Norm asked if the revolving fund authority will increase due to inflation. Mr. Hunter said the revolving fund applies to fact finding and arbitration. Mr. Jensen said the revolving fund is used to pay for the citizens fact finders which is $100 per day plus expenses.

Mr. Hunter said the department uses consultants for fact finding. The depari:J~lent kept the ClrTlOunt paid to them the :.3ame as last biennium.

Mr. Hunter said $5,000 has been added In contracted services for legal costs for hearings.

Norm said the LFA (Legislative Fiscal Analyst) added money to the base for training in the travel line-item.

Board of Personnel Appeals

Ron Weiss, Office of Budget and Program Planning, told the subcommittee if the department upgrades a position on their own, not through an appeal, there has to be a letter written to say there is enough money in the budget to handle the up­grade. In an appeal, if there is not enough money in the budget, the department has to come in for a supplemental.

At this time, the subcommittee went into EXECUTIVE SESSION.

DEPARTMENT OF h~BOR AND INDUSTRY

Personnel Appeals

Norm told the subcommitee the difference between the LFA and the·Executive (Governor's) recommendations is the amount of money put back into the base.

Senator Aklestad moved this subcommittee accept the Executive budget of $321,634 for FY'82 and $326.140 for FY'83.

The motion was voted on and PASSED unanimously.

DEPARTMENT OF HEAL'i'H AND ENVIRONMENTAL SCIENCES

Legal Division

Norm told the SUbcommittee the issue with this budget is the

Norm said the division is asking for $26,000 in each year of the biennium for secretarial staff.

Norm said this division is a service division and should charge the costs for services back Lo the receiver.

The rent line-item was discuss2d. Norm ~told the subcormnittee this division started renting data processing equipment in 1971. (The LFA has included only the building rent in their cecommenda­tion. The Executive included the building rent and the equip­ment rent.

Representative Waldron moved this subcommittee not recommend authority for direct general fund for the Legal Division.

~he motion was voted on and PASSED unanimously.

Senator Aklestad moved this subcornmi ttee recornmend the LFA budget of $157,lS9 for Fy'S2 and $158,559 for FY'S3.

Norm told the subcommi t tee the lavlyers are going to conventions and the amount for that travel is in the "other" line-item. Senator Regan said that amount should be in the "travel" line­item. Norm agreed it should be.

Senator Aklestad's motion was discussed. Senator Aklestad said, by taking the LFA budg~t recommendation, the $4,000 for the conventions and books would be deleted. Representative Waldron said it would also delete the amount for the word processing equipment and he doesn't think that would be a good idea. If the division is going to do good legal work, the division should have the necessary equipment to help.

Ron Weiss asked if this subcommittee gave this division permission to rent a System 6 last biennium. Norm said there was money for that in the budget for the last biennium. He said $6,000 was spent in FY'SO and $12,000 was spent in FY'SI. ~orm said he didn't think the $6,000 would have been enough to cover anything but the building rent.

The motion was voted on and PASSED. Representative Waldron and Senator Regan voted "no" and the other subcommittee members voted "aye".

Maternal and Child Health Bureau

Norm told the subcommittee the only issue in this bureau is the

Senator l'oklestad asked \o,7hy thl?re is an inc'o::ase in the nu,nber of FTEs. Norm told him 2.5 employees from the Nursing Bureau will be added into this bureau and some secretarial staff is being dropped. The net change is an increase of 1.25 FTEs.

Representa ti ve Waldron moved thi s sl1bcorr,mi tt.ee approve t.he federal authority for the Improved Pregnancy Outcome Progcc,m with the understanding that the state will not replace the federal funds with general funds if the federal funds drop off.

The motion was voted on and PASSED unanimously.

Senator Aklestad asked Norm why the LFA is higher in general fund in Fy'83 than in FY'82. Norm said Ms. Sylva anticipated a drop in federal funds and reduced her budget accordingly.

Senator Aklestad moved this subcornmittee recommend the Fxecutive base amount in Fy'82 of $11,078,791 and $12,107,389 in FY'83.

The motion was voted on and PASSED unanimously.

Senator Regan said if there is a concern in the "rent" line-item, this subcommittee could make a note that the Department of Health and Environmental Sciences (DHES) could not pay more than charged by the Departme;1t of Administration. The subcommittee could say there will not be any transfer in or out of that line-item.

Ron Weiss said it could be noted that it is the intention of this subcommittee to not allow extra rent to be used for any­thing other than the rent of the building or equipment and any excess could not be used for any other division or line-item.

Food and Consumer Safety

Norm told the subcommittee the LFA doesn't reflect any 3l4(d) funds in this budget recommendation. He feels the LFA recommenda­tion accurately reflects the base. The Executive recommendation is higher.
