This was the 11th con- secutive month, when equity mutual funds wit- nessed an inflow. Moreover, mutual fund houses are upbeat about inflow into equity schemes for the remaining part of the current fiscal, ending on March 31. According to the latest update available with Association of Mutual Funds in India (AMFI), equity funds saw net inflow of Rs 5,850 crore in January as compared to Rs 6,057 crore witnessed in the preceding month. The latest inflow takes the total fund infusion in equity MF schemes to Rs 55,872 crore at the end of January 31. Industry officials said equity markets have deliv- ered positive returns and that has attracted retail investors into such schemes. jections showing a clearvictory for it, top leaders ofAAP on Sunday deliberat-ed on the possible politicalscenario besides analysingthe party's performance inthe Delhi Assemblypolls.

Speaking at a meeting athis Kausambi residence,AAP chief Arvind Kejriwalcomplimented all the lead-ers and party volunteers fortheir hard work andexpressed confidence offorming the government.

The party's CampaignCommittee took stock ofthe possible political sce-nario once the results areannounced on Tuesday, aparty leader said.

Manish Sisodia, SanjaySingh, Kumar Viswas andAsish Khetan were amongthose present in the meet-ing that began around?2.30pm and lasted for aroundone hour.

"It was a generalpreparatory meeting. Themeeting analysed the elec-tions, took stock of the sit-uation and micromanage-

between BJP and AAPappears to be neck toneck in Delhi Assemblypolls, an SAD MP PremSingh Chandumajra onSunday said he does notsee clear majority forany party in the high-stake elections.

"The electoral battle(between BJP and AAP)appears to be neck toneck and the exit pollresults are also indicat-ing the same. I do notsee clear majority forany (political) party, the

kind of situation wehave in Delhi,"Chandumajra toldreporters here today atPGIMER campus.

Responding to queriesthat exit polls gave anedge to AAP, the SAD(Badal) GeneralSecretary said the partywas a temporary phe-nomenon. SAD has con-tested the DelhiAssembly elections inalliance with BJP in fourseats.

While ManjinderSingh Sirsa contested onSAD symbol from

Rajouri Garden con-stituency, HarmeetSingh Kalka (Kalkaji),Jitender Pal SinghShanty (Shahdara) andAvtar Singh Hit(Harinagar) contested onBJP's symbol.

Asked about the per-formance of SAD candi-dates, Chandumajra saidSirsa and Shanty wouldsurely win.

"But there is a fight ontwo other seats - Kalkajiand Harinagar," hesaid.

In the last Assemblypolls in Delhi, two can-

didates fought on AkaliDal symbol and two onBJP symbol.

"We cannot dismiss the exitpolls. If these turn out to betrue, it will be a matter ofconcern for us," Maken said.

Exit polls released afterSaturday's voting for the 70-member assembly said theCongress could slide furtherfrom the low it recorded inthe 2013 assembly electionswhen it won only eight seats.

The exit polls said the AamAadmi Party was likely to getanywhere between 31 and a

staggering 54 seats and theBharatiya Janata Party could

bag 17 to 35 seats.They said the Congress,

which ruled Delhi for 15years till December 2013,would be routed, winning noseat or at best four seats.

Votes will be counted Feb10.

Based on feedback fromworkers and candidates,Congress leaders said theywere expecting to win 12 to15 seats. However, the exitpolls dampened the moodwithin the party.

With two days left for the countingof votes, the BJP exuded confidencethat it will win, citing the narrow gapbetween its and AAP's vote shares inyesterday's exit polls after the conclu-sion of voting.

The meeting was held at the party'sstate headquarters and was attendedby BJP Delhi Unit chief SatishUpadhyay, party General Secretary(Organisation) Ram Lal, Delhi BJPin-charge Prabhat Jha, party's chiefministerial candidate Kiran Bedi andconveners of the Assembly con-stituencies and all the candidates andother leaders.

"All our constituencies wereanalysed, evaluated during the meet,and based on that we forecast thatBJP will form a government in Delhiunder the leadership of Kiran Bediji,with a comfortable majority,"Upadhyay told reporters after themeeting.

He, however, did not speculate howmany seats the BJP will get in the 70-member Assembly.

BJP's National Secretary SrikantSharma expressed confidence that theparty will emerge victorious.

"We are confident of our victory.Even in the exit polls, the projected

vote share gap between us and AAPis very narrow. We will win," hesaid.

BJP spokesperson G V LNarasimha Rao claimed that the exitpolls were favourable to AAPbecause AAP voters are vocal unlikethose of the BJP.

The real story lies in the projectionof vote shares of the different party,he said.

