That for the purpose of defraying the annual ourre expe' " diture of the Munioipal Corporati on of the Town of Dartmouth, whioh has been duly authorized by the CI>nnoil, the Counoil;, " do effeot a temporary loan from the Roya~ Bank of Canada for the sum of $70,000.(Seventy Thousand Dollars) and that the Mayor and the Town Clerk be and they are hereby author- , ized to exeoute in the name and under the oorporate soal of the Corporation the agreement with the said Bank in rela- ," tion to said loan whioh has been presented to this meeting' and is hereby approved."

On motion of Crs. Isnor and Pettipas it was RESOLVED that the

empowered to dispoae of the horaea aa he aees fit.

February 5th, on motion of Ors. Austin and Bell it waa resolved that the

Mayor and the Town Olerk be authorized to appoint presiding offioerl

and poll olerks for this eleotion.

speoted for the months of January and February, as annexed, was reoeived and filed.

LETTERS WERE READ FROMI

Dartmouth Ferry Oommission aBking the Town Oounoil to inoorporate in

their Bill of Legislation to be submitted at the preBent SeBsion a Seotion repeal­

ing Seotion 4 of Chapter 77 of the Aots of 1918. Letter reoeived and on motion

of Crs. Pettipas and Bell waB referred to Oommittee on Legislation.

A. T. Oroft, Seoretary Dartmouth and Eastern Halifax Oounty Tourist Asso •

solioiting the support of the Town Oounoil finanoially and otherwise. Letter re­

oeived and on motion of Crs. Pettipas and Austin it was RESOLVED that the Oounoil

seek Legislation naming them to make a. grant up to $300.00.

Dartmouth Sohool Board -asking the Oounoil to &BS88S and oolleot for

the sum of $67,337 being the amount required by the Board for sohool purposes

for the ourrent: year. Letter reoeived and on motion of Ors. Pettipas and Bell

was referred to Finanoe Committee.

Mr. L.i. Teaadale was present at the meeting and WAS given a hearing.

Petition read, signed by sane twenty merohants of the Town, that legis­

lation affeoting early olosing relative to grooery and meat shops be amended to

read as followsl "The Town Counoil shall have power to make and from time to time to

alter, amend, repeal and re-enao't a bye-law or bye-laws providing that any olass or all olasses of shops doing bUlinesB in the Town shall on any· day or on oertain days be oloBed to oustomers during oertain hours, exoepting shops oarrying on a retail buuinoss in whioh shop the personal property regardless of ownership is assesBed at under Six Hundred Dollars) and suoh bye-laws upon approval by the Governor-in-oounoil shall have the foroo of law. that thiB matter be reterred to the Solioitor to inolude in his draft of Legis­

The Auditor,' s report for the year 1934 was on motion of Ors • Austin

and Ienor tabled.

The Patriot Printing and Publishing Oompany tendered to supply 400 oopies

of the Town Annual report for the same prioe as last year, viz- .2.36 per page,

inoluding the oost ot publishing the finanoial statement in the Dartmouth Patriot.

On motion of Cra. Otto and Ianor it wal RESOLVED that their tender be aooepted.

Applioation ot John O. Ritohie tor Plumber's lioenle, WAS on motion

ot Crs. Bell and Austin.granted.

The Street Committee reported that they had reoeived a oommunioat~on

trom the Super Servioe Stations, Limited, and Capt. A. H. Young in reterenoe to

the land required from their properties for street widening purposes at the ~

Bridge. On motion of Crs. Austin and Bell it was RESOLVED that the T~ of Dart­

mouth for Street widening purposes do purohase from Super Servioe Stations, L~­

ited approx~ately 1900 sq. ft. of land at a oost of $114.66 and do purohase trom

Capt. A. H. Young a strip of land in front of his property 162 Portland Street

tor the sum of $27.07, further that the Street Committee be empowered to pay any

further oosts involved in transter.

On motion of Crs. Bell and Otto it was RESOLVED that the Street COIIDIIittee

~ report to Counoil with reoommendations as regards to appointment ot Plumbing In-

speotor.

Mayor Topple reported that the Tourist Assooiation had aaked for the

appointment of a BOAutifioation Committee from the Town Counoil to oo-operate with

them, and on motion of Gra. Pettipas and Bell it was RESOLVED that Crs. Austin, Mal­

oolm and Otto be appointed as suoh.

