It is necessary to say that
th e Ac t d o es n o t sa ve th e
institution, imparting religious
instruction and education from
adverse and crippling effect of its
p r o v i s i o n s a n d d r a s t i c a l l y
interferes w ith r ights of the
minor i t ies to es tab l ish an d
administer educational institution
of their choice. The Act has
created unrest in the religious
communit ies and minori t ies.
T h e r e f o r e w e s u g g e s t t h e
following amendment to be added
in the Right to Education Act as
Sec.39
"section 39 saying:
"Nothing contained in this
Act shall apply to any institution
imparting religious instruction
and education established or to
be established and maintained or
to be main ta ined und er the
protection of Article 26,and 30 of
the const itution of India and
education imparted to a child in
the afore mentioned institution
shall be considered sufficient
compliance of the obligation of
the central Government, Local
Authority, Guardian, Parent, and
the right of child to education
under this Act"
We think that this addition
in the Right to Education Act will
s u f f i c i e n t l y a d d r e s s t h e
constitutional guaranty provided
under Article 29 and 30 of the
Indian constitution. ______________________________

T h i s c o n f e r e n c e
appreciates the concept of the
"THE RIGHT OF CHILDREN TO
F R E E A N D C O M P U L S O R Y
EDUCATION"and congratulates
the government for the same.
However the silence of the Act
with regard to the status of the
minorities religious (Madarsa)
education institutions of Muslims,
Christians, Buddhist, etc. has led
to many apprehensions w ith
regard to the bonafides of the
objectives via-a- vis the religous
minorities and specially the of the
Muslim minorities.
Therefore, this conference
resolves to request the Central
Government to make suitable
amendments in the Act to ensure :
i) Minor i t i es re l ig iou s
education institutions (Madarsa)
run under the umbrella of Article
26 of the Constitution of India
shall continue to enjoy their
curriculum.
ii) They shall be free to
provide religious education, their
r i g h t o f m a n a g e m e n t a n d
administration shall remain intact.
iii) M a d r a s a p r o v i d i n g
rel igious education shal l be
exempted from the operation of
this Act.
iv) The parents w ho are
getting their children educated in
Madarsa shall not be subjected to
rigours of this Act.
This conference further
resolves that the minority schools
managenent will set up their own
Board on the pattern of I.C.S.E for
regulating their school education
which will be recognized by the
Government of India

Subject: Guidelines under
sect ion 35(1)o f the Right of

The ministry has received
representat ion f rom several
minority organizations seeking
clarification on the applicability of
the provisions of the right of
�
children to free and compulsory
Education (RTE) Act,2009 on
minority institution in Right of the
provisions of Article 29 and 30 of
the constitution.
(2)The matter has been
examined in the ministry .Wide
ranging constitution have also
been held to obtain views and
opinion of various stakeholders
on the subject ,and the following
guidelines are accordingly issued
under section 35(1) of the RTE
Act,2009
(3)Inst itut ion, including
Madrasa and vadic pathshalas
especially serving religious and
linguistic minorities are protected
under Article 29 and 30 of the
constitution ,The RTE Act does
n o t c o m e i n t h e w a y o f
continuance of such institutions,
or the right of children in such
institutions.
(4)Schools are defined in
section 2(n) of the RTE Act .
Schools of minority organizations
covered within the meaning of
section 2(n) of the Act, will be
governed by the provisions of the
RTE Act,2009
( 5 ) A p p r o p r i a t e
G o v e r n m e n t s a n d l o c a l
authorities shall ensure that the
rights of Minority Institutions,
guaranteed under Article 29 and
30 o f th e co n s t i t u t i on , a re
protected while implementing the
provisions of the RTE Act.