"These polls show a very narrowgap of only 5-6 per cent (vote share)between AAP and BJP.. .Had the gapbeen very wide, it would have been

very different to look for any otheroutcome, in what has been project-

ed," he said, adding, AAP has a "veryvocal and very noisy support base,open support base."?

Upadhyay said the ground realitiesfor each of the constituencies wereassessed based on people's feedbackand assessment of candidates fortheir respective seats.

"A survey is always a survey. Also,I think we need to wait for the 10thfor the final result. Because in someAssembly seats the margin is veryless. So it could swing any way,"Bedi said when her response wassought by reporters.

dicted a majority for the AAPin the Delhi Assembly polls,BJP leader SubramanianSwamy on Sunday said thatCongress' votes got transferredto the Arvind Kejriwal-ledparty.

"There are too many localreasons (in Delhi assemblyelection)... However, those aremerely predictions of exitpolls. We are yet to see the dif-ference between percentage ofvote-share... But the main rea-son was that Congress wasnowhere in the scene.Congress' votes have beentransferred to AAP," Swamysaid during his visit to a col-lege at Ankaleswar town inGujarat.

He added that during the1971 and 1980 Lok Sabhaelections Congress won major-

The workers ofvarious political party will be allowed inthe counting halls Tuesday when resultsfor the 70-member Delhi assembly will beannounced, said officials. "It is a three-tiersecurity for the EVMs. The machines havebeen kept inside the strong rooms made innine districts," said an official of theElection Commission. "Each strong roomis guarded by the Central IndustrialSecurity Force (CISF) personnel, armedpolice and the local police," the officialadded. The counting will begin at 8 a.m.Tuesday and it will be video graphed. Theparty workers will be allowed at the count-ing centres only on the counting day, headded. Delhi saw a voter turnout of 67.14percent during polling in the 70 assemblyconstituencies Saturday. A total of 11,763candidates contested the elections.

MetropolitanMagistrate Monika Sarohaabsolved the man, a resi-dent of south Delhi, of theoffence of molestationunder Section 354 of theIPC as the woman deniedthe incident in the court.

"The complainant totallyturned hostile and did notsupport the prosecutionstory at all. She only statedin the witness box that onthe day of the incidentnothing has happened withher. She even denied hav-ing made her statement tothe police," the court said.

AAP confident...poll surveys have given a clear majority in

the 70-member Delhi assembly to the AAP,which fought a tough battle as it took onPrime Minister Narendra Modi's BJP.

If the AAP wins, it would be seen as a blowto Modi, who took on Kejriwal vocally inelection rallies.

The mood in the Bharatiya Janata Partywas clearly subdued but senior leaders put upa brave face, saying they were hopeful ofedging out the AAP.

BJP's chief ministerial candidate KiranBedi met party leaders to review the election.Satish Upadhyay, president of the BJP'sDelhi unit, said the party was confident offorming a government.

"I am not commenting on the exit polls butwe are confident of winning the election andforming a government under Bedi's leader-ship," Upadhyay said.

BJP leader and central minister NirmalaSitharaman met Bedi and echoed Upadhyay'ssentiments. "We are hopeful we will win.

Asked about Bedi's comments that shewould take the blame if the BJP lost,Sitharaman said: "She has given her personalview."

In contrast to the subdued glee in the AAP- Kejriwal told his activists to relax until thevotes are counted Tuesday - and the BJP'sfervent hopes that the exit polls are wrong,the Congress was shattered.

Exit polls said the Congress, which ruledDelhi for 15 years until December 2013,would be wiped out or at best get four seatsout of the 70. The Congress won eight seatslast time.

A senior party leader said on the conditionof anonymity: "If the exit polls are correct, itwill be a matter of concern for us."

On polling day Saturday, Congress presi-dent Sonia Gandhi made no claim that herparty would win. In a tacit admission ofdefeat, she said: "Whatever people desirewill happen."

The Delhi election saw a record voterturnout of 67.14 percent, according to theElection Commission. At some places votingwas allowed even after 6 p.m. as voters hadalready entered the polling premises.

The AAP cornered a stunning 29.64 per-cent of all votes in 2013 to win a stunning 28seats. This led to a 49-day Congress-backedAAP government.

Its vote share in the Lok Sabha election lastyear went up to 33.08 percent although itcould win none of the seven parliamentaryseats in the capital.

Exit polls said the AAP could now end upwith 41-43 percent of votes.

Today's Chanakya exit poll said all majorsegments -- Dalits, Banias, Brahmins, OBCs,Muslims and Punjabis -- voted more for theAAP than the BJP.

