DESCRIPCION GENERAL PROYECTO DE APOYO A LA
PARTICIPACION DE CENTROAMERICA
EN TRATADOS DE LIBRE COMERCIO
I. ANTECEDENTES
Los cambios en la normativa internacional que rige las relaciones comerciales entre Estados, incluyen la incorporaci6n del tema de la Propiedad Intelectual como elemento estrategico y obligado en las mismas. La expresi6n mas concreta de su relaci6n con la Agenda Comercial Multilateral, se encuentra en el Anexo I C del Acuerdo de Creaci6n de la Organizaci6n Mundial del Comercio (OMC). EI Anexo al Acuerdo de la OMC contiene el Acuerdo sobre Derechos de Propiedad Intelectual rclacionados ,con el Comercio, y establece para sus paises miembros, la normativa minima a desarrollarse en cuanto a la Propiedad Intelectual para sus paises miembros. EI tema de Propiedad Intelectual es trascendental en el proceso y realizaci6n de las negociaciones comerciales internacionales y en el desarrollo mismo del comercio internacional y por ende, para las economias centroamericanas.
SIECA con el apoyo de la Organizaci6n Mundial de la Propiedad Intelectual (OMPI) y la Oficina de Patentes y Marcas del Departamento de Comercio de los Estados Unidos (USPTO), ha venido ejecutando actividades de divulgaci6n y capacitaci6n en el tema. SIECA realiza esfuerzos para dotar de una asistencia mas integral al tema de la Propiedad Intelectual en Centroamerica, y para ello ha elaborado un documento que contiene los terminos de referencia para un

GENERAL DESCRIPTION PROJECT IN SUPPORT
OF CENTRAL AMERICAN PARTICIPATION
IN FREE TRADE AGREEMENTS
I. BACKGROUND
Changes in international norms governing trade relations among countries include the incorporation of Intellectual Property as a compelled and strategic element. It's most concrete expression with the Multilateral Trade Agenda, could be found in the Annex I C of the Agreement of Conformation of the World Trade Organization (WTO). This WTO Annex contains the trade related Intellectual Property Rights Agreement, and establishes the minimum norms to be developed in intellectual property for member countries. The topic of intellectual property is very important in the process and fulfillment of international trade negotiations and in international trade development, and thereof Central Americans economies.
With the support of the Intellectual Property World Organization (IPWO) and the U. S. Department of Commerce Patent and Trademark Office (USPTO), SIECA has developed activities of disclosure and training on this topic. SIECA is pushing to provide a more integral assistance to property rights in Central America and has prepared a document with terms of reference for a medium-term program in order to strengthen the region.

II. DESCRIPCION DEL PROYECTO
Esta actividad tiene como prop6sito la participaci6n de 30 centroamericanos en la Conferencia de las Americas sobre Prop iedad Intelectual.
El objetivo basico de esta Conferencia es la de fomentar el intercambio' de un dialogo abierto y constructivo acerca de las interrogantes en materia de Propiedad Intelectual. Se espera que este intercambio conduzca a la cooperaci6n y el entendimiento reciproco de todos los paises del hemisferio y que promueva el ingenio creativo, la innovaci6n y el desarrollo econ6mico.
Esta conferencia dara la oportunidad a jefes de oficinas nacionales de propiedad intelectual, lideres politicos, representantes del sector privado y particulares, de compartir informaci6n y experiencia tecnica para mejorar la aplicaci6n de los derechos de propiedad intelectual en el hemisferio.
Esta conferencia permitira a los participantes asistir a reuniones plenarias sobre temas de interes general y escoger sesiones divididas que traten sus areas especificas de trabajo 0 interes.

