sectors.

• Insufficient and irregular supply of furnace oil (HSFO/LSFO) toGENCOs and IPPs Power Plants by PSO due to less availability ofproduct, logistic problems and especially payment issues on accountof circular debt.

• Frequent Forced outages of mechines on different Maintenanceschedules.

• Derating of old and outlived machines of GENCOs.

(b) The Load shedding in the country from 2008 to 2013 could not heeliminated due to the above mentioned reasons.

373. *Syed Asif Hasnain:

Will the Minister for Water and Power be pleased to state:

(a) the total outstanding amount of circular debt of IPPs for thecurrent year; and

(b) the time by which said amount will be paid to 1PPs?

Minister for Water and Power (Khawaja Muhammad Asif): (a) Thetotal outstanding amount of circular debt of IPPs for the current year upto31-01-2014 is Rs. 173 billion.

(b) Existence of receivables / payables is a regular feature of each businessconcern and always remains in books of accounts. There is no issue of circulardebt at present in Power Sector. Power Sector payables as on 31-01-2014 wereRs. 246 billion where as its receivables from consumers were Rs. 491 billion.Majority of the receivables are from Private consumers Rs. 326 billion, fromGovernment (federal provincial) Rs. 125 billion and from KESC Rs. 41 billion(without markup). As a business norm payables must be paid when they becomedue, however, low recovery and pilling up of receivables are major implement inthe way.

92. *Lal Chand:

Will the Minister for Water and Power be pleased to state:

(a) the year-wise details of water released down stream from KotriBarrage during the last five years; and

(b) the required water in million acre feet to be released therefromunder water accord 1991?

Minister for Water and Power (Khawaja Muhammad Asif): (a) Thewater escaped below Kotri Barrage during the last five year 2008-09 to 2012-13 is given as under:—

The Water Accord 1991 stipulates under para-7 as given below:—

“The need for minimum escapage to sea, below Kotri, to check seaintrusion was recognized. Sindh held the view, that the optimum levelwas 10 MAF, which was discussed at length, while other studiesindicated lower/higher figures. It was, therefore, decided that further

studies would be undertaken to establish the minimum escapageneeds downstream Kotri.”

In the year 2005, the study was conducted/completed by the internationalPanel of Experts (IPOE) which submitted its report on 20th November 2005.According to the study 3.6 MAF perennial & 5 MAF flood flows on annual basisare required. Main points of the study are as under:—

(a) 5000 Cs perennial flow is required below Kotri Barrage to checkseawater intrusion, accommodate the needs of fisheries and environmentalsustainability, and to maintain the river channel (In a dry year the amount can beproportionally reduced in relation to reductions in irrigation water supply) whichworks out to 3.6 MAF.

(b) A total volume of 25 MAF in any 5 years period (annual equivalentamount of 5 MAF) to be released in a concentrated way as flood flow (Kharifperiod), to be adjusted according to the ruling storage in the reservoirs and thevolume discharged in the four previous years.

(c) Based on the post Tarbela flow data the above recommendationswould result in a required additional release downstream of Kotri Barrage duringlow flow months in an average year and in a typical dry year. This will requireadditional storage capacity to prevent a reduction of water availability for irrigatedagriculture. Environmental flows would as and when appropriate be routed viaupper rivers before release downstream of Kotri Barrage.

93. *Dr. Nafisa Shah:

Will the Minister for Water and Power be pleased to state:

(a) the present status of the Gadani Power Project; and

(b) the total quantity of coal to be imported for the said projectduring the year 2013-14 alongwith the per unit tariff/ratethereof?

Minister for Water and Power (Khawaja Muhammad Asif): (a) ForGadani Power Park, Site Survey, Revenue Survey and Topographical Surveyhave been completed by the Consultant (NESPAK) and now NESPAK is in theprocess of preparing Master Plan and Feasibility Study related to Power Park atGadani.

(b) Coal will not be imported for the said project during the year2013-14. However, approximately 20 Million Tonnes of coal will be importedper annum after commissioning of 6600 MW complex. Furthermore, NEPRA isin the process of working on Upfront Tariff of Power Projects at Gadani.

94. *Dr. Nafisa Shah:

Will the Minister for Water and Power be pleased to state:

(a) the total number of Coal Fired Plants which have beencommissioned by the present Government; and

(b) whether coal will be imported for those plants; if so, the rate/tariff thereof?

