2000ChryslerVoyageroperatedbyRachelNyanthamandownedbyJacobTutLiech. SeeId.

at6,8. Atthetimeofthesubjectcollision,TerryCampbellwasinthecourseandscopeof

hisemploymentwithFarner-BockenCompany. ThesemiinwhichTerryCampbellwasa

passengeratthetimeofthecollisionwasownedbyFarner-BockenCompany.

ThecrashresultedinallegedinjuriesanddamagestoPlaintiffsTerryCampbell

(personal)andRoxannCampbell(lossofconsortium). Asaresult,Plaintiffsfiledtheir

underlyingactionagainstDefendantsRambangandLiech. Additionally,Plaintiffsfiledclaims

seekingunderinsuredmotoristbenefitsfromtwoseparateinsurancecompanies. Plaintiffsfiled

anactionforUIMbenefitsagainstTerryCampbellspersonalautomobileinsurer,Progressive

NorthernInsuranceCompany(hereinafterProgressive). Plaintiffsadditionallyfiledaclaim

forunderinsuredmotoristbenefitsagainstSentryCasualtyCompany,astheinsurerofthe

Farner-BockenownedMacksemitractor-traileronthedateofloss.

ThereisnogenuineissueofmaterialfactthatPlaintiffsclaimsagainstProgressiveare

barredbytheantistackingprovisionsofIowaCode516A.2(3),aswellasProgressives

positionasanexcessinsurer.

WHEREFORE,fortheabove-statedreasons,Defendant,ProgressiveNorthern

InsuranceCompany,respectfullyrequeststhisCourtenteritsOrderasfollows:

(A) ThatnogenuineissueofmaterialfactexistswhichwouldpermitPlaintiffsto

presentacaseforunderinsuredmotoristbenefitsagainstDefendantProgressive

II. MEMORANDUMOFAUTHORITIES

A. SUMMARYJUDGMENTISPROPERWHERETHEREEXISTSNO

FACTUALDISPUTE

InIowa,summaryjudgmentisproperwhenthepleadings,depositions,answersto

interrogatories,andadmissionsonfile,togetherwithaffidavits,ifany,showthatthereisno

genuineissueastoanymaterialfactandthatthemovingpartyisentitledtojudgmentasamatter

oflaw. IowaRuleofCivilProcedure1.981(3).

Forpurposesofsummaryjudgment,anissueoffactismaterialonlywhenthedispute

involvesfactswhichmightaffecttheoutcomeofthesuit,giventheapplicablegoverninglaw.

Wallacev.DesMoinesIndependentCommunitySchoolDist.Bd.ofDirectors,754N.W.2d

854,857(Iowa2008). Agenuineissueoffactexistswhenareasonablejurycouldreturna

verdictforthenon-movingparty. Id.

shallprovideforthestackingofuninsuredandunderinsuredcoverageswithanysimilar

coveragewhichmaybeavailabletoaninsured.

(Emphasisadded). Thissubsectionaddressestheintentofthelegislaturetoallowforthe

optionofaninsuredandinsurertocontractforthestackingofavailablecoverageundera

particularpolicy. SeeIowaCode516A.2(2). Thereisnorequirementthataninsuredand

insurercontractforthestackingofinsurancepolicies. Seeid. Furthermore,oneshouldpresume

thatanadditionalpremiumwouldbepaidbytheinsuredforanyagreementtoallowforstacking

ofcoverageunderseparatepolicies.

Section516A.2(3)states:

I tistheintentofthegeneralassemblythatwhenmorethanonemotorvehicleinsurancepolicy

ispurchasedbyoronbehalfofaninjuredinsuredandwhichprovidesuninsured,

underinsured,orhit-and-runmotorvehiclecoveragetoaninsuredinjuredinanaccident,

theinsuredisentitledtorecoveruptoanamountequaltothehighestsinglelimitfor

uninsured,underinsured,orhit-and-runmotorvehiclecoverageunderanyoneoftheabove-

describedmotorvehicleinsurancepoliciesinsuringtheinjuredpersonwhichamountshallbe

paidbytheinsurersaccordingtoanypriorityofcoverageprovisionscontainedinthepolicies

insuringtheinjuredperson.

(Emphasisadded). Thissubsectionisunequivocalinthatrelativetosituationslikethecaseat

barwheremorethanonepolicyisclaimedtoprovidecoveragetoaninjuredinsured,thatperson

isentitled(andgenerallylimited)torecoveruptoanamountequaltothehighestsinglelimit

underanyoneofthepolicies. SeeIowaCode516A.2(3). Thelanguageofthissubsectionis

furtherunequivocalinthatpaymentofanyavailablecoveragebytheinsurersistobecompleted

accordingtoanypriorityprovisionscontainedwithinthespecificpolicies. SeeId.