In this context, the participation of Central Americans directly related to intellectual property in the region is considered, in the Intellectual Property Conference of the Americas, to be held in Los Angeles, California, from July 14-17, 1996.
II. PROJECT DESCRIPTION
The purpose of this activity is the participation of 30 Central Americans to the Intellectual Property Conference of the Americas.
The main objective of this conference is to foster the exchange of open and constructive dialogue on intellectual property issues, hoping that this exchange will lead to mutual cooperation and understanding among all of the countries of the hemisphere and promote creativity, innovation, and economic development.
This conference will provide the opportunity to share information and technical experience to intellectual property national office chiefs, political leaders, private sector representatives and individuals, in order to improve the property rights in the hemisphere.
This conference will allow participants to attend plenary sessions on general topics and selected areas of personal interest.
Las sesiones plenarias incluinln los siguientes t6picos:
• La Propiedad Intelectual como Propiedad de Inversi6n;
• La Propiedad Intelectual en el Espacio Cibernetico;
• Aplicaci6n y Conocimiento PUblico de los Derechos de Propiedad Intelectual.
Las sesiones divididas cubriran una variedad de temas sobre patentes, marcas y derechos de autor y derechos conexos, tales como:
~ obtenci6n de derechos de propiedad intelectual en el hemisferio;
• oportunidades p~ra la comercializa-ci6n y otorgamiento de licencias; -
• seguridad en cuanto a la protecci6n adecuada de la propiedad intelectual en el espacio cibernetico; y
• respuestas sobre el acceso y divulgaci6n de la informaci6n.
A. SELECCION DE CANDIDATOS
La selecci6n de los candidatos que participaran en este evento, se realizo de la siguiente manera:
(1) Las Misiones de los Estados Unidos solicitaron a cada uno de los paises centroamericanos una lista del personal del sector publico, con experiencia y actual mente trabajando en. el area de Propiedad Intelectual de la regi6n.

The plenary sessions will include the following topics:
• the Intellectual Property as Investment property;
• Intellectual Property in Cyberspace;
• Enforcement and Public Awareness of Intellectual Property Rights.
Breakout sessions will cover a wide variety of patent, trademark, and copyright topics, such as:
• Obtaining intellectual property rights in the hemisphere;
• Licensing and commercialization opportunities;
• Ensuring adequate protection of intellectual property in cyberspace; and
• Information access and dissemination issues.
A. SELECTION OF CANDIDATES
The selection of candidates that will participate in this conference, was as follows:
(1) a list of the public sector personnel, with experience and working in intellectual property, was requested by the Missions of the United States to each country.
(2) Estas listas fueron enviadas a la USPTO.
(3) En forma conjunta y con base en estas !istas, USPTO y SIECA seleccionaron a los participantes a la Conferencia. Para esta selecci6n se tom6 en cuenta el conocimiento tecnico de cada participante en la materia y la actividad que desempefia dentro del area de Propiedad Intelectual.
El resultado esperado de esta actividad, es que los participantes a la Conferencia amp lien su conocimientos sobre la materia, fortalezcan sus contactos a nivel regional, compartan informaci6n y puedan apoyar a sus respectivos gobiemos en la toma de decisiones, en la elaboraci6n de leyes. y
. reglamentos y en el cumplimiento de los compromisos adquiridos por los pa~ses en materia de Propiedad Intelectual.
III. INFORMES
SIECA debera presentar para aprobaci6n de USAID/G-CAP, dos informes durante la ejecuci6n de esta actividad, los que deberan contener:
a) Un informe inicial a los tres dfas de haberse firmado el Convenio de Donaci6n para Proyecto de Alcance Limitado, el cual contendra informaci6n sobre los participantes al evento, lugar de trabajo, puesto que desempefian, pafs al que pertenecen e informaci6n general.
b) Un informe final a los diez dfas de finalizado el evento, que contendra un resumen de la actividad incluyendo bibliograffa repartida durante el seminario.

(3) Based on those lists, the USPTO and SIECA selected the participants. for the Conference. For the selection of each participant the technical knowledge of the topic and the work they carry out in intellectual property was considered.
The expected result of this activity is that the participants extend their knowledge on this topic, strengthen their regional contacts, share information and provide support to their respective governments in order to improve decision making, law and regulations development and the fulfillment of agreements by the countries on intellectual property.
III. REPORTS
During this activity, SIECA should send for approval to USAID/G-CAP, two reports containing the following:
a) An initial report three days after signed the Limited Scope Grant Project Agreement, with information of the participants to the seminar, place of work, position, country and general information.
b) A final report ten days after the end of the seminar, containing a summary of the activity, including bibliography distributed during the seminar.

La estimaci6n del costo del evento se muestra en el Cuadro I. Los costos totales de la actividad se estiman en US$55,300, y se utilizanin para financiar: 1) Viaticos y transporte US$48,660 (debera incluir seguro medico para cada uno de los participantes); 2) Miscelaneos US$1,613; y 3) Costos Directos US$5, 027.
The estimated cost of the seminar is shown in Table 1. Total costs of the activity are estimated in US$55,300, and will be used to finance: 1) Per diem and transportation US$48,660 (should include medical insurance for each participant); 2) Miscellaneous US$1,613; and 3) Direct Costs US$5,027.