Minister for Water and Power (Khawaja Muhammad Asif): (a) Atpresent, no coal fired power plants have been commissioned. However, presentGovernment has planned to construct following coal fired power plants.

i. 2x660 MW Coal Fired Power Plant, Jamshoro: The preliminarydocumentation of this project has been completed. This project isbeing financed by Asian Development Bank. The tentative completiondate of this project is 2018.

ii. 2x660 MW Coal Fired Power Plant, Gadani: Government hasplanned to construct power park at Gadani Balochistan. 10x660MW machines will be installed on imported coal. 8x660 MWmachines will be installed by IPPs and 2x660 MW machines will beinstalled by Pakistan Power Park management company limited. WsNESPAK has been assigned to prepare feasibility report, PC-I, EIA,bidding documents etc. by PPPMCL.

(b) i. For 2x660 MW Coal Fired Power Plant, Jamshoro, 20% Thar Coal(Lignite) and 80% imported coal (Sub-bituminous) will be used.

ii. For 2x660 MW Coal Fired Power Plant, Gadani, 100%importedcoal (Sub-bituminous) will be used.

iii. The tentative rate/tariff of electricity will be US 10 Cents/Kwh.As per NEPRA determination.

95. *Mrs. Shahida Rehmani:

Will the Minister for Water and Power be pleased to state whether itis a fact that subsidy has been given to industrial and commercialconsumers on energy during current year; if so, the details thereof?

Minister for Water and Power (Khawaja Muhammad Asif): NEPRAdetermines tariff of each distribution company, based on legitimate cost of supply.The tariff determined by NEPRA varies from company to company due to followingreasons:

• Variation of T&D losses among DISCOs due to geographical situationof companies.

• Consumer / consumption mix varies among DISCOs.

• Tariff adjustments, pertains to previous period varies among DISCOs.

Government, however, adopted a uniform policy for consumer end tariff.At present minimum tariff among DISCOs for commercial and industrial categoriesis being charged. A DISCOs having above minimum charge as determined byNEPRA has been paying subsidy to its consumers to keep the uniformity amongconsumer end tariff.

DISCO wise detail of per unit subsidy which is being provided to consumers itplaced at Annex-A.

It is added here that DISCOs submit their subsidy claims to the officer ofChief Engineering Advisor, Ministry of Water & Power, Government of Pakistan,Islamabad (Subsidy Cell). After verification of subsidy claims by subsidy cell thesame are forwarded to Ministry of Finance for release of subsidy is available inthat office.

(a) the classification of the taxes being charged from electricityconsumers at present alongwith the rates and justificationsthereof; and

(b) whether there is any proposal under consideration of theGovernment for abolishing such taxes for domestic consumers;if so, when it will be implemented?

102. *Belum Hasnain:

Will the Minister for National Food Security and Research be pleasedto state:

(a) the steps taken by the Pakistan Agricultural Research Council(PARC) for production and research of high yielding seeds ofTomatoes, Potatoes and Cucumber during the last three yearstill date; and

(b) the total types of said seeds produced/introduced by the PARCduring the said period?

Minister for National Food Security and Research (Mr. SikandarHayat Khan Bosan): (a) PARC has successfully developed hybrid seed oftomatoes. Which are under evaluation?

Potato varieties have been introduced and research on varietal developmentis in progress.

Cucumber germplasm acquired form different sources and being used forbreeding purposes.

(b) Tomato: High yielding variety Rio-Grande was introduced throughPARC system and is being successfully grown by the tomato growers. Its seed isavailable with Punjab Seed Corporation and other Private Seed Companies.

Potato: Tissue culture produced seed is being multiplied/evaluated at“Summer Agricultural Research Station, Kaghan”. National Potato Program,NARC and Gilgit Agriculture Research Station, Naltar.

Cucumber: The seed production in cucumber is a bit difficult task as itbelongs to highly cross pollinated group. There is no set system for seed productionin the country. Seed of a desi variety is available.

103. *Naeema Kishwar Khan:

Will the Minister for Water and Power be pleased to state:

(a) the quantum of electricity being generated in the province ofKhyber Pakhtunkhwa, at present;

(d) whether the production/generation of electricity in the saidprovince is more than its consumption; if so, the justification ofloadshedding in the said province; and

(e) the steps being taken by the Government in order to minimizethe loadshedding and provision of electricity to the people atlower rates?

——————————————————————————————The generation of hydel power from reservoirs is dependent on the indent

of IRSA for release of water. The run of river Projects are dependent on theavailability of water on snow melting season, At present 447 MW is being generated.

(b) The demand of electricity in the province of Khyber Pakhtunkhwa,at present is 1,757 MW (Average Daily-Reported Demand as on 06-01-2014).

(c) The tariff per unit rate is based on basket price for all the country.Each consumer is to pay that rate.

(d) The country is facing supply and demand gap and ultimately all sharethis gap. The generation is a national asset.