This despite the fact that BJP's Bedi, aPunjabi, was expected to attract most Punjabivotes.

wait for results to be declared on Tuesday.Meanwhile, Union minister and senior BJP

leader Nirmala Sitharaman today met party'schief ministerial candidate Kiran Bedi at herresidence here. "We will talk after the resultscome out on 10th. We're hopeful that theresults will favour us," Sitharaman toldreporters after her meeting with Bedi.

Sitharamam said Bedi's statement that shewould take "full responsibility" if her partysuffers a loss was her individual statement."She is the CM candidate and that statementis her own. She is being upfront about it," theMinister said, PTI reported.

The BJP's Delhi unit chief SatishUpadhyay also said the party will win by acomfortable majority in the Delhi Assemblyelection under the leadership of Kiran Bedi.

Speaking to reporters after a review meet-ing on the BJP's performance in yesterday'selection, Upadhyay said the party will formthe next government in Delhi.

"We will win by a comfortable majorityunder the leadership of Kiran Bedi and formthe next government in Delhi," Upadhyaysaid. Kiran Bedi, 65, a former top cop, joinedthe BJP and politics last month and withinfour days was named the party's presumptivechief minister of Delhi. The annointment ofBedi as the CM candiadate was considered asa masterstroke to counter Arvind Kejriwal.

But, if exit poll results turn true, victory forKejriwal would mark a stunning comebackfor the anti-graft champion who resigned fol-lowing a chaotic 49-day spell in charge of theDelhi state government a year ago.

However, observers say a defeat for BJPwill be a significant setback for a PrimeMinister Narendra Modi who has enjoyed anextended honeymoon with voters since hislandslide General Election victory.

PM Modi needs to win state elections incoming years to gain control of both housesof the national parliament, where he isattempting to push through reforms on landacquisition, tax and other issues to revive theeconomy. All seven exit polls predictedanother humiliating loss for the Congressparty. "The existence of domestic relationship isdependent upon subsistence of marriagebetween the parties and upon the fact thatthey had lived together in a shared householdand at present, they are living in the samehouse, though on different floors. Therefore,I do find existence of domestic relationshipbetween them," it said.

While noting that due to the dispute exist-ing between the parties, the woman needsprotection order, the court remanded back thematter to the trial court to decide the modali-ties for her protection as per law and theamount of maintenance.

"The appellant would be entitled to mainte-nance order as well as for protection orderagainst her dispossession from 1st floor ofproperty and from disconnection of electrici-ty connection," the court said.

The woman, a Delhi resident, had filed acomplaint seeking maintenance from herhusband claiming herself to be without anysource of income and alleging cruelty anddesertion by him.

Talking about challenges posed by terror-ism across the globe, he cited the horrifickillings in Syria, France and in a Peshawarschool and said international communitymust assert itself and take concerted anddetermined action against terrorism of whichIndia is one of the oldest victims.

"Terrorism is today an industry of evil. It isnot just a threat to peace and security but anattack on humanity as a whole and civilisa-tion as we understand.... The internationalcommunity must assert itself and tackle theproblem by taking concerted, coordinatedand determined action," he said.

The President stressed that this great chal-lenge to human values should be faced firm-ly and squarely through international cooper-ation and efforts should be made to mobilisethe world to take concerted and determinedaction against the menace.

Equity mutual...change in sentiment over the past few

months, especially after the general election'sverdict in May. We are witnessing a trendwhere more and more investors are comingback into financial assets. Positive invest-ment returns also attracted investors intoequity segment," said an industry official.

This inflow has helped the mutual fundindustry to reach nearly Rs 12 lakh croremark in assets under management (AUM) atthe end of January.

The inflow in equity funds is in line withthe BSE's benchmark Sensex surging by 30per cent in the first 10 month of the currentfinancial year.

After witnessing an outflow in March,equity mutual fund started the financial yearon a positive note and inflow in such fundsincreased in May due to change in sentimentsupported by the general election's verdictand the inflow continued till January.

Mutual fund is an investment vehicle witha pool of funds collected from investors tobuy securities such as stocks, bonds, moneymarket instruments and similar assets.

But the BJP`s vote share zoomed to 46.63percent, or more than 13 percent over theAAP`s, in the 2014 Lok Sabha election whena "Modi wave" helped it to win all seven par-liamentary seats in Delhi.

Saturday`s exit poll findings show theBJP`s vote share may have dropped to 34-37percent, indicating a large-scale shift of vot-ers from that party to the AAP since the LokSabha battle.

The Congress was ousted from power in2013 after 15 years but still got 24.55 percentof all votes. This dropped precariously to15.42 percent in the Lok Sabha polls when itwas routed.

The ABP News-Neilsen poll yesterday stillgives the Congress 15 percent vote sharewhile the News24-Today`s Chanakya pollput it at 13 percent.