The Grantee will submit an advance request of 70 % after the signing of the Limited Scope Grant Project Agreement and a final liquidation thirty days after the finalization of the activity. The Grantee will submit to USAID/G-CAP Controller, Voucher Form SF-1034 (original) and SF-1034-A (three copies) each voucher identified by the appropriate grant number, in the amount of expenditures. The voucher shall be supported by an original and two copies of a report rendered as follows:

ANEXO "C"
CONVENIO DE DONACION PARA PROYECTO DE ALCANCE LlMITADO
DISPOSICIONES GENERALES
A. Al hacer referencia al termino "este convenio" se hace referencia al Convenio de Proyecto original y sus modificaciones hechas a traves de revisiones que hayan entrado en vigor. Al hacer referencia al termino "pais cooperante" se hace referencia al pais 0 territorio del Donatario.
B. (1) USAID hanl disponible la suma especificada en el numeral 3 de este Convenio, segu.n sea necesario para el Proyec~o, tal y como se describe mas ampliamente en el Anexo "A".
(2) EI Dom·t}lrio hara d~sponible la suma especificada en el bloque 4 de este Convenio, segu.n sea necesario para el proyecto, tal y como se describe mas ampliamente en el Anexo "A". EI Donatario tambien had, 0 hara arreglos para que se hagan, contribuciones adicionales como propiedades, servicios, instalaciones y fondos necesarios para llevar a cabo el Proyecto segun se especifica en el Anexo "A".
C. USAID y el Donatario pod ran obten~r asistencia de otras agencias publicas 0
privadas para llevar a cabo sus obligaciones respectivas dentro de este Convenio. Las dos partes podran llegar a un acuerdo respecto a la aceptaci6n de contribuciones en calidad de propiedades, servicios, instalaciones y fondos de otras agencias publicas· 0
privadas para cubrir los prop6sitosde este Convenio, y podran llegar a un acuerdo respecto a la participaci6n de cualquier parte tercera para llevar a cabo actividades dentro de este Convenio.
ANNEX "C"
LIMITED SCOPE GRANT PROJECT AGREEMENT
ST ANDARD PROVISIONS
A. Reference to "this Agreement" means the original Project Agreement as modified by any revisions which have entered into effect. Reference to "cooperating country" means the country or territory of the Grantee.
B. (1) USAID will make available the amount specified in Block 3 of this Agreement, as necessary for the Project, as may be further described in Annex "A".
(2) The Grantee will make avail-able the amount specified in Block 4 of this Agreement, as necessary for the Project, as may further be described in Annex "A". The Grantee will also make, or arrange to have made, additional contributions of property, services, facilities and funds required for carrying out the Project as specified in Annex "A".
C. USAID and the Grantee may obtain the assistance of other public and private agencies in carrying out their respective obligations under this Agreement. The two parties may agree to accept contributions of property, services, facilities and funds for purposes of this Agreement from other public and private agencies, and may agree upon the participation of any such third party in carrying out activities under this Agreement.
D. Excepto si aqui se especificare de otra manera 0 se llegare a un acuerdo posterior entre las partes, todas las contribuciones de las partes confonne a este Convenio debenln hacerse en 0 antes de la Fecha de Tenninaci6n de Asistencia del Proyecto, 0

El desembolso de fondos podni llevarse a cabo despues de que se hayan hecho las contribuciones finales, pero no podni solicitarse a US AID que desembolse fondos para este Proyecto despues de la expiracion de los nueve meses posteriores a la Fecha de Tenninacion de Asistencia al Proyecto estimada (numeral 5 de este Convenio) 0 cualquier enmienda hecha a la fecha de Tenninaci6n de Asistencia al Proyecto que se haya especificado.
E. La compra de suministros y serviClOS financiados en su totalidad 0 parcialmente por US AID podni (en donde asi sea requerido por los procedimientos de USAID) llevarse a cabo solamente confonne a Ordenes de Ejecucion de Proyecto (PIO) emitidas por USAID.
F. Excepto que' se especifique de otra manera en la PIO 0 en la Carta de Ejecuci6n de Proy~cto (CEP) que se aplique, la adquisicion de suministros importados especificamente para el Proyecto y fmanciados con la contribucion de USAID a que se hace referencia en el numeral 3 de este Convenio debenin estar sujetos a las disposiciones del Reglamento No.1 de USAID.
G. Excepto que sea convenido de otra manera por las Partes 0 se especifique de otra manera en la PIO que se aplique, el