(e) Following steps are being taken by the Government in order tominimize the load shedding and provision of electricity to the people at lowerrates.

• To convert oil based plants to coal to reduce cost of generation.• Installation of plants on Hydel sources.• Provision of maximum gas for gas based plants.• Improvement in recovery position and reduction in losses.• To control theft of power.• To control law and order situation in the country.• Maximum provision of energy to Industrial Sector to improvement

revenue and overall economy of the country.

104. *Naeema Kishwar Khan:

Will the Minister for Water and Power be pleased to state:

(a) the reasons to fix Rs.6.00 billion annually for payment to theGovernment of the Khyber Pakhtunkhwa since 1991 till dateas royalty/Net Hydel Profit (NHP) under the head of electricity;

(b) whether there is any proposal under consideration of theGovernment to give royalty/NHP under the said head accordingto AGN Qazi Formula; if so, the steps being taken in this regard;and

(c) whether there is also any proposal under consideration of theGovernment to increase the amount of said royalty/NHP due toincrease in the prices of electricity; if so, the details thereof?

Minister for Water and Power (Khawaja Muhammad Asif): (a)Government of Khyber Pakhtunkhwa has been demanded the royalty / Net HydelProfit (NHP) for the renewable energy being produced in Khyber Pakhtunkhwa.Upon the directions of Government of Pakistan, WAPDA on receipt from NTDCL

is regularly making payment of Rs. 6 Billion annually to Government of KhyberPakhtunkhwa since 1991 as royalty / Net Hydel Profit (NHP) for all the hydelPower stations located in the province of Khyber Pakhtunkhwa.

(b), (c) In order to resolve the royalty / Net Hydel Profit (NHP) issues,a Committee has been constituted under the chairmanship of Ministry of Water &Power. However, Committee has not yet formulized its decision.

105. *Muhammad Muzammil Qureshi:

Will the Minister for Water and Power be pleased to state whether itis a fact that the construction of small Dams has been started by theGovernment to remove shortage of water in the country; if so, theprovince-wise details thereof?

Minister for Water and Power (Khawaja Muhammad Asif): TheGovernment of Pakistan gives highest priority to the development of water &power resources of the country to harness its full potential for ever increasingpopulation of the country.

President of Pakistan has assigned WAPDA to construct 12 Small/ MediumDams in four Provinces and FATA on fast track basis.

Two wind power projects of 49.5 MW and 56.4 MW capacitiesrespectively are operational. Three (03) wind power projects of 150 MWcapacities in total are under construction and will be completed in 2014. Anotherthirteen (13) wind projects having a cumulative capacity of 680 MW are at advancestages, ready to achieve financial closing in 2014. In total, 33 wind power projectsare in different stages of development.

22 solar power projects having a cumulative capacity of 772.99 MW areunder different stages of development and can achieve commercial operation DeCOD by 2015/16 subject to availability of Grid by NTDC and announcement oftariff by NEPRA.

(a) whether there is any proposal under consideration of theGovernment to allow private sector to generate solar electricityfor domestic use;

(b) if so, the incentives to be provided to the said sector therefor?

Minister for Water and Power (Khawaja Muhammad Asif): (a)Alternative Energy Development Board (AEDB) is promoting the use of solartechnology at domestic level for electricity generation. The private sector is alreadyusing solar energy for domestic use for self consumption as there is no restrictionor licensing requirement.

The RE Policy 2006 allows consumers to avail features like Net-Meteringand Wheeling of Energy which require interconnection with the grid. Theimplementation of such schemes, however; requires regulatory framework enablingthe domestic, commercial and industrial users to carry out net-metering / wheelingusing solar energy. AEDB has prepared draft rules for distributed generation,covering electricity generation from solar at domestic level, and submitted thesame to NEPRA for announcement.

(b) NEPRA, being the regulator, is the concerned agency for developingregulatory framework including incentives.

(a) whether it is a fact that a detailed study has been conducted bythe Ministry on Pakistan’s Glacial System;

(b) whether it is further a fact that the said study/analysis provideda futuristic assessment of water and silt discharge into majorrivers from glacial melts;

(c) the year-wise estimates/projections for per capita consumptionof water during next ten years in Pakistan; and

(d) the steps being taken by the Ministry to ensure the availabilityof water to meet the consumptive requirements?

Minister for Water and Power (Khawaja Muhammad Asif): (a) During1985-1989, WAPDA conducted comprehensive study on the Glacial System ofPakistan, that are located in the Upper Indus Basin, in collaboration with CanadianUniversities. The objective of the study was to establish the active hydrologic zonein the Hindukush-Karakoram-Himlayan Range and contribution of water fromsnow melt; glacier melt and rainfall from this zone into the Indus River System. Itwas estimated that the contribution of snow and ice melt towards the Indus RiverSystem from Western Rivers is about 95 MAF. The study also estimated thesediments generation from the glaciated Hunza basin of Upper Indus Basin (UIB).

