EXPLANATORY NOTE

The scourge of illegal d ru g s c o n tin u e s to p lague o u r co u n try . The n u m b e r of

d ru g d ep e n d e n ts h a s co n tin u ed to rise even w ith th e e n a c tm e n t of th e

C om prehensive D an g ero u s D rugs Act of 2002 . A ccording to th e D angerous D rugs

B oard, m ore th a n 4 .74 m illion p e rso n s in th e co u n try , or 6.1 p e rcen t of th e

po p u la tio n aged 10-69, have u se d illegal d ru g s a t le a st once in th e ir lifetim e. W hat

is m ore a la rm in g is th e in c rease in p revalence ra te to 2 .3 p e rce n t - rep re sen tin g

1.76 m illion ind iv iduals - from 1.8 p e rce n t or 1.3 m illion d ru g ad d ic ts in 2012 .

S ta tis tic s now show ev iden tia ry proof of th e d ep en d en ce a n d proclivity of o u r

co u n try m en to d ru g s. The rep u g n an c y of th is trad e by th e sh ee r n u m b e r an d

s ta tu re of th o se involved is chilling. O u r re so u rc e s a re lim ited in fighting th e en try

of d ru g su p p lie s from b ack d o o r e n try p o in ts , an d th e se lim ita tio n s a re fu r th e r

ex acerb a ted by b la ta n t co rru p tio n am ong th e ra n k s of police en fo rcem en t

p e rso n n e l tagged a s p ro tec to rs of th e trad e . The pro liferation of illegal d ru g s h a s

becom e even m ore w id esp read a n d ing ra in ed in n ic h es of th e y o u th , in th e eche lons

of th e rich , an d am ong o u r pow erful po litic ians.

Before th e faith of o u r people in governm en t is com pletely eroded , a n d th e

t r u s t in its ability to m a in ta in peace a n d o rd er is to tally u n d e rm in ed , it is

in c u m b e n t th a t we re-im pose th e d e a th p en a lty u p o n th e pow erful people a t th e

top w ho b ring in a n d d is tr ib u te large a m o u n ts of illegal d ru g s - th o se w ho en rich

them se lv es w ith b la ta n t d isreg ard to th e d is a s tro u s co n seq u en c es of th e grow ing

d ru g trad e , h ap p y to c o rru p t th e m o st e ssen tia l fib res of Philipp ine society for th e ir

d isg u s tin g p e rso n a l gain.

T his bill p rovides a q u a n tita tiv e s ta n d a rd in serv ing o u t th e p en a lty of d ea th

only to th o se people resp o n sib le for th e d is tr ib u tio n of illegal d ru g s in th e a m o u n ts

specified in th e provision h e re u n d e r. T hese people peddle, in d u ce a n d co rru p t th e

innocence of o u r y o ung a n d prey u p o n th e w eak to a b u se th e ir bodies. Let u s show

sh a ll be confisca ted a n d esch ea ted in favor of th e governm ent:

m a n u fa c tu re of any d a n g e ro u s d ru g REGARDLESS O F TH E QUANTITY

AND PURITY O F TH E DRUGS INVOLVED.

T he p en a lty of im p riso n m en t ran g in g from twelve (12) y ea rs an d

one (1) day to tw enty (20) y ea rs an d a fine ran g in g from O ne h u n d re d

th o u sa n d pesos (PIOO.OOO.OO) to [Five h u n d re d th o u san d ] TEN

The p resen ce of an y con tro lled p re c u rso r an d e sse n tia l chem ical

or lab o ra to ry eq u ip m en t in th e c lan d es tin e la b o ra to ry is a prim a facie

proof of m a n u fa c tu re of any d a n g e ro u s d rug . It sh a ll be co n sidered an

aggrava ting c irc u m sta n c e if th e c lan d es tin e lab o ra to ry is u n d e r ta k e n or

e s tab lish ed u n d e r th e following c irc u m stan c es :

(a) Any p h a se of th e m a n u fa c tu r in g p ro cess w as co n d u c ted in th e

p resen ce o r w ith th e help of m in o r /s ;

16 from th e approval of th is Act, th e S ecre tary of J u s t ic e sha ll p ro m u lg a te th e

17 n e c e ssa ry ru le s a n d reg u la tio n s for th e effective im p lem en ta tio n of th is Act.

18 SEC. 9 . S e p a ra b il i ty C lause . - If an y provision o r p a r t of th is Act is

19 dec lared invalid or u n c o n s titu tio n a l, th e rem a in in g p a rt or p rov isions no t affected

20 shall rem ain in full force a n d effect.

21 SEC. 10 . R e p e a lin g C lause . - R epublic Act No. 9346 is hereby repea led or

22 am en d ed in so far a s it p ro h ib its th e im position of d e a th p enalty for th e crim es

23 provided in th is Act. All o th e r law s, ru le s , reg u la tio n s , o rd ers , c ircu la rs , an d o th e r

1 is su a n c e s o r p a r ts thereof, w hich a re in c o n s is te n t w ith th e p rovisions of th is Act

2 are hereby repealed , am en d ed or m odified accordingly .

3 SEC. 11. E ffec tim ty . - T h is Act sh a ll ta k e effect fifteen (15) days a fte r its

4 p u b lica tio n in a n ew sp ap er of genera l c ircu la tion .