ThereisnodisputeinthiscasethattheapplicableProgressivepolicydoesnotexpressly

allowforinterpolicystacking. SeeExhibitA. Furthermore,assetforthmorefullyin

Progressivesdeclarationspage,thereisnopremiumamountnoted,norcoveragelisted,which

wouldsuggestthatPlaintiffsandProgressivecontractedforinterpolicystacking. SeeId.

Progressivespolicyisthereforesilentonthisissue. Assuch,theIowaSupremeCourtsruling

inMortensenv.HeritageMutualInsuranceCompanyiscontrolling. 590N.W.2d35,39

(1999).

InMortensen,theIowaSupremeCourtstated:

Inordertogiveeffecttotheentiretyofsection516A.2,weconcludetheruleprovided

insubsectionthreeappliesintheabsenceofstackinglanguageinthecontract. Thus,

whenacontractissilentregardingthestackingofuninsuredbenefits,theinsuredis

entitledtorecoveruptothehighestpolicylimit,withnostackingofcoverage.

Id. AlthoughtheCourtspecificallyaddresseduninsuredmotoristbenefitsinMortensen,the

sameanalysisandinterpretationisowedtocasesinvolvingunderinsuredmotoristbenefits. See

IowaCode516A.2(1);seealsoGreenfield,737N.W.2dat118.

Furthermore,Plaintiffscannotarguethatstackingispermissibleonthebasisthattheydid

notpersonallypurchasesuchcoverageundertheFarner-BockenpolicyissuedbySentry. Asset

forthabove,Section516A.2(3)isdraftedinsuchamannertoincludepolicieswhichbenefitan

injuredinsured. SeeIowaCode516A.2(3)(statingitistheintentofthegeneralassembly

thatwhenmorethanonemotorvehicleinsurancepolicyispurchasedbyoronbehalfofan

injuredinsured...)(emphasisadded). SeealsoMewesv.StateFarmAuto.Ins.Co.,Inc.,

530N.W.2d718,725(Iowa1995). ThereislittledoubtthattheFarner-Bockenpolicywas

purchasedonbehalfofindividualslikePlaintiffs. SeeExhibitB. Additionally,Sentryhasmade

noattempttodatetoarguethatPlaintiffsarenotaproperinsuredundertheFarner-Bocken

policy.

Asstackingisnotpermissibleundertheundisputedfactsandlawofthiscase,theCourt

islefttodecidewhat,ifany,obligationProgressiveowestoPlaintiffspursuanttotheOther

Insuranceprovisionofthepolicy. Progressiveisclearinitspolicylanguagethatanyinsurance

providedwithrespecttoavehiclethatisnotacoveredautowillbeexcessoveranyotheruninsured

orunderinsuredmotoristcoverage. ExhibitA,p.13. (Emphasisadded). Thereisnodispute

thatPlaintiffwasapassengerinamotorvehiclecoveredundertheSentryPolicy. SeeExhibit

B;seealsoExhibitC,No.29. Assuch,Sentryisresponsibleforprimaryunderinsuredmotorist

coverage. SeeRodishv.StateFarmMut.Ins.Co.,501N.W.2d514,515(Iowa1993). Given

theunavailabilityofstacking,andProgressivespositionasanexcessinsurer,Progressives

policywouldonlyapplyinthismatterifitcarriedahighercoveragelimitthanSentry. Itdoes

not;andtherefore,cannotbeheldliabletoPlaintiffsforanyamountoflegaldamagesawarded

forunderinsuredmotoristbenefits. SeeExhibitA,seealsoExhibitB;seealsoMewes,530

N.W.2dat725.

III. CONCLUSION

ThereisnogenuineissueofmaterialfactthatPlaintiffsareprohibitedfromstacking

coverageagainstDefendantsProgressiveandSentryforrecoveryofunderinsuredmotorist

benefits,ifany,inthismatter. Furthermore,asPlaintiffwasridingasapassengerinamotor

vehicleatthetimeofincidentcollisionthatwasnotcoveredbyProgressive,thesameisan

excessinsureronly. TheavailablelimitsundertheSentrypolicyexceedthatofProgressives

availablelimits;andtherefore,PlaintiffscannotrecoveragainstProgressivefordamagesofany

kind.

WHEREFORE,fortheabove-statedreasons,Defendant,ProgressiveNorthern

InsuranceCompany,respectfullyrequeststhisCourtenteritsOrderasfollows:

(A) ThatnogenuineissueofmaterialfactexistswhichwouldpermitPlaintiffsto

presentacaseforunderinsuredmotoristbenefitsagainstDefendantProgressive

NorthernInsuranceCompany;

(B) ThatProgressiveNorthernInsuranceCompanyisentitledtojudgmentasamatter

oflaw;