On the finding of that study, Flow Forecasting System was established in1991 within WAPDA that included establishment of high altitude automatic weathernetwork in Upper Indus Basin, acquisition and installation of data collection andtransmission system and development of Hydrologic Model.

With the growing concerns of Climate Change and its perceived threats tothe Glacial System of Pakistan, WAPDA has initiated six year Glacier MonitoringProgram in July 2012 through which WAPDA will be able to forecast future wateravailability into the Tarbela Reservoir and Indus Water System.

New study is being undertaken with the assistance of World Bank. TheToR of the study is as under:

• Mass balance of six major UIB glaciers will be carried out.

• Distributed hydrologic model will be developed for the UIB hydrologicconditions that will forecast long-term water availability for the currentcentury on decadel time steps for River Indus at Tarbela.

(b) The study will provide a futuristic assessment of water only, whereassediment generation from the possible glacial melts is not a part of this GlacierMonitoring Program.

(a) whether it is a fact that the surface water availability in IndusBasin is being badly affected due to climate change effects,melting of glaciers, and utilization of water of Western Riversby India;

Minister for Water and Power (Khawaja Muhammad Asif):

(a) • Climate change is often talked about at various forums and is effectingmetrological events resulting in severe drought (2000-2009) and floodof 2010, posing challenge to water availability in Pakistan.

• Realizing the importance of glaciers and their sensitivity to climatechange, WAPDA has initiated a Glacier Monitoring & ResearchProgram with the support of World Bank. The program aims atforecasting the water availability from the Upper Indus Basin glaciersinto the Indus River System during the current century.

• India is allowed to construct Run-of-the-River hydroelectric plantsand limited storage works on the Western Rivers (Indus, Jhelum &Chenab) within the limits of design criteria provided in the relevantprovisions of the Indus Waters Treaty 1960. Accordingly, India isbound to provide detailed information and design data regarding theproposed projects. Office of Pakistan Commissioner for Indus Watersreviews the design of these projects in accordance with the designcriteria provided in the Treaty and if the design does not confirm withspecified criteria, Pakistan has right to object on these projects. Theseobjections are resolved either at the level of the two Commissioners,called the Permanent Indus Commission during the meetings oraccording to the dispute settlement mechanism provided in the IndusWaters Treaty 1960.

• It is pertinent to mention here that so far India has not constructedany storage works on our rivers and do not have any capability tocontrol or misuse of the waters of Western rivers.

• Pakistan is receiving almost the same volume of water in all the threeWestern rivers as we were receiving waters at the time of signing ofthe Treaty in 1960 and none of the user agency including WAPDAand provincial Irrigation departs reported any reduction in the averageinflows of the rivers. The histograms showing inflows in all the threeWestern rivers are enclosed as Annex-I.

Minister for Water and Power (Khawaja Muhammad Asif): Existenceof Receivables/Payables is a regular feature of each business concern and alwaysremains in books of accounts. We understand that there is no issue of circular debtat present in Power Sector. Power Sector payables as on 31.12.2013 were Rs.209billion where as its receivables from consumers were Rs.480 billion.

Surge in Circular Debt takes place mainly due to non-availability of requiredfunds to pay off the liabilities of Power Generators. Circular Debt re-emerges dueto short remittance by DISCOs in the wake of less recovery and short releasesubsidy by Government of Pakistan. Moreover, heavy amounts have been stuckup with AJ&K and all provincial governments mainly due to non-implementationof policy decisions.

The strength of Power Sector mainly depends upon the behavior of all thestakeholders to meet their obligations relating to clear the liabilities of Power Sector

Smooth flow of Power according to energy need of the provinceswould lead to economic development which is ultimate objective of the Government.Elimination of circular debt depends upon the implementation of policy decisionsregarding resolution of aforesaid issues.

174. *Shahjahan Baloch:

Will the Minister for Water and Power be pleased to state the totalamount of circular debt of the country as on 15-12-2013?

Minister for Water and Power (Khawaja Muhammad Asif):Re-emergence of Circular Debt takes place due to non-availability of requiredfunds to pay off the liabilities of Power Generators. Circular Debt re-emerges dueto short remittance by DISCOs in the wake of less recovery and excess linelosses than determined by NEPRA and non-release/short release of subsidy byGovernment of Pakistan.