A contribution of goods or services shall be considered to have been made when the services hace been perfonned and the goods furnished as contemplated in this Agreement. Disbursement of funds may take place after final contributions have been made, but US AID shall not be required to disburse funds hereunder after the expiration of nine months following the estimated Project Assistance Completions Date (Block 5 of this Agreement) or any amended Project Assitance Completion Date specified.
E. The procurement of commodities and services to be financed in whole or in part by USAID may (where so required by USAID procedures) be undertaken only pursuant to Project Implementation Orders (PIOs) issued by USAID
F. Unless otherwise specified in the applicable PIO or Project Implementation Letter (PIL) , the procurement of commodities imported specifically for the Project and financed with the USAID contribution referred to in Block 3 of this Agreement shall be subject to the provisions of USAID Regulation No.1.
G. Unless otherwise agreed by the parties or otherwise specified in the applicable PI~, title to all property procured

(2) Cualquier suma de fondos proporcionada por cualquiera de las partes de confonnidad con este Convenio. que no sea utilizada de acuerdo con este Convenio, debeni ser reembolsada a la parte que haya proporcionado los fondos.
(3) Cualquier suma devengada por intereses u otras ganancias sobre los fondos proporcionados por USAID al Donatario dentro de este Convenio debeni ser devuelta a US AID por el Donatario.
I. (1) Si USAID 0 cualquier organizaci6n publica 0 privada que este proporcionando suministros a traves de financiamiento proporcionado por USAID para las operaciones de este Proyecto, esta, dentro de las !eyes, los reglamentos 0 los procedimientos administrativos del pais cooperante, sujeto a pagar derechos aduanales 0 impuestos de importaci6n sobre los articulos importados al pais cooperante con el prop6sito de llevar a cabo este Convenio, el Donatario cancelara tales derechos e impuestos a menos que se obtenga exensi6n a ser proporcionada por

through financing by USAID pursuant to Block 3 of this Agreement shall be in the Grantee, Or such public or private agency as it may authorize.
H. (1) Any resources financed under the Grant, unless otherwise agreed in writing by USAID, will be devoted to the project until the completion or tennination of the Project, and thereafter (as well as during any period of suspension of the project) will be used so as to further the objectives sought in carrying out the project.
(2) Any funds provided to either party pursuant to this Agreement which are not used in accordance with this Agreement, shall be refunded to the party providing the funds.
(3) Any interest or other earnings on funds provided by USAID to the Grantee under this Agreement will be returned to USAID by the Grantee.
I. (1) If US AID and any public or private organization furnishing commodities through USAID financing for operating hereunder in the cooperating country, is, under the laws, regulations or administrative procedures of the cooperating country, liable for customs, duties and import taxes on commodities imported into the cooperating country for purposes of carrying out this Agreement, the Grantee will pay such duties and taxes unless exemption is otherwise provided by any applicable international agreement.

(2) If any personnel (other than citizens and residents of the cooperating country), whether United States Government employees, or employees of public or private organizations under contract with, or individuals under contract with USAID, the Grantee or any agency authorized by the Grantee, who are present in the cooperating country to provide service& which US AID has agreed to furnish or finance under this Agreement, are under the laws, regulations or administrative procedures of the cooperating country, liable for income and social security taxes with respect to income which they are obligated to pay income or social security taxes to the Government of the United States of America, for property taxes on personal property intended for their own use, or for the payment of any tariff or duty upon personal or household goods brought into the cooperating country for the personal use of themselves and members of their families (not including such personal or household goods as may be sold by any such personnel in the cooperating country) or if any firm, not normally resident in the cooperating country, is liable for income, receipts or other taxes on work financed by USAID hereunder, the Grantee will pay such taxes, tariff, or duty unless exemption is otherwise provided by any applicable international agreement.
J. If funds provided by USAID are introduced into the cooperating country by