Cr. Austin reported that he thought it neoessary in order to repair

Jamieson Street that the Town would have to purohase some property along the Brook.

Atter some disoussion this matter WAS referred to the Chairman of the Street Com-

mittee and the Town Solioitor to look into.

On motion of Crs. Bell and Otto it wal RESOLVED that ohanges be made in

the Town Clerk's offioe as per plan of the Town Engineer. and the matter of an

extra vault WAS deferred for the present.

Cr. Austin moved, seoonded by Cr. Otto that this Counoil purohAse a ~

Spsed wagon 1/=28 - 142" Wheelbase for the sum of $1875. plus the S\.UII of $890. for

the Wood body, total oost 32765. all taxes inoluded.

Cr. Maloolm moved an amendment, seoonded by Cr. Pettipas that the Town ot

Dartmouth advertise publioly for ths purohase of a truok as ~er speoifioation to

be t'urniehe'd by the Town Engineer. The amendment was put and lost. The motion wiu

then put and oarried, Cra. Ianor,':A\I!lt1n, Otto and Bell voting for and Cra. Maloolm

and 'Pettipae against.

t .... A delegation was present at the meeting repr~senting Brightwood Golf

and Countr.~ Club. Mr. It. H. Read and Ufo 'John Il4isener were heard in oonneotion J- .

therewith. and Mr. Tufts was also heard representing the Trustees of the Estate .~tlfr./

of the late Col. I. W. Vidito. After some disoussion, on motion of Crs. Bell

and lsnor, the following resolution was unanimously adopted!

"RESOIJIED that in the event of the Tcw n aooepting the terms under the Will of the late I. W. Vidito in referenoe to Brightwood Golf and Country Club, that this Town Counoil go on reoord as aooepting the agreement made with the present Direotors of the said Club by the Exeoutor of the Estate .of I. W. Vidito, provided however that should expenses exoeed $600.00 the Direotors be required to pay to the Town of Dartmouth suoh amount in exoess, up to 3780.00."

The estimates of the different Committees, after having been dealt

with by the Finanoe Committee, were presented toCounoil and were examined by

members of Counoi1, and after making some minor ohanges, and inoluding in the

revenue thereof the amount of $7,000. to be transferred from the Dartmouth Fer-~ ry Commission ~ unanimously adopted,and on motion of Crs. Isnor and Bell, the

following resolution was unanimously adopted!

"That the assessment roll as finally passed by the Court of Appeal and oompleted and now laid before this meeting be and the said is hereby oonfirmed and that this Counoil authorize the levying and oolleotion of a rate for the our­rent year of $3.66 per $100.00 on the assessed value as par assessment roll whioh assessment roll and rates are hereby oonfirmed.

That the 21st day of Maroh, 1936, be and it is hereqy.fixed as the date the rates for the ourrent year shall be due and payable and that a disoount of two peroent be allawed thereon up to the Fourth day of June, 1935, and after the seoond day of July, 1936, interest be oharged on all taxes for the ourrent year then unpaid, at the rate of Six Peroent per annum,

Further resolved that a Poll Tax of .3.00 be levied on and oolleoted from persons assessed for personal property only and a Poll Tax of Seven Dollars be levied and oolleotsd from persons not assessed on Real and Personal Property as provided by Law."

On motion of Ors. Bell and Pettipas it was RESOLVED that the rate of

interest to be Oharged in future on baok taxes be at the rate o~r annum.

LETTER Wall read tr~ Martin Aroh1bald, Yunioip8J. Clerk and Treasurer,

eno1osing resolution a8 annexed, in referenoe to a joint Committee oonferring

with the Government to disoU88 ways and means whereby the annual oontributions , . to the Court .House Commission from the joint expenditure funds may hereafter be

lessened. Letter reoeived and on motion of Ors. Bell and Isnor, it. was RESOLVED

that the Oounoil of the Town of Dartmouth go on reoord as endorsing this resolution.

Minutes of the last three meetings were read and approved.

Cr. Otto's notioe of motion from the previous meeting was the first matter

dealt with, and atter Bome disoussion on motion of Crs. Otto and Austin resolu­~ ..

tion as annexed in referenoe to the revision of fees for lioenses under by-law

#36 was adopted. Cr. Pettipas voting against.