Reconciled overdue payables to Power generators as on 31.05.2013were Rs.561 billion. Payment/adjustment of Rs.503 billion was made. Afterdeducting liquated damages of Rs.23 billion, payments /adjustments of Rs. 480billion were made.

However, payables as on 15.12.2013 were Rs. 206.907 billion(Annex-I), increasing by Rs.126 billion (207-81). Increase in payables is due tofollowing reasons:

i. Short receipts by DISCOs to the tune of Rs.63 billion during theperiod (Jul-December) 2013.

ii. Short subsidy receipts from ministry of Finance to the tune of Rs.47billion during (Jul-December) 2013.

iii. Short receipt of KESC subsidy against Billing of Rs.10 billion (Jul-December) 2013.

Following steps are being taken by the present Government to eliminateCircular Debt in future:

Will the Minister for National Health Services, Regulations andCoordination be pleased to state:

(a) whether it is a fact that the drug manufacturers have againincreased the prices of essential medicines; if so, the reasonsthereof; and

(b) the steps being taken by the Government to control the saidprices?

Minister for National Health Services, Regulations andCoordination: (a) (i) During last 2 years, 105 cases of unauthorized price increaseby the Pharmaceutical companies were noticed by the Drug Regulatory Authorityof Pakistan (DRAP). Upon taking action by the DRAP, 16 companies filed writpetitions /suits in Sindh High Court, Karachi, Lahore High Court, Lahore andCivil Judge Lahore and managed to obtain stay orders.

(ii) Pakistan Pharmaceutical Manufacturing Association filed aConstitutional Petition in the Sindh High Court, Karachi against the withdrawal of15% price increase by the Federal Government and the honorable court suspendedthe operation of notification to withdraw the said increase. Resultantly, the mostrecent price increase observed, is under the shelter of the stay orders.

(b) The following steps have been taken by the Federal Government toensure that the drugs are available in the market at approved rates:

i. The DRAP filed an application in the Supreme Court of Pakistanseeking to pass appropriated orders for resolving /disposal of petitions/suits filed by pharmaceutical companies in Sindh High Court, Karachi,Lahore High Court, Lahore and Civil Judge Lahore and the honorablecourt issued notices to 14 companies for illegal price increase ofmedicines.

ii. It also filed 25 Civil Miscellaneous Applications (CMAs) in the SindhHigh Court, Karachi, Lahore High Court, Lahore and Civil JudgeLahore to vacate stay orders issued by the courts in matters ofunilateral price increase on medicines by pharmaceutical companies.

iii. DRAP field offices have been requested to be vigilant, conduct marketsurveys and take actions against the companies if found overchargingof drugs.

iv. Under Section 6 of the Drugs Act, 1976, the storage and sale ofdrugs is regulated by the Provincial Governments, therefore, DRAPhas advised the Provincial Health Authorities to take action underthe law against the companies who increase prices of drugs morethan approved prices.

32. *Dr. Mahreen Razaque Bhutto:

Will the Minister for National Food Security and Research be pleasedto state whether it is a fact that the bird flu is spreading again amongbroiler chicken in the country; if so, the steps being taken by theGovernment in this regard?

(d) whether it is further a fact that Pakistan did not submit data toICA regarding the impacts on the said project on Pakistan;

(e) if the answers to part (c) and (d) above are in the affirmative,the responsibles thereof alongwith the steps being taken in thisregard?

Minister for Water and Power (Khawaja Muhammad Asif): (a)Pakistan sought relief on the two questions from Court of Arbitration (CoA):—

(i) Whether or not India is allowed to divert waters of Kishenganga(Neelum) River to Jhelum River in occupied Jammu & Kashmirthrough Kishenganga project? and

(ii) Whether India is allowed to drawdown water level of a Run-of-River hydroelectric plant below Dead Storage Level except in anunforeseen emergency?

Regarding the first question the Court has given a partial award in February2013 and has ruled that India can divert the water of Kishenganga Dam to JhelumBasin. Due to this diversion the annual inflows at Neelum Jhelum Project site willreduce about 13% which will result in 10.6% less annual power production fromthe Neelum Jhelum Hydroelectric Plant.

(b) The second question was regarding placement of spillway and thecontrol on storage i.e. the lower the spillway the more the control on the reservoir.This question was decided completely in Pakistan’s favour, according to the decisionIndia will not be able to drawdown the water level in the reservoir and this willprotect Pakistan from the fluctuations in the Neelum flows due to operation ofsediment flushing by India.

(c) There is absolutely no river depended agriculture uses from the watersof Neelum river in Azad Jammu & Kashmir, therefore Pakistan could not providedany data of the agricultural uses from the Neelum river therefore the Court ofArbitration highlighted this point in the final decision that Pakistan did not providedany agricultural uses data.