L. Ambas partes tendran derecho en cualquier momento de observar las actividades llevadas a cabo de acuerdo con este Convenio. USAID or any public or private agency for purposes of carrying out obligations of USAID hereunder, the Grantee will make such arrangements as may be necessary so that such funds shall be convertible into currency of the cooperating country at the highest rate which, at the time the conversion is made, is not unlawful in the cooperating country to any person for any purpose.
K. USAID shall expend funds and carry on operations pursuant to this Agreement only in accordance with the applicable laws and regulations of the United States Government.
L. The two parties shall have the right at any time to observe operations carried out under this Agreement. Either party during the term of the Project and for three years after the completion of the Project shall further have the right to examine any property procured through financing by that party under this Agreement, wherever such property is located.
M. USAID and the Grantee shall each. furnish the other with such information as may be needed to determine the nature and scope of operations under this Agreement and to evaluate the effectiveness of such operations.
N. (a) Either party may terminate this Agreement in its entirety by giving the other party 30 days' written notice. USAID also may terminate this Agreement in part by giving the Grantee 30 days' written notice, and suspend this Agreement in whole or in part upon giving the Grantee written

notice. In addition, US AID may terminate this Agreement in whole or in part, upon giving the. Grantee written notice, if (I) the Grantee fails to comply with any provision of this Agreement, (II) an event occurs that US AID determines makes it improbable that the objectives of the project or the assistance program will be attained or that the Grantee will be able to perform its obligations under this Agreement, or (III) any disbursement by USAID would be in violation of the legislation governing USAID.
(b) Except for payment which the parties are committed to make pursuant to noncancellable commitments entered into with third parties prior to such suspension or termination, suspension or tennination of this entire Agreement or part thereof will suspend (for the period of the suspension) or tenninate, as applicable, any obligation of the parties to provide financial or other resources to the project, or to the suspended or tenninated portion of the project, as applicable. Any portion of this Agreement which is not suspended or terminated shall remain in full force and effect.
(c) In addition, upon such full or partial suspension or tennination, US AID may, at USAID's expense, direct that title to goods financed under the grant, or under the applicable portion of the grant, be transferred to USAID if the goods are from a source outside the Grantee's country, are in a deliverable state and have not been offloaded in ports of entry of Grantee's country.

O. Q. Informes. Registros de Contabilidad. Auditorias. Revisiones
(a) El Donatario debera propor-cionar a USAID la informaci6n y los informes relacionados con el Proyecto y con este Convenio que la Misi6n USAID considere necesarios.
(b) EI Donatario debera mantener suficientes libros de contabilidad, registros, documentos y otros comprobantes relacionados con el Proyecto y con este Convenio que muestren, sin ninguna limitaci6n, todos los gastos hechos con fondos de la Donaci6n; el recibo y uso de los bienes y los

O. To assist in the implementation of the Project, USAID, from time to time, may issue Project Implementation Letters (PILs) that will furnish additional information about matters stated in this Agreement. The parties may also use jointly agreed-upon PILs to confirm and record their mutual understanding on aspects of the implementation of this Agreement.
P. The Grantee agrees, upon request, to execute an assignment to A.I.D of any cause of action which may accrue to the Grantee in connection with or arising out of the contractual performance by' a party to a direct U.S. Dollar contract with USAID financed in whole or in part out of funds granted by USAID under this Agreement.
Q. Reports. Accounting Records. Audits. Inspections
(a) The Grantee shall furnish USAID such information and reports relating to the Project and to this Agreement as USAID may reasonably request.
(b) The Grantee shall mantain accounting books, records, documents, and other evidence relating to the Project and to this Agreement, adequate to show, without limitation, all costs incurred under the Grant, the receipt and use of goods and services acquired under the Grant, the costs

(c) Si fondos de Donaci6n por la cantidad de 25,000 d6lares 0 por una cantidad mayor son directamente desembolsados al Donatario durante cualquier ano fiscal de la Donaci6n, el Donatario velara porque se practiquen auditorfas a los desembolsos de fondos que Ie han sido hechos. of the Project supplied from other sources, the nature and extent of solicitations of prospective suppliers of goods and services acquired, the basis of award of contracts and orders, and the overall progress of the Project toward completion ("Project books and records"). At the Grantee's option, with approval by USAID, Project books and records shall be maintained in accordance with one of the following methods: (1) generally accepted accounting principles prevailing in the United States, (2) generally accepted accounting principles prevailing in the country of the Grantee, (3) accounting principles prescribed by the International Accounting Standards Committee (an affiliate of the International Federation of Accountants), or (4) such other accounting principles as the parties may agree to in writing. Project books and records shall be maintained for at least three years after the date of last disbursement by US AID .
(c) If dols. 100,000 or more is disbursed directly to the Grantee in anyone calendar year under the Grant, the Grantee, except as the parties may otherwise agree in writing, shall have financial audits made of the funds disbursed to the Grantee under the Grant in accordance with the following terms:
(1) The Grantee shall select an independent auditor in accordance with the "Guidelines for Financial Audits