Walking past the twinklingChristmas shop windowsof downtown Würzburg,

Germany, a very old and respectedUniversity town, I stumbled on somepavement stones. Pavements inadvanced capitalist countries such asGermany are not the treacherousspaces they are in India where timewounds all heels. Instead, ease ofpassage through the city is a goal towhich such municipalities are strong-ly committed. My stumbling wasclearly meant to disrupt the pleasuresof window shopping, and make thefaces that were lifted up to the warm,inviting glow of the shop window tolook down at the minor irritation thatimpedes movement.

I found a few unevenly set brasstiles, each inscribed with the name ofa Jew who had been deported to theconcentration camp at Auschwitz in1938. It was the municipality’s wayof not only honouring the memory ofthese Würzburg residents but of com-memorating the trauma of the holo-caust. Never again will there be sucha tragedy, but only if we never forget.

Such “negative commemoration”of the past recognises the dangers offorgetting, rationalising, or explain-ing away historical wounds. In a citylike Würzburg, the “negative com-memoration” goes alongside thegreat pride in the palaces, churchesand chapels that dominate thecityscape. The achievements of theCatholic Church, of which theMarienberg Fortress, the Universityand the religious monuments are tes-timony, proclaim the power and gloryof the medieval Prince Bishops —though no equivalent commemora-tions exist of the 8,000 peasants whowere killed in the Peasant War of1525. Or of 6-800 women in the 17thcentury witch trials. Both kinds ofcommemoration, negative and posi-tive, require the work of professionalhistorians, and more important, anopenness to the sense of the past. Toone history, you lift your head up, tothe other kind of commemorationyou bow your head in shame.

Historical memory

In a vast and heterogeneous sub-continent like India, history has apublic life which is large and farmore vivid than the practice of aca-demic historians. Historical memoryis continuously made and remade inthe public life of India, often with no

reference to what is taught, learned,researched and communicated inscholarly writing, classes, textbooksand so on.

Yet, like all complex and agingsocieties, there may be much in ourpast that makes our hearts swell withpride, as much as there are aspectsthat would make us squirm in dis-comfort. In order that historians arenot turned into court poets, one mustbe open to both possibilities in thepast.

Of late, we have had a loud and res-onating demand for a “glorious past”which will brook no interferencefrom mere academics, naysayers,critics and practicing historians. Asurfeit of certainties based on asser-tions, facts, rumours, authentic and

spurious Sanskrit texts, dubious andactual archaeological knowledge, etc.have flooded our public life and baf-fled our historical sensibilities.

Why is this latest demand for a glo-rious past deeply unsettling? Because

it comes from those who have noth-ing to learn from history or itsmethod, since the answers arealready known, sturdily built aroundthe question of Hindu pride. All theyrequire is the endorsement of the pro-fessional historian, who must provide“evidence” to fit pre-given conclu-sions.

Let us not repeat the comical sug-gestions about ancient Indians’knowledge of plastic surgery, aerody-namics, and gene theory. They arealready passing into the Indian com-monsense, if the new brochure ofBajaj Capital, which even presents anornamented toy aircraft as illustra-tion, is anything to go by.

The history of science is a seriousspecialisation to which I can lay no

claim. But I would like to illustratethe way in which Indian historiansnow practice their craft by using oneexample. History writing in India,over the last three decades at least, isless and less about countering fictionwith fact, and instead emphasises

process and context. My example isfrom the very well-known achieve-ments of the Madhava school ofmathematics, founded in the late 14thand early 15th centuries, whose bril-liant discoveries of trigonometrywere transmitted to his students andfollowers orally. As David Pingree,the well-known historian of science,has painstakingly showed, this dis-covery of the sine and cosine (power)series preceded Newtons’ — com-piled in 1669 — by at least two cen-turies. Now, we could bask in thatglory, or we could, as historians inter-ested in socio-economic processes,embed this intellectual history byasking questions. Why were the dis-coveries of the Madhava school con-fined to a small quadrilateral areabetween Calicut and Cochin: theVatasseri illam, Allattur, (to which

Paramesvara and Damodarabelonged) Kelallur illam inTrkkantiyur (to which Nilakanthabelonged) Parannottu illam ofAllattur (to which Jyesthadevabelonged) and Irinjalakkuda (fromwhere Madhava hailed)? Why was

their work not known to a largerworld until it was described in 1823by Sankara Varman and by C.M.Whish in 1830? How come theschool included Sankara, anAmbalavasi (generic name for a col-lection of castes among Hindus inKerala), who was the most importanttextualiser of the oral transmissionsof this parampara of Madhava — apeculiar feature only of the Keralasocial structure, when science wasdominated by Brahmanas elsewherein the pre-modern subcontinent?Why, despite their brilliance, did thisknowledge not trigger the kind ofrevolution set off by Newtonian cal-culus?