(d) It is not true that Pakistan did not submit data to the Court ofArbitration regarding the impacts of the Kishenganga Project on Pakistan. On theother side Pakistan’s whole case was based on the impacts of the KishengangaDam on the projects in Pakistan and environmental damages due to diversion ofwater through Kishenganga Dam. Due to this fact the Court of Arbitration orderedin the Final Award of December 2013 to release of minimum flow of 9 cumecswhich is mainly calculated on the basis of the environmental requirements. Thisrelease of 9 cumecs will reduce hydroelectric generation loss at Neelum JhelumHydropower Project from 13.6% to 10.6% annually.

(e) Replied as above.

34. *Dr. Arif Alvi:

(a) whether it is a fact that the Government of Pakistan andAfghanistan held negotiations regarding the construction ofKunar River Power Project (KRPP) of 1500 MW in Afghanistan;if so, the details thereof; and

(b) whether there is any proposal under consideration of theGovernment to sign a treaty with the Government ofAfghanistan on Kabal River similar to Indus Water Treaty beforesigning an agreement on KRPP; if so, when it will beimplemented; if not, the reasons thereof?

Minister for Water and Power (Khawaja Muhammad Asif): (a) Theproposal of developing power potential on Kunar River is under discussion.Afghanistan Government indicated that 1500 MW power can be generated fromKunar River. Govt. of Pakistan is requesting for the said feasibility study so thatmodality of joint development and collaboration in implementation can be workedout.

(b) Internally within Pakistan, there has been a proposal to have a legaldocument with Afghanistan for beneficial sharing of waters of common rivers betweenAfghanistan and Pakistan. But there is no response from Afghanistan, as yet.

Director General (Afghanistan) has been pursuing the matter withGovernment of Afghanistan to have maximum possible exchange of data/informationof river flows and potential water development/uses before going for formal talkswith Afghanistan about the treaty. It was learnt through Ministry of Foreign affairsthat Afghan Government was in process of preparing a National Water Policy andit was expected that after framing of the Policy, Afghan Government might initiatethe dialogue with Pakistan on the issue.

(a) whether it is a fact that floods damage crops and land worthbillions of rupees every year in the country;

Minister for Water and Power (Khawaja Muhammad Asif): (a) ) Itis fact that floods damage abadies, crops, valuable agricultural land and otherprivate and public property in the country during monsoon season.

(b) As short term measure, Federal Government provides funds throughPublic Sector Development Programme (PSDP) for execution of emergent floodprotection schemes under Normal/Emergent Flood Programme. Provincial IrrigationDepartments & Federal Line Agencies are responsible for preparation of PC-Isand execution of such schemes.

Rs. 1000.00 million have been allocated under PSDP (2013-14) forexecution of emergent nature flood protection schemes through Normal/EmergentFlood Programme.

For medium/long term measures, work on formulation of National FloodProtection Plan-IV (2015-2025) on countrywide basis has been initiated. ThePlan is- likely to be ready by the end of current year (2014).

Minister for National Health Services, Regulations andCoordination: (a) Manufacturing of essential medicines has not been stopped bythe pharmaceutical companies and most of the essential medicines are beingproduced locally.

(b) The following steps have been taken by the Federal Government toensure availability of medicines in the domestic market and to fix and maintain theprices of medicines affordable level:

i. Manufacturing of generic drugs is being encouraged and facilitated,as by and large the generic products are cheaper than the brandeddrugs. Priority and all facilitations are being given to the manufacturersof generic drugs and to make their investment fruitful in the shortestpossible time. For that purpose, meetings of the various boards arebeing held frequently.

ii. Priority is also being given to grant registration to new licenses/newsections to increase production of drugs which increase competitionin the market which in turn results in the reduction of prices of drugs.

iii. A policy to rationalize the prices of drugs is under consideration ofthe Policy Board of Drug Regulatory Authority of Pakistan, Ministryof National Health Services, Regulations and Coordination.

Minister for Ports and Shipping (Mr. Kamran Michael): All shipscalling Pakistani Ports are inspected by the Marine Pollution Control Departmentof the Ports for Pollution Prevention Measures strictly in accordance with theInternational Convention MARPOL 73/78. In this regard a prior notice to marinersis forwarded through their respective Shipping Agents.

This inspection not only ensures that the ship does not cause any pollution/emissions during its stay in port but also takes an account of oily and other wasteproduced onboard during its sea passage and their safe disposal.

Records related to production and disposal of oil sludge / plastic duringpast six months are checked to verify if the ship has discharged this stuff in theoceans, which is strictly prohibited.

