Notified Bodies

• Annex V of the Construction Products Regulations

(CPR) includes 5 Systems of assessment and

verification of constancy of performance (referenced 1+,

1, 2+, 3 and 4)

• Each system includes different tasks some of which are

to be carried out by the manufacturer and some by a

third part know as a “Notified Body”

Requirements of a NB (1 of 3)

(CPR Article 43)

1. Established under national law

2. Third party independent of the organisation or product being assessed

3. The body, top level management and personnel responsible for the tasks shall not be the designer manufacturer, supplier, installer

4. Highest degree of professional integrity and requisite technical competence

5. Capable of carrying out all third party tasks

6. Impartiality of the NB, its top level management and assessment personnel shall be guaranteed

7. Liability insurance

8. Personnel bound to observe professional secrecy

9. Participation in or informed of standardisation activities and NB coordination activities

Requirements of a NB (3 of 3)

1. The personnel responsible for carrying out the activities shall:

a) Have sound technical and vocational training covering all 3rd party tasks

b) Satisfactory knowledge of the requirements of the assessments and verifications they carry out and adequate authority to carry out such operations

c) Appropriate knowledge and understanding of applicable standards and of the relevant provisions of the Regulation

d) Ability required to draw up the certificates, records and reports to demonstrate that the assessments and verifications have been carried out

(CPR Article 55) - Coordination of NBs

The Commission shall ensure that an appropriate

framework for coordination and cooperation between

bodies are put into place

Member States shall ensure that bodies notified by

them participate in the work of that group either directly

or by means of designated representatives or shall

ensure that representatives of the NB are informed

Which AoC Applies?

If Annex of hEN only describes one AoC system

then this must be followed

Conclusions

• Increasing concerns regarding dangerous substances,

including VOCs – a trend to national regulatory air quality

schemes

• So far few dangerous substances addressed in product

standards under the CPD. Otherwise reference to national

provisions

• Mandates for product standards presently being revised to

address dangerous substances

• Horizontal test methods developed in CEN/TC 351 –

robustness testing begun, round robin seeking funding

• Commission database on dangerous substances being

populated by MSs.
