8:55 a.m. Welcome and Announcements

9:00 a.m. The Narratives of Murder. This session will highlight the meaning and functions of narratives and constructing narratives in murder cases. This session will address finding murder narratives in the jury instructions, defenses, and autopsy reports that will support a lesser verdict or begin making the first-degree murder verdict not one of the “worst of the worst.” It will also spell out the risks from narratives that open the door to Rule 404(b) evidence.

10:15 a.m. The Narratives of the Mitigation Case and How Jurors Can Do Their Duty and Still Return LWOP. This session explores various narratives and discusses how to address the nature and sources of the biases that jurors bring into the courtroom that cloud their ability to understand, appreciate, and use capital mitigation. This session shows you how to replace jurors’ preconceptions with an accurate understanding of your client’s life.

12:15 p.m. Lunch

1:00 p.m. Ballistics Primer. Many homicide cases involve firearm and ballistic evidence. Learn more about firearm and ballistic identification including the basics of the process of analysis such as class and industry characteristics comparisons, what a ballistic report shows, spotting ballistic issues, and identifying challenges to law enforcement’s handling procedures.

2:00 p.m. Focus on Evidence. Recurring and novel evidence issues in capital case litigation.

3:15 p.m. The Defendant’s Right to Tell His Story. The U.S. Supreme Court held in McCoy v. Louisiana that a defendant has the right to choose the objective of his defense and insist that his legal counsel refrain from admitting guilt. How will this decision apply to the critical elements of an offense, pieces of evidence, and other case strategies? Which issues are sufficiently important to warrant a new trial if a lawyer disregards his client’s wishes? This discussion will analyze the impact of McCoy on defense counsel’s experienced-based view on strategy and when it is trumped by the defendant’s decisions.
