South Los Angeles Community Profile

The Crenshaw Corridor

Crenshaw Corridor has a culturally rich history. From the early settlements of the Californias, in the 16th Century, the Baldwin Hills Crenshaw area has seen a significant presence of African Americans, Japanese Americans and Latino Americans.

The History of the Project

The Crenshaw Light Rail Transit project is due in part to:

• The vision and early work of L.A. County Supervisor Yvonne Brathwaite Burke

• The commitment of Supervisor Mark-Ridley Thomas & Mayor Antonio Villaraigosa, to fight for the money to fund the project.

• Adoption of a Light Rail Transit (LRT) project instead of a Bus Rapid Transit Project (BRT)

• The community’s drive to make the project a more robust light rail transit line.

Budget:

• Initial BRT budget was $640 million • Current LRT budget is $1.76 billion

Crenshaw/LAX Transit Corridor Procurement Actions

The Crenshaw/LAX Transit Project includes four separate contracts:

• Advanced Utilities Contract C-0990 – Awarded May 30, 2012 (First Metro contract with PLA)

• “Alignment” Design-Build Contract C-0988 – Contract Award anticipated June 2013

• Owner-furnished track materials – Contract C-0992 Award anticipated September 2013

• Southwestern Yard Contract C-0991 – Design-Build procurement – Release IFB Spring 2015

Crenshaw/LAX Transit Corridor Early Utility Relocation Work – C0990

Lowering utilities for follow-on

Cut and Cover Construction Clearing FAA/LAWA utility conflicts in LAX area in advance of construction

Major Milestones

Main Design-Build Contract C0988 • RFQ released December 23, 2011 • Four of five proposers were pre-qualified • RFP for “Alignment” Design-Build Contract

released – June 22, 2012 • Proposals received – December 6, 2012 • Discussion with Proposers – Jan./Feb. 2013 • BAFO released – February 22, 2013 • Final Scoring – Late March 2013 • D-B Contract award shifted from May to June

2013 board cycle − Allowed time for action on Leimert Park

Station that has nationwide attention

Crenshaw/LAX Transit Corridor Stipend Agreement

• RFP provides stipend for unsuccessful, responsive proposers in the amount of One Million Dollars ($1,000,000).

• Stipend Agreement must be submitted prior to proposal due date.

• Stipend Agreement includes LACMTA ownership of ATCs, which allows LACMTA to use the ATCs from unsuccessful bidders after contract award.

Statutory Requirement for Transit Design-Build Contracts, California Public Contract Code (PCC) §20209.5–20209.14

• “Best Value Procurement Process”

• Prequalify design-build entities using a standard questionnaire developed by the State Director of Industrial Relations.

Design-Build Delivery

Step One: Request for Qualifications (RFQ)

• Statement of Qualifications (SOQ) • Pass/Fail Evaluation

Step Two: Request for Proposal (RFP)

• Technical and Price Proposal Evaluations • Best Value Determination

Two-Step Procurement Process

Best Value – Source Selection

Best Value

• Award Firm-Fixed Price Contract to Design-Build Team whose Proposal provides the Best Value, considering RFP Evaluation Criteria and Tradeoffs

• Tradeoffs for added technical, schedule or performance benefits will be made against price

• May award to other than lowest price

• Contract options evaluated as part of total price

Acquisition Background Source Selection Process

Phase 1

• Evaluate Alternative Technical Concepts (ATCs)

• Definition of ATCs Allows for submittal of innovative ideas by proposers

Should reduce cost or provide other efficiencies

Address one or more elements of the Work

Improve aesthetic and functional design of the stations and structures

Provide schedule milestone and cost savings

Lessen community impacts and traffic interruptions

Results in improved operation, maintenance and serviceability

• Evaluate Technical & Price Proposals

Acquisition Background Source Selection Process (Cont.)

Phase 2

• Oral Presentations held to assist in the Determination of Best Value source

• An award decision was not made in Phase 2

Phase 3

• Established a Competitive Range

Phase 4

• Requested BAFO and Determined “Best Value” proposals for Contract Award

RFP Evaluation Criteria

Best Value RFP Evaluation Criteria • Project Management 30% • Technical Approach 25% • Price Proposal 45%

Price = 39% Delay Compensation = 5% Life Cycle Cost = 1%

Alternative Technical Concepts Design Innovations Desired by Metro

• ATCs were required to be equal or better than original contract requirements: Require full description of ATC Justification for use of the ATC Relation to Technical Requirements including

any design deviations Examples of similar applications from other

projects Cost & Schedule Impacts Operations and Maintenance Impacts Construction, Environmental, Right-of-way &

Safety Impacts Risks to Agency, Third Parties or the Project

Alternative Technical Concepts

Initial ATCs Detailed ATCs Pass: 88 Accept: 37

Reject: 27 Reject: 8

Not an ATC: 4 Not an ATC 2

Total : 119 Total: 47

Range of Cost Savings: $50 to $90 Million

Two Step Evaluation

Examples of ATCs

• Ventilation – Proposed innovation to meet “Arson Fire” Growth Rate; PE design based on “Medium Fire” Growth Rate.

• Station Kit of Parts – Metro adopted a Kit of Parts halfway through procurement process to create a branding for stations systemwide.

• Requirements were broadened for grade separation solutions at La Brea, which also resulted in significant improvements to a station in Inglewood by raising the station out of a deep cut to adjacent street level.

Center Platform Kit of Parts

Inglewood Station ATC

• Old and new alignments for the Grade Separation, from an underpass to an overpass, at La Brea Ave.

Inglewood Station ATC

• Grade Separation from an underpass to an overpass at La Brea Ave also allowed an Inglewood station to be raised from a deep cut to adjacent street level.

Examples of ATCs (Cont.)

• Change LRT Structure Type and Means & Methods for Construction over I-405. Creates an opportunity to consider clear span

over freeway. Allows use of former railroad bridge to erect

falsework and significantly reduces impacts on freeway traffic.

Leaves RR bridge in place for alternative uses.

• Optimizing Horizontal & Vertical Alignments

Provides potential cost advantage to proposers Raised inverts of underground stations as much

as ten feet.

I-405 Freeway ATC

Lessons Learned

• Allow confidential one-on-one discussions with Proposers early in RFP phase.

• ATC process was the only opportunity Proposers had for technical clarification dialogue.

• Two-step ATC provided screening process to eliminate infeasible or unwanted concepts; allowed Proposers to concentrate resources on only viable concepts.

• ATC process allowed shortening of the BAFO phase.

• Reduce overly-prescriptive requirements, yet still adhere to Metro Rail Design Criteria.

BAFO Changes

• Reduced number of Key Personnel allowing proposers more flexibility in staffing.

• Allowed more flexibility in hardscape and landscape treatments in station and plaza areas.

• Reduced daily Liquidated Damages rate and cap on maximum exposure.

• Reduced cap on liability limits on Builder’s Risk Insurance.

• Change in requirements for deflection criteria on support of excavation walls, allowing greater flexibility in means & methods.

• Provide staging areas and project office site for Proposer’s use.

Will There be a Leimert Park Station?

• Station carried as 2 bid options – Shell plus fully finished station

• City of LA Council Motion passes for $40M on May 22nd

• Metro Board motion passed 10:1 for $80 M on May 23rd

• Ratification expected at June 27th Board Meeting to add both Leimert Park plus an at-grade station in Westchester community