Pingree’s paper thus paves the wayfor an enriched history of science,though he enigmatically concludes

“Madhava’s achievements loom evenlarger when one considers that hewas operating with a tradition thatneither encouraged not valued hiswork.” Our search for answers willtake us to the histories of caste, fam-ily forms, agrarian structures, and thepurpose of cryptic knowledge inmedieval India. These are not thequestions that our warriors who wanta control of the past would like totake.

Ambiguous glories

The call for a glorious past alsocomes at a time when “the peopleswithout history” — notably Dalits,women, autochthonous groups —make a robust political claim to prac-tices which may tell us about the pastand all its ambiguous glories.Mahadeva Shankanapura calls for thebuilding of “imaginative truths” outof the Manteswamy andMalemadeshwara performance tradi-tions which are practices in contem-porary Karnataka, as a way of deal-ing with the paucity of sources for aDalit past. Only from making senseof such sources might we addresssome of the historical wounds whichhave been inflicted by those veryelites who produced the texts andinscriptions of which we may bearguably proud, and not brush asidethe conditions under which suchachievements were made possible.

At such a time, it is necessary tocall, not for a reassertion of a “scien-tific temper” among historians, but anewly imagined Indian “historicaltemper” with its own rules and proce-dures of knowledge production. Sucha history would acknowledge thenecessity of respecting alternativeversions of the past, rooted in evi-dence and material life, rather than asingular historical truth that “disci-plines” unruly and difficult memo-ries. The process may be risky, butthe time is ripe for propagating sucha historical temper.

Union Home SecretaryAnil Goswami’s removalfrom office is a bold

move by the government andwill be welcomed by all thosewho stand for an independentCentral Bureau of Investigation(CBI) — one that is allowed todischarge its functions freelyand fearlessly. Prime MinisterNarendra Modi and HomeMinister Rajnath Singh deserveto be complimented for theirswift decision. From allaccounts, the act was not capri-cious; they chose to probedeeply into allegations that wereswirling around in the NewDelhi circles over the past fewdays before sacking Mr.Goswami. It is believed that theCBI Director produced enoughmaterial evidence to prove theimpropriety of the HomeSecretary in trying to stall thearrest of former Union MinisterMatang Sinh in connection withthe Saradha Scam. Mr. Sinh waswidely known to be influential,even after the UnitedProgressive Alliance govern-ment lost power at the Centre.This time, however, he ran outof luck while trying to intimi-date the CBI. Mr. Goswami andMr. Sinh are said to have knowneach other for several years.Obviously Mr. Sinh had calledthe Home Secretary to save him-self the embarrassment of anarrest by the CBI, and it is likelythat their conversation wasrecorded.

Unmitigated impropriety

Thereafter the facts becomeslightly fuzzy. The rumours onthe grapevine are that Mr.Goswami called some seniorCBI officers (probably not theDirector himself) to plead hisfriend’s case. The officers spo-ken to by the Home Secretarythereafter conveyed this to theDirector, who in turn promptlybrought the whole episode to thenotice of the Home Minister andthe Prime Minister. It is still not

known whether the HomeSecretary acted on his own afterknowing that his friend was indistress or he was a mere con-duit through which some politi-cal bigwig — now not in power— was trying to save Mr. Sinh.The truth may never come out.In any case this was unmitigatedimpropriety on the part of a very

senior civil servant who is cul-pable to the core.

Mind you, the charges againstMr. Sinh were not ordinary. Hewas being probed for seriouscriminal misconduct which mer-ited an arrest and a custodialinterrogation. It was for the CBIto make up its mind on this, andwhatever it did was to bereviewed only by the courts andnot by anyone else, including theexecutive. I am happy that thegovernment lost no time in act-ing as it did.

In my view, Mr. Goswami’sindiscretion (to put it mildly)was both artless and unethical.

He has justifiably paid a heavyprice. The episode sends theright signal to both senior offi-cers and non-officials in highplaces that they will come togrief if they ever try to deflectserious criminal investigationsundertaken by the country’shighest law enforcement agency.I laud the current CBI Director

for having brought the facts tothe government’s notice. Thenormal tendency would havebeen to suppress such interfer-ence in CBI matters, especiallywhen the person meddling iseither a Minister or a senior civilservant.

Not many may know that theHome Secretary is a powerfulentity in the capital and can playwith the careers of senior policeofficers. Many senior officersgenuflect before him for routinefavours. It is true that many inMr. Goswami’s position in thepast had been great leaders andmen of the highest integrity. But

it is equally true that there havebeen a few aberrations — therehave been erratic and egoisticofficers who have abused theirproximity to centres of poweronly to promote the cause ofsome favoured unscrupulouspolicemen, while at the sametime destroying the careers ofthe not-so-unbending.

