R.A. 7610 otherwise known as the Child Abuse and Exploitation Act and PD 603 otherwise known as the Child and Youth Welfare C'.ode. it is necessary to include in the priority programs the protection of women and children from both physical and emotional abuses: WHEREAS, Artide II Section 11 of the Philippine Constitution provides that "The state values the dignity of every human person and guarantees full respect for human rights": WHEREAS, there is an increasing cases of abuses perpetrated against women and children and an increase cases of children In conflict with the law making it more imperative for the Qty Government of Santa Rosa, Laguna to immediately establish an institution that would take care of their needs; WHEREAS, to ensure that abused women and children and children in conflict with the law would be treated accordingly, It is essential that a CRISIS CENTER and CTCL CENTER be established under the supervision of the Oty Social Welfare and Development Office in cooperation with Non-Government Organizati on, that specializing and advocating in women and children's protection; NOW, THEREFORE, on a motion of SP Member Honorable Edward Femandito S. AN ORDINANCE ESTABUSHING A CENTER FOR WOMEN AND CHILDREN IN CRISIS AND CHILDREN IN CONFUCT WITH THE LAW (CICL) IN THE CITY OF SANTA ROSA, LAGUNA AND PROVIDING FUNDS THEREFORE

WHEREAS, in accordance with Section 16 of Republic Act 7160 otherwise known as the Local Government Code of 1991, the Qty Government of Santa Rosa, Laguna ought to pursue programs and projects that promote the welfare of its people;

WHEREAS, taking cognizance of the fact that women and children are more vulnerable to abuses. pursuant to the pertinent laws of our country. notably the Revised Penal Code of the Philippines. SECTION 1. 11JfJ! - This Ordinance shall be known as the Center for Women and Children and Children in Conflict with the Law (CWOCL) Ordinance.

SECTION 2. STATEMENT Of PQUCY AND OBJECTIVES - It is hereby declared as the policy of the Qty Government of Santa Rosa, Laguna to promote the welfare of women and children especially those who are vulnerable to abuses and in conflict with the law. Towards this end, the city Government of Santa Rosa, Laguna shall establish a center under the supervision of the Qty SOcial Welfare and Development Office dedicated for the protection of women and children and children's rights against violence notably, rape, incest, sexual harassment, battery and children in conflict with the law as defined in our nation's pertinent laws. In accordance with this policy, the center shall:

Function as temporary shelter for abused women, children and OCL hereinafter referred to as the patients/dients;

Employ and dispose appropriate resources in the diagnosis, treatment and protection of the patients/dients;

Coordinate with various Government and Non-Government Institutions/Organizations when necessary, to meet the needs of the patients/dients;

Make the patients/dients productive members of the society; and Prepare the patlents/dients for their eventual return and reintegration to their families and the community If they decide to do so.

SECTION 3. Definition of Tenn1 - as used in this Ordinance.

Center - is a residential care facilities that provide an alternative fonn of family care providing 24-hour group living on a temporary basis to indiViduals whose needs cannot be adequately met by their own families and relatives over a period of time.

Patients/Clients - refers to children, youth and women needing special protection, c;are recovery rehabilitation and development.

CICL - refers to Children in Conflict with the Law.

SECTION 4. SSn/kes and Intervent;ons:

Social Services - these are interventions that seek to restore/develop social functioning of the residents from admission to discharge and preparation for family reunification and community reintegration. Case management is in place indicated by the presence of a multidisciplinary team and utiliZing social work intervention which indude , family, group, individual, therapy etc.

Homelife Services · these refer to the provision of basic needs such as food, dothing and shelter and the development of values and appropriate social skills.

Educational Services - these are opportunities for fonnal, non-fonnal and special education in preparation for independent living or discharge from the center.

Health Services · these refers to proviSton for medical and dental examination and treatment : psychological/psychiatric assessment and evaluation as well as special dietary care.

Uvelihood Services · these are activities in preparation for future economic independence and selection of occupation/vocation, e.g. training, income generating projects and on-job training , whenever called for. Recreational and other cultural activities - these are activities that promote the physical , social and cultural development of the residents.

Spiritual Enrichment - these are activities that seek to enhance the moral and spiritual development of the residents.

Legal Services - these refers to work for free legal consultations and if the need arises, a case filled in the court, a lawyer will represent.

SECTION 5. Facilitle, of the Center - Toe Center for Women and Children shall consist primarily of the following entity or facilities :

Administration Building - it is a big building or facilities apart from the cottages of the dients. It Is where the organic staff can be found and where the management takes place. It consist of several rooms and facilities like :

Receiving Room - refers the room intended for admission of the dient. This where the initial Interview and preliminary assessment are being undertaken by the social worker. This is also the orientation room where client is oriented on the agency objective, programs and services, policies and expectations of the center.

Conference Room - it is a facility wherein formal meetings, consultations or dialogue and staff developments are being made by the multidisciplinary team to discuss dient's case, status, problems and plans.

Therapy Room - is a room where a one way mirror is stalled, a new structured model in the operation of women and children CWCICL Center. This is called the interviewing and counseling room. The interview session is conducted by a trained professional social worker whereby the interview process is being heard and seen outside by other member of the multi-disciplinary team without the knowledge of the client. This is to avoid repetitive interview and to observe actual behavior and attitude of the client during interview.

Staff Room - is a room for employed personnel who stayed in the center who rendered services for 24-hours on shifting basis. This Is a separate room for male and female staff specifically for the House Parents and on-call duty personnel.