(2) An audit of the funds provided under the Grant shall be conducted for each fiscal year of the Grantee. The audit shall determine whether the receipt and expenditure of the funds provided under the Grant are presented in a~cordance with generally accepted accounting principles agreed to in section (B) above and whether the Grantee has complied with the terms of the Agreement. Each audit shall be completed no later than one year after the close of the Grantee's fiscal year.
(d) The Grantee shall submit an audit report to USAID within 30 days after completion of each audit arranged for by the Grantee in accordance with this Section. The USAID Inspector General will review each report to determine whether it complies with the audit requirements of this Agreement. Subject to US AID approval, costs of audits performed in accordance with the terms of this Section may be charged to the Grant. In cases of continued inability or unwillingness to have an audit performed in accordance with the terms of this Section, USAID will consider appropriate sanctions which include suspension of all or a portion of disbursements until the audit is satisfactorily completed or US AID performs its own audit.
( e) The Grantee shall submit to USAID, in form and substance satisfactory to USAID, a plan by which the Grantee will

The plan should describe the methodology to be used by the Grantee to satisfy its audit responsibilities with respect to any subrecipient to which this Section applies. Such audit responsabilities with respect to subrecipients may be satisfied by relying on independent audits of the subrecipients or on appropriate procedures performed by the internal audit or program staff of the Grantee, by expanding the scope of the independent fmancial audit of the Grantee to encompass testing of subrecipients' accounts, or by a combination of these procedures. The plan should identify the funds made available to subrecipients that will be covered by audits conducted in accordance with other audit provisions that would satisfy the Grantee's audit responsibilities (a nonprofit organization organized in the United States is required to arrange for its own audits; a forprofit contractor organized in the United States that has a direct contract with USAID is audited by the Cognizant U. S. Government Agency; a private voluntary organization organized outside the United States with a direct Grant from USAID is required to arrange for its own audits; and a host-country contractor should be audited by the Cognizant Grantee Contracting Agency). The Grantee shall ensure that appropriate corrective actions are taken on the recommendations contained in the subrecipients' audit reports; consider whether subrecipient's audits necessitate adjustment of its own records; and require each subrecipient to permit independent auditors to have access to records and financial statements as necessary.

R. Actividades Prohibidas
1. Reubicacion de Instalaciones de Centros de Produccion de los Estados Unidos
Ninguna ayuda 0 fondos proporcionados por este medio podran ser utilizados para un proyecto 0 actividad que sea probable que involucre la reubicacion 0

(0 USAID may, at its discretion, perform on behalf of the Grantee by utilizing funds under the Grant or other resources available to USAID for this purpose. The Grantee shall afford authorized representatives of US AID the opportunity at all reasonable times to audit or inspect the Project, the utilization of goods and services financed by USAlD, and books, records and other documents relating to the Project and the Grant.
R. Prohibited Activities
1. Relocation of U. S. Production Facilities
No funds or other support provided hereunder may be used in a project or activity reasonably likely to involve the relocation or expansion outside of the United States of an enterprise located in the United States if non-U.S. production in such relocation or expansion replaces some or all of the production of, and reduces the number of employees at, said enterprise in the United States.

Ninguna ayuda 0 fondos proporcionados pot este medio podran ser utilizados para una actividad que contribuya a contravenir, en el pais beneficiario, los derechos intemacionalmente reconocidos de los trabajadores; esto incluye cualquier area ozona designada en dicho pais.

2. Export Processing Zones
No funds or other support provided hereunder may be used in a project or activity the purpose of which is the establishment or development in a foreign coun~ try of any export processing zone or designated area where the labor, environmental tax tariff and safety laws of the country would not apply, without the prior written approval of USAID.
3. Workers Rights
No funds or other support provided hereunder may be used in an activity which contributes to the violation of internationally recognized rights or workers in the recipient country, including in any designated zone or area in that country.