My own experience was notvery pleasant; I had to deal withsomeone who chose to flouteven what the Home Ministerhad granted the CBI by way ofinfrastructure support. I pre-sumed he had a hang-up as far asthe CBI was concerned, and hehad to constantly settle scoreswith the organisation by denyingit the support it required. Weneed a powerful Home Minister,both knowledgeable and plod-ding, and who will hold theHome Secretary to account, asMr. Singh has done.

Not many know that the CBIis part of the Department ofPersonnel and Training whichworks under the Prime Minister.The Home Ministry is mainly afacilitator which lends supportto the CBI in the form of man-power, especially by providingIndian Police Service officersborrowed from various States.Otherwise it has no authorityover the CBI, especially in mat-ters of anti-corruption work.(With respect to conventionalcrimes, the Ministry transferscases received at the instance ofStates to the CBI or the NationalInvestigation Agency for inves-tigation.)

The CBI Director’s adminis-trative head is the PrimeMinister and no one else. (Thisis a legacy of Prime MinisterIndira Gandhi who brought theagency under her control aftermoving it out of the HomeMinistry. The objective was notexactly honourable.) That thePrime Minister is the controllerdeters many Ministers and civilservants from interfering in the

agency’s investigations. If theCBI Director keeps the HomeMinster informed of certainbroad developments, it is purelyas a matter of courtesy and cer-tainly not as mandated by busi-ness rules. In my opinion, this ishow it should be to avoid differ-ing signals from being sent tothe CBI.

Need for introspection

The CBI undoubtedly emergescredible from the unseemlyepisode. It has also becomestronger with the knowledge thatno one will dare to dictate termsto it in future. It is exactly thissituation that calls for seriousintrospection on the part of theCBI leadership as to whether itdeserves this majesty in thebureaucracy. CBI critics — thereare far too many — would saythat the organisation does notmerit this kind of power or influ-ence. The CBI Director and histop leadership have, therefore, ahuge responsibility to ensurethat their investigators do notrun amuck. This is especiallywith regard to arrests of accusedor suspects. The authority isenormous. It has to be exercisedhumanely, and with great careand caution. A hasty and unjusti-fied arrest brings in moreignominy to an agency, especial-ly at a time when it has suffereda leadership crisis. Two of itschiefs are under a cloud, and it isnot known how the governmentis going to deal with them.

The cliché “Caesar’s wifeshould be above suspicion’comes readily to my mind.Internal vigilance should be thewatchword. Any failure on thepart of the Director or his lieu-tenants to insist on the higheststandards of integrity for them-selves and for their ranks will beunpardonable. The loser fromthe CBI’s sloth and connivancewith the corrupt will ultimatelybe the aam aadmi.

The release on parole of a high-profile apartheid-erapolice officer convicted on 89 charges and sentenced to212 years in 1996 is yet another reminder of SouthAfrica’s struggle to balance justice with reconciliation.The overriding imperative of securing peace and stabili-ty between the once brutally oppressed majority blackcommunities and their erstwhile Afrikaner white minori-ty rulers underlay the constitution of the Truth andReconciliation Commission (TRC) in 1994. Its visionentailed the avoidance of the potentially tortuous courseof divisive prosecutions and the award of amnesty for allthose who would come clean during public confessionsbefore the TRC. Notably, the grant of amnesty was to beexamined equally for those complicit in politically moti-vated crimes perpetrated against the white supremacistregime, as well as those in defence of apartheid rule.Although about 1,000 security personnel and othersadmitted to brutalities they had committed againstactivists of the African National Congress, just oneCabinet Minister pleaded guilty. A former apartheid-rulePresident, whom a court had implicated for unlawfulacts, refused to testify. Another former President neversought amnesty, pleading ignorance about atrocitiescommitted by the regime. “Prime Evil”, as Eugene deKock was described, is now to be released after 20 yearsin jail. But the 66-year-old convict is not the first of hisilk to be set free. The grant of amnesty in 1996 to a toppolice official within less than five years of the start of alife term was seen by critics as an attempt by the TRC toencourage others to atone for their crimes. Another deci-sion to pardon a notorious killer was surrounded byquestions about the veracity of the confessions. Such hasbeen the chequered history of bringing closure to pastwounds. A perception that he was made a scapegoat foractions authorised by political higher-ups, as well as hisexpression of genuine remorse to the relatives of victims,have influenced the grant of parole to de Kock. Thequestion of the nature of activities that should qualify forpardon was controversial in the aftermath of the releaseof Nelson Mandela and the restoration of democracy inthe 1990s. The ANC had insisted that guerrillas chargedwith crimes in the armed struggle against white minorityrule were also eligible. On the eve of the TRC hearingsin 1996, there was even a legal challenge from the kin ofsome of the victims arguing that they could not be deniedthe right to settle disputes in a court of law. To balancejustice with reconciliation is akin to making a choicebetween reason and emotion. There is much to learnfrom South Africa on this.