Draft of by-law if34 in regard to restaurants was read and tabled and the

Clerk was instruoted to have oopies made and sent to all the Counoillors.

Re Brightwood Golf and 00untry Club. After oonsiderable disoussion the

following resolution moved and seoonded by Crs. Bell and I snor was adopted I

"Resolvedl that the Town Solioitor be instruoted to'~epare legislation authorizing the Town to aooept the offer of the Estate of the late I. W. Vidito relating to the Brightwood Golf and Country Club, Limited} and that the Tawn aooept the said offer subjeot to said legislation being passed and subjeot to a favorable vote of the ratepayers of the Town assessed on real estate; and that a meeting of the ratep~yers as­sessed on real estate be oalled and held on the 10th day of May, A.D. 1935 and that a vote of said ratepayers be held at the Town Hall on the 15th day of May, A.D. 1935 upon the question of whether or not the said offer be aooepted by the Town.\ But that before said legislation be prepared or said meeting and vote be held, the exeoutors be asked whether or not aooeptanoe in this form will be satisfaotory."

take plaoe January 1st, 1936. Deputy Chief of Polioe maximum salary to be $1525.

per year. Polioe Offioers'to begin at ijllOO.OO per year with a yearly inorease

of $100.00 until suoh sa.lary has reaohed $1475.00 whioh shall be the maximum. On

motion of Ors. Austin and.Ualoolm it was resolved that the report be adopted.

from Messrs. Teasdal~ and Foot, Limited, for use of the Polioe Department one i

and that the Town trade in and sell to Teasdale and Foot, Limited its motor-oyole

and side~oar at a prioe of $158.00, to make the net oost of oar $650. Motion

oarried unanimously.

Letter reoeived from Hon. A. S. MoMillan, Minister of Highways stating

that there was no authority to limit the number of lioensed taxies in the Town.

Applioation of John P. Otto for permit to ereot a dwelling on the South

side of Rose Street, estimated oost f3500. as approved by the Town Engineer,

was granted.

At this junoture Cr. Austin asked permission to retire. A letter was read

from him tendering his resignation as Chairman of Streets and Publio Property

Committee, also Sewer and Water Committee, expressing his thanks for the sup-

port and stating that he would give his best support to the new Chairman of

these two Committees. On motion of Crs. Pettipas.and Isnor, Crs. Bell and Otto

were appointed a Committee to interview Cr. Austin asking' him to reoonsider. They

reported reoommending that the matter be left over for another month and in the

meantime Cr. Austin would aot as Chairman of these Committees.

Cr. Bell moved, seoonded by Cr. otto that Commissioner John Paterson be

asked to tender his resignation as Sohool Commissioner appo~nted by Counoil.

After oonsiderable disoussion resolution was tabled and the Clerk was instruot-

ed to write 0om. Paterson asking him if he would oare to appear before the Counoil

at a future meeting.

Number of bills signed by two Counoillors were passed for payment.

Three meetings were held, attended by the members of the Committee and The Mayor and a large number of oitizens, inoluding many Daughters of the Empire, all of whom hRVe promised to generously oo-operate with the oivio oommittee •

A tentative program haa been outlined to inolude attraotions as followsl

Parade ot sallool ohildren, starting trom Gree~ale Sohool to tl1e old Catral sohool site, prooession to be headed by a Band. rovision will be made in the prooession tor Boy Soouts and the Girl Guides. Both groups, through their leadDs have promised to partiUpate in the Dartmouth demonstration instead otthe one at Halitax.

The DaI ghters ot the Empire have promised to supply one th~U'lland flags to the sohool Board, providing tram. 50 to $75 tor the purpose, the balanoe, it any to be provided by the town.

A plattorm will be ereoted on the Central sohool site for the aooomodation of speakers and others who may be entitled to have honors .bestowed upon them. Around this platform will be gathered representatives of the Daughters of the Empire, Churohes and other publio bodies.

The r rinoipa.l of the publio sohools has kindly prom~sed to take oh .. ge of the pa.x:ade.

It is reoomended that the Town Counoil purohase a Nova Sootian flag and present it to the bohool Board to be flown at the Greenval High Sohool.

It is reoomended that a general appeal be made to the publio to deoorate their homes and premises and the!; the town do as muoh deooration of thexbgs streets as funds will permit and that the Ferry Comission be requested to do likewise.