Records ships bilge water overboard discharge valves are required to bekept chained and locked in the Harbour. Performance of oily water separator ischecked and it is also ensured that the ship does not have any connection bypassing the oily water separator. The inspection is conducted very strictly and incase of any contravention the ship is issued warning and subsequently penalized.The penalties have created sufficient deterrent and the Harbour has acquired cleanersurface in the context of oil pollution.

Marine Pollution control centre has been established in Port QasimAuthority and its main function is to keep vigilance, especially over the Sea tocheck and monitor that no oil spill is taking place from Ships / Vessels entering intoPort Qasim territorial water and to take corrective measures and recovery if oilspill is detected. Vigilance activity over the sea Ports is carried out by SurveillanceBoats.

Minister for National Food Security and Research (Mr. SikandarHayat Khan Bosan): The steps being taken by the Government for promotingagriculture are summarized as under:—

i. Development and promotion of new high yielding wheat varieties.Research system in the country developed during 2011-12 highyielding varieties of wheat (8), rice (1) and sugarcane (2), whichwere approved and released for production.

ii. Ensured supply of farm inputs for production of various crops.

iii. Dissemination of good agricultural practices through provincialagricultural department using field visits and electronic and printmedia.

iv. State Bank of Pakistan enhanced the agricultural credit allocation(2013-14) to the tune of Rs. 360 billion against last year’s(2012-13) disbursement of Rs.315 billion.

v. It has been decided between the Government and private fertilizermanufacturers that the price would be printed on the bags forinformation of the Consumer from 1st March, 2014.

(b) Timely repair of the Main Canal is of vital importance for assuranceof the indented supplies to the Secondary system of canal. However, themaintenance of canal has not been carried out for the last four years due to non-availability of funds to be provided by the Provincial Governments as per costsharing formula.

(c) The command area of Chashma Right Bank Canal is 6,06,600 Acres.

(d) Maintenance of canal has not been carried out for the last four yearsdue to non-availability of funds to be provided by the Provincial Governments asper cost sharing formula.

Will the Minister for National Health Services, Regulations andCoordination be pleased to state:

(a) the steps being taken by the Government in respect ofovercharging of the fee from parents at the time of admission inPrivate Medical and Dental Colleges which are functioning inthe country under the Administrative control of the Ministry;

(b) the steps being taken against the un-registered Private Medicaland Dental Colleges; and

their letter No. 5-4 (20) Misc/A&P/NABHQ/2013/1345 has instructed PM&DCto circulate “Fee and Refund of Fee policy to all public and private medical collegesunder the jurisdiction of PM&DC for strict compliance and for placement at theprominent places in the vicinity of the medical colleges. The instruction of NABhave been circulated vide PM&DC letter No. 4-NAB/Council-2013/260469-559dated 20th December, 2013.

(b) Admissions were stopped vide this office letter No. PF-12-F213 (Insp)21783 dated 20th January, 2014 and circulated to all concerned.

(c) It is a matter of fact that PM&DC only has regulatory control overthe fees being charged by medical colleges as per their admission criteria submittedto the Council. The PM&DC Ordinance does not have any clause to regulate theaspect of donations if any being charged by medical colleges from overseasPakistani students in the shape of donations for ensuring admissions. However, onthe cognizance of NAB, necessary remedial measures have been taken byPM&DC as per NAB’s directives and NAB’s instructions have been circulatedto all medical colleges in the country.

The sale proceeds of the stores is deposited in the Bank Accounts ondaily basis. The sales proceeds from different branches of the Bank are collectedin the main account of the corporation at Islamabad on daily basis for onwardpayment to the suppliers / vendors.

Minister for Ports and Shipping (Mr. Kamran Michael): (a) It iscorrect that influential persons have grabbed the land of KPT, worth million ofrupees in front of KPT Hospital. In fact during the year of 2012-13 oneMr. Akhter Jadoon former Provincial Minister for transport forcibly occupiedKPT Plot No. 5, 7, 8, measuring 16920 Sq. Meter in front of KPT Hospitalwhich were reserved for hospital for which notices have been sent to the occupantsand later the KPT Anti Encroachment Department demolished /stopped theconstruction work but they again started the work. Later KPT filed C.P.No. D-789/2013 in High Court and the court granted stay order; the Nazir of the HighCourt also inspected the site and submitted his report in the court. The KPT hasalso filed contempt proceeding against the above said Ex-Minister Mr. AkhtarJadoon and others which is still subjudice in the Court.

(b) The total No. of cases being proceeded against illegal occupationsof the land of KPT are 05 Nos. details attached at Annex-A.

(c) No proposal is under consideration to conduct survey of TimberMart, Kemari 69/1.