Meanwhile, Janata Dal(United) leader SumitKumar Singh said thatthe supporters of JitanRam Manjhi were feel-ing `threatened`.

"We are being threat-ened about the conse-quences of supportingManjhi ji. To show amajority we have tocome on the floor andwe will make sure thatwe prove it there," saidSingh.

Fellow JD (U) leaderGS Gyanu echoedSingh`s statement,adding that there is nochance for Nitish Kumarto be the chief minister.

Nitish, who was elect-ed as the leader of JD(U) legislature party at aparty meeting held in

Patna yesterday, isexpected to stake claimto form a new govern-ment in the state later inthe day.

On Saturday evening,Manjhi called a meetingof the state cabinet,which authorised theChief Minister to recom-mend the dissolution ofBihar Assembly. But thismove was stronglyopposed by 20 ministersloyal to former CMNitish Kumar.

Manjhi claimed he isauthorised to take adecision on dissolutionof the assembly.

Manjhi, who hasrefused to step downfrom his post, had yes-terday written a letter tothe Bihar Governor and

requested him not toaccept the recommenda-tions made by the JD(U) legislature partymeeting headed bySharad Yadav.

He also urged theGovernor to remove 15ministers from theirposts with immediateeffect.

Adding a new twist tothe entire controversy,20 ministers on Saturdaynight sent their resigna-tion to the Governor insupport of Nitish.

Meanwhile, Manjhi isexpected to call onPrime MinisterNarendra Modi at thelatter`s official 7, RaceCourse Road (RCR) res-idence later in theday.

"States should be givenmore power to carry outchanges in centralschemes as per regionalneeds," a press releaseissued by the state gov-ernment quoted the chiefminister as saying duringthe meeting. Singh alsostressed on the need forproviding constitutionalstature to NITI Aayogand strengthening of

inter-state council.He said good and effec-

tive schemes of any stateshould be implementedin all the states and thosegenerating no results

should be stopped. Singhalso urged the Aayog toprovide additional fundsto states for startingd e v e l o p m e n tschemes.

Speaking on the subjectof 'innovation and knowl-edge hub', he said itshould be given the statusof a permanent institutionor a commission.

"With national andinternational experts asits members, the institu-tion should work as a pol-icy making laboratoryand advise states and thecentral government ondecision making processand collection ofresources on the basis ofpast experiences," theChhattisgarh CMsaid.

Singh, a former minister, said RJD hasbeen championing social justice from the begin-ning and "going against Manjhi would not godown well with the people." cops for allegedly assaulting mediapersonnel who were covering astand-off between authorities andself-styled 'godman' Rampal inNovember last year, police said onSunday. The two constables -Dharampal and Chander Singh -were arrested yesterday and laterreleased on bail by a local court,police said.

The duo was arrested after theywere recognised using canes on themedia personnel without provoca-tion in video footage of the episode,police said. While Dharampal isemployed with Haryana police andis posted at Bhiwani, ChanderSingh is working with ParaMilitary Force, police said. Thepolice action on journalists cover-ing the stand-off between authori-ties and self-styled 'godman'Rampal was "unprovoked" and"pre-meditated", a media panelrecently said, recommending ajudicial probe into the incident.

The panel, set up by theBroadcast Editors' Association(BEA) to look into the incident, has

recommended probe by a SupremeCourt judge into the alleged assaultby police on the journalists atBarwala in Hisar district inNovember last year.

In its report, the three-membercommittee had concluded that thepolice action against media personswas "unprovoked" and "pre-medi-tated". It had said the police hadacted against media persons as theauthority did not want the use offorce against women and kids to berecorded by the media and showingit on channels. The BEA, a bodywith editors of leading news chan-nels as its members, had constitutedthe panel shortly after the incident.

In its report, the committee saidthat it had met Haryana ChiefMinister Manohar Lal Khattar,police officers, and also talked tothe local villagers.

The report added it found that notonly the victim journalists but alsopolice officers were categorical intheir assertions that there was noprovocation from or causing offunctional impediment from theside of media persons with regardto police operation.

Ahead of the Panaji assembly bye-election, the Congress has complainedthat Defence Minister ManoharParrikar has allegedly violated themodel code of conduct twice, whichincludes announcing the possible set-ting up of a helicopter manufacturingunit in Goa.