Be sta.ted that Mrs. Tynes was now making arrangements to purohase some land trom

the Criohton property further out. Report reoeived and adopted.

Town Engineer also reported that Mrs. Harriet V. Cleveland has not yet

tiled a sub-division plan 01' the Beoohmount property and that she has prooeeded

with the oonstruotion 01' two dwellings on the property tor whioh no permits have

been granted. Report reoeived and on motion of Crs. Pettipas and Bell it was

resolved that the Clerk notify Mrs. H. V. Cleveland that she must have plana 01' the

tension would involve the purohase 01' B. O. Bishop's property on Portland St. as

1. The Town of Dartmouth is authorized to borrow or raise by way of loan on the credit of the Town, the following:

(b) a Gum not exoeeding One Thousand Dollars to be used to pay and retire at maturity debentures of the Town amounting in the whole to One Thousand Five Hundred Dollars ($1,500.00) dated the 1st day of Uay, A.D. ~9l5, payab~e on the 1st day of Uay, A.D. 1935, issued und~f Section 6 of Chapter 52 of th~ Acts of 1915, the sinking fund in re­spect of said debentures being insuf­ficient;

(d) a sum not exceeding Two Thousand Dollars ($2000.00) to be used to~ay and retire at maturity debentures of the Town amounting in the whole to Five Thousand Dollars ~$5000.00) dated the 1st day of February, A.D. 1915, p8~able on the 1st day of February, A.D. 1935 issued under Section 105

Minutes of the laat regular meeting were read and approved.

Report of the plUlllbing inspeotor, as annexed, of fixtures installed and in­

speoted tor the month ot August was reoeived and tiled.

The Street and Publio Property Oommi ttes reported in referenoe to the

widening of Portland Street that the Town had aooepted deeda trom H. A. YOUDg

and Super-Servioe Stations Eastern L~ited, total ooat $167.13. Report adopted.

The Town Solioitor reported in referenoe to Mott's Lane that atter a aearoh

of the title he is of the opinion that this atreet is not vested in the exeoutors

of the Allison estate and were never awned by the late Mr. Alliaon. He reoommend-

ed that the projeot be abandoned by the Tawn. On motion of Cra. Pettipas and

Austin report was reoeived and theOlerk was instruoted to notit,y the Eastern

Trust Company of the aotion taken by the Town

The Town Solioitor also reported in reference to the applioation ot the

Starr Manufaoturing Co. Ltd. \Ulder the Nova Sootia Water Aot as to Dartmouth

Lakes, that the Company had advertised in the Dartmouth Patriot on July 20th

and 27th, and the applioation had been oonsidered by the Minister and favour­

ably reported on subjeot to oertain terms and oonditions, and that the applioa­

tionwill be oonsidered by the Governor-in-CoUDoil on September 6th. so that

whatever aotion the Tawn proposes should be taken betore that date. He also

attaohed a oopy of the applioation made by the Starr Manutaoturing Company and

also terms and oonditions prepared by Mr. Harold S. Johnston, Engineer of the

N. S. Power Commission. The Town Solioitor also reoommended a oommittee be

nmned by the CO\Uloil to oonsider the matter. On motion ot Cra. Austin and Mal­

oolm report wa.s adopted and on motion of Bell and Austin, Mayor Topple, Counoil-'­

lor Pettipas, Town Engineer and the Town Solioitor were appointed a oommittee

with power to aot.

The Town Engineer reported to the Chairman ot the Streets and Publio proper­

ty Committee that the new steps and plattorm at #4 Commeroial Street extenda . , '

over the street line exaot1y the aame distanoe as the old' flight, nam&ly It tt., and atated that there should be some agreement with the owners of the property,

whereby they oou1d be asked to remove the enoroaohment at any time and possibly

oovering a nominal yearly rental. On motion ot Cra. Austin and Llaloolm it was

resolved that the matter be referred to the Tawn Engineer to no~ity Mr. Cormier,

the owner of the property, to apply ror a permit.

Town Engineer and found it very unsanitary, having no wat~r or lower oonneotions,

and reoommended that the plaoe be oo~demned and. torn down. Report reoeived and

on motion ot Crs. Austin and )(a~oo~, it ~s resolved.