Multi Purpose Building - is a big hall where different functions can be held:

For outdoor activities like sports, recreation and cultural activities for socialization, cultural and physical development of women and children. It will be done on daily basis.

For seminars and lectures on different topic like self-care on women and children, tights of women and chtldren and other topic focusing on value development , ego building and empowerment , which is done once a week. For spiritual enhancement like bible study, fellowship and mass celebration which is held · once a week for two to three hours.

For group dynamics and group session with women and children done once a week too.

For family visit which is done twice a week.

For program or big gatherings and special event or occasions which is done once a month.

For skills training development on short courses like food processing, meat and vegetable processing , fruit processing, candy making and other forms of skills which they can use for livelihood upon their return to the community.

Cottage - ls one storey - building Intended for the temporary dwelling of the dientele. It is house-like feature with CO'ZY atmosphere. It has four (4) rooms, three (3) rooms for the dient and one (1) room for the staff on duty.

Ideally, each room of the client has the capacity of six (6) dients thus the three (3) rooms has total capacity of eighteen (18) dients.

For Initial operations the target patient/dient for one year is 40, 18-20 patlents/clients for the first six months and another set of it for the next six months . Additional provisions of beddings shall be made In case of more patients/clients coming in.

Relative to the length of stay of dient it will be a maximum of six months to one year, depending upon the progress and readiness of the client and their family. It will be treated and assessed on case to case basis.

Receiving room - after being screened and assessed by the Social Worker from the Administration Building, patient/dlent is accompanied to the cottage receiving room, this Is the place where patient/dient is formally received and is being Receiving room conslst of a sala set, television and some lively decors.

Dining room - the eating room for dientele. It is orderly and cheerfully arranged. Table manners and prayers before and after meal shall be observed. Dirty Kitchen - this is the facility for cooking of the daily menus. Daily menus shall be prepared by the dietitian. Three square meal shall be served. A special meal shall be served during special occasion like Christmas, New Year etc. Cooking will be under the supervision of the cook or a dietitian with the assistance of the dients who will be taught of art of cooking. Complete kitchen utensils will be provided , safety measures will be observed like having cabinets.

Laundry Area - is the lavatory area for dientele. Schedule lavatory shall be observed under the supervision of the House Parent.

Counseling Room - a space intended for direction giving shall be provided to immediately address the problem that may arise in every cottage. A tender loving care shall be the approach In giving direction.

Bed Room - is the sleeping quarters for dientele. There will bw (4) for every cottage, three (3) bedrooms for the dientele and one (1) bedroom for the divided according to age level and tenure of stay of the dient.

staff Room - is for female staff (house parent, Social Worker, Psychologist) who renders duty at night , since the center is a 24-hour service.

Clinic - serves as Isolation room where there is a ready bed for the sick or delivery room for the pregnant dients. It is also a room for primary care treatment . In case of sickness, dient will be immediately treated and given first aid by NURSE, DOCTOR-on-duty or House Parent as the case may be. This is situated inside the cottage so as to be responded at once especially during dawn or wee hours.

The Oty Government property in Barangay Tagapo, near the slaughter site , shall be the official location of the Women and Children Crisis and Children in Conflict with the Law hereinafter referred to as the Center.

semoN 1. Hanpower Requirement

The Qty Social Welfare and Development Office shall design and propose an Organizational Chart or Staffing Pattern for the Center as it sees it fit or appropriate. Provided that, the Center shall be headed by Social Welfare Officer and shall employ the services of Psychologist , two Social Workers , Houseparents and a cook.

Furthermore, the City Health Office shall designate medical specialist, preferably an OBGYNE, Pediatrician and Psychiatrist who will help the Center's personnel in the diagnosis and treatment of their patients/dients as referred in Section 5 of this Ordinance.

Lastly , the Office of the City Attorney shall serve as the primary agency of the City Government in assisting the Center's patients/dients with legal needs as stated in Section 4 of this Ordinance. Hence, the Qty Attorney shall serve as the legal adviser of the Center.

SEaION 8. Funding Requirements

The Center shall initially get its budget out of the mandatory allocation intended for Gender and DeVelopment in the 20% Development Fund of the Qty. Thereafter, such amount as maybe necessary to carry out this ordinance shall be prepared and included In the budget of the Qty Social Welfare and Development Office as a regular appropriation.

SECTION 9, Rules and Requ(atlons

Within two weeks after the effectivity of this Ordinance , the Office of the Mayor or Office of the Qty Administrator (If any) , jointly with the Office of the Qty Social Welfare and Development Office and the Local Committee on Anti Trafficking and Violence Against Women and Children (LCATVAWC) shall prescribe and promulgate rules and regulations as maybe necessary for the proper implementation of this Ordinance.

SECTION 10. Translto,y Proylsion

Until when a new set of employees and officials has been appointed for the smooth and effective operation of the Center, Incumbent specialists and employees in the Santa Rosa Community Hospital in coordination with a Social Welfare Officer of the Qty Social Welfare and Development Office, shall be appointed to temporarily manage , in concurrent capacities, the operation of the Center.

SECTION 11. Repealing aause

All Ordinances and Resolutions as well as the Mayor's Executive Orders and other Issuance's or parts thereof which are inconsistent with the provisions of this Ordinance are hereby · repealed, amended or modified accordingly.

SECTION 12. Se,,arability aause

If any part of this Ordinance Is held invalid, the other parts not affected thereby shall remain valid and effective.

SECTION 13, Effectiylty aause ThiS Ordinance shall take effect upon its review of the Sangguniang Panlalawigan and its publication in at

least one newspaper in province-wide circulation.