In its complaint to Goa`s chief elec-toral officer (CEO) Sunday, theCongress has alleged that the formerchief minister has also violated thecode of conduct Feb 5 by announcingthe inclusion of Panaji in the LightEmitting Diode (LED) bulb distribu-tion scheme launched by PrimeMinister Narendra Modi.

"On Feb 6, while addressing the GoaInvestment Summit 2015, Parrikardeclared that he has plans to set up ahelicopter manufacturing unit in Goa...On Feb 5, while campaigning for theBJP candidate, he managed to get

Panaji placed under the scheme for theLED bulb distribution," Congressorganising secretary Durgadas Kamatsaid, claiming these both were viola-tions of the model code of conduct.

The Panaji assembly bye-electionwas necessitated after elevation ofParrikar as the defence minister inNovember last year and he quit hisassembly seat in Goa.

The defence minister has been camp-ing in Goa for the past several days,campaigning for his Bharatiya Janataparty candidate from Panaji con-stituency.

revealing a grand jury sub-poena that seeks subscriberaccount information, a U.S.judge ruled, because doingso would violate the compa-ny's free speech rights.

U.S. Magistrate JudgePaul Grewal in San Jose,

California on Thursdaywrote that the government'srequest would prohibitYahoo from disclosing thesubpoena, even years afterthe grand jury concluded itsprobe. The court order doesnot disclose the target of thefederal investigation.

"In an era of increasingpublic demand for trans-

parency about the extent ofgovernment demands fordata from providers likeYahoo, this cannot stand,"Grewal wrote.

Representatives for Yahooand the U.S. Department ofJustice could not immediate-ly be reached for commenton Friday.

Internet companies such

as Yahoo, Twitter andFacebook have sought toclarify their relationshipwith U.S. security agenciesand law enforcement, and tochallenge secret orders toturn over information, asthey seek to re-assure usersthat they will safeguard theirpersonal information.

Symantec Corp, maker ofthe popular Nortonantivirus software, was

ordered to pay $17 million(roughly Rs. 104 crores) indamages on Friday after a fed-eral jury in Delaware found ithad violated two patentsowned by IntellectualVentures, a major patentlicensing company.

The damages award was farless than the $298 million(roughly Rs. 1,839 crores)Intellectual Ventures had beenseeking. The jury also clearedSymantec of infringing a thirdpatent.

The verdict is a blow toMountain View, Calif.-basedSymantec. It also confirmedthe validity of the patents andstrengthens IntellectualVentures' track record in court.The multibillion-dollar compa-ny has become one of thebiggest patent owners in theworld and only recently begansuing companies in addition toits longtime strategy of licens-ing its wide array of patents.

"This project provedthe feasibility of havingcompanion technology,while also highlightingdifferent importantaspects such as empathy,emotion, social intelli-gence as well as ethicsand its norm surroundingtechnology for independ-ent living,"Amirabdollahian said.

The robot uses a serviceplatform called Care-O-bot 3 and works within asmart-home environment.

Pakistan Cricket Board (PCB)Shaharyar Khan wants off-spinner Saeed Ajmal to playsome domestic cricket beforehe could be considered fornational selection with hismodified bowling action afterbeing cleared by theInternational Cricket Council.

Even as the PCB appears tobe less confident in Ajmal'sability to deliver with his newaction, they are others inPakistani cricket quarters whofeel that the selectors shouldtake a gamble with the wilyspinner for the World Cup.

Khan, soon after the ICCannounced Ajmal had passedhis official bowling assess-ment in Chennai yesterday,said that the off-spinner stillhad some work to do beforehe could be considered fornational selection.

"One of the working committee memberstoday raised concerns about constant unsub-stantiated claims made by one Aditya Vermaand wanted working committee members totake due cognisance of the matter. The BCCIis planning extensive legal action againstVerma, who has been constantly spreadingcanards about Srinivasan as well as raisingclaims of conflict of interest against ShivlalYadav and Rajiv Shukla," a senior BCCImember present at WC meeting said.

Yadav is interim president of the BCCI andShukla is the vice-president.

"In fact, don't be surprised if multipleBCCI affiliated units file legal petitionsagainst Verma, who is allegedly a front ofShashank Manohar, Lalit Modi and A CMuthiah faction. In fact Srinivasan, whoattended the meeting was very vocal aboutthe kind of things being said about him andBCCI by some former presidents," a sourceadded. "Srini himself raised the issue ofShivlal's alleged conflict of interest. He said'this man Verma said that Shivlal's son(Arjun Yadav) works in my company. This iscompletely false.