DETAILS OF CASES FILED BY KPT AGAINST LAND GRABBERS

1. KPT has filed a C.P.No. D-789 of 2013 against the land grabbers in theHigh Court of Sindh at Karachi wherein the court passed order and directed theparties to maintain status quo. The Honourable Court also appointed the Nazir ofthe High Court for inspection of the property and the Nazir of the High Courtinspected the property and submitted his report in the Court and now the matter issubjudice in the High Court of Sindh at Karachi. KPT has also filed a Petition forcontempt proceedings against the parties.

2. Further KPT has also filed constitution petition bearing C.P.No. D-1740/2011, C.P.No. D-322/2012 and C.P.No. 3136/2011 land Civil Suit No. 891/2006 in High Court of Sindh, against the encroachers which are still subjudice.

3. The Legal Advisor M.S. Khalid Anwar & Co. has also filed a constitutionPetition No. 47/2011 before the Supreme Court of Pakistan against Province ofSindh regarding title of KPT land within Port limits which is still subjudice in theHon’ble Court.

Will the Minister for National Health Services, Regulations andCoordination be pleased to state the mechanism of coordination withthe provinces to ensure the implementation of internationalcommitments made regarding Health related MDGs, the UN EveryWoman Every Child strategy, the Scaling up Nutrition (SUN) and ensuring100% immunization of children and access to health workers etc?

Minister for National Health Services, Regulations andCoordination: After assigning the roles of Coordination & Regulation to thisMinistry by the Cabinet. The Federal Government alongwith WHO and otherHealth Development Partners and the Provincial Government convened a nationalmeeting on accelerating progress in the health sector in Islamabad on 22-23November, 2013 for better Coordination among all, recommendation of the meetingare placed at Annex-I.

In the light of recommendations Ministry hold a consultative meeting with allProvincial and area Government where there is need to develop national Plan etc.

Thus for example to develop recommendations National Accelerated Planof Action for MDG 4-5 a meeting was held on 3rd December, 2013 which wasparticipated by Population and Health Department of all provinces and areaGovernment Health Development Partners and Ministry.

Similarly for SUN movement a meeting was held on 17th December,2013 in Bhurban and Road map was developed with consultation with all ProvincialHealth Development Partners and Ministry.

Annex-IRECOMMENDATIONS

This meeting of devolved health sector in Pakistan was a strategic step to fillthe important coordination vacuum that had been generated following devolutiondue to short transition time and inadequate preparations both at federal andprovincial level.

The Ministry of National Health Services, Regulations and Coordination andthe representatives from provincial health departments and AJK haveunanimously shown their resolve to further explore the roles and responsibilitiesidentified in their respective domains.

The actions agreed during the meeting are in line with the 18th constitutionalamendment and the expected roles of the Ministry of National Health Services,Regulations and Coordination.

The participants have resolved the potential roles for the federal Ministry andthe provincial departments for major areas that require coordination of healthsector in Pakistan. These include:

• Health policy planning and strategy development• Coordination at federal and provincial level for health sector financing• Human resource planning, forecasting and capacity development• Essential public health functions• Coordination with development partners• Pharmaceutical sector regulation• Health services regulation.

The deliberations from the meeting can serve as first working document forthe Ministry of National Health Services, Regulations and Coordination andthe provinces to further clarify their roles and coordination mechanisms withother sectors as well as with the development partners.

The development partners have shown their support to the new healthinfrastructure and are keen to work both at federal and provincial level in linewith the agreed roles and responsibilities of these arms of the state.

The compiled version of deliberations, suggesting the potential roles andresponsibilities of federal and provincial governments, categorized for variousareas of health system are annexed to the end of this report.

Both federal and provincial representatives agreed to continue dialogue andfurther explore these deliberations, and review the roles and responsibilities. Inorder to move ahead, the following way forward was suggested. The authoritiesboth at federal and provincial level agreed to:

o Share the outcome/recommendations of this consultation with provinces, nationalo Provinces to discuss these outcomes/recommendations at provincial levelo Nominate provincial focal points to work closely with national levelo Establish a task force at national and provincial levels to develop a mechanism too Endorse recommendations through appropriate forums (e.g. Council of

Common level, other stakeholders refine and provide guidance onimplementation of recommendations Interests or legislation).

Minister for National Health Services, Regulations andCoordination: The Drugs Act, 1976 regulates import, export, manufacture, storage,distribution and sale of drugs under section 7 of the Drugs Act, 1976. Drugs areregistered by Drugs Registration Board on the basis of safety, efficacy, quality andeconomic value of drugs as given under the Drugs (Licensing, Registering andAdvertising) Rules, 1976.
